[दिनांक १८ नवम्बर , २०२५ को राष्ट्रपति की अनुमति प्राप्त हुई; अनुमति " मध्यप्रदेश राजपत्र ( असाधारण ) " में दिनांक २७ नवम्बर, २०२५ को प्रथमबार प्रकाशित की गई. ]
मध्यप्रदेश राज्य को लागू हुए रूप में-
(एक ) ठेका श्रम ( विनियमन और उत्सादन ) अधिनियम , १ ९ ७० ( १ ९ ७० का ३७ )
(दो ) कारखाना अधिनियम, १ ९ ४८ ( १ ९ ४८ का ६३ )
(तीन ) औद्योगिक विवाद अधिनियम, १ ९ ४७ ( १ ९ ४७ का १४ )
को और संशोधित करने और प्रकीर्ण उपबंध करने हेतु अधिनियम.
भारत गणराज्य के छिहत्तरवें वर्ष में मध्यप्रदेश विधान- मण्डल द्वारा निम्नलिखित रूप में यह अधिनियमित हो :-
भाग-एक
प्रारंभिक
संक्षिप्त नाम और प्रारंभ.
१. ( १ ) इस अधिनियम का संक्षिप्त नाम मध्यप्रदेश श्रम विधियां ( संशोधन ) और प्रकीर्ण उपबंध अधिनियम, २०२५ है.
( २ ) यह " मध्यप्रदेश राजपत्र " में इसके प्रकाशन की तारीख से प्रवृत्त होगा.

ठेका श्रम ( विनियमन और उत्सादन ) अधिनियम , १ ९७० का संशोधन
२. मध्यप्रदेश राज्य को लागू हुए रूप में , ठेका श्रम ( विनियमन और उत्सादन ) अधिनियम, १ ९७० ( १ ९ ७० का ३७ ) ( जो इस भाग में इसके पश्चात् मूल अधिनियम के नाम से निर्दिष्ट है ) , को इस भाग में, इसके पश्चात् उपबंधित रीति में संशोधित किया जाए.

धारा १ का संशोधन.
३. मूल अधिनियम में, धारा १ की उपधारा ( ४ ) में, -
(एक) खण्ड ( क ) में, शब्द " बीस या उससे अधिक कर्मकार " के स्थान पर, शब्द " पचास या उससे अधिक कर्मकार " स्थापित किए जाएं.
(दो) खण्ड (ख ) में , शब्द " बीस या उससे अधिक कर्मकार " के स्थान पर , शब्द " पचास या उससे अधिक कर्मकार " स्थापित किए जाएं.
(तीन ) परंतुक में, शब्द " बीस से कम कर्मकार " के स्थान पर, शब्द " पचास से कम कर्मकार " स्थापित किए जाएं.

कारखाना अधिनियम, १ ९ ४८ का संशोधन
४. मध्यप्रदेश राज्य को लागू हुए रूप में कारखाना अधिनियम , १ ९ ४८ ( १ ९४८ का ६३ ) ( जो इस भाग में इसके पश्चात् मूल अधिनियम के नाम से निर्दिष्ट है ) को, इस भाग में इसके पश्चात्, उपबंधित रीति में संशोधित किया जाए.
मध्यप्रदेश राज्य को लागू हुए रूप में केन्द्रीय अधिनियम १ ९४८ का सं. ६३ कासंशोधन.
धारा २ का संशोधन.
५. मूल अधिनियम की धारा २ में , खण्ड (ड) में, -
(एक) उप- खण्ड ( एक ) में, शब्द " दस या अधिक कर्मकार " के स्थान पर, शब्द " बीस या उससे अधिक कर्मकार " स्थापित किए जाएं;
(दो) उप-खण्ड ( दो ) में, शब्द" बीस या अधिक कर्मकार " के स्थान पर, शब्द " चालीस या अधिक कर्मकार " स्थापित किए जाएं.
धारा ८५ संशोधन. का
६. मूल अधिनियम की धारा ८५ में, उपधारा ( १ ) में, खण्ड ( एक ) में, शब्द " दस से कम " के स्थान पर, शब्द " बीस से कम " स्थापित किए जाएं और आगे शब्द " बीस से कम " के स्थान पर, शब्द " चालीस से कम " स्थापित किए जाएं.

औद्योगिक विवाद अधिनियम, १ ९ ४७ का संशोधन
७. मध्यप्रदेश राज्य को लागू हुए रूप में , औद्योगिक विवाद अधिनियम , १ ९४७ ( १ ९४७ का १४ ) ( जो इस भाग में इसके पश्चात् मूल अधिनियम के नाम से निर्दिष्ट है ) , को इस भाग में , इसके पश्चात् उपबंधित रीति में संशोधित किया जाए.

८. मूल अधिनियम में, की धारा २२ में, -
धारा २२ का संशोधन.
(एक) उपधारा ( एक ) में, शब्द " लोक उपयोगी सेवा " के पश्चात्, शब्द " अथवा किसी औद्योगिक स्थापना " अंतःस्थापित किए जाएं;
(दो) उपधारा ( दो ) में, शब्द " किसी लोक उपयोगी सेवा " के पश्चात्, शब्द " अथवा किसी औद्योगिक स्थापना " अंतःस्थापित किए जाएं.
भाग-पांच
प्रकीर्ण उपबंध
नियम बनाने की ९. ( १ ) राज्य सरकार , पूर्व प्रकाशन की शर्त के अध्यधीन रहते हुए, इस अधिनियम के उपबंधों को कार्यान्वित
शक्ति. करने के प्रयोजन के लिए नियम बना सकेगी.
( २ ) इस अधिनियम के अधीन बनाए गए समस्त नियम, उनके बनाए जाने के पश्चात् यथाशक्य शीघ्र , विधान
सभा के पटल पर रखे जाएंगे .
कठिनाईयों का दूर १०. ( १ ) इस अधिनियम के उपबंधों के क्रियान्वयन में यदि कोई कठिनाई उद्भूत होती है तो , राज्य सरकार, राजपत्र
किया जाना. में प्रकाशित किए गए साधारण अथवा विशेष आदेश द्वारा , इस अधिनियम के उपबंधों से अनअसंगत
ऐसे उपबंध बना सकेगी , जो कठिनाई को दूर करने के लिए उसे आवश्यक अथवा समीचीन प्रतीत हों.
( २ ) उपधारा ( १ ) के अधीन किया गया प्रत्येक आदेश विधान सभा के पटल पर रखा जाएगा.

THE MADHYA PRADESH LABOUR LAWS ( AMENDMENT) AND MISCELLANEOUS PROVISIONS AСТ, 2025
[Received the assent of the President on the 18th November, 2025 ; assent first published in the "Madhya Pradesh Gazette ( Extra - ordinary ) " , dated the 27th November , 2025. ]
An Act further to amend the-
(i) Contract Labour (Regulation and Abolition) Act, 1970 (No. 37 of 1970) ;
(ii) Factories Act , 1948 (No. 63 of 1948 );
(iii) Industrial Disputes Act , 1947 (No. 14 of 1947) ;
in their application to the State of Madhya Pradesh and to make miscellaneous provisions .
Be it enacted by the Madhya Pradesh Legislature in the Seventy - sixth year of the Republic of India as follows: -
PART- I
PRELIMINARY
Short title and commencement .
1. ( 1 ) This Act may be called the Madhya Pradesh Labour Laws (Amendment) and Miscellaneous Provisions Act , 2025 .
(2) It shall come into force from the date of its publication in the " Madhya Pradesh Gazette" .
PART- II
AMENDMENT OF THE CONTRACT LABOUR (REGULATION AND ABOLITION) ACT, 1970
2. The Contract Labour ( Regulation and Abolition) Act, 1970 (No. 37 of 1970) (hereinafter in this Part referred to as the principal Act ) shall in its application to the State of Madhya Pradesh be amended in the manner hereinafter provided in this Part .

3. In the principal Act , in sub- section (4) of Section 1 , -
Amendment of Section 1 .
(i) in clause (a) , for the words " twenty or more workmen " , the words " fifty or more workmen " shall be substituted .
(ii) in clause (b ) , for the words " twenty or more workmen " , the words "fifty or more workmen " shall be substituted.
(iii) in the proviso , for the words " workmen less than twenty ", the words "workmen less than fifty " shall be substituted.

PART- III
AMENDMENT OF THE FACTORIES ACT, 1948
4. The Factories Act , 1948 ( No. 63 of 1948 ) (hereinafter in this Part referred to as the principal Act) shall in its application to the State of Madhya Pradesh be amended in the manner hereinafter provided in this Part.

5. In Section 2 of the principal Act , in clause (m) , -
Amendment of Section 2 .
(i) in sub - clause (i ) , for the words " ten or more workers " , the words "twenty or more workers " shall be substituted;
(ii) in sub - clause ( ii ) , for the words " twenty or more workers " , the words " forty or more workers " shall be substituted;
Amendment of Section 85.
6. In Section 85 of the principal Act, in sub- section ( 1 ) , in clause ( i ) , for the words "less than ten" the words " less than twenty " shall be substituted and further for the words "less than twenty " , the words " less than forty " shall be substituted.
PART- IV
AMENDMENT OF THE INDUSTRIAL DISPUTES ACT, 1947
7. The Industrial Disputes Act , 1947 (No. 14 of 1947) ( hereinafter in this Part referred to as the principal Act) shall in its application to the State of Madhya Pradesh be amended in the manner hereinafter provided in this Part .

8. In Section 22 of the principal Act , -
Amendment of Section 22 .
(i) in sub - section ( 1 ) , after the words " a public utility service ' , the words " or any industrial establishment " shall be inserted;
(ii) in sub - section (2 ) , after the words " any public utility service " , the words " or any industrial establishment " shall be inserted .
PART-V
MISCELLANEOUS PROVISIONS
Power to make rules .
9. ( 1 ) The State Government, subject to the condition of previous publication , may make rules for the purpose of giving effect to the provisions of this Act.
(2) All rules made under this Act shall . as soon as after they are made , be laid on the table of the Legislative Assembly .
Removal difficulties . of 10. ( 1 ) If any difficulty arises in giving effect to the provisions of this Act , the State Government may , by general or special order published in the Gazette , make such provision not inconsistent with the provisions of this Act as appear to it to be necessary or expedient for removal of the difficulty.
(2) Every order made under sub- section ( 1 ) shall be laid on the table of the Legislative Assembly .
