क्र.-3-3-4-0014-2024- Sec- 02- पांच (CT) (13) .-मध्यप्रदेश आबकारी अधिनियम, 1915 (क्रमांक 2 सन् 1915 ) की धारा 62 की उपधारा (1 ) एवं उपधारा (2 ) के खण्ड ( घ) , (ड. ), (च) , (छ) तथा ( ज) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए , राज्य सरकार , एतद्वारा , मध्यप्रदेश विदेशी मदिरा नियम , 1996 में निम्नलिखित और संशोधन करती है, अर्थात्ः-
संशोधन
उक्तनियमों में,
(1) नियम 8 में, उप-नियम (1 ) में,-
(क) खण्ड (कक -8 ) के स्थान पर, निम्नलिखित खण्ड स्थापित किया जाए, अर्थात्ः -
" (कक -8 ) आर . डब्ल्यू. एस. 1 (खुदरा मदिरा दुकान से हेरिटेज मदिरा एवं मध्यप्रदेश में निर्मित वाईन के विक्रय के लिए अनुज्ञप्ति): -
खुदरा मदिरा दुकान से सील बंद बोतलों में हेरिटेज मदिरा एवं मध्यप्रदेश में निर्मित वाईन, जो कि मध्यप्रदेश में उत्पादित अंगूर तथा अन्य फलों से मध्यप्रदेश में विनिर्मित की गई हो, ' के विक्रय के लिए प्ररूप आर. डब्ल्यू. एस. 1 में अनुज्ञप्ति, रूपये 10,000/- की वार्षिक अनुज्ञप्ति फीस के अग्रिम भुगतान पर स्वीकृत की जाएगी । " ।
(ख) खण्ड (कक -9 ) में, शब्द " वाइन " , जहां कहीं भी वे आया हो , के पश्चात, शब्द " एवं हेरिटेज मदिरा " अन्तःस्थापित किए जाए;
(ग) खण्ड (कक-10 ) , ( खख) , (ख खख ख) , (ग) , (गग), (घ) एवं (ङ) में, शब्द "विदेशी मदिरा " जहाँ कहीं भी वे आए हों, के पश्चात्, शब्द "एवं हेरिटेज मदिरा " अन्तःस्थापित किए जाएं ।

(2) नियम 8 - क के स्थान पर, निम्नलिखित नियम स्थापित किया जाए, अर्थात्: -
" 8 - क. एफ.एल.एच.बी. (होमबार अनुज्ञप्ति) .- प्ररूप एफ.एल.एच.बी. में होम- बार अनुज्ञप्ति ऐसे व्यक्ति के व्यक्तिगत निवास पर विदेशी मदिरा एवं हेरिटेज मदिरा के उपभोग एवं कब्जे के लिए दी जाएगी , जिसकी गत वित्तीय वर्ष की आयकर विवरणी अनुसार प्रतिवेदित सकल व्यक्तिगत आय न्यूनतम 35 लाख रुपए रहीं हो। यह अनुज्ञप्ति कलक्टर द्वारा रुपए 75,000/- की वार्षिक अनुज्ञप्ति फीस के संदाय पर दी जाएगी। " ו
(3) प्ररूप एफ.एल. 2 में , -
(क) प्रारंभिक पैरा में, नियमों के लघु शीर्षक को छोड़कर शब्द " विदेशी मदिरा " के पश्चात्, शब्द " एवं हेरिटेज मदिरा " अन्तःस्थापित किए जाएं;
(ख) शर्तों में, -
(एक) शर्त क्रमांक ( 1 ) में, शब्द तथा चिन्ह " जिन्हें कि कलक्टर द्वारा विनिर्दिष्ट किया जाए। " के पश्चात्, शब्द, चिन्ह, कोष्ठक, अक्षर एवं अंक " अनुज्ञप्तिधारक, हेरिटेज मदिरा का प्रदाय , हेरिटेज मदिरा विनिर्माण इकाई/विदेशी मदिरा भाण्डागार/देशी मदिरा भाण्डागार/हेरिटेज मदिरा फुटकर दुकान (एच.एल. - 2) /आर.डब्ल्यु.एस.1/ आर.डब्ल्यु.एस.2 से प्राप्त कर सकेगा । " जोड़े जाएं;
(दो) शर्त क्रमांक (2) , (3 ) एवं (4 ) में, शब्द " विदेशी मदिरा " के पश्चात्, शब्द "एवं हेरिटेज मदिरा " अन्तःस्थापित किए जाएं;
(तीन) शर्त क्रमांक (6 - क) में, अंत में, शब्द, अंक तथा चिन्ह " अनुज्ञप्तिधारक, विक्रय हेतु खोली गई बोतल को छोड़कर, 180 मिलीलीटर/375 मिलीलीटर/500 मिलीलीटर/750 मिलीलीटर की क्षमता के साथ हेरिटेज मदिरा का स्टॉक सील बंद बोतलों में कर सकेगा। " जोड़े जाएं;
(चार) शर्त क्रमांक (8 - ख) के पश्चात्, परंतुक में खण्ड (दो) के पश्चात् निम्नलिखित शर्त जोड़ी जाए, अर्थात्: -
" (8 - ग) बार का अनुज्ञप्तिधारक, मैन्यूमें, हेरिटेज मदिरा का उल्लेख अनिवार्य रूप से करेगा । " ।
(4) प्ररूप एफ. एल. 3 में, -
(क) प्रारंभिक पैराग्राफ में, नियमों के शीर्षक को छोड़कर, शब्द " विदेशी मदिरा " के पश्चात्, शब्द " एवं हेरिटेज मदिरा " अन्तःस्थापित किए जाएं ;

(ख) शर्तों में, -
(एक) शर्त क्रमांक (1 ) में, शब्द तथा चिन्ह " जैसा कि कलक्टर द्वारा विनिर्दिष्ट किया जाए । " के पश्चात्, शब्द, चिन्ह, कोष्ठक, अक्षर तथा अंक " अनुज्ञप्तिधारक, हेरिटेज मदिरा का प्रदाय, हेरिटेज मदिरा विनिर्माण इकाई/विदेशी मदिरा भाण्डागार/देशी मदिरा भाण्डागार/ हेरिटेज मदिरा फुटकर दुकान (एच.एल. - 2 )/आर.डब्ल्यु.एस.1/ आर.डब्ल्यु.एस .2 . " से प्राप्त कर सकेगा । " जोड़े जाएं;
(दो) शर्त क्रमांक (2 ) में, शब्द " विदेशी मदिरा " जहां कहीं भी वे आए हों, के पश्चात्, शब्द "एवं हेरिटेज मदिरा " अन्तःस्थापित किए जाएं ;
(तीन) शर्त क्रमांक ( 3 ) में, शब्द "केवल फुटकर (लूज) विदेशी मदिरा" के पश्चात्, शब्द " एवं फुटकर (लूज) हेरिटेज मदिरा " अन्तःस्थापित किए जाएं;
(चार) शर्त क्रमांक (4) (ख ) के पश्चात्, निम्नलिखित शर्त जोड़ी जाए, अर्थात्ः-
" (ग) अनुज्ञप्तिधारक, हेरिटेज मदिरा की न्यूनतम 2 पेटियाँ विक्रय हेतु अनिवार्य रूप से स्टाक करेगा । रखे गए निर्धारित न्यूनतम स्टॉक की मात्रा की गणना त्रैमासिक आधार पर की जाएगी । ऐसे समस्त दिवसों पर, जब हेरिटेज मदिरा का स्टॉक उक्त निर्धारित न्यूनतम मात्रा से कम होना पाया जाए, कलक्टर ऐसी मात्रा पर, जो निर्धारित न्यूनतम मात्रा से कम है , रूपये 500 /- प्रति प्रूफ लीटर प्रतिदिवस तक की दर से शास्ति अधिरोपित कर सकेगा। " ;
(पांच ) शर्त क्रमांक (5 ) एवं (8 ) में, शब्द " विदेशी मदिरा " के पश्चात्, शब्द "एवं हेरिटेज मदिरा " अन्तःस्थापित किए जाएं;
(छह) शर्त क्रमांक (6) में, अंत में, शब्द, अंक तथा चिन्ह "अनुज्ञप्तिधारक, विक्रय हेतु खोली गई बोतल को छोड़कर, 180 मिलीलीटर/ 375 मिलीलीटर/500 मिलीलीटर/750 मिलीलीटर की क्षमता के साथ हेरिटेज मदिरा का स्टॉक सील बंद बोतलों में कर सकेगा। " जोड़े जाएं;
(सात) शर्त क्रमांक ( 8 ) के पश्चात्, निम्नलिखित शर्त जोड़ी जाए, अर्थात्ः- " (8 - क) बार का अनुज्ञप्तिधारक, मैन्यू में, हेरिटेज मदिरा का उल्लेख अनिवार्य रूप से करेगा । " ।
(5) प्ररूप एफ.एल.3-क में,-
(क) प्रारंभिक पैरा में, नियमों के लघु शीर्षक को छोड़कर शब्द " विदेशी मदिरा " के पश्चात्, शब्द " एवं हेरिटेज मदिरा " अन्तःस्थापित किए जाएं ;

(ख) शर्तों में,-
( एक) शर्त क्रमांक (1 ) में, शब्द तथा चिन्ह " जैसा कि कलक्टर द्वारा विनिर्दिष्ट किया जाए। " के पश्चात्, शब्द, चिन्ह, कोष्ठक, अक्षर तथा अंक " अनुज्ञप्तिधारक , हेरिटेज मदिरा का प्रदाय , हेरिटेज मदिरा विनिर्माण इकाई/विदेशी मदिरा भाण्डागार/ देशी मदिरा भाण्डागार/हेरिटेज मदिरा फुटकर दुकान (एच.एल.- 2) /आर.डब्ल्यु.एस.1/ आर.डब्ल्यु.एस.2 से प्राप्त कर सकेगा । " जोड़े जाएं ;

दो) शर्त क्रमांक (2) , में, शब्द " विदेशी मदिरा" जहां कहीं भी वे आए हों, के पश्चात्, शब्द " एवं हेरिटेज मदिरा " अन्तःस्थापित किए जाएं;
(
तीन) शर्त क्रमांक (3 ) में, शब्द " केवल फुटकर (लूज) विदेशी मदिरा के पश्चात्, शब्द " एवं हेरिटेज मदिरा " अन्तःस्थापित किए जाएं ;
(चार
) शर्त क्रमांक (4 ) एवं ( 8) में, शब्द " विदेशी मदिरा " के पश्चात्, शब्द " एवं हेरिटेज मदिरा " अन्तःस्थापित किए जाएं;
(पाँच
) शर्त क्रमांक (6) में, अंत में, पूर्ण विराम के पश्चात्, शब्द, अंक तथा चिन्ह " अनुज्ञप्तिधारक, विक्रय हेतु खोली गई बोतल को छोड़कर, 180 मिलीलीटर/375 मिलीलीटर/500 मिलीलीटर/750 मिलीलीटर की क्षमता के साथ हेरिटेज मदिरा का स्टाक सील बंद बोतलों में कर सकेगा। " जोड़े जाएं ;
(
छह) शर्त क्रमांक (8 ) के पश्चात्, निम्नलिखित शर्त जोड़ी जाए, अर्थात्तः- " (8 - क) बार का अनुज्ञप्तिधारक, मैन्यू में, हेरिटेज मदिरा का उल्लेख अनिवार्य रूप से करेगा। " ।
(6) प्ररूप एफ.एल. 4 में, -
(क) शीर्षक में, शब्द "विदेशी मदिरा " के पश्चात्, शब्द " एवं हेरिटेज मदिरा" अन्तःस्थापित किए जाएं ;
(ख) प्रारंभिक पैराग्राफ में, नियमों के लघु शीर्षक को छोड़कर, शब्द "विदेशी मदिरा " के पश्चात्, शब्द "एवं हेरिटेज मदिरा " अन्तःस्थापित किए जाएं;
(ग) शर्तों में, -
(एक) शर्त क्रमांक (1 ) में, शब्द तथा चिन्ह " जैसा कि कलक्टर द्वारा विनिर्दिष्ट किया जाए । " के पश्चात्, शब्द, चिन्ह, कोष्ठक, अक्षर तथा अंक " अनुज्ञप्तिधारक, हेरिटेज मदिरा का प्रदाय, हेरिटेज मदिरा विनिर्माण इकाई/विदेशी मदिरा भाण्डागार/देशी भदिरा भाण्डागार/हेरिटेज मदिरा फुटकर दुकान (एच.एल. - 2)/आर.डब्ल्यु.एस.1/ आर.डब्ल्यु.एस.2 से प्राप्त कर सकेगा । " जोड़े जाएं ;

(तीन) शर्त क्रमांक (5 ) में, अंत में, शब्द, अंक तथा चिन्ह अनुज्ञप्तिधारक, विक्रय हेतु खोली गई बोतल को छोड़कर, 180 मिलीलीटर/ 375 मिलीलीटर/ 500 मिलीलीटर/750 मिलीलीटर की क्षमता के साथ हेरिटेज मदिरा का स्टाक सील बंद बोतलों में कर सकेगा । " जोड़े जाएं;
(चार) शर्त क्रमांक (9) के पश्चात् निम्नलिखित शर्त जोड़ी जाए, अर्थात्: - " ( 9 - क) बार का अनुज्ञप्तिधारक, मैन्यू में, हेरिटेज मदिरा का उल्लेख अनिवार्य रूप से करेगा । " ।
(7) प्ररूप एफ.एल. 5 में, -
(क) प्रारंभिक पैरा में, नियमों के लघु शीर्षक को छोड़कर, शब्द "विदेशी मदिरा " के पश्चात्, शब्द "एवं हेरिटेज मदिरा " अन्तःस्थापित किए जाएं ;
(ख) शर्तों में, -

(दो) शर्त क्रमांक (2) , ( 3 ) एवं ( 7 ) में शब्द " विदेशी मदिरा " के पश्चात्, शब्द " एवं हेरिटेज मदिरा " जोड़े जाएं ;
(तीन) शर्त क्रमांक (5 ) में शब्द, अंत में, शब्द, अंक तथा चिन्ह " अनुज्ञप्तिधारक, विक्रय हेतु खोली गई बोतल को छोड़कर, 180 मिलीलीटर/375 मिलीलीटर/500 मिलीलीटर/750 मिलीलीटर की क्षमता के साथ हेरिटेज मदिरा का स्टाक सील बंद बोतलों में कर सकेगा। " जोड़े जाएं;
(8 ) प्ररूप आर.डब्ल्यू.एस. 1 में,-
(क) अंग्रेजी संस्करण में शीर्षक में शब्द, कोष्ठक, अक्षर तथा चिन्ह " मध्यप्रदेश (एम.पी. ) निर्मित वाईन " के स्थान पर, शब्द "हरिटेज मदिरा एवं मध्यप्रदेश में निर्मित वाईन " स्थापित किए जाएं;
(ख) प्रारंभिक पैराग्राफ में, शब्द "वाईन" जहां कहीं भी वह आया है, के पश्चात् शब्द "एवं हेरिटेज मदिरा " अन्तःस्थापित किए जाएं;

(ग) शर्तों में,-
(एक) शर्त क्रमांक ( 1 ) में, शब्द " विक्रय करने हेतु " के पश्चात्, शब्द "हेरिटेज मदिरा एवं " अन्तःस्थापित किए जाएं;
(दो) शर्त क्रमांक (3 ) , (5 ) , (7 ) , ( 9) , ( 10 ) एवं ( 12 ) में, शब्द " वाईन " के पश्चात्, शब्द " एवं हेरिटेज मदिरा " जोड़े जाएं;
(तीन) शर्त क्रमांक (4 ) में, अंत में, शब्द, चिन्ह, कोष्ठक, अक्षर तथा अंक " अनुज्ञप्तिधारक , हेरिटेज मदिरा का प्रदाय, हेरिटेज मदिरा विनिर्माण इकाई/विदेशी मदिरा भाण्डागार/देशी मदिरा भाण्डागार /हेरिटेज मदिरा फुटकर दुकान (एच.एल. -2 ) से प्राप्त कर सकेगा । " जोड़े जाएं ।
(9) प्ररूप आर. डब्ल्यू. एस. 2 में, -
(क) शीर्षक एवं प्रारंभिक पैराग्राफ में, शब्द " वाईन " जहां कहीं भी वह आया है, के पश्चात् शब्द " एवं हेरिटेज मदिरा " जोड़े जाएं ;
(ख) शर्तों में,-
(एक) शर्त क्रमांक ( 1 ) में, शब्द तथा चिन्ह " भारत में निर्मित अथवा आयातित वाईन " के स्थान पर, शब्द " भारत में निर्मित अथवा आयातित वाईन एवं हेरिटेज मदिरा (मध्यप्रदेश में निर्मित) " स्थापित किए जाएं;
(दो) शर्त क्रमांक (4) , ( 5 ) , ( 8 ) , ( 9) , ( 11 ) एवं ( 12 ) में शब्द " वाईन" के पश्चात्, शब्द " एवं हेरिटेज मदिरा " अन्तःस्थापित किए जाएं;
(तीन) शर्त क्रमांक (6) में, अंत में, चिन्ह, शब्द, कोष्ठक, अक्षर तथा अंक " अनुज्ञप्तिधारक , हेरिटेज मदिरा का प्रदाय, हेरिटेज मदिरा विनिर्माण इकाई/विदेशी मदिरा भाण्डागार/देशी मदिरा भाण्डागार/हेरिटेज मदिरा फुटकर दुकान (एच.एल. - 2 ) से प्राप्त कर सकेगा । " जोड़े जाएं;
(चार) शर्त क्रमांक (7) में , -
(क) शब्द "वाईन" जहां कहीं भी वह आया हो, के पश्चात्, शब्द " एवं हेरिटेज मदिरा " अन्तःस्थापित किए जाएं;
(ख) अंत में, शब्द, अंक तथा चिन्ह " अनुज्ञप्तिधारक, विक्रय हेतु खोली गई बोतल को छोड़कर, 180 मिलीलीटर/375 मिलीलीटर/ 500 मिलीलीटर/750 मिलीलीटर की क्षमता के साथ हेरिटेज मदिरा स्टाक सील बंद बोतलों में कर सकेगा। " जोड़े जाएं ।

(क) शीर्षक में , शब्द "विदेशी मदिरा " के पश्चात्, शब्द " एवं हेरिटेज मदिरा " अन्तःस्थापित किए जाएं;
(ख ) प्रारंभिक पैरा में, नियमों के लघु शीर्षक को छोड़कर, शब्द " विदेशी मदिरा के पश्चात्, शब्द "एवं हेरिटेज मदिरा " अन्तःस्थापित किए जाएं;
(ग) शर्तों में, -
(एक) शर्त क्रमांक (3) में, शब्द " तथा वाईन " के स्थान पर, शब्द " वाईन एवं हेरिटेज मदिरा " स्थापित किए जाएं;

(11 ) प्ररूप एफ.एल. 2-कक में, -
(क) प्रारंभिक पैरा में, नियमों के लघु शीर्षक को छोड़कर, शब्द " विदेशी मदिरा " के पश्चात्, शब्द " एवं हेरिटेज मदिरा " अन्तःस्थापित किए जाएं ;
(ख) शर्तों में, -

(तीन) शर्त क्रमांक ( 3 ) , (4) , (5) एवं (7) में, शब्द " विदेशी मदिरा " के पश्चात्, शब्द "एवं हेरिटेज मदिरा " अन्तःस्थापित किए जाएं;
(चार) शर्त क्रमांक (9) के पश्चात्, निम्नलिखित शर्त जोड़ी जाए, अर्थात्: -
" (9-क) बार का अनुज्ञप्तिधारक, मैन्यूमें, हेरिटेज मदिरा का उल्लेख अनिवार्य रूप से करेगा। " ।
(12) प्ररूप एफ.एल.एच.बी. में, शर्तों में ,-
(क) शीर्षक में, शब्द " विदेशी मदिरा " के पश्चात्, शब्द " एवं हेरिटेज मदिरा " अन्तःस्थापित किए जाएं;
(ख) प्रारंभिक पैरा में, नियमों के लघु शीर्षक को छोड़कर, शब्द "विदेशी मदिरा " के पश्चात्, शब्द " एवं हेरिटेज मदिरा " अन्तःस्थापित किए जाएं;
(ग) शर्तों में, -
(एक) शर्त क्रमांक (2 ) तथा (3 ) में शब्द "विदेशी मदिरा " के पश्चात्, शब्द " एवं हेरिटेज मदिरा " अन्तःस्थापित किए जाएं;
(दो) शर्त क्रमांक (4 ) में, अंत में, शब्द तथा अंक " होमबार अनुज्ञप्तिधारक हेतु हेरिटेज मदिरा के आधिपत्य की अधिकतम सीमा 24 क्वार्ट बोतल अथवा उसके समतुल्य होगी। " जोड़े जाएं;
(तीन) शर्त क्रमांक (7 ) के पश्चात्, निम्नलिखित शर्तें जोड़ी जाएं, अर्थात्ः-
" 7 -क. होमबार अनुज्ञप्तिधारक, स्वयं , समय - समय पर , अपने अनुज्ञप्त परिसर का निरीक्षण वाणिज्यिक कर विभाग (आबकारी) के सक्षम अधिकारी से करा सकेगा।
7- ख. होमबार अनुज्ञप्तिधारक उसके द्वारा क्रय की गई मदिरा की इनवॉइस /इनवॉइसेस अभिलेख (रिकार्ड) में रखेगा तथा उन्हें निरीक्षणकर्ता अधिकारी को अनिवार्य रूप से प्रस्तुत करेगा।
7-ग. कोई शिकायत प्राप्त होने पर, वाणिज्यिक कर विभाग ( आबकारी) के सक्षम अधिकारी, होमबार अनुज्ञप्तिधारक के अनुज्ञप्त परिसर का निरीक्षण कर सकेंगे तथा त्रुटि/त्रुटियां पाए जाने पर अनुज्ञप्तिधारक मध्यप्रदेश आबकारी अधिनियम, 1915 (क्रमांक 2 सन् 1915 ) इसके अधीन बनाए गए नियमों एवं आबकारी आयुक्त के आदेशों/निर्देशों के उल्लंघन के लिए विधिक कार्रवाई करने के लिए अधिकृत होंगे। " ।
2. यह अधिसूचना मध्यप्रदेश राजपत्र में इसके प्रकाशन की तारीख से प्रवृत होगी।

No.3-3-4-0014-2023 - Sec - 02 - V ( CT) ( 13 ) .-In exercise of the powers conferred by sub - section ( 1) and clauses ( d) , (e ) , (f) , (g ) and (h ) of sub - section (2 ) of Section 62 of the Madhya Pradesh Excise Act , 1915 (No. II of 1915) , the State Government, hereby, makes the following further amendments in the Madhya Pradesh Foreign Liquor Rules , 1996, namely: -
AMENDMENTS
In the said rules , -
(1) in rule 8 , in sub - rule ( 1 ) , -
(a) for clause ( aa - 8 ) , the following clause shall be substituted , namely : -
"( aa-8) R.W.S.1 ( Licence for sale of heritage liquor and wine made in the Madhya Pradesh from retail wine shop) : -
Licence in form R.W.S.1 shall be granted for sale of heritage liquor and wine made in the Madhya Pradesh in sealed bottles from retail wine shop which is manufactured in Madhya Pradesh from grapes and other fruits produced in Madhya Pradesh on advance payment of annual licence fee of Rs . 10,000 / - . " .
(b) in clause (aa - 9 ) , after the word " wine " , wherever it occurs , the words " and heritage liquor " shall be inserted;

(c) in clause (aa - 10 ) , ( bb) , ( bbbb ) , (c) , (cc) , ( d) and ( e ) , after the words " foreign liquor " , wherever they occur , the words " and heritage liquor " shall be inserted .
(2) For rule 8 - A , the following rule shall be substituted , namely: -
" 8 - A . F.L.H.B. ( Home Bar Licence) .- Home bar licence shall be granted in Form F.L.H.B. for consumption and possession of foreign liquor and heritage liquor in the personal residence of such person whose reported gross individual income is minimum of Rs . 35 lakhs , as per his / her income tax return for the previous financial year. This licence shall be granted by the Collector on payment of an annual licence fee of Rs . 75,000/- . " .
(3) In FORM F.L. 2 , -
(a) in the opening paragraph , after the words " foreign liquor " , except for the short title of the rules , the words "and heritage liquor " shall be inserted;
(b) in the conditions , -
(i) in condition number ( 1 ) , after the words and symbol " as may be specified by the Collector . " , the words , symbols , brackets , letters and figures "The licensee may procure heritage liquor from heritage liquor manufacturing unit/ foreign liquor warehouse / country liquor warehouse / heritage liquor retail shop (H.L. - 2 ) /R.W.S.1/R.W.S.2 . " shall be added;

( ii) in condition number (2 ) , ( 3 ) and (4) , after the words " foreign liquor " , the words " and heritage liquor " shall be inserted;
(iii) in condition number (6 -A) , at the end , the words , figures and symbols " The licensee may stock heritage liquor in sealed bottles with a capacity of 180 millilitres / 375 millilitres / 500 millilitres / 750 millilitres , except for the ones that have been opened for sale . " shall be added;
(iv) after condition number (8 - B ) , in the proviso , after clause (ii ) , the following condition shall be added , namely:-
" (8 - C) The Bar licensee shall compulsorily mention heritage liquor in the menu . " .
(4) In FORM F.L. 3 , -
(a) in the opening paragraph , after the words " foreign liquor " , except for the short title of the rules , the words " and heritage liquor " shall be inserted ;
(b) in the conditions , -
(i) in condition number ( 1 ) , after the words and symbol " as may be specified by the Collector . " , the words , symbols , brackets , letters and figures "The licensee may procure heritage liquor from heritage liquor manufacturing unit / foreign liquor warehouse / country liquor warehouse /heritage liquor retail shop (H.L. - 2 ) /R.W.S.1/R.W.S.2 . " shall be added;

(ii) in condition number (2 ) , after the words " foreign liquor " wherever they occur , the words " and heritage liquor " shall be inserted ;
(iii ) in condition number (3 ) , after the words "only loose foreign liquor " , the words " and loose heritage liquor " shall be inserted ;
(iv) after condition number (4) ( b) , the following condition shall be added , namely: -
" (c) The licensee shall compulsorily stock minimum 2 cases of heritage liquor for sale . The calculation of the quantity of the specified minimum stock kept shall be done on quarterly basis . On all such days , when the stock of heritage liquor is found to be less than the specified minimum quantity , the collector may impose a penalty at the rate of upto Rs . 500 / - per proof litre , per day on such quantity falling short of the minimum specified quantity . " ;
(v) in condition number (5) and (8 ) , after the words " foreign liquor " , the words " and heritage liquor " shall be inserted ;

Department , may inspect the licensed premises of the home bar licensee and if in case any error/ errors are found , they shall be authorised to take legal action for the violation of the Madhya Pradesh Excise Act , 1915 (No. II of 1915) , the rules made thereunder and the orders / directions of the Excise Commissioner . " .
2. This notification shall come into force from the date of its publication in the Madhya Pradesh Gazette .
