फा. क्र. 10 - क- चार - निरर्हित - 2025-82.- भारत निर्वाचन आयोग के निम्नांकित आदेशों को सर्वसाधारण की जानकारी के लिए प्रकाशित किया जाता है : -

1. आदेश क्र. 76 - मध्यप्रदेश - वि.स.- 20-2024 - सी.ई.एम.एस. - III , दिनांक 30 सितम्बर 2025.

सं. 76- मध्यप्रदेश- वि.स.- 20-2024- सी.ई.एम.एस.- III. - यतः , भारत निर्वाचन आयोग द्वारा दिनांक 21 अक्टूबर 2023 की अधिसूचना नं. 15 विधि निर्वा.- चार- म.प्र.वि.स. - 2023 के अनुसरण में, मध्यप्रदेश के लिए साधारण निर्वाचन 2023 आयोजित किया गया था; और

यतः, लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 78 के अनुसार , किसी निर्वाचन में, निर्वाचन लड़ रहा प्रत्येक अभ्यर्थी , निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय का लेखा जिला निर्वाचन अधिकारी के पास दाखिल करेगा जो उक्त अधिनियम की धारा 77 के अंतर्गत उसके द्वारा या उसके निर्वाचन अभिकर्ता (एजेंट) द्वारा रखे गए लेखे की एक सत्यप्रति होगी; और

यतः , मध्यप्रदेश राज्य के 20 - सेवढा विधान सभा निर्वाचन क्षेत्र के साधारण निर्वाचन , 2023 का परिणाम रिटर्निंग ऑफिसर द्वारा दिनांक 03 दिसम्बर 2023 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय लेखे दाखिल करने की अन्तिम तारीख 02 जनवरी 2024 थी; और

यतः , निर्वाचनों का संचालन नियम , 1961 के नियम 89 के उपनियम ( 1 ) अंतर्गत , जिला निर्वाचन अधिकारी , दतिया की रिपोर्ट दिनांक 05 जनवरी 2024 , जो मुख्य निर्वाचन अधिकारी, मध्यप्रदेश, भोपाल से दिनांक 07 फरवरी 2024 के पत्र सं . 10 - क- 4 - निर्वा.व्यय -निर्देश - 2023-24-1032 के द्वारा प्राप्त हुई थी, के अनुसार श्री लाखन सिंह यादव जो मध्यप्रदेश राज्य के 20 - सेवढा विधान सभा निर्वाचन क्षेत्र, 2023 से निर्वाचन लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय लेखा दाखिल करने में असफल रहे हैं ; और

यतः , जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उपनियम (5 ) के अंतर्गत श्री लाखन सिंह यादव को अपने निर्वाचन व्यय का लेखा प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76- मध्यप्रदेश - वि.स.- 20-2024 - सी.ई.एम.एस.- III , दिनांक 19 जुलाई 2024 जारी किया गया था; और

यतः, उपयुक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम , 1961 के नियम 89 के उपनियम (6 ) के अनुसार श्री लाखन सिंह यादव को निर्वाचन व्यय का लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पष्ट करते हुए, आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनों के भीतर जिला निर्वाचन अधिकारी , दतिया को अपने निर्वाचन व्यय का पूर्ण लेखा प्रस्तुत करने का निदेश दिया गया था; और

यतः , जिला निर्वाचन अधिकारी , दतिया से दिनांक 4 जुलाई 2025 के पत्र सं. सामा . निर्वा.-तामील- 2025-359 के द्वारा सूचित किया है कि उक्त कारण बताओ नोटिस श्री लाखन सिंह यादव के द्वारा दिए गए पते पर दिनांक 25 जून 2025 को चस्पा किया गया था; और

यतः, जिला निर्वाचन अधिकारी , दतिया ने पत्र सं.- निर्वा. व्यय पूरक रिपोर्ट- 2023-24-379 , दिनांक 30 जुलाई 2025 के द्वारा प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री लाखन सिंह यादव ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है . इसके अतिरिक्त, उक्त नोटिस की पावती के उपरांत, श्री लाखन सिंह यादव ने विधि के अन्तर्गत यथा विहित लेखा दाखिल करने में असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया और न ही कोई स्पष्टीकरण दिया है ; और

यतः, लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 10 क में उपबंधित किया गया है कि:-

"यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है , दाखिल करने में असफल रहा है ; और

(ख) उस असफलता के लिए कोई अच्छा कारण अथवा न्यायोचित्य नहीं रखता है , तो निर्वाचन आयोग , शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित होगा.

यतः , तथ्यों और उपलब्ध रिकार्डों के आधार पर आयोग का यह समाधान हो गया है कि श्री लाखन सिंह यादव अपने निर्वाचन व्यय का लेखा दाखिल करने में असफल रहे हैं उनके पास ऐसा करने में असफल रहने के 556 (1)

लिए कोई भी उचित कारण अथवा औचित्य नहीं है ; और

अतः, अब , लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 10 क के अनुसरण में, भारत निर्वाचन आयोग , एतद्वारा घोषणा करता है कि मध्यप्रदेश राज्य के साधारण निर्वाचन , 2023 के 20 - सेवढा विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्री लाखन सिंह यादव, निवासी 170 , सेवढा रोड, बालाजी पुरम , इंदरगढ़ , तह. - इंदरगढ़ , जिला दतिया, मध्यप्रदेश, इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने अथवा होने के लिए निरर्हित होंगे.

No. 76 - MP - LA - 20-2024 - CEMS - III . - WHEREAS , the General Election to Legislative Assembly of Madhya Pradesh , 2023 was held in pursuance of the Election Commission of India Notification No. 15- विधि निर्वा- चार- म.प्र.वि.स. 2023 , dated 21st October 2023 ; and

WHEREAS , as per Section 78 of the Representation of the People Act , 1951 , every contesting candidate at an election shall , within 30 days from the date of election of the returned candidate , lodge with the District Election Officer an account of his election expenses which shall be true copy of the account kept by him or his election agent under Section 77 of the said act; and

WHEREAS , as per the District Election Officer's report dated 5th January 2024 forwarded by the Chief Electoral Officer, Madhya Pradesh, Bhopal vide his letter No. 10-क-4- निर्वा. व्यय - निर्देश- 2023-24-1032 , dated 7th February 2024, under sub - rule (1 ) of Rule 89 of the Conduct of Elections Rules , 1961 , Sh . Lakhan Singh Yadav, a contesting candidate from 20 - Sewda Assembly Constituency of Madhya Pradesh has failed to lodge his account of election expenses , as required under law ; and

WHEREAS , through the above said Show Cause Notice and under sub - rule ( 6) of Rule 89 of the Conduct of Elections Rules , 1961 , Sh . Lakhan Singh Yadav, was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Datia within 20 days from the date of receipt of the Notice ; and

WHEREAS , the District Election Officer, Datia , vide his letter No. सामा . निर्वा. -तामील- 2025-359 , dated 4th July 2025 it has informed that notice was pasted at the address given by the candidate Shri Lakhan Singh Yadav, on 25th June 2025 ; and

WHEREAS , the District Election Officer , Datia in his Supplementary Report , vide its letter No. निर्वा . व्यय पूरक रिपोर्ट- 2023-24-379 , dated 30th July 2025 has reported that Sh . Lakhan Singh Yadav, has not submitted his account of election expenses . further, after receipt of the said notice , Sh. Lakhan Singh Yadav, has neither furnished any reason nor explanation to the Election Commission of India , for failure to lodge the account as prescribed under law ; and

WHEREAS , Section 10 A of the Representation of the People Act, 1951 provides that : -

" If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses , within the time and in the manner required by or under this Act, and

(b) has no good reason justification for the failure , the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order. "

WHEREAS , on the basis of facts and available records , the Commission is satisfied that Sh . Lakhan Singh Yadav has failed to lodge his account of election expenses and has no good reason or justification for the failure to do so ; and

NOW, THEREFORE , in pursuance of Section 10A of the Representation of the People Act, 1951 , the Election Commission of India hereby declares Sh . Lakhan Singh Yadav resident of 170 , Sewda Road , Balaji Puram , Indergarh , Teh. Indergarh, Jila Datia , Madhya Pradesh , a contesting candidate in 20 - Sewda Assembly Constituency of General Election to the Legislative Assembly of Madhya Pradesh , 2023 , to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

यतः , लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 10 क में उपबंधित किया गया है कि :-

अतः, अब , लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 10 क के अनुसरण में , भारत निर्वाचन आयोग , एतद्वारा घोषणा करता है कि मध्यप्रदेश राज्य के साधारण निर्वाचन , 2023 के 20 - सेवढा विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्री राजेश सिंह , निवासी- ग्राम ऊचिया , जिला दतिया, इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने अथवा होने के लिए निरर्हित होंगे.

Rajesh Singh , a contesting candidate from 20 - Sewda Assembly Constituency of Madhya Pradesh has failed to lodge his account of election expenses , as required under law ; and WHEREAS , on the basis of the said report of the District Election Officer , Datia , a Show - Cause notice No. सं. 76- मध्यप्रदेश - वि.स. - 20-2024 - सी.ई.एम.एस.- III , dated 19th July 2024 was issued under sub - rule ( 5) of Rule 89 of the Conduct of Elections Rules , 1961 , by the Election Commission of India to Sh . Rajesh Singh for not lodging of his account of Election Expenses ; and WHEREAS , through the above said Show Cause Notice and under sub -rule ( 6) of Rule 89 ofthe Conduct of Elections Rules , 1961 , Sh . Rajesh Singh , was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Datia within 20 days from the date of receipt of the Notice ; and WHEREAS , the District Election Officer , Datia , vide his letter No. सामा. निर्वा.- तामील -2025-359 , dated 4th July 2025 , has informed that the notice was received by the candidate's wife Smt . Poonam , on 26th June 2025 ; and

WHEREAS , the District Election Officer, Datia in his Supplementary Report , vide its letter No. निर्वा. व्यय पूरक रिपोर्ट - 2023-24-379 , dated 30th July 2025 has reported that Sh . Rajesh Singh , has not submitted his account of election expenses . Further , after receipt of the said notice , Sh . Rajesh Singh , has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and

WHEREAS , Section 10 A of the Representation of the People Act , 1951 provides that: - " If the Election Commission is satisfied that a person-

यतः, मध्यप्रदेश राज्य के 20- सेवढा विधान सभा निर्वाचन क्षेत्र के साधारण निर्वाचन , 2023 का परिणाम रिटर्निंग ऑफिसर द्वारा दिनांक 03 दिसम्बर 2023 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय लेखे दाखिल करने की अन्तिम तारीख 02 जनवरी 2024 थी; और

यतः , जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम , 1961 के नियम 89 के उपनियम (5) के अंतर्गत श्री राम प्रकाश को अपने निर्वाचन व्यय का लेखा प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76- मध्यप्रदेश - वि.स.-20-2024 - सी.ई.एम.एस.- III, दिनांक 19 जुलाई 2025 जारी किया गया था; और

यतः , उपयुक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम , 1961 के नियम 89 के उपनियम (6 ) के अनुसार श्री राम प्रकाश को निर्वाचन व्यय का लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पष्ट करते हुए , आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनों के भीतर जिला निर्वाचन अधिकारी , दतिया को अपने निर्वाचन व्यय का पूर्ण लेखा प्रस्तुत करने का निदेश दिया गया था; और

यतः , जिला निर्वाचन अधिकारी , दतिया से दिनांक 4 जुलाई 2025 के पत्र सं. सामा. निर्वा.-तामील- 2025-359 के द्वारा सूचित किया है कि उक्त कारण बताओ नोटिस अभ्यर्थी श्री राम प्रकाश द्वारा दिनांक 24 जून 2025 को प्राप्त किया गया था; और

यतः, जिला निर्वाचन अधिकारी , दतिया ने पत्र सं.- निर्वा. व्यय पूरक रिपोर्ट- 2023-24-379 , दिनांक 30 जुलाई 2025 के द्वारा प्रस्तुत की गई अनुपूरक रिपोर्ट में यह बताया गया है कि श्री राम प्रकाश ने निर्वाचन व्यय का लेखा प्रस्तुत नहीं किया है. इसके अतिरिक्त, उक्त नोटिस की पावती के उपरांत, श्री राम प्रकाश ने विधि के अन्तर्गत यथा विहित लेखा दाखिल करने में असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया 556(7)

और न ही कोई स्पष्टीकरण दिया है ; और

यतः , लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 10 क में उपबंधित किया गया है कि :-

" यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-

(ख ) उस असफलता के लिए कोई अच्छा कारण अथवा न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग , शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित होगा.

यतः , तथ्यों और उपलब्ध रिकार्डों के आधार पर आयोग का यह समाधान हो गया है कि श्री राम प्रकाश अपने निर्वाचन व्यय का लेखा दाखिल करने में असफल रहे हैं उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है ; और

अतः, अब , लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 10 क के अनुसरण में, भारत निर्वाचन आयोग , एतद्वारा घोषणा करता है कि मध्यप्रदेश राज्य के साधारण निर्वाचन , 2023 के 20 - सेवढा विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्री राम प्रकाश , निवासी - बिजौरा , इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने अथवा होने के लिए निरर्हित होंगे .

No. 76 - MP - LA - 20-2024 - CEMS - III . - WHEREAS , the General Election to Legislative Assembly of Madhya Pradesh, 2023 was held in pursuance of the Election Commission of India Notification No. 15 - विधि निर्वा. चार- म.प्र.वि.स. 2023 , dated 21st October 2023 ; and

WHEREAS , the result of the above - mentioned elections for 20 - Sewda Assembly मध्यप्रदेश राजपत्र, दिनांक 10 अक्टूबर 2025

Constituency of Madhya Pradesh was declared by the Retuming Officer on 3rd December 2023 and hence the last date for lodging the account of Election Expenses was 2nd January 2024 ; and

WHEREAS , as per the District Election Officer's report dated 5th January 2024 forwarded by the Chief Electoral Officer, Madhya Pradesh, Bhopal vide his letter No. 10- क-4-निर्वा. व्यय- निर्देश - 2023-24-1032 , dated 7th February 2024 , under sub - rule ( 1 ) of Rule 89 of the Conduct of Elections Rules , 1961 , Sh . Ramprakash , a contesting candidate from 20 - Sewda Assembly Constituency of Madhya Pradesh has failed to lodge his account of election expenses , as required under law; and

WHEREAS , on the basis of the said report of the District Election Officer, Datia , a Show - Cause notice No.सं. 76- मध्यप्रदेश - वि.स.- 20-2024- सी.ई.एम.एस.- III , dated 19th July 2024 was issued under sub - rule (5) of Rule 89 of the Conduct of Elections Rules , 1961 , by the Election Commission of India to Sh. Ramprakash for not lodging of his account of Election Expenses ; and WHEREAS , through the above said Show Cause Notice and under sub - rule (6) of Rule 89 of the Conduct of Elections Rules , 1961 , Sh . Ramprakash , was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge account of election expenses with the District Election Officer, Datia within 20 days from the date of receipt of the Notice ; and WHEREAS , the District Election Officer , Datia, vide his letter No. सामा. निर्वा.-तामील -2025-359 , dated 4th July 2025, has informed that the notice was received by the candidate Sh . Ramprakash , on 24th June 2025 ; and

WHEREAS , the District Election Officer , Datia in his Supplementary Report , vide its letter No. निर्वा. व्यय पूरक रिपोर्ट- 2023-24-379 , dated 30th July 2025 has reported that Sh . Ramprakash , has not submitted his account of election expenses . Further , after receipt of the said notice , Sh . Ramprakash , has neither furnished any reason nor explanation to the Election Commission of India, for failure to lodge the account as prescribed under law; and

WHEREAS , Section 10 A of the Representation of the People Act , 1951 provides that : -

"If the Election Commission is satisfied that a person-

(a) has failed to lodge an account of election expenses , within the time and in the manner required by or under this Act , and

WHEREAS , on the basis of facts and available records , the Commission is satisfied that Sh. Ramprakash has failed to lodge his account of election expenses and has no good reason or justification for the failure to do so ; and

NOW, THEREFORE , in pursuance of Section 10A of the Representation of the People Act , 1951 , the Election Commission of India hereby declares Sh . Ramprakash resident of Bijaura , a contesting candidate in 20 - Sewda Assembly Constituency of General Election to the Legislative मध्यप्रदेश राजपत्र, दिनांक 10 अक्टूबर 2025
