क्रमांक GAD /2 /0010 /2024 / GAD - 1-01 ( GAD ) - भारत के संविधान के अनुच्छेद 166 के खण्ड (2 ) एवं (3 ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए , मध्यप्रदेश के राज्यपाल , मध्यप्रदेश शासन कार्य (आवंटन ) नियम में निम्नलिखित संशोधन करते हैं: -

संशोधन

उक्तनियमोंमें, -

अनुसूची में , विद्यमान शीर्षक " सैंतालीस - भोपाल गैस त्रासदी राहत तथा पुनर्वास विभाग " तथा उससे संबंधित प्रविष्टियों के स्थान पर निम्नलिखित शीर्षक तथा उससे संबंधित प्रविष्टियां स्थापित की जाएं, अर्थातः-

"सैंतालीस - भोपाल गैस त्रासदी राहत तथा पुनर्वास विभाग "

(अ) विभाग में प्रतिपादित नीति संबंधी विषय :

1. भोपाल में गैस त्रासदी के कारण उत्पन्न विनिर्दिष्ट स्वास्थ्य समस्याएं.

2.. भोपाल में गैस त्रासदी से पीड़ित व्यक्तियों को राहत तथा उनका पुनर्वास.

3. भोपाल गैस त्रासदी से उद्भूत हुए नुकसान संबंधी मामले .

4. ऐसी सेवाओं से सम्बद्ध सभी विषय जिनका विभाग से संबंध हो (वित्त विभाग और सामान्य प्रशासन विभाग को आवंटित किए गए विषयों को छोड़कर) उदाहरणार्थ- नियुक्तियां, पदस्थापनाएं, स्थानान्तरण , वेतन, छुट्टी, पेंशन, पदोन्नतियां, भविष्य निधि, प्रतिनियुक्ति, दण्ड तथा अभ्यावेदन

5. (एक) भ्रष्टाचार निवारण अधिनियम, 1988 ( 1988 का 49 ) की धारा 19 के अन्तर्गत अभियोजन की मंजूरी.

(दो) भारतीय नागरिक सुरक्षा संहिता, 2023 (2023 का 46 ) की धारा 218 तथा विशेष/अन्य अधिनियमों के अंतर्गत लोक सेवकों के विरुद्ध अभियोजन कीमंजूरी.

(आ) विभाग द्वारा प्रशासित अधिनियम तथा नियम :

1. मध्यप्रदेश भोपाल, गैस त्रासदी, राहत एवं पुनर्वास विभाग संविदा सेवा (नियुक्ति तथा सेवा शर्तें) नियम, 2003 .

(इ) विभाग के अधीन आने वाले संचालनालय तथा कार्यालय :

1. संचालनालय- गैस राहत एवं पुनर्वास.

(ई) अधिनियमों के अधीन स्थापित मण्डल तथा निगम : कुछ नहीं.

(उ) ऊपर ( ई) के अन्तर्गत न आने वाली अन्य संस्थाएं तथा मंडल : कुछ नहीं.

(ऊ) विभाग के अधीन आने वाली सेवा का नाम, यदि कोई हो, और विशेष सेवा संबंधी विषय , यदि कोई हो :

संचालनालय -गैस राहत एवं पुनर्वास, भोपाल में प्रथम श्रेणी, द्वितीय श्रेणी, 1. तृतीय श्रेणी एवं चतुर्थ श्रेणी ।

मध्यप्रदेश के राज्यपाल के नाम से तथा आदेशानुसार,

नमः शिवाय अरजरिया , उपसचिव.

No. GAD /2/0010 / 2024 / GAD - 1-01 ( GAD) - In exercise of the powers conferred by clauses ( 2) and ( 3 ) of Article 166 of the Constitution of India , the Governor of Madhya Pradesh is pleased to make the following amendments in the Madhya Pradesh Government Business (Allocation ) Rules , namely: -

AMENDMENTS

In the said rules , -

In the Schedule , For the existing heading and entries relating thereto " XLVII - BHOPAL GAS TRAGEDY RELIEF AND REHABILITATION DEPARTMENT" , the following heading and entries relating thereto shall be substituted , namely: -

" XLVII - BHOPAL GAS TRAGEDY RELIFE AND REHABILITATION DEPARTMENT "

(A) Matters of Policy Dealt within the Department:

1. Originate specific health problems due to Gas Tragedy at Bhopal .

2. Relief and rehabilitation of the persons suffering from the Gas Tragedy at Bhopal .

3. Matters relating to damages arising out of Bhopal Gas Tragedy .

4. All matters relating to the services with which the Department is concerned ( other than matters allotted to the Finance Department and the General Administration Department) e.g. appointments , postings , transfers , pay , leave , pensions , promotions , provident funds , deputations , punishments and memorials .

5. (i ) Sanction of prosecution under section 19 of the Prevention of Corruption Act, 1988 (49 of 1988 ) .

( ii ) Sanction of prosecution against Public Servants under Section 218 of the Bharatiya Nagarik Suraksha Sanhita , 2023 (46 of 2023 ) and Special/Other Act .

(B) Acts and Rules Administered by the Department :

1. The Madhya Pradesh Bhopal , Gas Tragedy , Relief and Rehabilitation Department Contract Service (Appointment and Conditions of Service ) Rules , 2003 .
