क्र. एफ 1 / 1 / 18 / 01 / 2025 / 29-2 , भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग में लाते हुए , मध्यप्रदेश के राज्यपाल, एतद्वारा , मध्यप्रदेश खाद्य , नागरिक पूर्ति तथा उपभोक्ता संरक्षण विभाग ( राजपत्रित ) सेवा भरती नियम, 2013 में निम्नलिखित संशोधन करते हैं, अर्थात्ः-

संशोधन
उक्त नियमों में, -
(1 ) नियम 5. में, उप - नियम ( 2 ) के पश्चात्, निम्नलिखित उप - नियम जोड़ा जाए , अर्थात्ः- " (3) मध्यप्रदेश शासन , सामान्य प्रशासन विभाग के परिपत्र क्र. सी-5-2/2018/1/3 , दिनांक 22 जुलाई , 2023 के खण्ड 4.1.3 के अनुसार वेतनमान दिया जाएगा । " ।
(2) नियम 8 में , उप- नियम ( एक ) में , खण्ड ( ख ) के पश्चात्, निम्नलिखित खण्ड जोड़ा जाए, अर्थात्ः-
" (ख - क ) इन नियमों की अनुसूची-दो में यथा उल्लेखित विभाग में सीधी भर्ती के नियमित पदों के समकक्ष संविदा पदों पर 5 वर्ष की निरंतर सेवा पूर्ण करने वाले संविदा अधिकारियों की कुल संख्या के 50 प्रतिशत अथवा रिक्त पदों के 50 प्रतिशत तक ( जो भी कम हो ) , संविदा अधिकारियों की नियुक्ति के लिए आरक्षित रखे जाएंगे। इन निर्देशों के अधीन एक बार आरक्षण सुविधा का लाभ प्राप्त के पश्चात् अभ्यर्थी पुनः लाभ प्राप्त करने का पात्र नहीं होगा।
(ख -ख ) संविदा आरक्षण का लाभ प्राप्त करने लिए निम्नलिखित संविदा सेवक पात्र होंगे, अर्थात्ः-
" (7) इन नियमों की अनुसूची - दो में यथा उल्लेखित विभाग में सीधी भर्ती के नियमित पदों के समकक्ष संविदा पदों पर 5 वर्ष की निरंतर सेवा पूर्ण करने वाले संविदा अधिकारियों की कुल संख्या के 50 प्रतिशत अथवा विभाग में सीधी भर्ती के रिक्त पदों का 50 प्रतिशत तक ( जो भी कम हो ) , संविदा अधिकारियों की नियुक्ति के लिए आरक्षित रखे जाएंगे । इन निर्देशों के अधीन आरक्षण सुविधा का एक बार लाभ लेने के पश्चात् या नियुक्ति प्राप्त कर लेने के पश्चात् उन्हें पुनः लाभ की पात्रता नहीं होगी ।
(8 ) संविदा आरक्षण का लाभ प्राप्त करने लिए निम्नलिखित संविदा सेवक पात्र होंगे , अर्थात्ः 156( 1)

(एक ) आवेदक विभाग में नियमित भर्ती के रिक्त पद के समकक्ष संविदा पद पर न्यूनतम 5 वर्ष की अवधि के लिए संविदा आधार पर नियुक्त रहा हो। संविदा पद से नियमित पद की समकक्षता का निर्धारण मध्यप्रदेश शासन , सामान्य प्रशासन विभाग के परिपत्र दिनांक 22 जुलाई , 2023 के अनुसार किया जाएगा । 5 वर्ष की यह अवधि रिक्त पद के विरुद्ध आवेदन करने की दिनांक को पूर्ण होना चाहिए । उसे इस आशय का प्रमाण - पत्र प्रस्तुत करना होगा और यह प्रमाण- पत्र यथास्थिति जिला अथवा राज्य स्तर पर सक्षम अधिकारी द्वारा जारी किया जाएगा;
(दो ) वह इन नियमों के अधीन नियमित पदों के लिए अपेक्षित शैक्षणिक अर्हता तथा अन्य सुसंगत अनुभव पूर्ण करता हो ,
(तीन ) यदि किसी संविदा अधिकारी ने एक ही संविदा पद पर कार्य न करते हुए विभिन्न संविदा पदों पर कार्य किया है तो 5 वर्ष की उपरोक्त अवधि की गणना पूर्ण होने पर वह उस श्रेणी के नियमित पद पर नियुक्ति के लिए मध्यप्रदेश शासन , सामान्य प्रशासन विभाग के परिपत्र दिनांक 22 जुलाई , 2023 के अनुसार नियमित पद की समकक्षता के निर्धारण के पश्चात् आवेदन कर सकेगा , जो 5 वर्ष की अवधि के पश्चात् निम्नतम श्रेणी में होगा;
(चार ) यदि किसी संविदा अधिकारी को संविदा के पद से किसी अवधि में हटा दिया गया हो तथा उसे पुनः उसी पद पर अथवा किसी अन्य पद पर संविदा पर नियुक्ति प्राप्त हो गई हो, तो 5 वर्ष की संविदा सेवा की अवधि की गणना , सेवा से पृथक रहने की अवधि को घटा कर की जाएगी;
( पाँच ) किसी भी विभाग में कार्यरत संविदा पर नियुक्त अधिकारी खाद्य , नागरिक पूर्ति तथा उपभोक्ता संरक्षण विभाग द्वारा विज्ञप्त पद पर आवेदन कर सकेगा , जो नियमित पद हेतु समकक्षता एवं अर्हता रखता हो;
( छह ) नियमित नियुक्ति होने की स्थिति में , संविदा अधिकारी को पूर्व की संविदा सेवाओं का किसी भी प्रकार का लाभ प्राप्त नहीं हो सकेगा ,
(सात ) संविदा अधिकारी के लिए आरक्षित किए गए नियमित पदों पर भर्ती की पारदर्शी एवं प्रतिस्पर्धात्मक प्रक्रिया के माध्यम से चयन किया जाएगा, इस हेतु नियुक्तिकर्ता विभाग द्वारा न्यूनतम कटऑफ अंक निर्धारित किए जा सकेंगे ;

(आठ ) संविदा अधिकारी एक अथवा एक से अधिक प्रकार के संविदा पदों पर नियुक्त रहा हो सकता है । ऐसी स्थिति में , संविदा पद के जिस समकक्ष नियमित पद पर वह नियुक्ति हेतु आवेदन करता है, उसके बराबर या उच्चतर संविदा पर वह जितने वर्ष कार्यरत रहा, उतने वर्ष की उसे विहित अधिकतम आयु सीमा में छूट की पात्रता होगी। आयु संबंधी समस्त छूट सम्मिलित करते हुए , संविदा अधिकारी की अधिकतम आयु 55 वर्ष से अधिक नहीं होगी ।
( नौ ) संविदा अधिकारियों के लिए समकक्ष नियमित पदों पर नियुक्ति हेतु आरक्षित वे पद उस स्थिति में अन्य उम्मीदवारों से भरे जाएंगे, जिन पदों को भरे जाने के लिए विहित पारदर्शी एवं प्रतिस्पर्धात्मक प्रक्रिया के पालन उपरांत पर्याप्त संख्या में संविदा अधिकारी अंतिम रूप से चयनित नहीं हो पाते । ऐसे रिक्त रहे शेष पद अग्रनीत (कैरी फारवर्ड ) नहीं किए जाएंगे, जो संविदा अधिकारियों/ कर्मचारियों के लिए आरक्षित हैं;
(दस ) नियमित पदों के विरुद्ध नियुक्ति की प्रक्रिया में , अनुसूचित जाति, अनुसूचित जनजाति, अन्य पिछड़ा वर्ग तथा आर्थिक रूप से कमजोर वर्ग के आरक्षण नियमों का पालन सुनिश्चित किया जाएगा । " ו
( 3 ) अनुसूची- चार में , टिप्पणी क्रमांक ( 3 ) का लोप किया जाए ।

F.No 1 / 1 / 18 / 01 / 2025 / 29-2 , In exercise of the powers conferred by the proviso to article 309 of the Constitution of India , the Governor of Madhya Pradesh , hereby , makes the following amendment in the Madhya Pradesh Food , Civil Supplies and Consumer Protection Department ( Gazetted ) Service Recruitment Rules , 2013 , namely: -
AMENDMENT
In the said rules , -
(1 ) in rule 5 , after sub - rule ( 2) , the following sub - rule shall be added , namely.-
"( 3 ) The pay scale shall be given as per clause 4.1.3 of the circular No. C-5- 2/2018/1/3 dated 22nd July, 2023 of the General Administration Department , Government of Madhya Pradesh . " .
(2) In rule 8 , in sub- rule ( 1 ) , after clause ( b) , the following clauses shall be inserted , namely: -
" (ba) 50 percent of the total number of contractual officers who have completed 5 years of continuous service on contractual posts equivalent to regular posts of direct recruitment in the department as mentioned in Schedule - ll of these rules or up to 50 percent of the vacant posts ( whichever is less) shall be kept reserved for the appointment of contractual officers . Under these instructions , after taking the benefit of reservation facility once, the candidate shall not be eligibile to get the benefit of reservation again .
(bb) The following contractual servants shall be eligible to get the benefit of contractual reservation , namely :-
" (7) 50 percent of the total number of contractual officers who have completed 5 years of continuous service on contractual posts equivalent to regular posts of direct recruitment in the department as mentioned in Schedule- ll of these rules or up to 50 percent of the vacant posts of direct recruitment In the department मध्यप्रदेश राजपत्र, दिनांक 13 मार्च 2025

(whichever is less ) shall be kept reserved for the appointment of contractual officers . Under these instructions , after taking the benefit of reservation facility once or after getting the appointment (joining ) , they shall not be eligible for the benefit again.
(8) The following contractual servants shall be eligible to get the benefit of contractual reservation , namely:-
( i) the applicant must have been appointed on contractual basis for a minimum period of 5 years on contractual basis equivalent to the vacant posts of regular recruitment in the department . The equivalence of regular post with contractual post shall be determined according to the Government of Madhya Pradesh , General Administration Department's Circular dated 22nd July, 2023. This period of 5 years should be completed on the date of applying against the vacant post . He shall have to produce a certificate to this effect and this certificate shall be issued by the competent authority at the District or State level , as the case may be ;
(ii) he must fulfill the educational qualification and other relevant experience required for the regular posts under these rules ;
(iii) if a contractual officer has worked on different contractual posts without working on the same contractual post, then on completion of the calculation of the above period of 5 years , he can apply for appointment to the regular post of that category, according to the Government of Madhya Pradesh , General Administration Department's Circular dated 22nd July, 2023, after determining the equivalence of the regular post , it shall be in the lowest category after a period of 5 years ;
(iv) if a contractual officer has been removed from the contractual service during any period and he has got appointment on contract again on the same post or on any other post, then the period of contractual service of 5 years'shall be counted from the service , after reducing the period of isolation;

(v) an officer appointed on contract , working in any department may apply for the post advertised by the Department of Food , Civil Supplies and Consumer Protection who has equivalence and qualification for the regular post ;
(vi ) in case of regular appointment , the contractual officer shall not be able to get any benefit of the previous contractual services ;
(vii ) selection shall be made through a transparent and competitive process of recruitment to the regular posts reserved for the contractual officer, for this the minimum cutoff marks may be fixed by the appointing department;
(viii) The contractual officer may have been appointed on one or more than one type of contractual posts . In such a situation , the number of years he has been employed on a contract equal to or higher than the regular post for which he applies for appointment , he shall be eligible for relaxation of the prescribed maximum age limit . Including all age relaxation , the maximum age of the contractual officer shall not exceed 55 years ;
(ix) those posts reserved for appointment to equivalent regular posts for contractual officers shall be filled from other candidates in the event that sufficient number of contractual officers are finally not selected after following the prescribed transparent and competitive process to fill the posts , then the remaining vacant posts shall not be carried forward which are reserved for contractual officers /employees ;
(x) in the process of appointment against regular posts , it shall be ensured that the reservation rules of Scheduled Castes , Scheduled Tribes , Other Backward Classes and Economically Weaker Sections are followed. " .
(3) in Schedule - IV, Note number ( 3 ) shall be omitted .
