मध्यप्रदेश निजी विद्यालय (फीस तथा संबंधित विषयों का विनियमन) संशोधन अधिनियम , २०२४
[ दिनांक २४ जनवरी, २०२५ को राज्यपाल की अनुमति प्राप्त हुई, अनुमति " मध्यप्रदेश राजपत्र (असाधारण ) " में दिनांक ३१ जनवरी , २०२५ को प्रथमबार प्रकाशित की गई. ]
मध्यप्रदेश निजी विद्यालय (फीस तथा संबंधित विषयों का विनियमन) अधिनियम, २०१७ को और संशोधित करने हेतु अधिनियम.
भारत गणराज्य के पचहत्तरवें वर्ष में मध्यप्रदेश विधान- मण्डल द्वारा निम्नलिखित रूप में यह अधिनियमित हो:-
संक्षिप्त नाम .
१. इस अधिनियम का संक्षिप्त नाम मध्यप्रदेश निजी विद्यालय (फीस तथा संबंधित विषयों का विनियमन) संशोधन अधिनियम , २०२४ है.
धारा १ का संशोधन.
२. मध्यप्रदेश निजी विद्यालय (फीस तथा संबंधित विषयों का विनियमन ) अधिनियम, २०१७ (क्रमांक ६ सन् २०१८) (जो इसमें इसके पश्चात् मूल अधिनियम के नाम से निर्दिष्ट है ) की धारा १ में,-
(एक) विद्यमान पार्श्व शीर्ष के स्थान पर, निम्नलिखित पार्श्व शीर्ष स्थापित किया जाए , अर्थात्ः- "संक्षिप्त नाम , विस्तार, प्रारंभ और अनुप्रयोग "
(दो) उपधारा ( ३ ) के पश्चात्, निम्नलिखित उपधारा जोड़ी जाए , अर्थात्ः-
" ( ४) इस अधिनियम के उपबंध ऐसे निजी विद्यालयों को लागू होंगे जिनकी वार्षिक फीस किसी भी कक्षा के लिए राज्य सरकार द्वारा समय - समय पर यथाविहित राशि से अधिक है , किन्तु ऐसी विहित राशि रुपए २५००० /- (पच्चीस हजार रुपए) से कम नहीं होगी . " .
३. मूल अधिनियम की धारा २ में, -
धारा २ का संशोधन.
(एक) खण्ड (ख ) के पश्चात्, निम्नलिखित खण्ड अंतःस्थापित किया जाए , अर्थात्ः-
" (खक) " फीस तथा संबंधित विषयों के विनियमन हेतु विभागीय समिति " से अभिप्रेत है , धारा ११ की उपधारा (१ ) के अधीन गठित समिति. " .
(दो) खण्ड ( थ) के स्थान पर , निम्नलिखित खण्ड स्थापित किया जाए, अर्थातूः-
" (थ ) "फीस तथा संबंधित विषयों के विनियमन हेतु राज्य समिति " से अभिप्रेत है , धारा १२अ की उपधारा ( १ ) के अधीन गठित समिति . " .
४. मूल अधिनियम की धारा ३ में , उपधारा ( १ ) में, खण्ड (ड) के पश्चात् निम्नलिखित खण्ड जोड़ा जाए , अर्थात्ः- धारा ३ का संशोधन .
"(ढ) परिवहन फीस." .
धारा ५ का संशोधन .
५. मूल अधिनियम की धारा ५ में , शब्द " राज्य समिति " जहां कहीं भी वे आए हों, के स्थान पर, शब्द " विभागीय समिति " स्थापित किए जाएं .

धारा ८ का
संशोधन .
६. मूल अधिनियम की धारा ८ में , शब्द " राज्य समिति " जहां कहीं भी वे आए हों , के स्थान पर, शब्द " विभागीय समिति " स्थापित किये जाएं .
७. मूल अधिनियम के, अध्याय छह में , -
अध्याय छह का संशोधन.
(एक) अध्याय के वर्तमान शीर्षक, के स्थान पर, निम्नलिखित शीर्षक स्थापित किया जाए, अर्थात्ः- "फीस तथा संबंधित विषयों के विनियमन हेतु विभागीय समिति तथा राज्य समिति." .
(दो) धारा ११ में, शब्द " राज्य समिति " जहां कहीं भी वे आए हों, के स्थान पर, शब्द " विभागीय समिति" स्थापित किए जाएं .
(तीन) धारा १२ में, -
(क) विद्यमान पार्श्व शीर्ष के स्थान पर, निम्नलिखित पार्श्व शीर्ष स्थापित किया जाए, अर्थात्ः- "विभागीय समिति को अपील का उपबंध ." .
(ख) शब्द " राज्य समिति" जहां कहीं भी वे आए हों, के स्थान पर , शब्द " विभागीय समिति " स्थापित किए जाएं .
(चार) धारा १२ के पश्चात्, निम्नलिखित नई धारा जोड़ी जाए, अर्थात्ः-
"१२क .
अपील का उपबंध . राज्य समिति को ( १ ) फीस तथा संबंधित विषयों को विनियमित करने हेतु एक राज्य समिति गठित की जाएगी , जो निजी विद्यालयों द्वारा फीस में १५ प्रतिशत से अधिक की वृद्धि से संबंधित आदेशों के संबंध में विभागीय समिति द्वारा पारित आदेशों के विरुद्ध अपीलों की सुनवाई करेगीः
परन्तु राज्य समिति के समक्ष जिला समिति के आदेश के विरूद्ध प्रथम अपील में विनिश्चित मामलों से संबंधित , विभागीय समिति द्वारा पारित आदेशों के विरूद्ध द्वितीय अपील नहीं की जाएगी. " .
(२) फीस तथा संबंधित विषयों को विनियमित करने हेतु राज्य समिति निम्नलिखित सदस्यों से मिलकर बनेगी, अर्थात्ः-
अध्यक्ष
(क) मंत्री, मध्यप्रदेश शासन , स्कूल शिक्षा विभाग
सदस्य
(ख) भारसाधक सचिव , मध्यप्रदेश शासन , स्कूल शिक्षा विभाग
सदस्य
(ग) आयुक्त लोक शिक्षण, भोपाल
सदस्य
(घ) संचालक, राज्य शिक्षा केन्द्र, भोपाल
सदस्य
(ङ) संचालक, लोक शिक्षण , मध्यप्रदेश
सदस्य सचिव
(च) उप सचिव, मध्यप्रदेश शासन , स्कूल शिक्षा विभाग
( छ) संयुक्त संचालक या संचालनालय , लोक शिक्षण का कोई अधिकारी,
जो कि आयुक्त, लोक शिक्षण द्वारा इस कार्य के लिए प्राधिकृत किया जाए सदस्य.
(३) फीस तथा संबंधित विषयों को विनियमित करने हेतु राज्य समिति की गणपूर्ति पांच सदस्यों से होगी .
(४) फीस तथा संबंधित विषयों को विनियमित करने हेतु राज्य समिति अपील का विनिश्चय ऐसे समय के भीतर तथा ऐसी रीति में करेगी , जैसा कि विहित किया जाए .
(५) फीस तथा संबंधित विषयों के विनियमन हेतु राज्य समिति फीस तथा संबंधित विषयों के विनियमन हेतु विभागीय समिति द्वारा अधिरोपित शास्ति को घटा या बढ़ा सकेगी . " .

No. 7 OF 2025
THE MADHYA PRADESH NIJI VIDYALAYA (FEES TATHA SAMBANDHIT VISHAYON KA VINIYAMAN) SANSHODHAN ADHINIYAM , 2024 [ Received the assent of the Governor on the 24th January , 2025 ; assent first published in the " Madhya Pradesh Gazette (Extra - ordinary ) " , dated the 31st January , 2025. ]
An Act further to amend the Madhya Pradesh Niji Vidyalaya (Fees Tatha Sambandhit Vishayon Ka Viniyaman) Adhiniyam , 2017 .
Be it enacted by the Madhya Pradesh Legislature in the seventy- fifth year ofthe Republic of India as follows : -
Short title .
1. This Act may be called the Madhya Pradesh Niji Vidyalaya (Fees Tatha Sambandhit Vishayon Ka Viniyaman) Sanshodhan Adhiniyam , 2024.
Amendment of Section 1 .
2. In Section 1 of the Madhya Pradesh Niji Vidyalaya (Fees Tatha Sambandhit Vishayon Ka Viniyaman) Adhiniyam , 2017 (No. 6 of 2018) ,
(hereinafter referred to as the principal Act) , -
(i) for the existing marginal heading , following marginal heading shall be substituted , namely: -
" Short title , extent , commencement and application" .
( ii) after sub - section (3 ) , the following sub - section shall be added, namely: -
" (4) The provisions of this Act shall apply to such private schools whose annual fee for any class is more than the amount as prescribed by the State Government , from time to time, but such prescribed amount shall not be less than Rs . 25,000 (Rupees Twenty Five Thousand) . ".
3. In Section 2 of the principal Act, -
(i) after clause (b), the following clause shall be inserted, namely : - Amendment of Section 2 .
" (ba) " Departmental Committee for Regulating Fee and Related Issues " means a Committee constituted under sub - section ( 1) ofSection 11 ;" .
(ii) for clause (q) , the following clause shall be substituted , namely: -
" (q) " State Committee for Regulating Fee and Related Issue " means the Committee constituted under sub - section ( 1 ) of Section 12A. " .

Amendment of Section 3 .
4. In Section 3 of the principal Act, in sub - section ( 1 ) , after clause ( m) , the following clause shall be added , namely: -
" (n) transportation fee ." .
Amendment of Section 5.
5. In Section 5 of the principal Act , for the words " State Committee" , wherever they occur , the words " Departmental Committee " shall be substituted.
Amendment of Section 8 .
6. In Section 8 of the principal Act , for the words " State Committee " , wherever they occur, the words " Departmental . Committee " shall be substituted.
7. In Chapter VI of the principal Act, -
Amendment of ChapterVI.
(i) for the existing heading of the Chapter the following heading shall be substituted, namely: -
"DEPARTMENTAL COMMITTEE AND STATE COMMITTEE FOR REGULATING FEE AND RELATED ISSUES . "
(ii) inSection 11 , for the words " State Committee " , wherever they occur , the words " Department Committee " shall be substituted .
(iii) in Section 12 , -
(a) for the existing marginal heading , the following marginal heading shall be substituted, namely: -
"Provision of appeal to Departmental Committee . " .
(b) for the words " State Committee " , wherever they occur, the words "Departmental Committee " shall be substituted.
(iv) after Section 12 , the following new Section shall be added, namely : -
Provision of appeal to State Committee.
" 12A. ( 1 ) There shall be constituted a State Committee for regulating fees and related issues to hear appeal against the orders passed by the Departmental Committee pertaining to the orders related to increment of fees of more than 15 percent by the private schools : Provided that , no second appeal shall lie before the State Committee against the orders passed by the Departmental Committee , pertaining to the matters decided in first appeal against the order of District Committee .

(2) The State Committee for regulating fees and related issues shall consist of the following members , namely : -
Chairperson (a) the Minister, Government of Madhya Pradesh , Department
ofSchool Education .
Member (b) the In -charge Secretary, Government of Madhya Pradesh , Department of School Education.
Member (c) the Commissioner of Public Instruction.
(d) the Director , Rajya Shiksha Kendra , Bhopal .
Member
(e) the Director of Public Instruction , Madhya Pradesh .
Member
Member Secretary (f) the Deputy Secretary, Government of Madhya Pradesh , Department of School Education.
Member (j ) the Joint Director or an officer from the Directorate of Public Instruction , as authorized by the Commissioner of Public Education for this task .
(3) The quorum of the State Committee for regulating fee and related issues shall be of five members .
(4) The State Committee for regulating fees and related issues shall decide the appeal within such time and in such manner , as may be prescribed.
(5) The State Committee for regulating fees and related issues may reduce or increase the penalty imposed by the Departmental Committee for the regulation of fees and related matters . " .
