THE MADHYA PRADESH NAGAR TATHA GRAM NIVESH
(SANSHODHAN) VIDHEYAK, 2025
A Bill further to amend the Madhya Pradesh Nagar Tatha Gram Nivesh Adhiniyam, 1973 .
Be it enacted by the Madhya Pradesh Legislature in the seventy - sixth year of the Republic of India as follows : -
Short title and commencement .
1. ( 1 ) This Act may be called the Madhya Pradesh Nagar Tatha Gram Nivesh (Sanshodhan) Adhiniyam , 2025 .
(2) It shall come into force from the date of its publication in the Madhya Pradesh Gazette.
Insertion of section 66 - A .
2. After Section 66 of the Madhya Pradesh Nagar Tatha Gram Nivesh Adhiniyam , 1973 (No. 23 of 1973 ) , the following section shall be inserted , namely: -
Other agencies as Special Area Development Authority.
"66- A. Notwithstanding anything contained in this Act, the State Government may, by notification, if it deems it necessary in the public interest , delineate any large infrastructure development project area , including its influence area as may be specified , to be developed as a Special Area and may designate a Government agency or a Government owned company, or a local body as the Special Area Development Authority. Such project shall be developed in accordance with the procedure mentioned in Section 50 , and shall meet one ofthe following criterion, -
(i) project area more than 40 hectare ; or
(ii) project cost more than 500 crores as per the administrative approval .
'The functions of such authority shall be as specified under section 68 , for the purpose of developing the area so notified under sub - section ( 1 ) of Section 64. " .
STATEMENT OF OBJECTS AND REASONS
In the Madhya Pradesh Nagar Tatha Graın Nivesh Adhiniyam , 1973 (No. 23 of 1973 ) , there is a provision to constitute Town and Country Development Authority or Special Area Development Authority to develop any area or urban area. Development plan proposal's implemented by the Special Area Development Authority prepares the plan and implement the proposals of Development plan . Section 66 of the said Act , provides for incorporation of Special Area Development Authority. With the objective to clarify the provisions of the Act regarding the development of any infrastructure development project to be undertaken by a Governruent owned company or urban local body in special area , an intent to develop any infrastructure development project area in public interest , there is a need to include a new Section 66 -A to be inserted in the principal Act. Therefore , it is proposed to make suitable amendment in the said Act .
