फा.क्र. 10- क- चार- निरर्हित- 2024-251.- भारत निर्वाचन आयोग के निम्नांकित आदेशों को सर्वसाधारण की जानकारी के लिये प्रकाशित किया जाता है :-

1. भारत निर्वाचन आयोग का पत्र क्र. 76- मध्यप्रदेश- वि.स.-68- रीवा-2024- सी.ई.एम.एस.-III- 33633 , दिनांक 06 दिसम्बर 2024.

आदेश

यतः , मध्य प्रदेश राज्य की 68 - सिरमौर विधान सभा क्षेत्र के साधारण निर्वाचन 2023 अधिसूचना नं . 15 - विधि निर्वा. -चार-म.प्र. - वि.स. -2023 दिनांक 21.10.2023 के जरिए की गई थी ।

यतः लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है; और

यतः 68 - सिरमौर विधान सभा निर्वाचन क्षेत्र के रिटर्निंग अधिकारी द्वारा उक्त निर्वाचन का परिणाम 03 दिसम्बर, 2023 को घोषित किया गया था। इस प्रकार, निर्वाचन व्यय का लेखा दाखिल करने की अन्तिम तारीख 02 जनवरी , 2024 थी; और

यतः , जिला निर्वाचन अधिकारी, रीवा, मध्य प्रदेश के द्वारा प्रस्तुत संवीक्षा रिपोर्ट और मुख्य निर्वाचन पदाधिकारी , मध्य प्रदेश द्वारा पत्र सं . 10-क/4/निर्वा .व्यय/निर्देश/2023-24 /1032 दिनांक 25.01.2024 के जरिए अग्रेषित रिपोर्ट के अनुसार सरिता पाण्डेय जो मध्य प्रदेश विधान सभा का साधारण निर्वाचन 2023 के निर्वाचन क्षेत्र 68 - सिरमौर से लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं; और ,

यतः , जिला निर्वाचन अधिकारी , भोपाल , मध्य प्रदेश , और उप मुख्य निर्वाचन पदाधिकारी, मध्य प्रदेश की उक्त रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5 ) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए सरिता पाण्डेय को कारण बताओ नोटिस सं. 76/ मध्यप्रदेश - वि0 स0/68/2024/सीईएमएस- III , दिनांक 19.07.2024 जारी किया गया था; और

यतः , निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप- नियम (6) के अनुसार, दिनांक 19.07.2024 के उपर्युक्त कारण बताओ नोटिस के जरिए सरिता पाण्डेय को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही , निर्वाचन व्यय का अपना लेखा दाखिल करें; और 730(1)

यतः , जिला निर्वाचन अधिकारी , रीवा द्वारा अपने पत्र संख्या 1487/ 15/निर्वा ./निर्वा .व्यय लेखा/2023 दिनांक 09.10.2024 जो मुख्य निर्वाचन अधिकारी , मध्य प्रदेश के पत्र 10- क/4/निर्वा.व्यय/निर्देश/2023- 24/14164 दिनांक 30.10.2024 द्वारा अग्रेषित किया गया है, के जरिए आयोग को सूचना दी गई की उक्त नोटिस अभ्यर्थी द्वारा 31.07.2024 को प्राप्त किया गया; और,

यतः , यतः , जिला निर्वाचन अधिकारी , रीवा द्वारा अपने पत्र संख्या 1487/15/निर्वा./निर्वा.व्यय लेखा/2023 दिनांक 09.10.2024 जो मुख्य निर्वाचन अधिकारी , मध्य प्रदेश के पत्र 10- क/4/निर्वा.व्यय/निर्देश/2023-24/ 14164 दिनांक 30.10.2024 द्वारा अग्रेषित किया गया है, के जरिए प्रस्तुत की गई अनुपूरक संवीक्षा रिपोर्ट में यह बताया गया है कि सरिता पाण्डेय ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और ,

यतः , आयोग का यह समाधान हो गया है कि सरिता पाण्डेय निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचितकारण अथवा औचित्य नहीं है; और

यतः , लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 10 क में अनुबंधित किया गया हैकिः-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा

(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित होगा।

अतः , अब लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्वारा घोषणा करता है कि मध्य प्रदेश राज्य के 68 - सिरमौर विधान सभा निर्वाचन क्षेत्र से मध्य प्रदेश राज्य में विधान सभा के साधारण निर्वाचन , 2023 में निर्वाचन लड़ने वाले अभ्यर्थी सरिता पाण्डेय , ग्राम पोस्ट - दोहा, तहसील - सिरमौर, जिला -रीवा (म.प्र. ) को इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने अथवा होने के लिए निरर्हित है।

ORDER

WHEREAS , the General Election to 68 - Sirmour Legislative Assembly of Madhya Pradesh , 2023 was announced by Notification No. 15 विधि निर्वा. चार-म.प्र.- वि.स. -2023 dated 21.10.2023 .

WHEREAS , the result of the said election along with 68 - Sirmour Assembly Constituency was declared by the concerned Returning Officer on 3rd December , 2023. Hence , the last date for lodging the account of Election Expenses was 02nd January , 2024; and, WHEREAS , as per the scrutiny report submitted by the District Election Officer , Rewa , Madhya Pradesh and forwarded by the Deputy Chief Electoral Officer , Madhya Pradesh vide their letter No. 10- क/4/निर्वा.व्यय/ निर्देश/2023-24/1032, dated 25th January, 2024, Sarita Pandey, a contesting candidate from 68- Sirmour Assembly Constituency of Madhya Pradesh in General Election to Legislative Assembly , 2023 , has failed to lodge account of his election expenses , in the manner , as required under law; and,

WHEREAS, on the basis of the reports of the District Election Office , Rewa , Madhya Pradesh and the Chief Electoral Officer , Madhya Pradesh , a Show - Cause notice , 76 / MP - LA/ 68 / 2024/ CEMS - III dated 19.07.2024 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules , 1961 by the Election Commission of India to Sarita Pandey for not lodging the account of Election Expenses ; and ,

WHEREAS , As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules , 1961 , through the above said Show- Cause Notice , dated 19.07.2027 , Sarita Pandey was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and , 730(3)

WHEREAS, the said notice was received by the candidate on 31.07.2024. The acknowledgment receipt has been submitted to the Commission by the District Election Officer, Rewa , vide its letter no. 1487/15/निर्वा ./निर्वा. व्यय लेखा/2023 dated 09.10.2024 forwarded by CEO , Madhya Pradesh vide its letter no . 10-क/4/निर्वा . व्यय/निर्देश/2023-24/ 14164 dated 30.10.2024; and,

WHEREAS , the District Election Officer , Rewa in his Supplementary Report , vide its letter 1487/15/निर्वा./निर्वा. व्यय लेखा/ 2023 dated 09.10.2024 forwarded by CEO , Madhya Pradesh vide its letter no . 10- क/4/निर्वा. व्यय/निर्देश/2023-24/ 14164 dated 30.10.2024 has reported that Sarita Pandey has neither submitted any representation nor any statement of account of election expenses . Further , after receipt of the due notice of the Election Commission of India , he has furnished neither any reason nor explanation for the said failure ; and,

WHEREAS , the Commission is satisfied that Sarita Pandey has failedto lodge the account of election expenses and has no good reason or justification for the failure,

WHEREAS , Section 10 A of the Representation of the People Act, 1951 provides that : -

"Ifthe Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under this Act, and

has no good reason or justification for the failure ,

(b)

the Election Commission shall, by order published in the Official Gazette , declare him to be disqualified andany such person shall be disqualifiedfor a period of three years from the date ofthe order " ;

NOW, THEREFORE , in pursuance of Section 10A of the Representation of the People Act , 1951 , the Election Commission of India hereby declares Sarita Pandey resident of Gram /Post - Doha , Tehsil- Sirmour , Dist. Rewa, Madhya Pradesh a contesting candidate from 68-Sirmour Assembly Constituency of the State of Madhya Pradesh in the General Election to the Legislative Assembly 2023 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order .

यतः , मध्य प्रदेश राज्य की 72- देवतालाब विधान सभा क्षेत्र के साधारण निर्वाचन 2023 अधिसूचना नं. 15- विधि निर्वा. चार-म.प्र. - वि.स. -2023 दिनांक 21.10.2023 के जरिए की गई थी।

यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार , निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है; और

यतः 72- देवतालाब विधान सभा निर्वाचन क्षेत्र के रिटर्निंग अधिकारी द्वारा उक्त निर्वाचन का परिणाम 03 दिसम्बर, 2023 को घोषित किया गया था । इस प्रकार , निर्वाचन व्यय का लेखा दाखिल करने की अन्तिम तारीख 02 जनवरी , 2024 थी; और

यतः , जिला निर्वाचन अधिकारी , रीवा, मध्य प्रदेश के द्वारा प्रस्तुत संवीक्षा रिपोर्ट और मुख्य निर्वाचन पदाधिकारी , मध्य प्रदेश द्वारा पत्र सं. 10-क/4/निर्वा.व्यय/निर्देश/2023-24/1032 दिनांक 25.01.2024 के जरिए अग्रेषित रिपोर्ट के अनुसार बंशरूप कठेल जो मध्य प्रदेश विधान सभा का साधारण निर्वाचन 2023 के निर्वाचन क्षेत्र 72- देवतालाब से लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं; और ,

यतः , जिला निर्वाचन अधिकारी , भोपाल , मध्य प्रदेश, और उप मुख्य निर्वाचन पदाधिकारी , मध्य प्रदेश की उक्त रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए बंशरूप कठेल को कारण बताओ नोटिस सं . 76/मध्यप्रदेश -वि0स0/72/2024/ सीईएमएस- III , दिनांक 19.07.2024 जारी किया गया था; और

यतः , निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप- नियम (6) के अनुसार, दिनांक 19.07.2024 के उपर्युक्त कारण बताओ नोटिस के जरिए बंशरूप कठेल को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही , निर्वाचन व्यय का अपना लेखा दाखिल करें; और 730(9)

यतः , जिला निर्वाचन अधिकारी , रीवा द्वारा अपने पत्र संख्या 1487/ 15/निर्वा./निर्वा.व्यय लेखा/2023 दिनांक 09.10.2024 जो मुख्य निर्वाचन अधिकारी , मध्य प्रदेश के पत्र 10-क/4/ निर्वा.व्यय /निर्देश/2023- 24/14164 दिनांक 30.10.2024 द्वारा अग्रेषित किया गया है, के जरिए आयोग को सूचना दी गई की उक्त नोटिस अभ्यर्थी द्वारा 03.08.2024 को प्राप्त किया गया; और ,

यतः , यतः , जिला निर्वाचन अधिकारी , रीवा द्वारा अपने पत्र संख्या 1487/ 15/ निर्वा. /निर्वा.व्यय लेखा/2023 दिनांक 09.10.2024 जो मुख्य निर्वाचन अधिकारी , मध्य प्रदेश के पत्र 10- क/4/निर्वा.व्यय/निर्देश/2023-24/ 14164 दिनांक 30.10.2024 द्वारा अग्रेषित किया गया है, के जरिए प्रस्तुत की गई अनुपूरक संवीक्षा रिपोर्ट में यह बताया गया है कि बंशरूप कठेल ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और ,

यतः, आयोग का यह समाधान हो गया है कि बंशरूप कठेल निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचितकारण अथवा औचित्य नहीं है; और

यतः , लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है किः-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है , दाखिल करने में असफल रहा है; तथा

(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा व्यक्ति उस आदेश कीतारीख से तीन वर्ष की कालावधि के लिए निरर्हित होगा।

अतः , अब लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 10 क के अनुसरण में भारत निर्वाचन आयोग एतद्वारा घोषणा करता है कि मध्य प्रदेश राज्य के 72- देवतालाब विधान सभा निर्वाचन क्षेत्र से मध्य प्रदेश राज्य में विधान सभा के साधारण निर्वाचन , 2023 में निर्वाचन लड़ने वाले अभ्यर्थी बंशरूप कठेल , ग्राम पोस्ट - खैरा कन ० , तहसील - मऊगंज को इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने अथवा होने के लिए निरर्हित है।

WHEREAS , as per Section 78 of the Representation of the People Act , 1951 , every contesting candidate at an election has to , within 30 days from the date of election of the returned candidate , lodge a true copy of the account of his election expenses with the District Election Officer ; and, WHEREAS , the result of the said election along with 72 - Deotalab Assembly Constituency was declared by the concerned Returning Officer on 3rd December , 2023. WHEREAS , on the basis of the reports of the District Election Office , Rewa , Madhya Pradesh and the Chief Electoral Officer , Madhya Pradesh, a Show - Cause notice , 76/ MP - LA/ 72 /2024 / CEMS - III dated 19.07.2024 was issued under sub rule ( 5) of Rule 89 of the Conduct of Elections Rules , 1961 by the Election Commission of India to Raj Kumar Patel for not lodging the account of Election Expenses ; and,

WHEREAS , As per the sub rule ( 6) of Rule 89 of the Conduct of Elections Rules , 1961 , through the above said Show-Cause Notice , dated 19.07.2027 , Raj Kumar Patel was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice ; and, 730(11)

Further , after receipt of the due notice of the Election Commission of India , he has furnished neither any reason nor explanation for the said failure ; and ,

WHEREAS, the Commission is satisfied that Raj Kumar Patel has failed to lodge the account of election expenses and has no good reason or justification for the failure,

WHEREAS , Section 10 A of the Representation of the People Act , 1951 provides that : -

"Ifthe Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under this Act, and

(b) has no good reason or justification for the failure ,

the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period ofthree years from the date of the order " ;

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act , 1951 , the Election Commission of India hereby declares Raj Kumar Patel resident of Village Post - Padriya , Dist Rewa, M.P. a contesting candidate from 72 - Deotalab Assembly Constituency of the State of Madhya Pradesh in the General Election to the Legislative Assembly 2023 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order .

यतः , जिला निर्वाचन अधिकारी, रीवा, मध्य प्रदेश के द्वारा प्रस्तुत संवीक्षा रिपोर्ट और मुख्य निर्वाचन पदाधिकारी, मध्य प्रदेश द्वारा पत्र सं . 10-क/4/ निर्वा.व्यय /निर्देश/2023-24/ 1032 दिनांक 25.01.2024 के जरिए अग्रेषित रिपोर्ट के अनुसार राकेश कुमार पाण्डेय जो मध्य प्रदेश विधान सभा का साधारण निर्वाचन 2023 के निर्वाचन क्षेत्र 75- गुढ़ से लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं; और ,

यतः , जिला निर्वाचन अधिकारी , भोपाल , मध्य प्रदेश, और उप मुख्य निर्वाचन पदाधिकारी, मध्य प्रदेश की उक्त रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5 ) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए राकेश कुमार पाण्डेय को कारण बताओ नोटिस सं . 76/मध्यप्रदेश -वि0 स0/ 75/2024/सीईएमएस-III , दिनांक 19.07.2024 जारी किया गया था; और

यतः , निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप- नियम (6) के अनुसार , दिनांक 19.07.2024 के उपर्युक्त कारण बताओ नोटिस के जरिए राकेश कुमार पाण्डेय को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें; और मध्यप्रदेश राजपत्र , दिनांक 27 दिसम्बर 2024

यतः , जिला निर्वाचन अधिकारी, रीवा द्वारा अपने पत्र संख्या 1487/ 15/निर्वा ./निर्वा .व्यय लेखा/2023 दिनांक 09.10.2024 जो मुख्य निर्वाचन अधिकारी , मध्य प्रदेश के पत्र 10- क/4/निर्वा .व्यय/ निर्देश/2023- 24/14164 दिनांक 30.10.2024 द्वारा अग्रेषित किया गया है , के जरिए आयोग को सूचना दी गई की उक्त नोटिस अभ्यर्थी के घर पर दिनांक 12.08.2024 को चस्पा किया गया; और,

यतः, यतः , जिला निर्वाचन अधिकारी , रीवा द्वारा अपने पत्र संख्या 1487/15/निर्वा ./निर्वा.व्यय लेखा/2023 दिनांक 09.10.2024 जो मुख्य निर्वाचन अधिकारी , मध्य प्रदेश के पत्र 10- क/4/निर्वा.व्यय/निर्देश/2023-24/14164 दिनांक 30.10.2024 द्वारा अग्रेषित किया गया है , के जरिए प्रस्तुत की गई अनुपूरक संवीक्षा रिपोर्ट में यह बताया गया है कि राकेश कुमार पाण्डेय ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और,

यतः, आयोग का यह समाधान हो गया है कि राकेश कुमार पाण्डेय निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचितकारण अथवा औचित्य नहीं है; और

यतः , लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है किः- " यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति -

(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है , तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित होगा।

अतः , अब लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 10 क के अनुसरण में भारत निर्वाचन आयोग एतद्वारा घोषणा करता है कि मध्य प्रदेश राज्य के 75- गुढ़ विधान सभा निर्वाचन क्षेत्र से मध्य प्रदेश राज्य में विधान सभा के साधारण निर्वाचन , 2023 में निर्वाचन लड़ने वाले अभ्यर्थी राकेश कुमार पाण्डेय , 01 , वार्ड नं. 3, महादेवन टोला , कष्टहरनाथ मंदिर के पास गुढ़ , तह. गुढ़ , जिला रीवा, (म.प्र. ) को इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने अथवा होने के लिए निरर्हित है।

ORDER

WIIEREAS , the General Election to 75 - Gurh Legislative Assembly of Madhya Pradesh , 2023 was announced by Notification No. 15 विधि निर्वा. चार-म.प्र.वि.स.-2023 dated 21.10.2023.

WHEREAS , the result of the said election along with 75 - Gurh Assembly Constituency was declared by the concerned Returning Officer on 3rd December , 2023. Hence , the last date for lodging the account of Election Expenses was 02nd January , 2024; and, WHEREAS , as per the scrutiny report submitted by the District Election Officer , Rewa , Madhya Pradesh and forwarded by the Deputy Chief Electoral Officer , Madhya Pradesh vide their letter No. 10- क/4/निर्वा.व्यय/निर्देश/2023-24/ 1032, dated 25th January, 2024 Rakesh Kumar Pandey , a contesting candidate from 75 - Gurh Assembly Constituency of Madhya Pradesh in General Election to Legislative Assembly , 2023 , has failed to lodge account of his election expenses , in the manner , as required under law; and ,

WHEREAS , on the basis of the reports of the District Election Office , Rewa , Madhya Pradesh and the Chief Electoral Officer , Madhya Pradesh , a Show- Cause notice , 76/ MP - LA/ 75 / 2024 / CEMS - III dated 19.07.2024 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules , 1961 by the Election Commission of India to Rakesh Kumar Pandey for not lodging the account of Election Expenses; and,

WHEREAS , As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules , 1961 , through the above said Show-Cause Notice , dated 19.07.2027 , Rakesh Kumar Pandey was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice ; and , मध्यप्रदेश राजपत्र, दिनांक 27 दिसम्बर 2024

WHEREAS , the said notice was pasted at given address of the candidate on 12.08.2024 . The acknowledgment receipt has been submitted to the Commission by the District Election Officer , Rewa , vide its letter no . 1487/ 15/निर्वा ./निर्वा . व्यय लेखा/2023 dated 09.10.2024 forwarded by CEO , Madhya Pradesh vide its letter no . 10- क/4/निर्वा . व्यय / निर्देश/2023-24 / 14164 dated 30.10.2024; and ,

WHEREAS , the District Election Officer , Rewa in his Supplementary Report , vide its letter 1487/15/निर्वा./निर्वा. व्यय लेखा/ 2023 dated 09.10.2024 forwarded by CEO , Madhya Pradesh vide its letter no . 10 -क/4/निर्वा. व्यय / निर्देश /2023-24/ 14164 dated 30.10.2024 has reported that Rakesh Kumar Pandey has neither submitted any representation nor any statement of account of election expenses . Further , after receipt of the duc notice of the Election Commission of India , he has furnished neither any reason nor explanation for the said failure ; and ,

WHEREAS , the Commission is satisfied that Rakesh Kumar Pandey has failed to lodge the account of election expenses and has no good reason or justification for the failure ,

WHEREAS , Section 10 A of the Representation of the People Act , 1951 provides that: -

" If the Election Commission is satisfied that a person-

a) has failed to lodge an account of election expenses , within the time and in the manner required by or under this Act, and

b) has no good reason or justification for the failure ,

the Election Commission shall, by order published in the Official Gazette , declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order " ;

NOW , THEREFORE , in pursuance of Section 10A of the Representation of the People Act, 1951 , the Election Commission of India hereby declares Rakesh Kumar Pandey resident of 01 , Ward No. 3 , Mahdevan Tola, Kashtaharnath Mandir ke pass , Tehsil - Gurh , Dist. - Rewa, M.P. a contesting candidate from 75- Gurh Assembly Constituency of the State of Madhya Pradesh in the General Election to the Legislative Assembly 2023 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order .
