मध्यप्रदेश निजी विद्यालय (फीस तथा संबंधित विषयों का विनियमन) नियम, 2020 में संशोधन का निम्नलिखित प्रारूप जिसे राज्य सरकार, मध्यप्रदेश निजी विद्यालय (फीस तथा संबंधित विषयों का विनियमन) अधिनियम, 2017 की धारा 14 की उप-धारा (1 ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए बनाना प्रस्तावित करती है एतद्वारा उक्त अधिनियम की धारा 14 की उप-धारा (1 ) द्वारा यथा अपेक्षित, उन समस्त व्यक्तियों को, जिनके कि उससे प्रभावित होने की संभावना है , जानकारी के लिए, एतद्वारा , प्रकाशित किया जाता है और एतद्द्वारा , यह सूचना दी जाती है कि इस सूचना के मध्यप्रदेश राजपत्र में प्रकाशन की तारीख से 30 दिन का अवसान होने पर उक्त प्रारूप पर विचार किया जाएगा ।
किसी भी आपत्ति या सुझाव पर जो कि उक्त प्रारूप के संबंध में, किसी व्यक्ति से ऊपर विनिर्दिष्ट कालावधि का अवसान होने के पूर्व प्राप्त हो, राज्य सरकार द्वारा विचार किया जाएगा ।
संशोधन का प्रारूप
उक्त नियमों में-
1. नियम 1 में,-
(1) विद्यमान पार्श्व शीर्षक के स्थान पर, निम्नलिखित पार्श्व शीर्षक स्थापित की जाए , अर्थात्ः-

" 1. संक्षिप्त नाम, प्रारंभ और लागू होना.-" ।
(2) उप-नियम (2) के पश्चात्, निम्नलिखित उप-नियम जोड़ा जाए, अर्थात् -
"(3) (क) ये नियम ऐसे निजी विद्यालयों को जिनकी वार्षिक फीस किसी भी कक्षा के लिए रूपये 25000 /- (पच्चीस हजार रूपये मात्र) से कम नहीं है, लागू होंगे ।
. (ख) ऐसे निजी विद्यालय जो उपरोक्त खण्ड (क) के अनुसार इन नियमों के दायरे से बाहर हैं उन्हें इस संबंध में ऐसी प्रक्रिया एवं समय सीमा में नोटरीकृत शपथपत्र पोर्टल पर अपलोड करना होगा जैसा कि राज्य सरकार द्वारा विहित किया जाए और ऐसे निजी विद्यालय जो उपरोक्त अनुसार यदि विहित समय सीमा में बिना उचित कारण दिए नोटरीकृत शपथपत्र अपलोड नहीं करते है, तो ऐसे सभी निजी विद्यालयं इन नियमों के उपबंधों के दायरे में माने जाएंगे एवं इन नियमों के समस्त उपबंध उन पर लागू होंगे । " ।
2 नियम 2 में , उपनियम (1) में, -
(1 ) खण्ड (घ) के पश्चात्, निम्नलिखित खण्ड अन्तःस्थापित किया जाए, अर्थातः-
"(घक) "विभागीय समिति" से अभिप्रेत है, मध्यप्रदेश निजी विद्यालय (फीस तथा संबंधित विषयों का विनियमन ) अधिनियम, 2017 (क्र. 6 सन् 2018) की धारा 11 की उप-धारा (1 ) के अधीन फीस तथा संबंधित मामले विनियमित करने के लिए गठित विभागीय समितिः " ।
(2) खण्ड (ञ) के स्थान पर, निम्नलिखित खण्ड स्थापित किया जाए, अर्थात्ः-
" (ञ ) "राज्य समिति" से अभिप्रेत है, उक्त अधिनियम की धारा 12 क की उप-धारा (1 ) के अधीन जारी फीस तथा संबंधित विषयों के विनियमन हेतु गठित राज्य समिति । " ।
3. नियम 3 में, शब्द " प्रत्येक निजी विद्यालय" जहां कहीं भी आया हो, के स्थान पर, शब्द "निजी विद्यालय " स्थापित किया जाए ।
4.नियम 4 में, शब्द "राज्य समिति" जहां कहीं भी आया हो, के स्थान पर, शब्द "विभागीय समिति" स्थापित किया जाए ।
5. नियम 8 में, शब्द " राज्य समिति" जहां कहीं भी आया हों के स्थान पर, शब्द "विभागीय समिति' स्थापित किया जाए ।
6. नियम 8 के पश्चात्, निम्नलिखित नियम अंतःस्थापित किया जाए, अर्थात्ः- 162(1)

"8क. राज्य समिति की प्रकिया एवं कृत्य. -
(1 ) नियम 7 के समस्त उपबंध यथावश्यक परिवर्तन सहित राज्य समिति पर लागू होंगे ।
(2) राज्य समिति, उक्त अधिनियम के नियम 12क के उपबंधों के अनुक्रम में निजी विद्यालय द्वारा प्रस्तुत अपील का विनिश्चय करेगी ।
(3) राज्य समिति, विभागीय समिति द्वारा अधिरोपित शास्ति को घटा या बढ़ा या निरसन कर सकेगी ।" ।
7. नियम 11 में,-
(1 ) विद्यमान पार्श्व शीर्षक के स्थान पर, निम्नलिखित पार्श्व शीर्षक स्थापित किया जाए, अर्थात्:-
" 11. विभागीय समिति द्वारा अपील का निराकरण.-" ।
(2) उप-नियम (1) से (4) में, शब्द "राज्य समिति" जहां कहीं भी आया हों, के स्थान पर, शब्द "विभागीय समिति" स्थापित किए जाएं।
(3) उप-नियम (5) के स्थान पर, निम्नलिखित उप- नियम स्थापित किया जाए, अर्थात्ः-
"(5) विभागीय समिति, अपील आवेदन की प्राप्ति दिनांक से 45 कार्य दिवसों के भीतर अपील का विनिश्चय करेगी । किसी निजी विद्यालय द्वारा 15 % से अधिक की फीस वृद्धि संबंधी निर्णयों के अतिरिक्त शेष सभी मामलों पर विभागीय समिति का निर्णय अंतिम एवं बाध्यकारी होगा । " ।
8. नियम 11 के पश्चात्, निम्नलिखित नियम अन्तःस्थापित किया जाएं , अर्थात्ः-
" 11 क. राज्य समिति द्वारा अपील का निपटारा.-
(1) नियम 11 के उप- नियम (1 ) से (4) के उपबंध यथावश्यक परिवर्तन सहित राज्य समिति को लागू होंगे ।
(2) राज्य समिति, अपील आवेदन प्राप्ति की दिनांक से 45 कार्य दिवसों के भीतर अपील का विनिश्चय करेगी । ऐसे निजी विद्यालय द्वारा 15 % से अधिक की फीस वृद्धि संबंधी समस्त प्रकरणों पर राज्य समिति का निर्णय अंतिम एवं बाध्यकारी होगा ।" ।

The following draft of amendments in the Madhya Pradesh Niji Vidyalaya (Fees Tatha Sambandhit Vishayon Ka Viniyaman) Rules , 2020 , which the State Government proposes to make in exercise of the powers conferred by sub - section ( 1 ) of section 14 . of the Madhya Pradesh Niji Vidyalaya ( Fees Tatha Sambandhit Vishayon Ka Viniyaman) Adhiniyam , 2017 ( No. 6 of 2018) is. hereby published as required by sub - section (1) of section 14 of the said Act for the information of all persons likely to be affected thereby and notice is hereby given that the said draft of amendments shall be taken into consideration on the expiry of 30 days from the date of publication of this notice in the Madhya Pradesh Gazette .
Any objection or suggestion which may be received from any.
person with respect to the said draft of amendments on or before the expiry of the period specified above shall be considered by the State Government ..
DRAFT OF AMENDMENTS
In the said rules, -
in rule 1,- 1.
(1) for the existing marginal heading, the following marginal heading shall be substituted , namely: -
" 1. Short title , commencement and application.- " ..
(2) After sub -rule (2) , the following sub-rule shall be added, namely: - 162( 3)

"(3) ( a) These rules shall apply to all such private schools whose annual fees in any class being is not less than Rs . 25,000 /- (Rupees Twenty- Five Thousand only);
(b) such private schools which are outside the purview of these rules in accordance with the above clause ( a) shall have to upload a notarized affidavit in this regard on the portal in the time and manner , as prescribed by the State Government and such private schools which do not upload a notarized affidavit in accordance with the above within the prescribed time limit without giving any reasonable cause shall come under the purview of the provisions of these rules and all the provisions of these rules shall apply to them ." .
2. In rule 2 , in sub - rule ( 1 ) , -
(1) after clause (d) , the following clause shall be inserted , namely:-
"(da) "Departmental Departmental Committee " Committee means a constituted for regulation of fees and related issues under sub- section ( 1 ) of section 11 of the Madhya Pradesh Niji Vidyalaya (Fees Tatha Sambandhit Vishayon Ka Viniyaman ) Adhiniyam, 2017 (No. 6 of 2018 ) ; " .
(2) For clause (j ) , the following clause shall be substituted, namely:-

" (j ) "State Committee " means a State Committee constituted for regulation of fees and related issues under sub - section ( 1 ) of section 12A of the said Act ." .
3. In rule 3 , for the words " each private school " , wherever they occur , the words " private school " shall be substituted .
4. In rule 4 , for the words " State Committee " , wherever they occur, the words " Departmental Committee " shall be substituted .
5 . In rule 8 , for the words " State Committee " , wherever they occur, the words " Departmental Committee" shall be substituted .
6. After rule 8 , the following rule shall be inserted , namely: -
" 8A . Procedure and functions of the State Committee.-
(1) All the provisions of rule 7 shall mutatis mutandis apply to the State Committee .
(2) The State Committee shall decide the appeal submitted by the private school in accordance with the provisions of section 12A of the said Act .
(3) The State Committee may reduce or increase or repeal the penalty imposed by the Departmental Committee . " .
7. In rule 11 , -
(1) for the existing marginal heading, the following marginal heading shall be substituted , namely: -
" 11. Disposal of appeal by the Departmental Committee.-" .

(2) In sub - rule (1) to (4) , for the words " State Committee " , wherever they occur , the words " Departmental Committee " shall be substituted .
(3) For the existing sub - rule (5) , the following sub - rule shall be substituted , namely: -
" (5) The Departmental Committee shall decide the appeal within 45 working days from the date of receipt of the appeal application . The decision of the Departmental Committee shall be final and binding on all the matters , except the matters regarding increment of fees by more than 15% by any private school . " .
8. After rule 11 , the following rule shall be inserted , namely: - " 11A . Disposal of appeal by the State Committee.-
(1) The provisions of sub -rule ( 1) to (4) of rule 11 shall mutatis mutandis apply to the State Committee .
(2) The State Committee shall decide the appeal within 45 working days from the date of receipt of the appeal application . The decision of the State Committee shall be final and binding on all the matters regarding increment of fees by more than 15% by any private school . " .
