क्रमांक यूडीएच 3/0324/2025/ 18-5: - मध्यप्रदेश नगर तथा ग्राम निवेश अधिनियम 1973 ( क्रमांक 23 , सन 1973 ) की धारा 24 की उपधारा उपधारा (3 ) के साथ पठित धारा 85 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुये , राज्य सरकार, एतदद्वारा मध्य प्रदेश भूमि विकास नियम, 2012 के निम्न नियमों में संशोधन करती है , जो उक्त अधिनियम की धारा-85 की उपधारा ( 1 ) के द्वारा अपेक्षित किये गये अनुसार मध्य प्रदेश ( साधारण ) दिनांक 14 नवम्बर 2025 में पूर्व में प्रकाशित किये जा चुके है : -
संशोधन
उक्त नियमों में, -
1 ) नियम 5 में, उपनियम ( 6) के स्थान पर निम्नलिखित उपनियम स्थापित किया जाए , अर्थात्ः-
"( 6) हरित भवनः ( 1 ) ऊर्जा कुशल, पर्यावरण अनुकूल हरित भवनों के लिए मानदंड, मानक एवं प्रोत्साहन परिशिष्ट- ड में उल्लेखित अनुसार होंगे ।
2) परिशिष्ट-ठ के पश्चात् निम्नलिखित परिशिष्ट जोड़ा जाए, अर्थात्ः -

(1 ) भारत की विभिन्न मूल्यांकन प्रणालियों के अंतर्गत, हरित भवनों के लिए प्रोत्साहन निम्नलिखित तालिका के अनुसार होगा: -

स्पष्टीकरण-
(i ) परन्तु अतिरिक्त एफ.ए.आर. का प्रोत्साहन उन भवनों पर लागू होगा जो वाणिज्यिक एवं कार्यालय भवनों के लिए ऊर्जा संरक्षण और सतत् भवन संहिता (ईसीएसबीसी) ( नवीनतम) और आवासीय भवनों के लिए ईको निवास संहिता (ईएनएस) ( नवीनतम) के तहत निर्धारित मापदंडों, प्रदर्शन मानकों और स्थिरता मानकों के अनुसार संरचना विधिवत निर्मित और प्रमाणित हो । जैसा कि भारत सरकार के विद्युत मंत्रालय के अधीन ऊर्जा दक्षता ब्यूरो (बीईई) द्वारा जारी किया गया है, और भारत सरकार के आवासन और शहरी कार्य मंत्रालय ( एमओएचयूए ) द्वारा मान्यता प्राप्त है ।
किसी भी मूल्यांकन प्रणाली जैसे कि गृह , आईजीबीसी, एलईईडी या संघ राज्य सरकार द्वारा विधिवत मान्यता प्राप्त किसी अन्य संस्था से प्राप्त प्रमाणन , प्राधिकारी द्वारा सत्यापन और अनुमोदन के अधीन , उपरोक्त मानदंडों के अनुपालन को पूरा करने वाला माना जाएगा। (ii)
इसका उद्देश्य भूमि उपयोग और विकास नियंत्रण की रूपरेखा के अन्तर्गत एकीकृत विकास प्रोत्साहनों के माध्यम से ऊर्जा संरक्षण उपायों को अपनाने , नवीकरणीय ऊर्जा के उपयोग, जल दक्षता, अपशिष्ट में कमी और आंतरिक पर्यावरणीय गुणवत्ता को बढ़ावा देना है । (iii )
(iv) ऐसे मामलों में जहां किसी भवन ने एक से अधिक मान्यता प्राप्त हरित भवन मूल्यांकन प्रणाली के तहत प्रमाणन प्राप्त किया हो , आवेदक केवल एक प्रमाणन के तहत प्रोत्साहन का दावा करने का हकदार होगा।
(a ) आवेदक को प्राधिकारी को भवन निर्माण की अनुमति के लिए आवेदन करने के चरण/ समय पर "हरित भवन " के निर्माण के आशय की घोषणा करनी होगी तथा उपर्युक्त खंड ( 1 ) में उल्लेखित प्रस्तावित प्रमाणन स्तर की श्रेणी निर्दिष्ट करनी होगी ।
(b) आवेदक को ऐसे आवेदन के समय घोषित प्रमाणन स्तर के अनुरूप अतिरिक्त एफ.ए.आर. के प्रोत्साहन का दावा करना होगा, जिसे अनुमोदित बेस एसफआर से अधिक अनुज्ञेय निर्माण का हिस्सा माना जाएगा ।

(c ) आवेदक को भवन निर्माण अनुमति दस्तावेजों में एक स्पष्ट विवरण भी प्रस्तुत करना होगा , जिसमें भवन के उस भाग या क्षेत्र का उल्लेख होगा , जहां अतिरिक्त एफ.ए.आर. के प्रोत्साहन का उपयोग किया जाना प्रस्तावित है ।
(d ) अतिरिक्त एफ.ए. आर. के प्रोत्साहन के लिए दावा भवन निर्माण अनुमति आवेदन प्रस्तुत करने के समय घोषित प्रमाणन स्तर तक सीमित होगा , और प्राधिकारी द्वारा अनुमोदित किए जाने तक दावे में बाद में कोई संशोधन या वृद्धि की अनुमति नहीं दी जाएगी ।
(e ) निम्नलिखित तालिका में भवनों को ' हरित भवन' के रूप में मान्यता देने के लिए एवं हरित भवनों के लिए अतिरिक्त एफ.ए.आर. के प्रोत्साहन से संबंधित उपरोक्त खंड ( 1 ) के कार्यान्वयन के लिए, निम्नलिखित परिदृश्य पूर्णता और अधिभोग प्रमाण पत्र प्रदान करने के लिए आवेदन की योग्यता एवं पात्रता को नियंत्रित करेंगे: -

आवेदक ने खंड ( 1 ) के अंतर्गत घोषित प्रमाणन स्तर की श्रेणी के अनुसार अतिरिक्त एफ.ए.आर. के प्रोत्साहन का दावा किया हो और निर्माण अवधि के दौरान बेस एफ.ए.आर. और अतिरिक्त एफ.ए.आर. के प्रोत्साहन सहित एफ.ए.आर. का पूर्ण उपयोग किया हो और घोषित प्रमाणन स्तर के लिए किसी मान्यता प्राप्त संस्था से संबंधित हरित भ्वन प्रमाणन प्राप्त किया हो , तो आवेदक प्राधिकारी से पूर्णता प्रमाण पत्र और अधिभोग प्रमाण पत्र प्राप्त करने का हकदार होगा । ऐसी स्थिति में , भवन को "हरित भवन" के रूप में मान्यता दी जाएगी और दर्ज किया जाएगा ।
केवल बेस एफ.ए.आर. का उपयोग करने वाले तथा हरित भवन प्रमाणन प्राप्त न करने वाले भवन
आवेदक ने खंड (1 ) के अंतर्गत घोषित प्रमाणन स्तर की श्रेणी के अनुसार अतिरिक्त एफ.ए.आर. के प्रोत्साहन का दावा किया हो , लेकिन निर्माण अवधि के दौरान केवल बेस एफ.ए.आर. का ही उपयोग किया हो और किसी मान्यता प्राप्त मूल्यांकन संस्था से अपेक्षित हरित भवन प्रमाणन प्राप्त नहीं किया हो । ऐसे मामले में, आवेदक को बेस एफ.ए.आर. के अन्तर्गत निर्मित भाग के लिए पूर्णता प्रमाणपत्र और अधिभोग प्रमाणपत्र प्रदान किया जाएगा । इसलिए , भवन को "हरित भवन " के रूप में मान्यता नहीं दी जाएगी ।

बेस एफ.ए.आर. और अतिरिक्त एफ.ए.आर. के प्रोत्साहन सहित एफ.ए. आर. का उपयोग करने वाले भवन लेकिन हरित भवन प्रमाणन प्राप्त नहीं करने वाले भवन
आवेदक ने खंड ( 1 ) के तहत घोषित प्रमाणन स्तर की श्रेणी के अनुसार अतिरिक्त एफ.ए.आर. के प्रोत्साहन का दावा किया हो , और निर्माण अवधि के दौरान बेस एफ.ए.आर. और अतिरिक्त एफ.ए.आर. के प्रोत्साहन सहित एफ.ए.आर. का उपयोग किया हो, लेकिन किसी मान्यता प्राप्त
मूल्यांकन संस्था से अपेक्षित हरित भवन प्रमाणन प्राप्त करने में विफल रहा हो ।
ऐसे मामले में, प्राधिकारी अतिरिक्त निर्माण के प्रशमन या निर्मित अतिरिक्त एफ.ए.आर. के विध्वंस पर लागू प्रावधानों और निर्देशों के अधीन पूर्णता प्रमाण पत्र प्रदान करेगा ।
इसके बाद अधिभोग प्रमाण पत्र तदानुसार जारी किया जा सकता है , और भवन को " हरित भवन" नहीं माना जाएगा ।

भवन निर्माण की अनुमति के समय घोषित स्तर से कम प्रमाणन स्तर प्राप्त करने तथा तदानुसार अतिरिक्त एफ.ए.आर. के प्रोत्साहन का उपयोग करना
आवेदक ने खंड ( 1 ) के अंतर्गत उच्चतर प्रमाणन स्तर ( उदाहरण के लिए , 5- स्टार या समकक्ष) के अनुरूप अतिरिक्त एफ.ए.आर. के प्रोत्साहन का दावा किया हो, किन्तु किसी मान्यता प्राप्त मूल्यांकन संस्था से निम्न स्तर (उदाहरण के लिए , 4- स्टार या समकक्ष) का हरित भवन प्रमाणन प्राप्त किया हो । ऐसे मामले में , प्राधिकारी , अतिरिक्त निर्मित क्षेत्र के लिए प्राधिकारी द्वारा निर्धारित अतिरिक्त निर्माण के प्रशमन के अधीन, पूर्णता प्रमाणपत्र प्रदान करेगा ।
इसके बाद अधिभोग प्रमाणपत्र जारी किया जा सकता है , और भवन को वास्तव में प्राप्त प्रमाणन स्तर के अनुरूप " हरित भवन " के रूप में मान्यता दी जाएगी ।

( f) भवनों में ऊर्जा दक्षता और नवीन विकास में नवीकरणीय ऊर्जा नवाचारों को बढ़ावा देने से संबंधित सतत् आवास पर राष्ट्रीय मिशन के उद्देश्यों के अनुसरण में , प्राधिकारी द्वारा उपयुक्त नियामक प्रावधानों और विकास प्रोत्साहनों के माध्यम से मॉडल बिल्डिंग बायलॉज , 2016 की धारा 10.2.1 से 10.2.6, या समय - समय पर संघ राज्य सरकार द्वारा जारी किए गए किसी अन्य ऊर्जा दक्षता दिशानिर्देशों या मानकों में निहित प्रावधानों को अपनाने के लिए प्रोत्साहित किया जाएगा।
3) नियम 81 में, उपनियम (4) के पश्चात् निम्नलिखित उपनियम अंतः स्थापित किया जाए , अर्थात्ः-
" ( 5 ) शीतल छतों और हरित छतों का निर्माण या फ्रेमिंग मॉडल बिल्डिंग बायलॉज 2016 के 'अनुलग्नक 2: शीतलन कार्य योजना के लिए प्रावधान' में निर्दिष्ट मानदंडों के अनुसार किया जाएगा। "

NOTICE
No.UDH - 3 /0324/2025/ 18-5 : - In exercise of the powers conferred by sub - section ( 1 ) of Section 85 read with sub- section ( 3) of Section 24 of Madhya Pradesh Town and Country Planning Act , 1973 the State Government hereby makes the following amendments in Madhya Pradesh Bhumi Vikas Niyam , 2012 the same having been previously published in the Madhya Pradesh Gazette (Ordinray ) dated 14th November 2025 as required by sub - section ( 1 ) of Section 85 of the saied Act .
Amendment
In the said Rules , -
1) In rule 5, sub -rule ( 6), the following sub - rule shall be substituted , namely: -
" (6 ) Green building : ( 1 )The norms, standards and incentives for energy efficient , environment friendly green buildings shall be as mentioned in Appendix -M . "
2) After Appendix -L, the following appendix shall be inserted , namely: -

Explanation-
(i ) Provided that the incentive of additional FAR , shall be applicable to buildings that are duly designed , constructed and certified in accordance with the parameters , performance benchmarks and sustainability standards prescribed under the Energy Conservation and Sustainable Building Code ( ECSBC ) (latest) for commercial and office buildings and the EcoNiwas Samhita ( ENS) (latest) for residential buildings, as issued by the Bureau of Energy Efficiency (BEE) under the Ministry of Power, Government of India , and recognized by the Ministry of Housing and Urban Affairs ( MoHUA ) , Government of India.

(ii) The certification obtained under any of the rating systems such as GRIHA, IGBC , LEED , or under any other agency duly recognized by the Union /State Government , shall be deemed to satisfy the criteria of compliance with the aforesaid norms , subject to verification and approval by the Authority.
(iii) The objective is to promote the adoption of energy conservation measures , use ofrenewable energy, water efficiency , waste reduction , and enhanced indoor environmental quality, through development incentives integrated within the framework of land use and development control .
(iv) In cases where a building has obtained certification under more than one recognized Green Building rating system , the applicant shall be entitled to claim incentiveunder only one certification.
(a) The applicant shall declare the intent to construct a " Green Building " , at the stage/time of applying for a building permission to the Authority and shall specify the category of certification level proposed to be achieved as mentioned in clause ( 1 ) above.
(b) The applicant shall , at the time of such application , claim the incentive of additional FAR corresponding to the declared certification level , which shall be deemed to form part of the permissible constructionover and above the Base FARso approved .
(c) The applicant shall also furnish , in the building permission documents , a clear statement indicating the portion or area of the building where the Incentive of additional FAR is proposed to be utilized .
(d) The claim for incentive ofadditional FAR shall be limited to the certification level declared at the time of submission of the building permission application , and no subsequent revision or enhancement of the claim shall be permitted unless approved by the Authority .
(e) For implementation of clause ( 1 ) above , relating to Incentive of Additional FAR for Green Buildings , the following scenarios shall govern the eligibility and entitlement of the application for grant of completion and occupancycertificates , and for recognition of the building as a " Green Building" in the table given below:

Building utilizing only Base FARand not obtaining Green Building Certification
The applicant has claimed the Incentive of Additional FAR as per the category of certification level declared under clause ( 1 ) , but has utilized only the Base FAR during construction period and has not obtained the requisite Green Building certification from accreditation arecognised agency. In such case , the applicant shall be granted the completion certificate and occupancy certificate for the portion constructed within the Base FAR . So , the building shall not be recognized as a " Green Building " .
The applicant has claimed the Incentive of Additional FAR as per the category of certification level declared under clause ( 1 ) , and has utilized the FAR including Base FAR and Incentive ofAdditional FAR during construction period , but has failed to obtain the requisite Green Building certification from arecognised accreditation agency.
Building utilizing FAR including Base FAR and Incentive of Additional FAR but not Green obtaining Building certification
In such case , the Authority shall grant the completion certificatesubject to applicable provisions and directionsupon compounding of the additional construction or demolition of the additional FAR so constructed .
The occupancy certificate may thereafter be issued accordingly , and the building shall not be deemed to be a "Green Building. "
IV
Building achieving lower certification level than declared at the time of building permission and utilizing Incentive of Additional FAR accordingly
The applicant has claimed the Incentive of Additional FAR corresponding to a higher certification level under clause ( 1 ) (for instance , 5- Star or equivalent ) , but has obtained Green Building certification of a lower level (for instance , 4 - Star or equivalent) from arecognised accreditation agency. In such case , the Authority shall grant the completion certificate subject to compounding of the 700(7)

additional construction , determined by the Authority for the excess built-up area . The occupancy certificate may thereafter be issued, and the building shall be recognized as a "Green Building " corresponding to the certification level actually achieved .
(f) In pursuance of the objectives of the National Mission on Sustainable Habitat pertaining to energy efficiency in buildings and promotion of renewable energy initiatives in newdevelopments , the Authority shall encourage the adoption of the provisions contained in Sections 10.2.1 to 10.2.6 of the Model Building Byelaws , 2016, or any other energy efficiency guidelines or standards issued by the Union / State Government from time to time , through appropriate regulatory provisions and development incentives .
3) In rule 81 , after sub - rule (4) , the following shall be inserted, namely: -
"(5) The construction or framing of cool roofs and green roofs shall be undertaken in accordance with the norms specified in 'Annexure 2: Provisions for Cooling Action Plan', oftheModel Building Byelaws , 2016. "
