मध्यप्रदेश माल और सेवा कर अधिनियम , 2017 ( क्रमांक 19 सन् 2017 ) की धारा 9 की उप- धारा (3 ) और उप- धारा (4) , धारा 11 की उप- धारा ( 1 ) , धारा 15 की उप- धारा (5) और धारा 148 के तहत प्रदत्त शक्तियों का प्रयोग करते हुए , राज्य सरकार, इस बात से संतुष्ट होते हुए कि ऐसा करना *जनहित में आवश्यक है और जीएसटी परिषद की सिफारिशों के आधार पर, एतद्वारा, इस विभाग की अधिसूचना क्रमांक एफ ए -3-42/ 2017/1/ पांच ( 53) 18 अक्टूबर , 2017 , में और आगे भी निम्नलिखित संशोधन करती है, यथा: -
उक्त अधिसूचना में, -
(क)मारणीमें, -
(i ) क्रमः संख्या 18 के समक्ष, स्तंभ (3 ) में, खंड (ख) के पश्चात्, निम्नलिखित स्पष्टीकरण अंतःस्थापित किया जाएगा, अर्थात्ः-
"म्पष्टीकरण.- इस प्रविष्टि में निहित कोई भी बात निम्नलिखित पर लागू नहीं होगी:
(i ) किसी इलेक्ट्रॉनिक कॉमर्स ऑपरेटर द्वारा प्रदान की जाने वाली म्थानीय वितरण सेवाएँ; या (ii) किमी इलेक्ट्रॉनिक कॉमर्स ऑपरेटर के माध्यम से प्रदान की जाने वाली स्थानीय वितरण मेवाएँ। ";

म्पष्टीकरणः शंकाओं के निवारण हेतु , यह स्पष्ट किया जाना है किः
क. यह छूट उस बीमा अनुबंध पर लागू होगी जहाँ बीमिन एक व्यक्ति है, या एक व्यक्ति और उसका परिवार है ।
ख. उपर्युक्त ( क) के प्रयोजनों के लिए , परिवार में बीमा अनुबंध में परिवार के रूप में बीमित सभी व्यक्ति शामिल होंगे।

स्पष्टीकरणः शंकाओं के निवारण हेतु , यह स्पष्ट किया जाता है किः
क. यह छूट उस बीमा अनुबंध पर लागू होगी जहां बीमित एक व्यक्ति या एक व्यक्ति और उसका परिवार है।
ख. उपर्युक्त ( क) के प्रयोजनों के लिए , परिवार में बीमा अनुबंध में परिवार के रूप में बीमित सभी व्यक्ति शामिल होंगे।

क्रम संख्या 36ग या 36घ में निर्दिष्ट बीमा सेवाओं का पुनर्वीमा।
(ख) पैरा 2 में,
( i) खंड (जैडई ) के स्थान पर निम्नलिखित को अंतः स्थापित किया जाएगा , अर्थात्ः-
"(जैडई) ' माल परिवहन एजेंसी' मे तात्पर्य ऐसे किसी व्यक्ति से है जो सड़क मार्ग मे माल के परिवहन के संबंध में सेवा प्रदान करता है और किसी भी नाम से माल भेजने का नोट जारी करता
है , किन्तु इसमें शामिल नहीं है: - 528(1)

(i ) कोई इलेक्ट्रॉनिक कॉमर्स ऑपरेटर जिसके द्वारा स्थानीय वितरण की सेवाएं प्रदान की जाती हैं, ( ii ) कोई इलेक्ट्रॉनिक कॉमर्स ऑपरेटर जिसके माध्यम से स्थानीय वितरण की सेवाएं प्रदान की जानी हैं" ;
(ii ) खंड (जैडएफए ) के पश्चात् निम्नलिखित खंड अंतः स्थापित किया जाएगा, अर्थात्ः-
"(जैडएफबी) ऊपर तालिका में क्रम संख्या 36 ग और 36 घ की प्रविष्टियों के प्रयोजनों के लिए , ' समूह' का अर्थ ऐसे व्यक्तियों का समूह है जो बीमा प्राप्म करने के अलावा एक समान उद्देश्य से या एक ममान आर्थिक गतिविधि में मंलग्न होने के लिए एक साथ आते हैं , और इसमें शामिल हैं:
क. नियोक्ता-कर्मचारी समूह , जहाँ मास्टर/ समूह पॉलिसीधारक और समूह के सदस्यों के बीच , लागू कानूनों के अनुमार, नियोक्ता- कर्मचारी संबंध विद्यमान हो;
ख. गैर - नियोक्ता-कर्मचारी समूह, जहाँ बीमा के अलावा अन्य सेवाओं /गतिविधियों के लिए मास्टर/ समूह पॉलिसीधारक और समूह के सदस्यों के बीच स्पष्ट संबंध विद्यमान हो । " ;
(iii ) खंड (जैडजी) के बाद , निम्नलिखित खंड अंतः स्थापित किया जाएगा, अर्थात्ः -
" (जैडजीए ) ' म्वाम्थ्य बीमा व्यवसाय' का अर्थ ऐसे अनुबंधों का कार्यान्वयन है जो रूग्णता लाभ या चिकित्सा, शल्य चिकित्सा या अस्पताल व्यय लाभ, चाहे वे आंतरिक रोगी हों या बाह्य रोगी, यात्रा कवर और व्यक्तिगत दुर्घटना कवर प्रदान करते हैं; " ।
2. यह अधिसूचना दिनांक 22 सितंबर , 2025 से लागू होगी।

क्र. एफ ए- 3-42-2017-1- पांच. भारत के संविधान के अनुच्छेद 348 के खण्ड (3) के अनुसरण में, इस आशय की अधिसूचना क्रमांक एफ ए- 3-42-2017-1- पांच (30) , दिनांक 18 सितम्बर 2025 का अंग्रेजी अनुवाद राज्यपाल के प्राधिकार से एतद्वारा प्रकाशित किया जाता है.
मध्यप्रदेश के राज्यपाल के नाम से तथा आदेशानुसार, वन्दना शर्मा , उपसचिव.

Bhopal , the 18th September 2025 No. F A-3-42-2017-1 -V- (30)
In exercise of the powers conferred by sub - sections (3 ) and (4) of section 9 , sub- section ( 1 ) of section 11. sub - section ( 5 ) of section 15 and section 148 of the Madhya Pradesh Goods and Services Tax Act, 2017 ( 19 of 2017 ) , the State Government, on being satisfied that it is necessary in the public interest so to do, on the recommendations of the Council , hereby makes the following further amendments in this department notification No. F A- 3-42/ 2017 / 1 /V ( 53 ) dated the 30th June , 2017, namely :--
In the said notification , -
(a) In the table , -
(i) against serial number 18 , in column ( 3 ) , after clause ( b) , the following explanation shall be inserted , namely: -
"Explanation . - Nothing contained in this entry shall apply to:
(i) local delivery services provided by an Electronic Commerce Operator ; or
(ii) local delivery services provided through an Electronic Commerce Operator . " ;
( ii ) after serial number 36B and the entries relating thereto, the following serial numbers and entries relating thereto shall be inserted , namely: -

Explanation: For the removal of doubts , it ishereby clarified that:
a. This exemption shall apply to a contract of insurance where the insured is an individual , or an individual and family of the said individual .
b. For the purposes of ( a) above . family shall include all individuals
insured as family in the contract of insurance.

(b) in paragraph 2,
( i ) for clause (ze ) , the following shall be substituted , namely: -
" (ze) goods transport agency ' means any person who provides service in relation to transport of goods by road and issues a consignment note by whatever name called, but does not include
(i) an electronic commerce operator by whom the services of local delivery are provided , ( ii ) an electronic commerce operator through whom the services of local delivery are provided" ;
(ii ) after clause ( zfa ), the following clause shall be inserted , namely: -
"( zfb ) For the purposes of entries at serial numbers 36C and 36D in the table above , ' group ' means group of persons who join together with a commonality of purpose or for engaging in a common economic activity , other than availing insurance , and includes :
a . Employer- employee groups , where an employer - employee relationship exists between the master /group policyholder and the members of the group in accordance with the applicable laws;
b . Non employer- employee groups , where a clearly evident relationship exists between the master/group policyholder and the members of the group, for services / activities other than insurance." ;
( iii ) after clause ( zg ) , the following clause shall be inserted , namely : -
"( zga) health insurance business ' means the effecting of contracts which provide for sickness benefits or medical , surgical or hospital expense benefits , whether in- patient or out- patient , travel cover and personal accident cover ; " .
2. This notification shall come into force with effect from the 22nd day of September , 2025.
