यतः पहचान स्थापित करने के लिए आधार संख्या का उपयोग नागरिकों को सुविधाजनक और निर्बाध तरीके से सब्सिडी, लाभ और सेवाएँ प्राप्त करने में सक्षम बनाता है , पहचान स्थापित करने के लिए दस्तावेजों की बहुलता की आवश्यकता को समाप्त करता है , प्रक्रियाओं को सरल बनाता है और पारदर्शिता और दक्षता को बढ़ावा देता है:
और यतः, इलेक्ट्रॉनिक्स और सूचना प्रौद्योगिकी मंत्रालय , भारत सरकार ने भारतीय विशिष्ट पहचान प्राधिकरण ( UIDAI ) के अनुसार, अपने कार्यालय ज्ञापन क्रमांक 13 (2 ) / 2021- ईजी- II, दिनांक 24 अगस्त, 2022 के द्वारा विज्ञान और प्रौद्योगिकी विभाग ( एमपीएसईडीसी) ( जिसे आगे उक्त मंत्रालय या उक्त विभाग या उक्त एजेंसी कहा जाएगा ) , मध्यप्रदेश शासन (जिसे आगे उक्त सरकार कहा जाएगा) को सुशासन के लिए आधार प्रमाणीकरण (समाज कल्याण , नवाचार, ज्ञान) नियम , 2020 (जिसे आगे उक्त नियम कहा जाएगा ) के नियम 3 के उप-नियम ( 1 ) के अंतर्गत निर्धारित प्रयोजनों के लिए अनुमति दी गयी है, उक्त सरकार/ मंत्रालय/ विभाग / एजेंसी को आधार संख्या धारक की पहचान स्थापित करने के लिए प्रमाणीकरण करने और प्रमाणीकरण के दौरान आधार संख्या के उपयोग की अनुमति दी जा सकती है और आधार ( वित्तीय और अन्य सब्सिडी, लाभ और सेवाओं का लक्षित वितरण ) अधिनियम, 2016 ( जिसे आगे अधिनियम कहा जाएगा) की धारा 4 की उप - धारा ( 4 ) के खंड ( ख ) के उप- खंड ( ii ) के साथ पठित उक्त नियमों के नियम 5 के अंतर्गत इसे अधिसूचित किया जा सकता है:
और यतः , लाभार्थी पंजीकरण और सत्यापन के प्रयोजन के लिए स्वैच्छिक आधार समग्र पोर्टल पर समग्र आईडी का उपयोग करके पर आधार प्रमाणीकरण किया जाएगा , (जिसे इसके बाद उक्त उद्देश्य के रूप में संदर्भित किया जाएगा ) उक्त नियमों के अनुसार नियम 3 के उप- नियम ( 1 ) के तहत निर्धारित किया गया है कि, उक्त उद्देश्य के लिए आधार प्रमाणीकरण का

उपयोग स्वैच्छिक आधार पर होगा एवं उक्त मंत्रालय/विभाग /एजेंसी के परिशिष्ट -1 के रूप में संलग्न विभिन्न सरकारी सेवाओं और योजनाओं के लिए आधार प्रमाणीकरण किया जाएगा। [जिसे इसके बाद उपयोग मामले के रूप में संदर्भित किया जाएगा।।
अतएव, अधिनियम की धारा 4 की उपधारा (4 ) के खंड ( ख ) के उप- खंड ( ii ) के साथ
पठित उक्त नियमों के नियम 5 के अनुसरण में , उक्त मंत्रालय /विभाग/एजेंसी एलद्वारा निम्नलिखित को अधिसूचित करता है , अर्थात्ः-
1. ( 1 ) मंत्रालय /विभाग/एजेंसी, अधिनियम में दिए गए प्रावधान के अनुसार, इसमें प्रमाणीकरण के प्रयोजन हेतु आधार संख्या धारक की सहमति प्राप्त करेगा ।
(2) उक्त नियमों के नियम 3 के उपनियम ( 2 ) के अनुसार, आधार प्रमाणीकरण स्वैच्छिक आधार पर है । मंत्रालय/विभाग/ एजेंसी आधार संख्या धारक को पहचान के वैकल्पिक और उपयुक्त साधनों की जानकारी देगा एवं आधार प्रमाणीकरण को अस्वीकार करने या आधार प्रमाणीकरण कराने में असमर्थ होने पर किसी भी आधार संख्या धारक को कोई सेवा देने
से वंचित नहीं करेगी, अर्थात्
(a ) भारत के चुनाव आयोग द्वारा जारी मतदाता फोटो पहचान पत्र;
(b) राशन कार्ड;
(c) राजपत्रित अधिकारी , जो कार्यपालिक मजिस्ट्रेट या तहसीलदार से अनिम्न पद श्रेणी का राज्य शासन का राजस्व अधिकारी हो, द्वारा जारी जाति प्रमाण- पत्र या निवास प्रमाण-पत्र;
(d ) भारतीय पासपोर्ट;
(e ) किसी मान्यता प्राप्त स्कूल शिक्षा बोर्ड द्वारा जारी मैट्रिकुलेशन या 10 वीं कक्षा या उच्चतर माध्यमिक या 12 वीं कक्षा का प्रमाण-पत्र या अंकसूची;

And whereas the Ministry of Electronics and Information Technology, Government of India, after consultation with the Unique Identification Authority of India ( UIDAI ) , had allowed vide its letter no . 13 ( 2 ) / 2021 - EG - II , dated 24th August - 2022 to the Department of Science and Technology ( MPSEDC ) ( hereinafter referred to as the said Ministry or the said department or the said Agency ) , Government of Madhya Pradesh ( hereinafter referred to as the said Government) for the purposes prescribed under sub - rule ( 1 ) of rule 3 of the Aadhaar Authentication for Good Governance ( Social Welfare , Innovation, Knowledge ) Rules , 2020 ( hereinafter referred to as the said rules ) that the said Government /Ministry/ Department /Agency may be allowed to perform authentication and be permitted the use of Aadhaar number during authentication for establishing identity of Aadhaar number holder and notify the same under rule 5 of the said rules read with sub - clause ( ii ) of clause (b) ofsub - section (4) of section 4 of the Aadhaar ( Targeted Delivery of Financial and Other Subsidies , Benefits and Services ) Act , 2016 ( hereinafter referred to as the Act) :
And whereas, the Aadhaar authentication shall be performed for Aadhaar Authentication on voluntary basis using Samagra ID on Samagra Portal for the purpose of beneficiary registration and verification , ( hereinafter referred to as the said purpose ) as prescribed under sub - rule ( 1 ) of rule 3 of the said rules and the performance of Aadhaar authentication for the said purpose shall be on voluntary basis and that the said Ministry /Department/Agency shall perform the Aadhaar authentication only for various government services and schemes enclosed herewith as Annexure - 1 ( hereinafter referred to as the use case ( s) ] .
Now, therefore , in pursuance of rule 5 of the said rules read with sub- clause ( ii ) of clause ( b ) of sub - section ( 4) of section 4 of the Act, the said Ministry /Department /Agency hereby notifies the following , namely:
1. ( 1) The Ministry/Department/ Agency , as provided in the Act, shall obtain the consent of the Aadhaar number holder for the purpose of authentication herein.
(2) As per sub - rule ( 2 ) of rule 3 of the said rules , Aadhaar authentication is on voluntary basis the Ministry /Department/Agency shall inform to the Aadhaar number holder of alternate and viable means of identification and shall not deny any service to the Aadhaar number holder for refusing to, or being unable to, undergo Aadhaar authentication, namely :
(a) Elector's Photo Identity Card issued by the Election Commission of India;
(b) Ration card;
(c) caste certificate or domicile certificate , issued by a Gazetted Officer , who is an Executive Magistrate or a Revenue Officer of the State Government , not below the rank of Tehsildar;
(d) Indian passport ;
(e) certificate or statement of marks of Matriculation or 10th Class or Higher Secondary or 12th Class , issued by a recognized Board of School Education ;
