क्र.-452- आर- 2242099-2024-बाईस पं.-1.- मध्यप्रदेश पंचायत (अतिरिक्त स्टाम्प शुक्ल निधि सहायता अनुदान) नियम, 2024 का निम्नलिखित प्रारुप जिसे कि राज्य सरकार , मध्यप्रदेश पंचायत राज एवं ग्राम स्वराज अधिनियम, 1993 (क्रमांक 1 सन् 1994) की धारा 75 तथा धारा 76- क की उपधारा (4) के साथ पठित धारा 95 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए बनाना प्रस्तावित करती है. उक्त अधिनियम की धारा 95 की उपधारा (3) द्वारा अपेक्षित किए गए अनुसार उन समस्त व्यक्तियों की, जिनके कि उससे प्रभावित होने की संभावना है. जानकारी के लिए एतद्वारा प्रकाशित किया जाता है और एतद्वारा यह सूचना दी जाती है कि इस सूचना के मध्यप्रदेश राजपत्र में प्रकाशन की तारीख से 30 दिन का अवसान होने पर नियमों के उक्त प्रारुप पर विचार किया जाएगा.
किसी भी ऐसी आपत्ति या सुझाव पर जो नियमों के उक्त प्रारुप के संबंध में किसी भी व्यक्ति से ऊपर विनिर्दिष्ट अवधि का अवसान होने पर या उसके पूर्व प्राप्त हो. प्रमुख सचिव, मध्यप्रदेश शासन, पंचायत एवं ग्रामीण विकास विभाग, मंत्रालय , वल्लभ भवन, भोपाल द्वारा विचार किया जाएगा.
नियमों का प्रारुप
1. संक्षिप्त नाम विस्तार तथा प्रारम्भ.-
(1 ) इन नियमों का संक्षिप्त नाम मध्यप्रदेश पंचायत (अतिरिक्त स्टाम्प शुल्क निधि सहायता अनुदान) नियम, 2024 है.
(2) इनका विस्तार संपूर्ण मध्यप्रदेश राज्य पर होगा.
(3) ये मध्यप्रदेश राजपत्र में इनके प्रकाशन की तारीख से प्रवृत्त होंगे.

2. परिभाषाएं-
( 1 ) इन नियमों में . जब तक कि संदर्भ से अन्यथा अपेक्षित न हो.- (क) अधिनियम से अभिप्रेत है, मध्यप्रदेश पंचायत राज एव ग्राम स्वराज अधिनियन, 1993 ( क्रमांक 1 सन् 1994) ,
t (ख) ' निधि से अभिप्रेत है. उक्त अधिनियम की धारा 75 के अधीन उद्गृहीत एवं संगृहीत अतिरिका स्टाम्प शुल्क की निधि,
(ग) सरकार से अभिप्रेत है , मध्यप्रदेश सरकार,
(प) 'राज्यपाल से अभिप्रेत है, मध्यप्रदेश के राज्यपाल,
(ड) ' पंचायत' से अभिप्रेत है, उक्त अधिनियम , के अधीन गठित पंचायत , (च) जनसख्या' से अभिप्रेत है . ऐसी अतिम पूर्ववर्ती जनगणना में यथा अभिनिश्चित जनसख्या, जिसके सुसंगत आकडे प्रकाशित किए गए है , (छ) धारा से अभिप्रेत है, उक्त अधिनियम की धारा ,
(ज) राज्य" से अभिप्रेत है, मध्यप्रदेश राज्य ,
(झ) 'ग्राम रोजगार सहायक से अभिप्रेत है. महात्मा गांधी राष्ट्रीय ग्रामीण रोजगार गारंटी योजना के अधीन नियुक्त ग्राम रोजगार सहायक।
(2) उन शब्दों तथा अभिव्यक्तियों के, जो इन नियमों में प्रयुक्त किए गए है, किंतु परिभाषित नहीं किए गये है, क्रमशः वही अर्थ होंगे, जैसा कि अधिनियम में उनके लिए समनुदेशित किए गए है ।
3. अतिरिका स्टाम्प शुल्क से संबंधित राशि का वितरण-
(1 ) अधिनियम की धारा 75 के अधीन संगृहीत की गई अतिरिक्त स्टाम्प शुल्क की रकम के समतुल्य निधि की राशि का वितरण , जनपद पंचायतो और ग्राम पंचायतों के बीच प्रतिवर्ष निम्नलिखित रीति में किया जाएगा, अर्थात्: -
(क) जनपद पंचायत- जनपद पंचायतों को प्रतिवर्ष निम्नलिखित राशि उपलब्ध कराई जाएगी.-
(एक) जनपद पंचायत के स्वीकृत मूल कर्मचारिवृन्द के वेतन तथा भत्तों पर व्यय की जाने वाली राशि,
(दो) जनपद पंचायत के पदधारियो के मानदेय पर व्यय की जाने वाली राशि, 712(1)

(ख ) ग्राम पंचायत- ग्राम पंचायतों को प्रतिवर्ष निम्नलिखित राशि उपलब्ध कराई जाएगी, -
(एक) ग्राम रोजगार सहायकों के मानदेय एवं ग्राम पंचायत सचिवों के वेतन भत्तों पर व्यय की जाने वाली राशि,
(दो) ग्राम पंचायत के पदधारियों के मानदेय पर व्यय की जाने वाली राशि।
(2 ) ऊपर उप - नियम (1 ) में यथा उल्लिखित निधियों के वितरण के पश्चात् उपलब्ध शेष राशि ग्रामीण क्षेत्रों की आवश्यकताओं तथा प्राथमिकताओं को ध्यान में रखते हुए राज्य सरकार द्वारा विनिर्दिष्ट श्रेणी के अवसरचना निर्माण कार्यों के लिए संबंधित जनपद / ग्राम पंचायतों को अंतरित की जा सकेगी ।
( 3) नियम 3 के उप- नियम ( 1 ) तथा (2) के अनुसार राशि के वितरण के पश्चात् उपलब्ध शेष राशि फार्मूला आधारित प्रक्रिया के अनुसार ऑनलाइन पोर्टल के माध्यम से जनसंख्या के आधार पर ग्राम पंचायतो / जनपद पंचायतो को अतरित की जाएगी ।
4. निर्वचन-
इन नियमो के किसी भी उपबंध के निर्वचन के संबंध में यदि कोई प्रश्न उद्भूत होता है, तो इसे राज्य सरकार को निर्दिष्ट किया जाएगा तथा उस पर राज्य सरकार का विनिश्चय अतिम होगा ।

No.453 - R- 2242099-2024-XXII -P - 1.- The following draft of rules of the Madhya Pradesh Panchayat (Additional Stamp Duty Fund Grant - in- Aid) Rules , 2024, which the State Government proposes to make in exercise of the powers conferred by sub - section ( 1 ) of Section 95 read with Section 75 and sub- section (4) ofSection 76 - A of the Madhya Pradesh Panchayat Raj Avam Gram Swaraj Adhiniyam, 1993 (No. 1 of 1994) is hereby published as required by sub - section (3 ) of Section 95 of the said Act for the information of all persons likely to be affected thereby and notice is hereby given that the said draft ofrules shall be taken into consideration on the expiry of 30 days from the date of publication of this notice in the Madhya Pradesh Gazette.
Any objection or suggestion which may be received from any person with respect to the said draft of rules on or before the expiry of the period specified above , shall be considered by the Principal Secretary, Government of Madhya Pradesh, Panchayat and Rural Development Department, Mantralaya , Vallabh Bhawan,Bhopal .
DRAFT OF RULES
1. Short title, extent and commencement.-
(1) These rules may be called the Madhya Pradesh Panchayat (Additional Stamp Duty Fund Grant - in -Aid) Rules , 2024 .
(2) They shall extend to the whole of the State of Madhya Pradesh .
(3) They shall come into force from the date oftheir publication in the Madhya Pradesh Gazette.

2. Definitions.-
(1) In these rules , unless the context otherwise requires , -
(a) "Act " means the Madhya Pradesh Panchayat Raj Avam Gram Swaraj Adhiniyam , 1993 (No. 1 of 1994 ) ;
(b) " fund " means the fund of additional stamp duty levied and collected under section 75 of the said Act ;
(c) "Government " means the Government of Madhya Pradesh;
(d) "Governor " means the Governor of Madhya Pradesh ;
(e) " Panchayat " means a Panchayat constituted under the said Act;
(f) "population " means the population as ascertained at the last preceding census of which the relevant figures have been published ;
"section " means section of the said Act ;
(g)
"State " means the State of Madhya Pradesh ;
(h)
(i) "Village Employment Assistant " means Village Employment Assistant appointed under the Mahatma Gandhi National Rural Employment Guarantee Scheme .
(2) Words and expressions used but not defined in these rules shall have the same meaning as assigned to them in the said Act.
3. Distribution of amount relating to additional stamp duty.- ( 1 ) An amount of the fund equivalent to the amount of additional stamp duty collected under section 75 of the Act shall be distributed every year among the Janpad Panchayats and Gram Panchayats in the following manner , namely: -
( a) Janpad Panchayat- The following amount shall be provided to the Janpad Panchayats every year , -
(i) the amount to be spent on the salary and allowances of the approved basic staff of the Janpad Panchayat ;
(ii) the amount to be spent on the honorarium of the office bearers of the Janpad Panchayat ;

(b) Gram Panchayat- The following amount shall be provided to Gram Panchayats every year , -
(i) amount to be spent on honorarium of Gram Rozgar Sahayaks and salary allowances of Gram Panchayat Secretaries ;
(ii) amount to be spent on honorarium of office bearers of Gram Panchayat .
(2 ) The remaining amount available after distribution of funds , as mentioned in sub - rule ( 1 ) above , may be transferred to the concerned Janpad / Gram Panchayats for infrastructure construction works of the category specified by the State Government , keeping in view the needs and priorities of rural areas .
(3) After distribution of amount as per sub - rule ( 1 ) and (2 ) of rule 3 , the remaining amount available shall be transferred to the Gram Panchayats / Janpad Panchayats on the basis of population through online portal as per formula based process .
4. Interpretation .
If any question arises regarding the interpretation of any provision of these rules , it shall be referred to the State Government and the decision of the State Government thereon shall be final .
