फा. क्र. 10 - क-चार निरर्हित - 2025-78.- भारत निर्वाचन आयोग के निम्नांकित आदेश को सर्वसाधारण की जानकारी के लिए प्रकाशित किया जाता है : -

आदेश
सं. 76- मध्यप्रदेश -वि.स.- 152-2024- सी.ई.एम.एस.- III.- यतः , भारत निर्वाचन आयोग द्वारा दिनांक 21 अक्टूबर 2023 की अधिसूचना नं. 15 विधि निर्वा.- चार- म.प्र.- वि.स. 2023 के अनुसरण में , मध्यप्रदेश के लिए साधारण निर्वाचन 2023 आयोजित किया गया था; और
यतः , लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 78 के अनुसार, किसी निर्वाचन में , निर्वाचन लड़ रहा प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय का लेखा जिला

निर्वाचन अधिकारी के पास दाखिल करेगा जो उक्त अधिनियम की धारा 77 के अंतर्गत उसके द्वारा या उसके निर्वाचन अभिकर्ता (एजेंट) द्वारा रखे गए लेखे की एक सत्यप्रति होगी; और
यतः , मध्यप्रदेश राज्य के 152 - भोपाल दक्षिण पश्चिम विधान सभा निर्वाचन क्षेत्र के साधारण निर्वाचन , 2023 का परिणाम रिटर्निंग ऑफिसर द्वारा दिनांक 03 दिसम्बर 2023 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय लेखे दाखिल करने की अन्तिम तारीख 02 जनवरी 2024 थी; और
यतः , निर्वाचनों का संचालन नियम , 1961 के नियम 89 के उपनियम (1 ) के अंतर्गत , जिला निर्वाचन अधिकारी , भोपाल की रिपोर्ट दिनांक 05 जनवरी 2024 , जो मुख्य निर्वाचन अधिकारी , मध्यप्रदेश, भोपाल से दिनांक 07 फरवरी 2024 के पत्र सं. 10 - क - 4 - निर्वा.व्यय - निर्देश - 2023-24-1032 के द्वारा प्राप्त हुई थी, के अनुसार एडवोकेट सुधीर उबनारे जो मध्यप्रदेश राज्य के 152 – भोपाल दक्षिण पश्चिम विधान सभा निर्वाचन क्षेत्र , 2023 से निर्वाचन लड़ने वाले अभ्यर्थी है , विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय लेखा दाखिल करने में असफल रहे हैं; और यतः , जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम , 1961 के नियम 89 के उपनियम (5 ) के अंतर्गत एडवोकेट सुधीर उबनारे को अपने निर्वाचन व्यय का लेखा अपेक्षित रीति से प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76- मध्यप्रदेश - वि.स.- 152-2024 - सी. ई.एम.एस.- III , दिनांक 9 जुलाई 2025 जारी किया गया था; और
यतः , उपयुक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम , 1961 के नियम 89 के उपनियम (6 ) के अनुसार एडवोकेट सुधीर उबनारे को निर्वाचन व्यय का लेखा अपेक्षित रीति से प्रस्तुत न किए जाने संबंधी कारणों को स्पष्ट करते हुए , आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनों के भीतर जिला निर्वाचन अधिकारी , भोपाल को अपने निर्वाचन व्यय का पूर्ण लेखा प्रस्तुत करने का निदेश दिया गया था; और
यतः , जिला निर्वाचन अधिकारी, भोपाल ने दिनांक 28 अगस्त 2025 के पत्र सं.- 1030- विधान सभा निर्वाचन- 2023-2025 के द्वारा सूचित किया है कि उक्त कारण बताओ नोटिस एडवोकेट सुधीर उबनारे के द्वारा दिनांक 22 जुलाई 2025 को स्वयं प्राप्त किया गया था; और
यतः , जिला निर्वाचन अधिकारी, भोपाल ने पत्र सं.- 1030- विधान सभा निर्वाचन- 2023-2025 , दिनांक 28 अगस्त 2025 के द्वारा प्रस्तुतं की गई अनुपूरक रिपोर्ट में यह बताया गया है कि एडवोकेट सुधीर उबनारे ने अपेक्षित वाउचर प्रस्तुत नहीं किये हैं . इसके अतिरिक्त , उक्त नोटिस की पावती के उपरांत , एडवोकेट सुधीर उबनारे ने विधि के अन्तर्गत यथा विहित लेखा अपेक्षित रीति में दाखिल करने में असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया और न ही कोई स्पष्टीकरण दिया है ; और
यतः , लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 10 क में उपबंधित किया गया है कि :-
"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-
(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; और
(ख ) उस असफलता के लिए कोई अच्छा कारण अथवा न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग , शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित होगा.
यतः , तथ्यों और उपलब्ध रिकार्डों के आधार पर आयोग का यह समाधान हो गया है कि एडवोकेट सुधीर उबनारे अपने निर्वाचन व्यय का लेखा अपेक्षित रीति से दाखिल करने में असफल रहे हैं उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है ; और मध्यप्रदेश राजपत्र, दिनांक 29 सितम्बर 2025

अतः , अब, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10 क के अनुसरण में , भारत निर्वाचन आयोग , एतद्वारा घोषणा करता है कि मध्यप्रदेश राज्य के साधारण निर्वाचन , 2023 के 152 - भोपाल दक्षिण- पश्चिम विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी एडवोकेट सुधीर उबनारे , निवासी बी -21 , जनता क्वार्टर , गौतम नगर , गोविन्दपुरा , भोपाल , मध्यप्रदेश , इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने अथवा होने के लिए निरर्हित होंगे .

ORDER
No. 76 - MP - LA - 152-2024 - CEMS - III . - WHEREAS , the General Election to Legislative Assembly of Madhya Pradesh, 2023 was held in pursuance of the Election Commission of India Notification No. 15 - विधि निर्वा .- चार- म.प्र.वि.स. 2023 , dated 21st October 2023 ; and
WHEREAS , as per Section 78 of the Representation of the People Act , 1951 , every contesting candidate at an election shall , within 30 days from the date of election of the returned candidate , lodge with the District Election Officer an account of his election expenses which shall be true copy of the account kept by him or his election agent under section 77 of the said act; and
WHEREAS , the result of the above - mentioned elections for 152 - Bhopal Dakshin - Pashim Assembly Constituency of Madhya Pradesh was declared by the Retuming Officer on 3rd December 2023 and hence the last date for lodging the account of Election Expenses was 2nd January 2024 ; and
WHEREAS , as per the District Election Officer's report dated 5th January 2024 forwarded by the Chief Electoral Officer, Madhya Pradesh, Bhopal vide his letter No. 10- क-4-निर्वा. व्यय - निर्देश- 2023-24-1032 , dated 7th February 2024 , under sub - rule ( 1 ) of Rule 89 of the Conduct of Elections Rules , 1961 , Advocate Sudhir Ubnare , a contesting candidate from 152 - Bhopal Dakshin - Pashim Assembly Constituency of Madhya Pradesh has failed to lodge his account of election expenses , in the manner as required under law; and
WHEREAS , on the basis of the said report of the District Election Officer, Bhopal , a Show -Cause notice No. सं. 76- मध्यप्रदेश - वि.स.- 152-2024- सी.ई.एम.एस.- III , dated 9th July 2025 was issued under sub - rule ( 5) of Rule 89 of the Conduct of Elections Rules , 1961 , by the Election Commission of India to Advocate Sudhir Ubnare for not lodging of his account of Election Expenses in the manner as required under law ; and मध्यप्रदेश राजपत्र, दिनांक 29 सितम्बर 2025

WHEREAS , through the above said Show Cause Notice and under sub - rule (6) of Rule 89 of the Conduct of Elections Rules , 1961 , Advocate Sudhir Ubnare , was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account in the manner as required under law and also to lodge account of election expenses with the District Election Officer, Bhopal within 20 days from the date of receipt of the Notice ; and
WHEREAS , the District Election Officer, Bhopal , vide his letter No. 1030- विधान सभा निर्वाचन- 2023-2025 , dated 28th August 2025 , has informed that the show cause notice was served to candidate Advocate Sudhir Ubnare , on 22nd July 2025 ; and
WHEREAS , the District Election Officer, Bhoapl in his Supplementary Report , vide its letter No. 1030 - विधान सभा निर्वाचन - 2023-2025 , dated 28th August 2025 has reported that Advocate Sudhir Ubnare , has not submitted requisite vouchers in respet of election expenses . Besides , after receipt of the said notice , Advocate Sudhir Ubnare , has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account of election expenses in the manner as prescribed under law ; and
WHEREAS , Section 10 A of the Representation of the People Act , 1951 provides that : -
" If the Election Commission is satisfied that a person-
(a) has failed to lodge an account of election expenses , within the time and in the manner required by or under this Act, and
(b) has no good reason or justification for the failure , the Election Commission shall , by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order. "
WHEREAS , on the basis of facts and available records , the Commission is satisfied that Advocate Sudhir Ubnare has failed to lodge his account of election expenses in the manner as required under law and has no good reason or justification for the failure to do so ; and
NOW, THEREFORE , in pursuance of Section 10A of the Representation of the People Act , 1951 , the Election Commission of India hereby declares Advocate Sudhir Ubnare resident of B - 21 , Janta Quarters , Gautam Nagar , Govindpura , Bhopal . Madhya Pradesh , a contesting candidate in 152 - Bhopal Dakshin Pashchim Assembly Constituency of General Election to the Legislative Assembly of Madhya Pradesh, 2023 , to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legisla- tive Council of a State or Union Territory for a period of three years from the date of this order.
