सं. 76- म.प्र. - वि.स. - 18-2024- सी.ई.एम.एस.- III. - यतः, मध्यप्रदेश राज्य की 18 - भितरवार विधान सभा क्षेत्र के साधारण निर्वाचन 2023 अधिसूचना नं. 15-विधि निर्वा. चार- म.प्र. वि.स. 2023 , दिनांक 21 अक्टूबर 2023 के जरिए की गई थी.

यतः , लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है; और,

यतः, 18-भितरवार विधान सभा निर्वाचन क्षेत्र के रिटर्निंग अधिकारी द्वारा उक्त निर्वाचन का परिणाम 3 दिसम्बर, 2023 को घोषित किया गया था. इस प्रकार निर्वाचन व्यय का लेखा दाखिल करने की अंतिम तारीख 2 जनवरी 2024 थी; और

यतः, जिला निर्वाचन अधिकारी, ग्वालियर, मध्यप्रदेश के द्वारा प्रस्तुत संवीक्षा रिपोर्ट और मुख्य निर्वाचन पदाधिकारी, मध्यप्रदेश द्वारा पत्र सं. 10- क/चार/निर्वा.व्यय/निर्देश/2023-24/ 1032, दिनांक 25 जनवरी 2024 के जरिए अग्रेषित रिपोर्ट के अनुसार अगर सिंह, जो मध्यप्रदेश विधान सभा का साधारण निर्वाचन 2023 के निर्वाचन क्षेत्र 18 - भितरवार से लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं; और,

यतः, जिला निर्वाचन अधिकारी , ग्वालियर, मध्यप्रदेश और उप मुख्य निर्वाचन पदाधिकारी, मध्यप्रदेश की उक्त रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उपनियम ( 5 ) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए अगर सिंह को कारण बताओ नोटिस सं. 76 - मध्यप्रदेश- वि.स. 18-2024- सी.ई.एम.एस.- III, दिनांक 19 जुलाई 2024 को जारी किया गया था; और,

यतः , निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उपनियम ( 6 ) के अनुसार, दिनांक 19 जुलाई 2024 के उपर्युक्त कारण बताओ नोटिस के जरिए अगर सिंह को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें; और

यतः , जिला निर्वाचन अधिकारी, ग्वालियर द्वारा अपने पत्र संख्या निर्वा-25-6-60-2023-4061-489 ग्वालियर दिनांक 21-11-2024- जो मुख्य निर्वाचन अधिकारी , मध्यप्रदेश के पत्र 10- क-4- निर्वा. व्यय- निर्देश- 2023-24-14971 दिनांक 27 नवम्बर 2024 द्वारा अग्रेषित किया गया है, के जरिए आयोग को सूचना दी गई की उक्त नोटिस अथ्यर्थी द्वारा 29-7-2024 को प्राप्त किया गया; और

यतः, जिला निर्वाचन अधिकारी, ग्वालियर द्वारा अपने पत्र संख्या निर्वा-25-6-60-2023-4061-489 ग्वालियर दिनांक 21 नवम्बर 2024 जो मुख्य निर्वाचन अधिकारी , मध्यप्रदेश के पत्र 10- क- 4- निर्वा. व्यय- निर्देश- 2023-24-14971 , दिनांक 27-11-2024 द्वारा अग्रेषित किया गया है के जरिए प्रस्तुत की गई अनुपूरक संवीक्षा रिपोर्ट में यह बताया गया है कि अगर सिंह ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है . इसके अतिरिक्त, उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है ; और

यतः, आयोग का यह समाधान हो गया है कि अगर सिंह , निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और,

यतः , लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है कि:-

" यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है. दाखिल करने में असफल रहा है; तथा मध्यप्रदेश राजपत्र, दिनांक 10 जनवरी 2025

(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित होगा " ;

अतः, अब, लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्वारा, घोषणा करता है कि मध्यप्रदेश राज्य के 18 - भितरवार विधान सभा निर्वाचन क्षेत्र से मध्यप्रदेश राज्य में विधान सभा के साधारण निर्वाचन , 2023 में निर्वाचन लड़ने वाले अभ्यर्थी , अगर सिंह , ग्राम सहवई, पो. रिछारी कला, तहसील- भितरवार, जिला ग्वालियर, मध्यप्रदेश को इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निरर्हित है.

No. 76 - MP -LA - 18-2024 - CEMS- III . WHEREAS , the General Election to 18 - Bhitarwar Legislative Assembly of Madhya Pradesh , 2023 was announced by Notification No. 15 विधि निर्वा. चार. म.प्र. वि.स. 2023 , dated 21st October 2023 .

WHEREAS, the result of the said election along with 18- Bhitarwar Assembly Constituency was declared by the concerned Returning Officer on 3rd December 2023. Hence the last date for lodging the account of Election Expenses was 2nd January, 2024; and,

WHEREAS, as per the scrutiny report submitted by the District Election Officer , Gwalior , Madhya Pradesh and forwarded by the Deputy Chief Electoral Officer, Madhya Pradesh vide their letter No. 10- क/चार/निर्वा.व्यय/निर्देश/ 2023-24/ 1032 , dated 25th January 2024 , Agar Singh , a contesting candidate from 18 - Bhitarwar Assembly Constituency of Madhya Pradesh in General Election to Legislative Assembly 2023 , has failed to lodge account of hisElection Expenses , in the manner, as required under law; and ,

WHEREAS , on the basis of the reports of the District Election Office , Gwalior , Madhya Pradesh and the Chief Electoral Officer, Madhya Pradesh a Show- Cause Notice , 76- MP - LA - 18-2024- CEMS- III , dated 19th July 2024 was issued under sub- rule ( 5) of Rule 89 of the Conduct of Elections Rules , 1961 by the Election Commission of India to Agar Singh , for not lodging the account of Election Expenses ; and ,

WHEREAS , as per the sub - rule ( 6) of Rule 89 of the Conduct of Elections Rules , 1961 , through the above said Show- Cause Notice dated 19th July 2024 , Agar Singh , was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of Election Expenses within 20 days from the date of receipt of the notice ; and ,

WHEREAS , the said notice was received by the candidate on 29th July 2024. The Acknowledgment receipt has been submitted to the Commission by District Election Officer , Gwalior vide its letter No. निर्वा.-25-6-60-2023- 4061-489- ग्वालियर dated 21-11-2024 forwarded by CEO , Madhya Pradesh vide its letter No. 10-क-4 निर्वा . व्यय- निर्देश- 2023-24-14971 dated 27-11-2024 ; and मध्यप्रदेश राजपत्र, दिनांक 10 जनवरी 2025

WHEREAS, the District Election Officer, Gwalior in his Supplementary Report, vide its letter निर्वा-25-6-60- 2023-4061-489 ग्वालियर, dated 21-11-2024 forwarded by CEO , Madhya Pradesh vide its letter No. 10-क-4-निर्वा. व्यय- निर्देश - 2023-24-14971 dated 27-11-2024; has reported that Agar Singh has neither submitted any representation nor any statement of account of election expenses , Further, after receipt of the due notice of the Election Commission of India, he has furnished neither any reason nor explanation for the said failure ; and,

WHEREAS, the Commission is satisfied that Agar Singh, has failed to lodge the account of election expenses and has no good reason or justification for the failure;

WHEREAS , Section 10A of the Representation of the People Act, 1951 provides that :-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by or under this Act ; and

(b) has no good reason or justification for the failure,

the Election Commission shall by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order " ;

NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act , 1951 , the Election Commission of India hereby declares Agar Singh, resident of Gram-Sehvai, PO- Richharikala , Teh. - Bhitarwar, Jila- Gwalior (M. P. ) a contesting candidate from 18 - Bhitarwar Assembly Constituency, of the State of Madhya Pradesh in the General Election to the Legislative Assembly 2023 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order .

WHEREAS , the District Election Officer , Gwalior in his Supplementary Report , vide its letter निर्वा-25-6-60- 2023-4061-489 ग्वालियर , dated 21-11-2024 forwarded by CEO , Madhya Pradesh vide its letter No. 10- क-4-निर्वा. व्यय- निर्देश- 2023-24-14971 dated 27-11-2024; has reported that Manish Singhal has neither submitted any representation nor any statement of account of election expenses , Further , after receipt of the due notice of the Election Commission of India, he has furnished neither any reason nor explanation for the said failure ; and ,

WHEREAS , the Commission is satisfied that Manish Singhal has failed to lodge the account of election expenses and has no good reason or justification for the failure ;

WHEREAS , Section 10A of the Representation of the People Act , 1951 provides that :-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses , within the time and in the manner required by or under this Act ; and

(b) has no good reason or justification for the failure ,

the Election Commission shall by order published in the Official Gazette , declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order " ;

NOW THEREFORE , in pursuance of Section 10A of the Representation of the People Act, 1951 , the Election Commission of India hereby declares Manish Singhal , resident of Tulsi Vihar Colony, Gwalior, a contesting candidate from 15 -Gwalior Assembly Constituency , of the State of Madhya Pradesh in the General Election to the Legislative Assembly 2023 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order .

यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है; और,

यतः, 15 -ग्वालियर विधान सभा निर्वाचन क्षेत्र के रिटर्निंग अधिकारी द्वारा उक्त निर्वाचन का परिणाम 03 दिसम्बर, 2023 को घोषित किया गया था. इस प्रकार निर्वाचन व्यय का लेखा दाखिल करने की अंतिम तारीख 02 जनवरी, 2024 थी; और

यतः, जिला निर्वाचन अधिकारी, ग्वालियर, मध्यप्रदेश के द्वारा प्रस्तुत संवीक्षा रिपोर्ट और मुख्य निर्वाचन पदाधिकारी, मध्यप्रदेश द्वारा पत्र सं. 10- क/चार/निर्वा.व्यय/निर्देश/2023-24/1032 , दिनांक 25 जनवरी 2024 के जरिए अग्रेषित रिपोर्ट के अनुसार रोशन बेग , जो मध्यप्रदेश विधान सभा का साधारण निर्वाचन 2023 के निर्वाचन क्षेत्र 15 - ग्वालियर से लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं; और,

यतः, जिला निर्वाचन अधिकारी , ग्वालियर, मध्यप्रदेश और उप मुख्य निर्वाचन पदाधिकारी, मध्यप्रदेश की उक्त रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उपनियम ( 5 ) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए रोशन बेग को कारण बताओ नोटिस सं. 76 - मध्यप्रदेश - वि.स. 15-2024- सी.ई.एम.एस.- III , दिनांक 19 जुलाई 2024 को जारी किया गया था; और,

यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उपनियम ( 6 ) के अनुसार, दिनांक 19 जुलाई 2024 के उपर्युक्त कारण बताओ नोटिस के जरिए रोशन बेग को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें; और

यतः, जिला निर्वाचन अधिकारी , ग्वालियर द्वारा अपने पत्र संख्या निर्वा-25-6-60-2023-4061-489 ग्वालियर दिनांक 21-11-2024- जो मुख्य निर्वाचन अधिकारी , मध्यप्रदेश के पत्र 10- क-4- निर्वा. व्यय- निर्देश- 2023-24-14971 दिनांक 27 नवम्बर 2024 द्वारा अग्रेषित किया गया है, के जरिए आयोग को सूचना दी गई की उक्त नोटिस अभ्यर्थी द्वारा 21-8-2024 को प्राप्त किया गया; और

यतः, जिला निर्वाचन अधिकारी , ग्वालियर द्वारा अपने पत्र संख्या निर्वा-25-6-60-2023-4061-489 ग्वालियर दिनांक 21 नवम्बर 2024 जो मुख्य निर्वाचन अधिकारी , मध्यप्रदेश के पत्र 10- क-4- निर्वा. व्यय- निर्देश- 2023-24-14971 , दिनांक 27-11-2024 द्वारा अग्रेषित किया गया है के जरिए प्रस्तुत की गई अनुपूरक संवीक्षा रिपोर्ट में यह बताया गया है कि रोशन बेग ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है. इसके अतिरिक्त, उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है ; और

यतः, आयोग का यह समाधान हो गया है कि रोशन बेग निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और,

यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है किः-

" यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-

(ख ) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है , तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित होगा . " ;

WHEREAS , the result of the said election along with 15 - Gwalior Assembly Constituency was declared by the concerned Returning Officer on 3rd December 2023. Hence the last date for lodging the account of Election Expenses was 2nd January, 2024; and,

WHEREAS , as per the scrutiny report submitted by the District Election Officer, Gwalior , Madhya Pradesh and forwarded by the Deputy Chief Electoral Officer, Madhya Pradesh vide their letter No. 10- क/चार/निर्वा.व्यय/निर्देश/ 2023-24/1032, dated 25th January 2024, Roshan Beg , a contesting candidate from 15 - Gwalior Assembly Constituency of Madhya Pradesh in General Election to Legislative Assembly 2023 , has failed to lodge account of his Election Expenses , in the manner, as required under law; and ,

WHEREAS , on the basis of the reports of the District Election Office , Gwalior , Madhya Pradesh and the Deputy Chief Electoral Officer , Madhya Pradesh a Show- Cause Notice , 76 - MP- LA- 15-2024 - CEMS - III, dated 19th July 2024 was issued under sub- rule (5) of Rule 89 of the Conduct of Elections Rules , 1961 by the Election Commission of India to Roshan Beg , for not lodging the account of Election Expenses ; and ,

WHEREAS , as per the sub - rule ( 6) of Rule 89 of the Conduct of Elections Rules , 1961 , through the above said Show-Cause Notice dated 19th July 2024, Roshan Beg , was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of Election Expenses within 20 days from the date of receipt of the notice ; and ,

WHEREAS , the said notice was received by the candidate on 21st August 2024. The Acknowledgment receipt has been submitted to the Commission by the District Election Officer , Gwalior vide its letter No. निर्वा.-25-6-60- 2023-4061-489 - ग्वालियर dated 21-11-2024 forwarded by CEO, Madhya Pradesh vide its letter No. 10-क-4 निर्वा. व्यय-निर्देश- 2023-24-14971 dated 27-11-2024 ; and

यतः , लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को , निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है; और,

यतः , 14-ग्वालियर ग्रामीण विधान सभा निर्वाचन क्षेत्र के रिटर्निंग अधिकारी द्वारा उक्त निर्वाचन का परिणाम 03 दिसम्बर, 2023 को घोषित किया गया था. इस प्रकार निर्वाचन व्यय का लेखा दाखिल करने की अंतिम तारीख 02 जनवरी , 2024 थी; और

यतः, जिला निर्वाचन अधिकारी, ग्वालियर, मध्यप्रदेश के द्वारा प्रस्तुत संवीक्षा रिपोर्ट और मुख्य निर्वाचन पदाधिकारी, मध्यप्रदेश द्वारा पत्र सं. 10- क/चार/निर्वा.व्यय/निर्देश /2023-24/1032, दिनांक 25 जनवरी , 2024 के जरिए अग्रेषित रिपोर्ट के अनुसार दीपेन्द्र सिंह परमार, जो मध्यप्रदेश विधान सभा का साधारण निर्वाचन 2023 के निर्वाचन क्षेत्र 14-ग्वालियर ग्रामीण से लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं ; और,

यतः, जिला निर्वाचन अधिकारी, ग्वालियर, मध्यप्रदेश और उप मुख्य निर्वाचन पदाधिकारी , मध्यप्रदेश की उक्त रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम , 1961 के नियम 89 के उपनियम ( 5 ) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए दीपेन्द्र सिंह परमार को कारण बताओ नोटिस सं. 76 - मध्यप्रदेश - वि.स. - 14-2024- सी.ई.एम.एस.- III , दिनांक 19 जुलाई , 2024 को जारी किया गया था; और,

यतः, निर्वाचनों का संचालन नियम , 1961 के नियम 89 के उपनियम ( 6 ) के अनुसार, दिनांक 19 जुलाई 2024 के उपर्युक्त कारण बताओ नोटिस के जरिए दीपेन्द्र सिंह परमार को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें; और

यतः, जिला निर्वाचन अधिकारी , ग्वालियर द्वारा अपने पत्र संख्या निर्वा-25-6-60-2023-4061-489 ग्वालियर , दिनांक 21-11-2024 जो मुख्य निर्वाचन अधिकारी , मध्यप्रदेश के पत्र 10- क-4- निर्वा. व्यय- निर्देश- 2023-24-14971 दिनांक 27 नवम्बर 2024 द्वारा अग्रेषित किया गया है , के जरिए आयोग को सूचना दी गई कि उक्त नोटिस अभ्यर्थी द्वारा 7-8-2024 को प्राप्त किया गया; और

यतः, जिला निर्वाचन अधिकारी , ग्वालियर द्वारा अपने पत्र संख्या निर्वा-25-6-60-2023-4061-489 ग्वालियर, दिनांक 21 नवम्बर 2024 जो मुख्य निर्वाचन अधिकारी , मध्यप्रदेश के पत्र 10- क-4- निर्वा. व्यय-निर्देश- 2023-24-14971, दिनांक 27-11-2024 द्वारा अग्रेषित किया गया है, के जरिए प्रस्तुत की गई अनुपूरक संवीक्षा रिपोर्ट में यह बताया गया है कि दीपेन्द्र सिंह परमार ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है. इसके अतिरिक्त, उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है ; और

यतः , आयोग का यह समाधान हो गया है कि दीपेन्द्र सिंह परमार, निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है ; और,

यतः, लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 10क में अनुबंधित किया गया है कि:-

" यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है. दाखिल करने में असफल रहा है ; तथा 30 ( 11)

(ख ) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित होगा" ;

WHEREAS , the result of the said election along with 14- Gwalior Rural Assembly Constituency was declared by the concerned Returning Officer on 3rd December, 2023. Hence the last date for lodging the account of Election Expenses was 2nd January, 2024; and,

WHEREAS , on the basis of the reports of the District Election Office , Gwalior , Madhya Pradesh and the Chief Electoral Officer , Madhya Pradesh a Show- Cause Notice , 76- MP - LA- 14-2024- CEMS- III , dated 19th July 2024 was issued under sub - rule (5) of Rule 89 of the Conduct of Elections Rules , 1961 by the Election Commission of India to Deepandra Singh Parmar for not lodging the account of Election Expenses ; and,

WHEREAS , as per the sub - rule (6 ) of Rule 89 of the Conduct of Elections Rules , 1961 , through the above said Show -Cause Notice dated 19th July 2024 , Deepandra Singh Parmar was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of Election Expenses within 20 days from the date of receipt of the notice ; and,

WHEREAS , the said notice was received by the candidate on 7th August 2024. The Acknowledgment receipt has been submitted to the Commission by the District Election Officer, Gwalior vide its letter No. निर्वा.- 25-6-60- 2023-4061-489 - ग्वालियर dated 21-11-2024 forwarded by CEO, Madhya Pradesh vide its letter No. 10- क -4 निर्वा. व्यय- निर्देश- 2023-24-14971 dated 27-11-2024 ; and , मध्यप्रदेश राजपत्र , दिनांक 10 जनवरी 2025

WHEREAS , the District Election Officer, Gwalior in his Supplementary Report , vide its letter निर्वा-25-6-60- 2023-4061-489 ग्वालियर, dated 21-11-2024 forwarded by CEO, Madhya Pradesh vide its letter No. 10-क-4-निर्वा. व्यय- निर्देश- 2023-24-14971 dated 27-11-2024; has reported that Deepandra Singh Parmar has neither submitted any representation nor any statement of account of election expenses . Further, after receipt of the due notice of the Election Commission of India , he has furnished neither any reason nor explanation for the said failure ; and ,

WHEREAS , the Commission is satisfied that Deepandra Singh Parmar has failed to lodge the account of election expenses and has no good reason or justification for the failure ;

WHEREAS , Section 10 A of the Representation of the People Act , 1951 provides that :-

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by or under this Act ; and

(b) has no good reason or justification for the failure,

the Election Commission shall by order published in the Official Gazette , declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order " ;

NOW THEREFORE , in pursuance of Section 10A of the Representation of the People Act, 1951 , the Election Commission of India hereby declares Deepandra Singh Parmar, resident of 200 , RaghuNagar , Dabra, Tehsil- Dabra , Dist. यतः, जिला निर्वाचन अधिकारी , ग्वालियर, मध्यप्रदेश के द्वारा प्रस्तुत संवीक्षा रिपोर्ट और मुख्य निर्वाचन पदाधिकारी , मध्यप्रदेश द्वारा पत्र सं. 10- क/चार/निर्वा.व्यय/निर्देश/2023-24/ 1032, दिनांक 25 जनवरी 2024 के जरिए अग्रेषित रिपोर्ट के अनुसार पंडित राम मुदगल , जो मध्यप्रदेश विधान सभा का साधारण निर्वाचन 2023 के निर्वाचन क्षेत्र 18 -भितरवार से लड़ने वाले अभ्यर्थी हैं , विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं ; और,

यतः , जिला निर्वाचन अधिकारी , ग्वालियर , मध्यप्रदेश और उप मुख्य निर्वाचन पदाधिकारी , मध्यप्रदेश की उक्त रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उपनियम ( 5 ) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए पंडित राम मुदगल को कारण बताओ नोटिस सं. 76 - मध्यप्रदेश -वि.स. 18-2024- सी.ई.एम.एस.- III, दिनांक 19 जुलाई 2024 को जारी किया गया था; और ,

यतः, निर्वाचनों का संचालन नियम , 1961 के नियम 89 के उपनियम ( 6 ) के अनुसार, दिनांक 19 जुलाई 2024 के उपर्युक्त कारण बताओ नोटिस के जरिए पंडित राम मुदगल को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पष्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही , निर्वाचन व्यय का अपना लेखा दाखिल करें ; और

यतः, जिला निर्वाचन अधिकारी , ग्वालियर द्वारा अपने पत्र संख्या निर्वा- 25-6-60-2023-4061-489 ग्वालियर दिनांक 21-11-2024- जो मुख्य निर्वाचन अधिकारी , मध्यप्रदेश के पत्र 10- क-4- निर्वा. व्यय- निर्देश - 2023-24-14971 दिनांक 27 नवम्बर 2024 द्वारा अग्रेषित किया मध्यप्रदेश राजपत्र, दिनांक 10 जनवरी 2025

गया है, के जरिए आयोग को सूचना दी गई की उक्त नोटिस अभ्यर्थी के निर्वाचन अभिकर्ता श्री कमल पाण्डे द्वारा 05-08-2024 को प्राप्त किया गया; और

यतः, जिला निर्वाचन अधिकारी , ग्वालियर द्वारा अपने पत्र संख्या निर्वा-25-6-60-2023-4061-489 ग्वालियर दिनांक 21 नवम्बर 2024 जो मुख्य निर्वाचन अधिकारी , मध्यप्रदेश के पत्र 10- क- 4-निर्वा . व्यय- निर्देश- 2023-24-14971, दिनांक 27-11-2024 द्वारा अग्रेषित किया गया है के जरिए प्रस्तुत की गई अनुपूरक संवीक्षा रिपोर्ट में यह बताया गया है कि पंडित राम मुदगल ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है . इसके अतिरिक्त, उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और

यतः, आयोग का यह समाधान हो गया है कि पंडित राम मुदगल , निर्वाचन खर्चों का लेखा दाखिल करने में विफल रहे हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है ; और,

यतः, लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 10क में अनुबंधित किया गया है कि:-

" यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-

WHEREAS , as per the scrutiny report submitted by the District Election Officer, Gwalior , Madhya Pradesh and forwarded by Deputy Chief Electoral Officer , Madhya Pradesh vide their letter No. 10 - क/चार/निर्वा.व्यय/निर्देश/2023- 24/1032, dated 25th January 2024 , Pandit Ram Mudgal , a contesting candidate from 18 - Bhitarwar Assembly Constituency of Madhya Pradesh in General Election to Legislative Assembly 2023 , has failed to lodge account of his Election Expenses , in the manner, as required under law; and ,

WHEREAS , on the basis of the reports of the District Election Office , Gwalior , Madhya Pradesh and the Chief Electoral Officer, Madhya Pradesh a Show - Cause Notice , 76- MP- LA - 18-2024 - CEMS - III , dated 19th July 2024 was issued under sub- rule ( 5) of Rule 89 of the Conduct of Elections Rules , 1961 by the Election Commission of India to Pandit Ram Mudgal , for not lodging the account of Election Expenses ; and,

WHEREAS , as per the sub - rule ( 6 ) of Rule 89 of the Conduct of Elections Rules , 1961 , through the above said Show- Cause Notice dated 19th July 2024, Pandit Ram Mudgal , was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of Election Expenses within 20 days from the date of receipt of the notice ; and,

WHEREAS , the said notice was received by Shri Kamal Pandey, election agent of the candidate on 5th August 2024. The Acknowledgment receipt has been submitted to the Commission by the District Election Officer , Gwalior vide its letter No. निर्वा.- 25-6-60-2023-4061-489- ग्वालियर dated 21-11-2024 forwarded by CEO , Madhya Pradesh vide its letter No. 10 - क -4 निर्वा. व्यय-निर्देश- 2023-24-14971 dated 27-11-2024 ; and

WHEREAS , the District Election Officer, Gwalior in his Supplementary Report , vide its letter निर्वा-25-6-60- 2023-4061-489 ग्वालियर, dated 21-11-2024 forwarded by CEO , Madhya Pradesh vide its letter No. 10-क-4-निर्वा. व्यय - निर्देश - 2023-24-14971 dated 27-11-2024 ; has reported that Pandit Ram Mudgal has neither submitted any representation nor any statement of account of election expenses , Further , after receipt of the due notice of the Election Commission of India , he has furnished neither any reason nor explanation for the said failure ; and,

WHEREAS , the Commission is satisfied that Pandit Ram Mudgal , has failed to lodge the account of election expenses and has no good reason or justification for the failure ;

WHEREAS, Section 10A of the Representation of the People Act, 1951 provides that :-

" If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses within the time and in the manner required by or under this Act; and

(b) has no good reason or justification for the failure,

NOW THEREFORE , in pursuance of Section 10A of the Representation of the People Act, 1951 , the Election Commission of India hereby declares Pandit Ram Mudgal , resident of 140 , Hanumaan Mandir , Gram- Chitauli , Post- Devri Kalan , Tehsil - Bhitarwar, Jila - Gwalior (M. P.) a contesting candidate from 18- Bhitarwar Assembly Constituency, of the State of Madhya Pradesh in the General Election to the Legislative Assembly 2023 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

सं. 76- म.प्र. - वि.स. - 18-2024- सी.ई.एम.एस.- III.- यतः, मध्यप्रदेश राज्य की 18 - भितरवार विधान सभा क्षेत्र के साधारण निर्वाचन 2023 अधिसूचना नं. 15- विधि निर्वा. चार-म.प्र. वि.स. 2023 , दिनांक 21 अक्टूबर 2023 के जरिए की गई थी.

यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है; और,

यतः, 18- भितरवार विधान सभा निर्वाचन क्षेत्र के रिटर्निंग अधिकारी द्वारा उक्त निर्वाचन का परिणाम 03 दिसम्बर, 2023 को घोषित किया गया था. इस प्रकार निर्वाचन व्यय का लेखा दाखिल करने की अंतिम तारीख 02 जनवरी 2024 थी; और

यतः, जिला निर्वाचन अधिकारी , ग्वालियर, मध्यप्रदेश के द्वारा प्रस्तुत संवीक्षा रिपोर्ट और मुख्य निर्वाचन पदाधिकारी , मध्यप्रदेश द्वारा पत्र सं. 10- क/चार/निर्वा.व्यय/निर्देश/2023-24/ 1032, दिनांक 25 जनवरी 2024 के जरिए अग्रेषित रिपोर्ट के अनुसार धर्मेन्द्र चौधरी, जो मध्यप्रदेश विधान सभा का साधारण निर्वाचन 2023 के निर्वाचन क्षेत्र 18 - भितरवार से लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रहे हैं ; और,

यतः, जिला निर्वाचन अधिकारी , ग्वालियर द्वारा अपने पत्र संख्या निर्वा-25-6-60-2023-4061-489 ग्वालियर दिनांक 21-11-2024- जो मुख्य निर्वाचन अधिकारी , मध्यप्रदेश के पत्र10-क-4- निर्वा. व्यय-निर्देश-2023-24-14971 दिनांक 27 नवम्बर 2024 द्वारा अग्रेषित किया गया है, के जरिए आयोग को सूचना दी गई की उक्त नोटिस अथ्यर्थी द्वारा 29-7-2024 को प्राप्त किया गया; और

यतः, जिला निर्वाचन अधिकारी , ग्वालियर द्वाराअपने पत्र संख्या निर्वा-25-6-60-2023-4061-489 ग्वालियर दिनांक 21 नवम्बर 2024 जो मुख्य निर्वाचन अधिकारी , मध्यप्रदेश के पत्र 10- क- 4- निर्वा. व्यय- निर्देश-2023-24-14971 , दिनांक 27-11-2024 द्वारा अग्रेषित किया गया है के जरिए प्रस्तुत की गई अनुपूरक संवीक्षा रिपोर्ट में यह बताया गया है कि धर्मेन्द्र चौधरी ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है. इसके अतिरिक्त, उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और

(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है , तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित होगा";
