आदेश

सं. 76- म.प्र.- वि.स.- 58-2024- सी.ई.एम.एस.- III.- यतः, भारत निर्वाचन आयोग द्वारा दिनांक 21 अक्टूबर 2023 की अधिसूचना नं. 15- विधिनिर्वा. चार- म.प्र. वि.स. 2023 के अनुसरण में , मध्यप्रदेश के 58 पवई विधान सभा निर्वाचन क्षेत्र के लिए साधारण निर्वाचन 2023 आयोजित किया गया था; और

यतः , लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 78 के अनुसार, किसी निर्वाचन में, निर्वाचन लड़ रहा प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय का लेखा जिला निर्वाचन अधिकारी के पास दाखिल करेगा जो उक्त अधिनियम की धारा 77 के अंतर्गत उसके द्वारा या उसके निर्वाचन अभिकर्ता (एजेंट) द्वारा रखे गए लेखे की एक सत्यप्रति होगी; और

यतः, मध्यप्रदेश राज्य के 58 पवई विधान सभा निर्वाचन क्षेत्र के साधारण निर्वाचन , परिणाम रिटर्निंग ऑफिसर द्वारा दिनांक 03 दिसम्बर 2023 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय लेखे दाखिल करने की अन्तिम तारीख 02जनवरी 2024 थी; और

यतः , निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उपनियम (1 ) अंतर्गत, जिला निर्वाचन अधिकारी , पन्ना की रिपोर्ट दिनांक 05 जनवरी 2024 , जो मुख्य निर्वाचन अधिकारी , मध्यप्रदेश , भोपाल से दिनांक 07 फरवरी 2024 के पत्र सं. 10- क-4- निर्वा.व्यय- निर्देश- 2023-24-1032 को प्राप्त हुई थी, के अनुसार श्रीमती रजनी यादव जो मध्यप्रदेश राज्य के 58- पवई विधान सभा निर्वाचन क्षेत्र, 2023 से निर्वाचन लड़ने वाले अभ्यर्थी है, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं ; और

यतः, जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उपनियम (5) के अंतर्गत श्रीमती रजनी यादव को अपने निर्वाचन व्यय लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76- मध्यप्रदेश- वि.स.-58-2024- सी.ई.एम.एस.- III, दिनांक 19 जुलाई 2024 जारी किया गया थाः, और

यतः, उपयुक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उपनियम (6) के अनुसार श्रीमती रजनी यादव को व्यय लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पष्ट करते हुए , आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनों के भीतर जिला निर्वाचन अधिकारी, पन्ना को अपने निर्वाचन व्यय का पूर्ण लेखा प्रस्तुत करने का निदेश दिया गया था; और

यतः , जिला निर्वाचन अधिकारी , पन्ना से दिनांक 10 फरवरी 2025 के पत्र सं0 96 - सामान्य निर्वाचन-2025 के द्वारा सूचित किया है कि उक्त कारण बताओ नोटिस श्रीमती रजनी यादव के द्वारा दिनांक 29 जुलाई 2024 को प्राप्त किया गया था; और

यतः, जिला निर्वाचन अधिकारी, पन्ना ने पत्र सं. 96- सामान्य निर्वाचन-2025 , दिनांक 10 फरवरी 2025 के द्वारा प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्रीमती रजनी यादव ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है. इसके अतिरिक्त , उक्त नोटिस की पावती के उपरांत, श्रीमती रजनी यादव ने विधि के अंतर्गत यथा- विहित लेखा दाखिल करने में असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया और न ही कोई स्पष्टीकरण दिया है; और

यतः , लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10 क में उपबंधित किया गया है कि:-

" यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है , दाखिल करने में असफल रहा है; और 228(1)

(ख) उस असफलता के लिए कोई अच्छा कारण अथवा न्यायोचित्य नहीं रखता है , तो निर्वाचन आयोग , शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित होगा . "

यतः , तथ्यों और उपलब्ध रिकार्डों के आधार पर आयोग का यह समाधान हो गया है कि श्रीमती रजनी यादव अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और

अतः, अब, लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 10 क के अनुसरण में, भारत निर्वाचन आयोग , एतद्वारा घोषणा करता है कि मध्यप्रदेश राज्य के साधारण निर्वाचन, 2023 के 58 पवई विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्रीमती रजनी यादव, निवासी- बरबसपुरा, ग्राम पाटन, पोस्ट इमलहा , तहसील राजनगर, जिला छतरपुर (म.प्र.) , इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने अथवा होने के लिए निरर्हित होंगे.

ORDER

WHEREAS, as per Section 78 of the Representation of the People Act , 1951 , every contesting candidate at an election shall , within 30 days from the date of election of the returned candidate , lodge with the District Election Officer an account of his election expenses which shall be true copy of the account kept by him or his election agent under Section 77 of the said act ; and

WHEREAS , as per the District Election Officer's report dated 5th January 2024 forwarded by the Chief Electoral Officer, Madhya Pradesh, Bhopal vide his letter No. 10-क-4-निर्वा.व्यय-निर्देश - 2023-24-1032 , dated 7th February 2024, under sub - rule ( 1 ) of Rule 89 of the Conduct of Elections Rules , 1961 , Smt . Rajni Yadav , a contesting candidate from 58- Pawai Assembly Constituency of Madhya Pradesh has failed to lodge her account of election expenses , as required under law; and

WHEREAS , on the basis of the said report of the District Election Officer, Panna , a Show -Cause noticeNo. सं.76- म.प्र.-वि.स.-58-2024- सी.ई.एम.एस.- III, dated 19th July 2024 was issued under sub -rule (5) of Rule 89 of the Conduct of Elections Rules , 1961 , by the Election Commission of India to Smt . Rajni Yadav for not lodging ofher account of Election Expenses ; and

WHEREAS , through the above said Show Cause Notice and under sub - rule (6) of Rule 89 of the Conduct of Elections Rules , 1961 , Smt . Rajni Yadav, was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer , Panna within 20 days from the date of receipt of the Notice ; and मध्यप्रदेश राजपत्र, दिनांक 11 अप्रैल 2025

WHEREAS , the District Election Officer, Panna , vide his letter No. 96- सामान्य निर्वाचन-2025 , dated 10th February 2025 it has informed that notice was served to Smt . Rajni Yadav, received on 05th August 2024; and WHEREAS, the District Election Officer, Panna in his Supplementary Report , vide its letter No.96- सामान्य निर्वाचन-2025, dated 10th February 2025 has reported that Smt . Rajni Yadav, has not submitted her account of election expenses . Further, after receipt of the said notice , Smt. Rajni Yadav, has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and

WHEREAS, Section 10 A of the Representation of the People Act , 1951 provides that : -

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses , within the time and in the manner required by or under this Act, and

(b) has no good reason or justification for the failure , the Election Commission shall, by order published in the Official Gazette , declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order. "

WHEREAS , on the basis of facts and available records , the Commission is satisfied that Smt . Rajni Yadav has failed to lodge her account of election expenses and has no good reason or Justification for the failure to do so; and

NOW, THEREFORE , in pursuance of Section 10A of the Representation of the People Act , 1951 , the Election Commission of India hereby declares Smt . Rajni Yadav Residence of Barbaspura , Gram Patan, Post Imolha, Tehsil Rajnagar, Jila - Chhatarpur (M.P. ) , a contesting candidate in 58- Pawai Assembly Constituency of General Election to the Legislative Assembly of Madhya Pradesh, 2023 , to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date ofthis order .

WHEREAS, the result of the above - mentioned elections for 58- Pawai Assembly Constituency ofMadhya Pradesh was declared by the Retuming Officer on 3rd December 2023 and hence the last date for lodging the account of Election Expenses was 2nd January 2024 ; and WHEREAS , as per the District Election Officer's report dated 5th January 2024 forwarded by the Chief dated Electoral Officer, Madhya Pradesh, Bhopal vide his letter No. 10- क-4- निर्वा.व्यय-निर्देश- 2023-24-10 7thFebruary 2024, under sub - rule ( 1 ) of Rule 89 of the Conduct of Elections Rules , 1961 , Sh. यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, किसी निर्वाचन में, निर्वाचन लड़ रहा प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय का लेखा जिला निर्वाचन अधिकारी के पास दाखिल करेगा जो उक्त अधिनियम की धारा 77 के अंतर्गत उसके द्वारा या उसके निर्वाचन अभिकर्ता (एजेंट) द्वारा रखे गए लेखे की एक सत्यप्रति होगी; और

यतः, मध्यप्रदेश राज्य के 65- मैहर विधान सभा निर्वाचन क्षेत्र के साधारण निर्वाचन , परिणाम रिटर्निंग ऑफिसर द्वारा दिनांक 03 दिसम्बर 2023 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय लेखे दाखिल करने की अन्तिम तारीख 02जनवरी 2024 थी; और

यतः, निर्वाचनों का संचालन नियम , 1961 के नियम 89 के उपनियम (1 ) अंतर्गत, जिला निर्वाचन अधिकारी , सतना की रिपोर्ट दिनांक 04 जनवरी 2024 , जो मुख्य निर्वाचन अधिकारी , मध्यप्रदेश भोपाल से दिनांक 07 फरवरी 2024 के पत्र सं. 10 - क-4- निर्वा.व्यय-निर्देश- 2023-24-1032 को प्राप्त हुई थी, के अनुसार श्री चन्द्रप्रकाश पटेल उर्फ छोटू भैया जो मध्यप्रदेश राज्य के 65-मैहर विधान सभा निर्वाचन क्षेत्र, 2023 से निर्वाचन लड़ने वाले अभ्यर्थी है , विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं; और,

यतः, जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उपनियम (5) के अंतर्गत श्री चन्द्रप्रकाश पटेल उर्फ छोटू भैया को अपने निर्वाचन व्यय लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76- मध्यप्रदेश - वि.स.- 65-2024 - सी.ई.एम.एस.- III , दिनांक 19 जुलाई 2024 जारी किया गया थाः , और

यतः, उपयुक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उपनियम (6) के अनुसार श्री चन्द्रप्रकाश पटेल उर्फ छोटू भैया को व्यय लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पष्ट करते हुए , आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनों के भीतर जिला निर्वाचन अधिकारी , सतना को अपने निर्वाचन व्यय का पूर्ण लेखा प्रस्तुत करने का निदेश दिया गया था; और

यतः , जिला निर्वाचन अधिकारी, सतना से दिनांक 11 फरवरी 2025 के पत्र सं. 2510- ई.-15-25-निर्वा -व्यय-2025 के द्वारा सूचित किया है कि उक्त कारण बताओ नोटिस अभ्यर्थी श्री चन्द्रप्रकाश पटेल उर्फ छोटू भैया द्वारा दिए गए पते पर दिनांक 05 अगस्त 2024 को चस्पा किया गया था; और मध्यप्रदेश राजपत्र, दिनांक 11 अप्रैल 2025

यतः, जिला निर्वाचन अधिकारी , सतना ने पत्र सं. 2510- ई -15-25- निर्वा.- व्यय-2025 दिनांक 11 फरवरी 2025 के द्वारा प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री चन्द्रप्रकाश पटेल उर्फ छोटू भैया ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है. इसके अतिरिक्त, उक्त नोटिस की चस्पा के उपरांत , श्री चन्द्रप्रकाश पटेल उर्फ छोटू भैया ने विधि के अंतर्गत यथा विहित लेखा दाखिल करने में असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया और न ही कोई स्पष्टीकरण दिया है; और

यतः , लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10 क में उपबंधित किया गया है कि:- " यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है ; और

यतः, तथ्यों और उपलब्ध रिकार्डों के आधार पर आयोग का यह समाधान हो गया है कि श्री चन्द्रप्रकाश पटेल उर्फ छोटू भैया अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नही है ; और

अतः, अब, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में, भारत निर्वाचन आयोग , एतद्वारा घोषणा करता है कि मध्यप्रदेश राज्य के साधारण निर्वाचन, 2023 के 65 मैहर विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्री चन्द्रप्रकाश पटेल उर्फ छोटू भैया निवासी- मु.पो. छोटी जरियारी , तहसील मैहर, जिला मैहर (म.प्र.) , इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने अथवा होने के लिए निरर्हित होंगे.

No. 76 - MP -LA - 65-2024 - CEMS - III .- WHEREAS , the General Election to Legislative Assembly of Madhya Pradesh, 2023 for 65 - Maihar Assembly Constituency was held in pursuance of the Election Commis- sion of India Notification No. 15- विधि निर्वा. चार म.प्र.वि.स.-2023, dated 21st October 2023 ; and WHEREAS , as per Section 78 of the Representation of the People Act , 1951, every contesting candidate at an election shall , within 30 days from the date of election of the returned candidate , lodge with the District Election Officer an account of his election expenses which shall be true copy of the account kept by him or his election agent under Section 77 of the said act ; and

WHEREAS , the result of the above - mentioned elections for 65 - Maihar Assembly Constituency of Madhya Pradesh was declared by the Retuming Officer on 3rd December 2023 and hence the last date for lodging the account of Election Expenses was 2nd January 2024 ; and

WHEREAS , as per the District Election Officer's report dated 4th January 2024 forwarded by the ChiefElectoral Officer, Madhya Pradesh, Bhopal vide his letter no . 10- क-4-निर्वा .व्यय-निर्देश- 2023-24-1032, dated 7th February 2024 , under sub - rule ( 1 ) of Rule 89 of the Conduct of Elections Rules , 1961 , 228(7)

Sh . Chandraprakash Patel urf Chottu Bhaiya , a contesting candidate from 65 - Maihar Assembly Constitu- ency of Madhya Pradesh has failed to lodge his account of election expenses , as required under law ; and

WHEREAS , on the basis of the said report of the District Election Officer, Satna , a Show-Cause notice No. सं.76- म.प्र.- वि.स.- 65-2024- सी.ई.एम.एस.- III, dated 19th July 2024 was issued under sub - rule (5 ) of Rule 89 of the Conduct of Elections Rules , 1961 , by the Election Commission of India to Chandraprakash Patel urf Chottu Bhaiya for not lodging of his account of Election Expenses ; and WHEREAS, through the above said Show Cause Notice and under sub -rule (6) of Rule 89 of the Conduct of Elections Rules , 1961 , Sh . Chandraprakash Patel urf Chottu Bhaiya, was directed to submit representation inwriting to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Satna within 20 days from the date of receipt of the Notice; and

WHEREAS, the District Election Officer , Satna , vide his letter No. 2510 - ई.-15-25-निर्वा -व्यय -2025, dated 11th February 2025 it has informed that notice was pasted at the residence given by the candidate Sh . Chandraprakash Patel urf Chottu Bhaiya , pasted on 05th August 2024; and

WHEREAS, the District Election Officer , Satna in his Supplementary Report , vide its letter No. 2510- ई.- 15-25- निर्वा.- व्यय -2025 , dated 11th February 2025 has reported that Sh . Chandraprakash Patel urf Chottu Bhaiya, has not submitted his account of election expenses . Further , after receipt of the said notice , at his residence Sh . Chandraprakash Patel urf Chottu Bhaiya , has neither furnished any reason nor explanation to the Election Commission of India , for failure to lodge the account as prescribed under law ; and

WHEREAS , Section 10 A of the Representation of the People Act, 1951 provides that : -

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under this Act, and

(b) has no good reason or justification for the failure , the Election Commission shall , by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order. "

WHEREAS , on the basis of facts and available records , the Commission is satisfied that Sh. Chandraprakash Patel urf Chottu Bhaiya has failed to lodge his account of election expenses and has no good reason or Justification for the failure to do so ; and

NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act , 1951 , the Election Commission of India hereby declares Sh . Chandraprakash Patel urf Chottu Bhaiya residence of Mu. , Post Chhoti Jariyari , Tehsil Maihar , Jila - Maihar (M.P. ) , a contesting candidate in 65 - Maihar Assembly Constituency of General Election to the Legislative Assembly ofMadhya Pradesh, 2023 , to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order .
