फा. क्र. 10- क- चार निरर्हित-2025-80.- भारत निर्वाचन आयोग के निम्नांकित आदेश को सर्वसाधारण की जानकारी के लिए प्रकाशित किया जाता है: --
1. भारत निर्वाचन आयोग का आदेश क्र. 76- मध्यप्रदेश लो.स. 11-2024- सी.ई.एम.एस.-III , दिनांक 30 सितम्बर 2025.

सं. 76- मध्यप्रदेश- लो.स. 11-2024- सी.ई.एम.एस.- III.- यतः, भारत निर्वाचन आयोग द्वारा दिनांक 20 मार्च 2024 की अधिसूचना नं. आ.अ. 59 (अ ) के अनुसरण में, मध्यप्रदेश के लिए साधारण निर्वाचन 2024 आयोजित किया गया था; और

यतः, लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 78 के अनुसार, किसी निर्वाचन में, निर्वाचन लड़ रहा प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय का लेखा जिला निर्वाचन अधिकारी के पास दाखिल करेगा जो उक्त अधिनियम की धारा 77 के अंतर्गत उसके द्वारा या उसके निर्वाचन अभिकर्ता ( एजेंट) द्वारा रखे गए लेखे की एक सत्य प्रति होगी; और
यतः , मध्यप्रदेश के 11 सीधी लोक सभा निर्वाचन क्षेत्र साधारण निर्वाचन, 2024 का परिणाम रिटर्निंग ऑफिसर द्वारा दिनांक 04 जून 2024 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय लेखे दाखिल करने की अन्तिम तारीख 04 जुलाई 2024 थी; और
यतः, निर्वाचनों का संचालन नियम , 1961 के नियम 89 के उपनियम (1 ) के अंतर्गत, जिला निर्वाचन अधिकारी , सीधी की रिपोर्ट दिनांक 05 जुलाई 2024 , जो मुख्य निर्वाचन अधिकारी , मध्यप्रदेश , भोपाल से दिनांक 24 जुलाई 2024 के पत्र सं. 10 - क- 4- निर्वा .व्यय- निर्देश-2024 के द्वारा प्राप्त हुई थी, के अनुसार श्रीमती तारा देवी सिंह जो मध्यप्रदेश के 11 सीधी संसदीय निर्वाचन क्षेत्र, 2024 से निर्वाचन लड़ने वाली अभ्यर्थी हैं , विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का लेखा दाखिल करने में असफल रहीं हैं; और
यतः , जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम , 1961 के नियम 89 के उपनियम (5) के अंतर्गत श्रीमती तारा देवी सिंह को अपने निर्वाचन व्यय का लेखा प्रस्तुत नहीं करने के कारण बताओ नोटिस सं . 76- मध्यप्रदेश- लो.स.- 11-2024- सी.ई.एम.एस.- III , दिनांक 29 अगस्त 2024 जारी किया गया था; और
यतः, उपयुक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उपनियम (6) के अंतर्गत श्रीमती तारा देवी सिंह को निर्वाचन व्यय का लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पष्ट करते हुए , आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनों के भीतर जिला निर्वाचन अधिकारी , सीधी को अपने निर्वाचन व्यय का पूर्ण लेखा प्रस्तुत करने का निदेश दिया गया था; और
यतः, जिला निर्वाचन अधिकारी , सीधी से दिनांक 28 जुलाई 2025 के पत्र सं.- 424-निर्वाचन व्यय लेखा -2025 में सूचित किया है कि उक्त कारण बताओ नोटिस अभ्यर्थी , श्रीमती तारा देवी सिंह द्वारा दिनांक 18 सितम्बर 2024 को प्राप्त किया था; और
यतः , जिला निर्वाचन अधिकारी , सीधी ने पत्र सं. - 424- निर्वाचन- व्यय लेखा -2025 , दिनांक 28 जुलाई 2025 के द्वारा प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्रीमती तारा देवी सिंह ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है. इसके अतिरिक्त, उक्त नोटिस की पावती के उपरांत, श्रीमती तारा देवी सिंह ने विधि के अन्तर्गत यथा विहित लेखा दाखिल करने में असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया और न ही कोई स्पष्टीकरण दिया है; और
यतः , लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10 क में उपबंधित किया गया है कि:-
"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-
(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है , दाखिल करने में असफल रहा है ; और
(ख) उस असफलता के लिए कोई अच्छा कारण अथवा न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग , शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित होगा.

यतः, तथ्यों और उपलब्ध रिकार्डों के आधार पर आयोग का यह समाधान हो गया है कि श्रीमती तारा देवी सिंह अपने निर्वाचन व्यय का लेखा दाखिल करने में असफल रही हैं उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और
अतः , अब, लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 10क के अनुसरण में, भारत निर्वाचन आयोग , एतद्वारा घोषणा करता है कि मध्यप्रदेश राज्य के साधारण निर्वाचन, 2023 के 11 - सीधी संसदीय निर्वाचन क्षेत्र से निर्वाचन लड़ने वाली अभ्यर्थी श्रीमती तारा देवी सिंह , निवासी 290 , वार्ड नं. 23 नवानगर, जिला - सिंगरौली , मध्यप्रदेश , इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने अथवा होने के लिए निरर्हित होंगी .

ORDER
No. 76- MP - PC - 11-2024 - CEMS - III - WHEREAS , the General Election to Lok Sabha of Madhya Pradesh , 2024 was held in pursuance of the Election Commission of India Notification No. आ.अ. 59 (अ) , dated 20th March 2024; and
WHEREAS , as per Section 78 of the Representation of the People Act , 1951 , every contesting candidate at an election shall , within 30 days from the date of election of the returned candidate , lodge with the District Election Officer an account of his election expenses which shall be true copy of the account kept by him or his election agent under Section 77 of the said act; and
WHEREAS , the result of the above - mentioned Elections for 11 - Sidhi Parliamentary Constituency of Madhya Pradesh was declared by the Returning Officer on 4th June 2024 and hence the last date for lodging the account of Election Expenses was 4th July 2024; and
WHEREAS , as per the District Election Officer's report dated 5th July 2024 forwarded by the Chief Electoral Officer, Madhya Pradesh , Bhopal vide his letter No.10-क-4--निर्वा. व्यय-निर्देश- 2024, dated 24th July 2024, under sub - rule ( 1 ) of Rule 89 of the Conduct of Elections Rules , 1961 , Smt . Tara Devi Singh , a contesting candidate from 11 - Sidhi Parliamentary Constituency of Madhya Pradesh has failed to lodge her account of election expenses , as required under law; and
WHEREAS , on the basis of the said report of the District Election Officer, Sidhi , a Show- Cause notice No. सं. 76- मध्यप्रदेश - वि.स. 11-2024- सी.ई.एम.एस.- III , dated 29th August 2024 was issued under sub - rule (5) of Rule 89 of the Conduct of Elections Rules , 1961 , by the Election 554(2)

Commission of India to Smt . Tara Devi Singh for not lodging of her account of Election Expenses ; and
WHEREAS , through the above said Show Cause Notice and under sub - rule (6) of Rule 89 of the Conduct of Elections Rules , 1961 , Smt . Tara Devi Singh , was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer , Sidhi within 20 days from the date of receipt of the Notice ; and
WHEREAS , the District Election Officer , Sidhi , vide his letter No. 424- निर्वाचन - व्यय लेखा-2025 , dated 28th July 2025 , it has informed that notice was served to candidate Smt . Tara Devi Singh , on 18th September 2024 ; and
WHEREAS , the District Election Officer , Sidhi in his Supplementary Report , vide its letter No. 424 - निर्वाचन- व्यय लेखा-2025 , dated 28th July 2025 has reported that Smt . Tara Devi Singh , has not submitted her account of election expenses . Further , after receipt of the said notice , Smt . Tara Devi Singh, has neither furnished any reason nor explanation to the Election Commission of India , for failure to lodge the account as prescribed under law; and
WHEREAS , Section 10 A of the Representation of the People Act, 1951 provides that: -
" If the Election Commission is satisfied that a person-
(a) has failed to lodge an account of Election expenses , within the time and in the manner required by or under this Act, and
(b) has no good reason or justification for the failure , the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order. "
WHEREAS , on the basis of facts and available records , the Commission is satisfied that Smt . Tara Devi Singh has failed to lodge her account of election expenses and has no good reason or justification for the failure to do so ; and
NOW, THEREFORE , in pursuance of Section 10A of the Representation of the People Act, 1951 , the Election Commission of India hereby declares Smt . Tara Devi Singh resident of 290, Ward No. 23 Nawanager , District - Singrauli , Madhya Pradesh , a contesting candidate in 11 - Sidhi Parliamentary Constituency of General Election to the Lok Sabha of Madhya Pradesh , 2024 , to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order .

स्पष्टीकरण दिया है; और
यतः, लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 10 क में उपबंधित किया गया है कि:-
"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-
(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है , दाखिल करने में असफल रहा है; और

Mahendra Bhaiya, has not submitted his account of election expenses . Further, after receipt of the said notice , Sh . Mahendra Bhaiya , has neither furnished any reason nor explanation to the Election Commission of India , for failure to lodge the account as prescribed under law; and
WHEREAS , Section 10 A of the Representation of the People Act , 1951 provides that : -
