मध्यप्रदेश माल और सेवा कर अधिनियम, 2017 ( क्रमांक 19 सन् 2017 ) की धारा 11 की उप-धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और इस विभाग की अधिसूचना क्रमांक एफ-ए -3-35/2017/ 1 /V( 63 ) दिनांक 07 दिसम्बर, 2018 , का अधिक्रमण करते हुए , सिवाय उन बातों के जो ऐसे अधिक्रमण से पहले की गई हैं या करने से छोड़ी गई हैं , राज्य सरकार, यह संतुष्ट होने पर कि लोक हित में ऐसा करना आवश्यक है , परिषद की सिफारिशों पर, एतद्वारा माल की अंतरराज्यीय आपूर्ति को, जिसका विवरण इस अधिसूचना से संलग्न अनुसूची के स्तंभ ( 3 ) में विनिर्दिष्ट है , और जो टैरिफमद , उप- शीर्षक, शीर्षक या अध्याय, जैसा भी मामला हो, के अंतर्गत आता है, जैसा कि उक्त अनुसूची के स्तंभ (2 ) में संबंधित प्रविष्टि में विनिर्दिष्ट है, मध्यप्रदेश माल और सेवा कर अधिनियम, 2017 की धारा 9 के तहत उस पर लगने वाले संपूर्ण राज्य कर से छूट देती है।

स्पष्टीकरण- इस अनुसूची के प्रयोजनों के लिए, -
(क) अभिव्यक्तियाँ, -
(i ) " यूनिट कंटेनर " का अर्थ है एक पैकेज, चाहे बड़ा हो या छोटा ( उदाहरण के लिए, टिन, कैन , बॉक्स , जार, बोतल, बैग , या कार्टन, ड्रम , बैरल, या कनस्तर) जो एक पूर्व- निर्धारित मात्रा या संख्या रखने के लिए डिज़ाइन किया गया है, जो ऐसे पैकेज पर इंगित किया गया है;
(ii) "प्री- पैकेज्ड और लेबल किया हुआ" का अर्थ है वे सभी वस्तुएं जो खुदरा बिक्री के लिए अभिप्रेत हैं और जिनमें 25 किलोग्राम या 25 लीटर से अधिक नहीं है , जो कानूनी माप विज्ञान अधिनियम, 2009 (2010 का 1 ) की धारा 2 के खंड (1 ) में परिभाषित " प्री- पैक्ड" हैं, जहां , जिस पैकेज में वस्तु प्री- पैक्ड है या उस पर सुरक्षित रूप से चिपकाए गए लेबल पर कानूनी माप विज्ञान अधिनियम, 2009 (2010 का 1 ) और उसके तहत बनाए गए नियमों के प्रावधानों के तहत घोषणाएं करना आवश्यक है;
(ii) "टैरिफ आइटम" , "उप- शीर्षक" , " शीर्षक" और " अध्याय " का क्रमशः अर्थ होगा एक टैरिफ आइटम, शीर्षक, उप- शीर्षक और अध्याय जैसा कि सीमा शुल्क टैरिफ अधिनियम, 1975 ( 1975 का 51 ) की पहली अनुसूची में निर्दिष्ट है ;
(iv) "सरकारी इकाई" का अर्थ एक प्राधिकरण या एक बोर्ड या कोई अन्य निकाय होगा जिसमें एक सोसायटी, ट्रस्ट, निगम शामिल है , जो है-
(क ) संसद या राज्य विधानमंडल के एक अधिनियम द्वारा स्थापित; या
(ख )किसी भी सरकार द्वारा स्थापित, मध्यप्रदेश राजपत्र, दिनांक 18 सितम्बर 2025

Explanation. For the purposes of this Schedule , -
(a) the expressions , -
(i) " unit container" means a package , whether large or small ( for example , tin , can, box, jar, bottle , bag , or carton , drum , barrel , or canister) designed to hold a pre -determined quantity or number , which is indicated on such package;
( ii ) " pre-packaged and labelled " means all commodities that are intended for retail sale and containing not more than 25 kg or 25 litre , which are " pre- packed " as defined in clause ( 1 ) of section 2 of the Legal Metrology Act , 2009 ( 1 of 2010) where , the package in which the commodity is pre - packed or a label securely affixed thereto is required to bear the declarations under the provisions of the Legal Metrology Act , 2009 ( 1 of 2010) and the rules made thereunder ;
(iii) "tariff item" , " sub- heading " "heading " and "Chapter " shall mean respectively a tariff item , heading , sub - heading and Chapter as specified in the First Schedule to the Customs Tariff Act , 1975 ( 51 of 1975);
(iv) "Government entity " shall mean an authority or a board or any other body including a society, trust, corporation , which is- (a) set up by an Act of Parliament or State Legislature ; or

with 90 percent or more participation by way of equity or control, to carry out a function entrusted by the Central Government , State government , Union territory or a local authority ;

2. This notification shall come into force with effect from the 22nd day of September, 2025.
