आदेश
सं. 76- म.प्र.- वि.स.- 45-2024- सी.ई.एम.एस.- III. - यतः , भारत निर्वाचन आयोग द्वारा दिनांक 21 अक्टूबर 2023 की अधिसूचना नं. 15- विधि निर्वा.- चार- म.प्र.- वि. स .- 2023 के अनुसरण में, मध्यप्रदेश के 45- पृथ्वीपुर विधान सभा निर्वाचन क्षेत्र के लिए साधारण निर्वाचन 2023 आयोजित किया गया था; और
यतः, लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 78 के अनुसार, किसी निर्वाचन में, निर्वाचन लड़ रहा प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय का लेखा जिला निर्वाचन अधिकारी के पास दाखिल करेगा जो उक्त अधिनियम की धारा 77 के अंतर्गत उसके द्वारा या उसके निर्वाचन अभिकर्ता (एजेंट) द्वारा रखे गए लेखे की एक सत्यप्रति होगी ; और
यतः , मध्यप्रदेश राज्य के 45- पृथ्वीपुर विधान सभा निर्वाचन क्षेत्र के साधारण निर्वाचन, परिणाम रिटर्निंग ऑफिसर द्वारा दिनांक 03 दिसम्बर 2023 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय लेखे दाखिल करने की अन्तिम तारीख 02जनवरी 2024 थी; और
यतः , निर्वाचनों का संचालन नियम , 1961 के नियम 89 के उपनियम (1 ) अंतर्गत, जिला निर्वाचन अधिकारी, निवाड़ी की रिपोर्ट दिनांक 05 जनवरी 2024 , जो मुख्य निर्वाचन अधिकारी , मध्यप्रदेश , भोपाल से दिनांक 07 फरवरी 2024 के पत्र सं. 10- क-4- निर्वा.व्यय - निर्देश- 2023-24-1032 को प्राप्त हुई थी , के अनुसार श्रीमती उमा कुशवाहा जो मध्यप्रदेश राज्य के 45 - पृथ्वीपुर विधान सभा निर्वाचन क्षेत्र , 2023 से निर्वाचन लड़ने वाले अभ्यर्थी है , विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं ; और
यतः, जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उपनियम (5) के अंतर्गत श्रीमती उमा कुशवाहा को अपने निर्वाचन व्यय लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं . 76- मध्यप्रदेश - वि.स.-45-2024 - सी.ई.एम.एस.- III, दिनांक 19 जुलाई 2024 जारी किया गया थाः, और
यतः, उपयुक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उपनियम (6 ) के अनुसार श्रीमती उमा कुशवाहा को व्यय लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पष्ट करते हुए , आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनों के भीतर जिला निर्वाचन अधिकारी , निवाड़ी को अपने निर्वाचन व्यय का पूर्ण लेखा प्रस्तुत करने का निदेश दिया गया था ; और
यतः , जिला निर्वाचन अधिकारी , निवाड़ी से दिनांक 19 फरवरी 2025 के पत्र सं. सामा. निर्वा.-2025 /46 के द्वारा सूचित किया है कि उक्त कारण बताओ नोटिस श्रीमती उमा कुशवाहा के द्वारा दिनांक 11 नवम्बर 2024 को प्राप्त किया गया था; और
यतः, जिला निर्वाचन अधिकारी , निवाड़ी ने पत्र सं. सामा. निर्वा.- ES - 2025 / 96 , दिनांक 11 अप्रैल 2025 के द्वारा प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्रीमती उमा कुशवाहा ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है. इसके अतिरिक्त, उक्त नोटिस की पावती के उपरांत, श्रीमती उमा कुशवाहा ने विधि के अंतर्गत यथा- विहित लेखा दाखिल करने में असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया और न ही कोई स्पष्टीकरण दिया है; और
यतः , लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 10 क में उपबंधित किया गया है कि:-
" यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति
(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; और मध्यप्रदेश राजपत्र, दिनांक 21 मई 2025

(ख) उस असफलता के लिए कोई अच्छा कारण अथवा न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग , शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित होगा. "
यतः, तथ्यों और उपलब्ध रिकार्डों के आधार पर आयोग का यह समाधान हो गया है कि श्रीमती उमा कुशवाहा अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है ; और
अतः , अब , लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10 क के अनुसरण में, भारत निर्वाचन आयोग , एतद्वारा घोषणा करता है कि मध्यप्रदेश राज्य के साधारण निर्वाचन, 2023 के 45- पृथ्वीपुर विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्रीमती उमा कुशवाहा , निवासी-338 , वार्ड नं. 14 , विन्दपुरा , पृथ्वीपुर, जिला निवाड़ी (म.प्र.) -472336, इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने अथवा होने के लिए निरर्हित होंगे.

ORDER
No. 76 - MP - LA - 45-2024 - CEMS - III .- WHEREAS , the General Election to Legislative Assembly of Madhya Pradesh, 2023 for 45 - Prithvipur Assembly Constituency was held in pursuance of the Election Commission of India Notification No. 15- विधि निर्वा. - चार- म.प्र.वि.स.- 2023 , dated 21st October 2023 ; and
WHEREAS , as per Section 78 of the Representation of the People Act , 1951, every contesting candidate at an election shall, within 30 days from the date of election of the returned candidate , lodge with the District Election Officer an account of her election expenses which shall be true copy of the account kept by him or his election agent under Section 77 of the said act; and
WHEREAS, the result of the above - mentioned elections for 45 - Prithvipur Assembly Constituency of Madhya Pradesh was declared by the Retuming Officer on 3rd December 2023 and hence the last date for lodging the account of Election Expenses was 2nd January 2024; and
WHEREAS , as per the District Election Officer's report dated 5th January 2024 forwarded by the Chief Electoral Officer , Madhya Pradesh , Bhopal vide his letter No. 10- क-4 - निर्वा. व्यय -निर्देश -2023-24-1032 , dated 7th February 2024 , under sub - rule ( 1 ) ofRule 89 of the Conduct of Elections Rules , 1961 , Smt. Uma Kushwaha , a contesting candidate from 45 - Prithvipur Assembly Constituency of Madhya Pradesh has failed to lodge her account of election expenses , as required under law; and
WHEREAS, on the basis of the said report of the District Election Officer , Niwari , a Show-Cause notice No. सं . 76- म.प्र.- वि.स.-45-2024- सी.ई.एम.एस.- III, dated 19th July 2024 was issued under sub - rule (5 ) of Rule 89 ofthe Conduct of Elections Rules , 1961, by the Election Commission of India to Smt . Uma Kushwaha for not lodging of her account of Election Expenses ; and
WHEREAS , through the above said Show Cause Notice and under sub -rule ( 6) of Rule 89 of the Conduct of Elections Rules , 1961 , Smt . Uma Kushwaha , was directed to submit representation in writing to the Commis- sion explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Niwari within 20 days from the date of receipt of the Notice; and मध्यप्रदेश राजपत्र, दिनांक 21 मई 2025

WHEREAS , the District Election Officer, Niwari , vide his letter No. सामान्य निर्वाचन - 2025-46 , dated 19th February 2025 it has informed that notice was served to candidate Smt . Uma Kushwaha , on 11th November 2024; and
WHEREAS, the District Election Officer, Niwari in his Supplementary Report , vide its letter No. सामान्य निर्वाचन- ES- 2025-96 , dated 11th April 2025 has reported that Smt . Uma Kushwaha, has not submitted her account of election expenses . Further, after receipt of the said notice , Smt. Uma Kushwaha , has neither furnished any reason nor explanation to the Election Commission of India , for failure to lodge the account as prescribed under law; and
WHEREAS , Section 10 A of the Representation of the People Act , 1951 provides that : -
"If the Election Commission is satisfied that a person-
(a) has failed to lodge an account of election expenses , within the time and in the manner required by or under this Act, and
(b) has no good reason or justification for the failure, the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order. "
WHEREAS, on the basis of facts and available records , the Commission is satisfied that Smt . Uma Kushwaha has failed to lodge her account of election expenses and has no good reason or Justification for the failure to do so; and
NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act , 1951 , the Election Commission of India hereby declares Smt . Uma Kushwaha Residence of 338 , Ward No. 14, Bindpura, Prithvipur , Jila- Niwari (M.P. ) , a contesting candidate in 45 - Prithvipur Assembly Constituency of General Election to the Legislative Assembly of Madhya Pradesh, 2023 , to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

अतः , अब , लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10 क के अनुसरण में , भारत निर्वाचन आयोग , एतद्वारा घोषणा करता है कि मध्यप्रदेश राज्य के साधारण निर्वाचन , 2023 के 45- पृथ्वीपुर विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्री आशीष कुमार रैकवार, निवासी- बरऊआ खेरा ग्राम- सुहागी , पो. भेलसी, तहसील बल्देवगढ़ , जिला टीकमगढ़ (म.प्र. ) . इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने अथवा होने के लिए निरर्हित होंगे.
