क्र. - 3-1-0016-2023- TECH-चौंतीस (PHE) .-मध्यप्रदेश खुले नलकूप में इंसानों के गिरने से होने वाली दुर्घटनाओं की रोकथाम एवं सुरक्षा अधिनियम, 2024 (क्रमांक 15 सन् 2024 ) की धारा 12 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए , राज्य सरकार , एतद्वारा , खुले बोरवेल और ट्यूबवेल में गिरने वाले व्यक्तियों की दुर्घटना से सुरक्षा को विनियमित करने के लिए निम्नलिखित नियम बनाती है , अर्थात्ः-
नियम
1. संक्षिप्त नाम , विस्तार और प्रारंभ.-
(क) इन नियमों का संक्षिप्त नाम मध्यप्रदेश खुले नलकूप में इंसानों के गिरने से होने वाली दुर्घटनाओं की रोकथाम एवं सुरक्षा नियम, 2024 है.
(ख) इनका विस्तार सम्पूर्ण मध्यप्रदेश राज्य पर होगा.
(ग) ये मध्यप्रदेश राजपत्र में इनके प्रकाशन की तारीख से प्रवृत्त होंगे.
2. परिभाषाएं.- (1 ) इन नियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो.-
(क) " अधिनियम" से अभिप्रेत है, मध्यप्रदेश खुले नलकूप में इंसानों के गिरने से होने वाली दुर्घटनाओं की रोकथाम एवं सुरक्षा अधिनियम, 2024;
(ख) " सक्षम प्राधिकारी " से अभिप्रेत है , अनुसूची के कॉलम (4) में यथा- उल्लिखित सक्षम प्राधिकारी;
(ग) " ड्रिलिंग ऐजेन्सी" से अभिप्रेत है, कोई व्यक्ति या प्राधिकृत व्यक्ति या कोई फर्म ( जिसमें शासकीय/ अर्द्धशासकीय अभिकरण (एजेन्सी) सम्मिलित है, जो यांत्रिक या अन्य साधनों द्वारा बोरवेल / ट्यूबवेल की खुदाई (ड्रिलिंग ) के कार्य अंतर्ग्रस्त हो;
(घ) "शासन" से अभिप्रेत है, मध्यप्रदेश शासन ;

(ड. ) "भूमि स्वामी " से अभिप्रेत है, मध्यप्रदेश भू- राजस्व संहिता , 1959 (क्रमांक 20 सन् 1959) की धारा 158 में भूमि स्वामी के रूप में निर्दिष्ट कोई भूमि स्वामी;
(च) " स्थानीय शासन " से अभिप्रेत है , मध्यप्रदेश नगरपालिक निगम अधिनियम, 1956 (क्रमांक 23 सन् 1956) के अधीन गठित नगरीय स्थानीय निकाय, मध्यप्रदेश नगरपालिका अधिनियम, 1961 (क्रमांक 37 सन् 1961 ) के अधीन गठित नगरपालिका तथा नगर परिषद् और मध्यप्रदेश पंचायत राज एवं ग्राम स्वराज अधिनियम, 1993 (क्रमांक 1 सन् 1994) के अधीन गठित ग्राम पंचायत, जनपद पंचायत और जिला पंचायत जैसी पंचायती राज संस्थाएं;
(छ) " पुरुष" से अभिप्रेत है, किसी भी आयु का कोई पुरुष और " महिला " से अभिप्रेत है, किसी भी आयु की कोई महिला;
(ज) "खुला ट्यूबवेल / बोरवेल " से अभिप्रेत है, ऐसा ट्यूबवेल या बोरवेल जो अधिनियम के अधीन बनाए गए इन नियमों में उल्लिखित किए गए अनुसार ढंका हुआ या पूर्णतः बंद न हो तथा खुला रखा गया हो और जिससे घातक दुर्घटना का खतरा उत्पन्न करता हो ;
(झ ) "व्यक्ति" से अभिप्रेत है और उसमें सम्मिलित है , कोई कम्पनी या संथा या व्यक्ति या व्यक्तियों का निकाय , चाहे वह निगमित हो अथवा नहीं;
(ञ) "सार्वजनिक उपद्रव' का वही अर्थ होगा जैसा कि भारतीय न्याय संहिता, 2023 (2023 का 45) की धारा 270 में परिभाषित किया गया है;
(ट) "संहिता" से अभिप्रेत है, भारतीय न्याय संहिता, 2023 (2023 का 45 );
(ठ) " ट्यूबवेल या बोरवेल " से अभिप्रेत है, भूमि में नीचे पानी खीचने के लिए अथवा अन्य प्रयोजनों के लिए, यांत्रिक या अन्य साधनों द्वारा जल के लिए , खोदा गया, केसिंग पाइप युक्त या उसके बिना कोई संकीर्ण तथा गहरा कुँआ;
(ड) "पीडित" से अभिप्रेत है, भारतीय नागरिक सुरक्षा संहिता, 2023 (2023 का 46) की धारा 2 के खण्ड (म) के अधीन यथा परिभाषित कोई व्यक्ति;
(2) उन शब्दों और अभिव्यक्तियों का, जो यहां इसमें प्रयोग में लाई गई हैं, किन्तु परिभाषित नहीं की गई हैं, परंतु जो भारतीय न्याय संहिता , 2023 (2023 का 45 ), भारतीय नागरिक सुरक्षा संहिता, 2023 (2023 का 46) , मध्यप्रदेश भू- राजस्व संहिता, 1959 (क्रमांक 20 सन् 1959) और साधारण खण्ड अधिनियम, 1957 (1958 का 3 ) में परिभाषित की गई हैं. क्रमशः वहीं अर्थ होगा जैसा कि इन अधिनियमों में उनके लिए समनुदेशित किया गया है.
के उत्तरदायित्व. -
3. ड्रिलिंग ऐजेंसी
(1 ) ड्रिलिंग ऐजेंसी पर लागू उत्तरदायित्व को पूर्ण करने के लिए निम्नलिखित प्रक्रिया अपनाई जाएगी, अर्थात्ः-
(क) ड्रिलिंग एजेंसी, किसी बोरवेल / ट्यूबवेल की ड्रिलिंग के पूर्व अनुज्ञा- पत्र (परमिट जनित ) करने के उद्देय से इस प्रयोजन के लिए बनाए गए सरकारी पोर्टल में ब्यौरे प्रविष्ट करेगी;
(ख) सरकारी एजेंसियां, बोरवेल / ट्यूबवेल की ड्रिलिंग के पूर्व इस प्रयोजन के लिए बनाए गए सरकारी पोर्टल में ब्यौरे प्रविष्ट करेंगी.
(ग) शासकीय पोर्टल पर ड्रिलिंग एजेंसी के लिए अनुज्ञा- पत्र (परमिट जनित) लोक स्वास्थ्य यांत्रिकी विभाग के संबंधित कार्यपालन यंत्री या ऐसा करने के लिए प्राधिकृत व्यक्ति द्वारा जारी किया जाएगा.

(2 ) ड्रिलिंग एजेंसी के लिए प्रक्रिया निम्नानुसार है: -
(एक) ड्रिलिंग एजेंसी पोर्टल पर, -
(क) समस्त प्रयोज्य ब्यौरों के साथ ड्रिलिंग की तारीख और समय अद्यतन करें;
(ख) ड्रिलिंग प्रक्रिया के दौरान किए गए सुरक्षा उपायों की जियो -टैग तस्वीरें;
(ग) ड्रिलिंग के पूर्ण होने के पश्चात् जियो - टैग फोटो अपलोड करें, जिसमें गहराई, परिणाम, कार्यक्षमता आदि जैसे ब्यौरे सम्मिलित हैं;
(घ) असफल ट्यूबवेल/बोरवेल की दशा में, उचित रूप से सीलबंद किए गए/ ढंके गएट्यूबवेल/बोरवेल की जियो टैग फोटो अपलोड करेगी।
(दो) ड्रिलिंग एजेंसी निम्नलिखित सुरक्षात्मक उपाय करेगी, -
(एक) निर्माण कार्य के समय ड्रिलिंग स्थल के पास निम्नलिखित विवरणों के साथ साइनबोर्डलगाना: -
(क) ड्रिलिंग एजेंसी का पूरा पता, जिसमें संपर्क नंबर सम्मिलित है ;
(ख) भू-स्वामी का पूरा पता, जिसमें सम्पर्क नम्बर सम्मिलित है।
(दो) निर्माण के दौरान ड्रिलिंग स्थल के चारों और कांटेदार तार की बाड या कोई अन्य उपयुक्त अवरोध लगाना;
(तीन) केसिंग पाइप के चारों ओर 0.50x0.50x0.60 मीटर माप के सीमेंट/कंक्रीट, प्लेटफॉर्म का निर्माण (भूमि की संतह के स्तर से 0.30 मीटर ऊपर और भूमि कीसतहके स्तर से 0.30 मीटर नीचे) ;
(चार) कार्य की पूर्णता के पश्चात् मिट्टी के गड्डों और नालियों को भरना;
(पाँच) असफल ट्यूबवेल/ बोरवेल को नीचे से भूमि की सतह स्तर तक मिट्टी/रेत/पत्थर/कंकड़/ड्रिल कटिंग आदि से पूर्णतः भरना;
(छह) किसी विशेष स्थल पर ड्रिलिंग संक्रिया के पूर्ण होने पर भूमि की सतह स्थिति ड्रिलिंग प्रारंभ होने के पूर्व जैसी की जाए;
(सात) स्टील प्लेट के वेल्डिंग द्वारा या बोल्ट और नट से केसिंग पाइप पर मजबूत ढक्कन लगाकर केसिंग पाइप से बंद करना ।

4. भूमिस्वामी का उत्तरदायित्व.- पुराने/ अक्रियाशील/असफल/अधूरे बोरबेल/ ट्यूबवेल के संबंध में भूमिस्वाामी/ड्रिलिंग एजेंसी के उत्तरदायित्व निम्नानुसार होंगे: -
(एक) कार्य की पूर्णता के पश्चात् मिट्टी के गड्डों और नालियों को भरना;
(दो) असफल ट्यूबवेल/बोरवेल को नीचे से भूमि की सतह के स्तर तक मिट्टी/रेत/पत्थर/ कंकड़/ड्रिल कटिंग आदि से भरना;
(तीन) किसी विशेष स्थल पर ड्रिलिंग संक्रिया के पूर्ण होने पर, भूमि की स्थिति को ड्रिलिंग के प्रारंभ होने के पूर्व जैसी की जाए ;
(चार) स्टील प्लेट के वेल्डिंग द्वारा या बोल्ट और नट से केसिंग पाइप पर मजबूत ढक्कन लगाकर केसिंग पाइप से बंद करना;
(पाँच) केसिंग पाइप के चारों ओर 0.50x0.50x0.60 मीटर माप के सीमेंट/कंक्रीट प्लेटफॉर्म का निर्माण (भूमि की सतह के स्तर से 0.30 मीटर ऊपर और भूमि की सतह के स्तर से 0.30 मीटर नीचे) ।
5. रिपोर्टिंग के लिए प्रक्रिया.- रिपोर्टिंग के लिए प्रक्रिया निम्नानुसार होगी: -
(एक) शिकायतकर्ता/रिपोर्टकर्ता व्यक्ति इस प्रयोजन के लिए बनाए गए सरकारी पोर्टल में विवरणों की प्रविष्टि करेगा;
(दो) शिकायतकर्ता/रिपोर्टकर्ता, सक्षम प्राधिकारी को लिखित शिकायत दे सकेगा ;
(तीन) शिकायत के प्राप्त होने पर सक्षम प्राधिकारी या उसका प्रतिनिधि, स्थल का तुरंत भ्रमण करेगा;
(चार) निरीक्षण पर, यदि ट्यूबवेल/ बोरवेल खुला पाया जाता है, तो भूमिस्वामी/ड्रिलिंग ऐंजेसी को इसे ढक्कन लगाने/सीलबंद करने के लिए तुरंत अनुदेश देगा;
(पांच ) भूमि स्वामी/ ड्रिलिंग ऐंजेसी के ट्यूबवेल / बोरवेल को तुरंत न ढकने/ सीलबंद करने की : दशा में सक्षम प्राधिकारी , अधिनियम की धारा 5 और 7 और उसके अधीन बनाए गए नियमों के अधीन ट्यूबवेल / बोरवेल को तुरंत ढकेगा / सीलबंद करेगा;
(छह) यदि शिकायत सत्य पाई जाती है, तो शिकायत करने वाले व्यक्ति को पुरस्कार दिया जाएगा, जिसे सक्षम प्राधिकारी द्वारा उसमें अन्र्तनिहित चूक के स्तर और उसमें अन्र्तनिहित खतरे केस्तर को विचार में लेते हुए सुनिश्चित किया जाएगा।
6. अपील.- इस अधिनियम के अधीन पारित आदेशों से व्यथित कोई भी व्यक्ति , 30 दिनों की अवधि के भीतर सक्षम प्राधिकारी द्वारा पारित आदेश के विरूद्ध अनुसूची में उल्लिखित प्राधिकारी को अपील कर सकेगा, जिसके कि आदेश पारित करने वाला प्राधिकारी अधीनस्थहै।

In exercise of the powers conferred by section 12 of the Madhya Pradesh Khule Nalkup Mein Insanno Ke Girne Se Hone Wali Durghatnao Ki Rokthaam Evam Suraksha Adhiniyam , 2024 (No. 15 of 2024 ) , the State Government , hereby , makes the following rules to regulate the protection from accident of persons falling into open borewell and tubewell , namely: -
RULES
1. Short title , extent and commencement.-
(1) These rules may be called the Madhya Pradesh Khule Nalkup Mein Insanno Ke Girne Se Hone Wali Durghatnao Ki Rokthaam Evam Suraksha Niyam , 2024 .
(2) It extends to the whole of the State of Madhya Pradesh .
(3) They shall come into force with effect from the date of their publication in the Madhya Pradesh Gazette . : !
2. Definitions.- ( 1 ) In these rules , unless the context otherwise requires , -
(a) " Act" means the Madhya Pradesh Khule Nalkup Mein Insaano Ke Girne Se Hone Wali Durghatnao Ki Rokthaam Evam Suraksha Adhiniyam , 2024 (No. 15 of 2024 ) ;
(b) " Competent Authority " means competent authority as mentioned in column (4) of the Schedule;
ог a (c) "Drilling Agency " means a person or authorized person firm ( including Government/Semi - Government agency) which is involved in the work of drilling borewell / tubewell by mechanical or other means ;

(d) "Government" means the Government of Madhya Pradesh;
(e) "Landowner " means a landowner referred to as Bhumi Swami in section 158 of the Madhya Pradesh Land Revenue Code , 1959 (No. 20 of 1959) ;
( f) " Local Government " means the Urban Local Bodies constituted under the Madhya Pradesh Municipal Corporation Act, 1956 (No. 23 of 1956) , the Municipalities and the Municipal Council constituted under the Madhya Pradesh. Municipalities Act , 1961 (No. 37 of 1961) and Panchayati Raj Institutions like Gram Panchayat , Janpad Panchayat and Zila Panchayat constituted under the Madhya Pradesh Panchayat Raj Avam Gram Swaraj Adhiniyam , 1993 (No. 1 of 1994 ) ;
(g) "Man " means a male human being of any age and "Woman" means a female human being of any age ;
(h) " Open Tubewell / Borewell " means a Tubewell or Borewell which is not covered or sealed completely as mentioned in these rules made under the Act and kept open as it poses a threat to fatal accident ;
(i) " Person" means and includes any company or association or person or body of persons , whether incorporated or not ;
(j ) " Public nuisance " shall have the same meaning as defined in section 270 of the Bharatiya Nyaya Sanhita , 2023 ( 45 of 2023 ) ;
(k) " Sanhita" means Bhartiya Nyaya Sanhita , 2023 (45 of 2023);

(1 ) "Tube well or borewell " means a narrow and deeper well drilled for water in the ground by mechanical or other means with or without casing pipe to draw water or for other purposes in the earth underground ;
(m) " Victim" means a person as defined under clause (y) of section 2 of the Bharatiya Nagarik Suraksha Sanhita , 2023 (46 of 2023) .
(2) Words and expressions used herein but not defined in these rules , but defined in the Bharatiya Nyaya Sanhita , 2023 ( No .. 45 of 2023 ) , the Bharatiya Nagarik Suraksha Sanhita , 2023 (No. 46 of 2023 ) , the Madhya Pradesh Land Revenue Code , 1959 (No. 20 of 1959 ) and the General Clauses Act , 1957 (No. 3 of 1958) shall have the same meanings respectively as assigned to them in these Acts .
3. Responsibility of the drilling agency.- ( 1 ) To fulfil the responsibility ensued upon drilling agency, the following procedure shall be adopted , namely: -
(a) drilling agency shall enter the details in the Government portal meant for this purpose in order to generate permit before drilling a bore well / tube well ;
(b) Government agencies shall enter the details in the Government portal meant for this purpose before drilling a bore well / tube well ;
(c) permit for the drilling agency on the Government portal shall be issued by the respective Executive Engineer , Public Health Engineering Department or by the person authorized to do so .
(2) The procedure for the drilling agency are as follows : -
(i) the drilling agency shall on the portal- मध्यप्रदेश राजपत्र, दिनांक 17 जनवरी 2025

(a) update the date and time of drilling with all applicable details ;
(b) geo - tag photos of safety measures taken during drilling process ;
(c) upload geo- tag photos after completion of drilling including the details such as depth , yield , functionality etc.;
(d) in case of unsuccessful tubewell / borewell , shall upload geo - tag photos of properly sealed /capped tubewell/ borewell .
( ii ) Drilling agency shall take following precautionary measures-
( i) erection of signboard at the time of construction near the drilling site with the following details: -
(a) complete address of the drilling agency including contact number ;
(b) complete address of the Landowner including contact number .
(ii) erection of barbed wire fencing or any other suitable barrier around the drilling site during construction ;
(iii ) construction of cement/ concrete platform measuring 0.50x0.50x0.60 meter (0.30 meter above ground level and 0.30 meter below ground level ) around the casing pipe ;
(iv) filling of mud pits and channels after completion of works;

(v) filling up unsuccessful tubewells / borewells by clay/ sand/ boulders / pebbles / drill cuttings etc. from bottom to ground level duly compacted;
(vi ) on completion of the drilling operations at a particular location , the ground conditions are to be restored as before the start of drilling;
(vii ) capping of casing pipe by welding steel plate or by providing a strong cap to be fixed to the casing pipe with bolts and nuts .
4. Responsibility of Landowner . The responsibility of landowner / drilling agency regarding old/non- functional /failed/ unfinished borewell /tubewell shall be as follows: -
(i) filling of mud pits and channels after completion of works ;
(ii) filling up unsuccessful tubewells /borewells by clay/ sand/boulders / pebbles/ drill cuttings etc. from bottom to ground level duly compacted;
(iii ) on completion of the drilling operations at a particular location , the ground conditions are to be restored as before the start of drilling;
( iv) capping of casing pipe by welding steel plate or by providing a , strong cap to be fixed to the casing pipe the bolts and nuts .
(v) construction of cement / concrete platform measuring 0.50x0.50x0.60 meter (0.30 meter above ground level and 0.30 meter below ground level) around the casing pipe .

5. Procedure for reporting. The procedure for reporting shall be as follows: -
( i) complainant/ reporting person shall enter the details in Government portal meant for this purpose ;
(ii) complainant/ reporting person may give written complaint to the competent authorities ;
(iii) on receiving the complaint , the competent authority or his representative shall visit the site immediately;
(iv) upon the inspection , if tubewell/ borewell is found to be open shall instruct landowner/ drilling agency to immediately cap/ seal the same;
(v) in case landowner/ drilling agency does not immediately cap/ seal the cubewell/ borewell the competent authority shall cap/seal the open tubewell/borewell under section 5 and 7 of the Act and the rules made thereunder;
(vi) if the complaint is found to be true , then person making the complaint shall be given a reward , which shall be ascertained by the competent authority, taking into consideration the level of lapses involved and the amount of threat involved .
6. Appeal . Any person aggrieved by the orders passed under this Actmay, within a period of 30 days , prefer an appeal against the order passed by the competent authority to the authority mentioned in the Schedule to whom the authority passing the order is subordinate .
