क्र.- 2332-24- नियम.- भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए , मध्यप्रदेश के राज्यपाल , एतद्वारा , मध्यप्रदेश सिविल सेवा (पेंशन ) नियम, 1976 में निम्नलिखित और संशोधन करते हैं, अर्थात्:-

उक्त नियमों में , नियम 47 में , उपनियम (11 ) के स्थान पर, निम्नलिखित उपनियम स्थापित किया जाए , अर्थात्:-
" (11 ) (क) (एक) यदि जीवित बच्चा अथवा बच्चे दोनों परिवार पेंशन उपनियम (3 ) में उल्लिखित दर पर आहरित करने के पात्र है/ हैं, तो दोनों ही पेंशनों की राशि छठवें वेतनमान के अधीन पुनरीक्षित पेंशन में रु. 36,940/ - एवं सातवें वेतनमान के अधीन रु. 1,07,350 / - तक सीमित होगी;
(दो) यदि एक परिवार पेंशन उपनियम (3 ) में उल्लिखित दर पर देय होना बंद हो जाती है, तो उसके बदले उपनियम (2) में उल्लिखित दर पर पेंशन देय हो जाएगी , दोनों ही पेंशनों की राशि भी छठवें वेतनमान के अधीन पुनरीक्षित पेंशन में रु. 36,940/- एवं सातवें वेतनमान के अधीन रु. 1,07,350/- तक सीमित होगी;
(ख) यदि दोनों ही बढ़ी हुई परिवार पेंशनों की पात्रता समाप्त हो जाती है तथा वे उपनियम (2) में उल्लिखित सामान्य दर पर देय परिवार पेंशन के पात्र हैं, तो दो पेंशनों की राशि छठवें वेतनमान के अधीन पुनरीक्षित पेंशन में रु. 22,164/- एवं सातवें वेतनमान के अधीन रु. 64,410/- तक सीमित होगी. " .
2. यह संशोधन , छठवें वेतन आयोग के अधीन दिनांक 1 अक्टूबर , 2008 से तथा सातवें वेतन आयोग के अधीन दिनांक 1 अप्रैल, 2018 से प्रवृत्त हुआ समझा जाएगा.

No.2332-24 - Rule - IV.- In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, the Governor of Madhya Pradesh hereby , makes the following further amendment in the Madhya Pradesh Civil Services (Pension ) Rules , 1976, namely: -
AMENDMENT
In the said rules, in rule 47 , for sub - rule ( 11 ) , the following sub - rule shall be substitued, namely : -
"(11 ) (a) (i) if the surviving child or children is or are eligible to draw two family pensions at the rate mentioned in sub - rule (3 ) , the amount of both the pensions shall be limited to Rs.36,940/ - in the revised pension under the sixth pay scale and Rs.1,07,350/- under the seventh pay scale;
(ii) if one of the family pension ceases to be payable at the rate mentioned in sub - rule (3) , in lieu thereof the pension at the rate mentioned in sub - rule (2) become payable, the amount of both the pensions shall also be limited to Rs . 36,940/- in the revised pension under the sixth pay scale and Rs . 1,07,350/- under the seventh pay scale;
(b) ifeligibility of both the enhanced family pensions is over and they are eligible for family pensions payable at the normal rate mentioned in sub - rule ( 2) , then the amountof two pensions shall be limited to Rs . 22,164/- in the revised pension under the Sixth pay scale and Rs . 64,410/- under the Seventh pay scale . " .
2. This amendment shall be deemed to have come into force with effect from 1st October. 2008 under the Sixth Pay Commission and 1st April , 2018 under the Seventh Pay Commission respectively .
