मध्यप्रदेश दुकान तथा स्थापना (द्वितीय संशोधन ) अधिनियम, २०२५
[ दिनांक १५ दिसम्बर , २०२५ को राज्यपाल की अनुमति प्राप्त हुई; अनुमति " मध्यप्रदेश राजपत्र (असाधारण) " में दिनांक १५ दिसम्बर, २०२५ को प्रथमबार प्रकाशित की गई. ]
मध्यप्रदेश दुकान तथा स्थापना अधिनियम , १ ९ ५८ को और संशोधित करने हेतु अधिनियम.
भारत गणराज्य के छिहत्तरवें वर्ष में मध्यप्रदेश विधान - मण्डल द्वारा निम्नलिखित रूप में यह अधिनियमित हो:-
१. (१ ) इस अधिनियम का संक्षिप्त नाम मध्यप्रदेश दुकान तथा स्थापना (द्वितीय संशोधन ) अधिनियम, २०२५ है. संक्षिप्त नाम और प्रारंभ.
(२) यह "मध्यप्रदेश राजपत्र " में इसके प्रकाशन की तारीख से प्रवृत्त होगा.
२. मध्यप्रदेश दुकान तथा स्थापना अधिनियम , १ ९ ५८ (क्रमांक २५ सन् १ ९ ५८ ) (जो इसमें इसके पश्चात् मूल अधिनियम
के नाम से निर्दिष्ट है ) की धारा २ में, -
धारा संशोधन. २ का
(एक) खण्ड (१ ) के पश्चात्, निम्नलिखित खण्ड अंतःस्थापित किया जाए, अर्थात्ः-
"(१ क) "केन्द्रीय निरीक्षण प्रणाली ' से अभिप्रेत है, इस अधिनियम के अधीन निरीक्षण के निर्धारण, आवंटन, संचालन और निगरानी हेतु राज्य सरकार द्वारा अधिसूचित ऑनलाइन कम्प्यूटरीकृत प्लेटफार्म; " .
(दो) खण्ड (१९ ) के पश्चात्, निम्नलिखित खण्ड अंतःस्थापित किया जाए, अर्थात्ः-
" (१ ९क ) "पोर्टल " से अमभिप्रेत है, मध्यप्रदेश राज्य के श्रम विभाग द्वारा अधिसूचित ऑनलाइन वेबसाइट;".
(तीन) खण्ड (२० ) के स्थान पर, निम्नलिखित खण्ड स्थापित किया जाए, अर्थात्ः-
"(२०) "स्थापना पंजी ' से अभिप्रेत है , इस अधिनियम के अधीन जारी पोर्टल जनित प्रमाण-पत्रों का संकलन;".
(चार) खण्ड (२१ ) के स्थान पर, निम्नलिखित खण्ड स्थापित किया जाए, अर्थात्ः-
"(२१ ) "पंजीयन प्रमाण- पत्र " से अभिप्रेत है, पोर्टल द्वारा जनित डिजिटल प्रमाण- पत्र; " .
३. मूल अधिनियम की धारा ६ के स्थान पर, निम्नलिखित धारा स्थापित की जाए, अर्थात्ः-
धारा ६ का स्थापन .
"६. (१ ) प्रत्येक स्थापना का, जिस पर यह अधिनियम लागू होता हो, इस धारा के उपबंधों के अनुसार पंजीयन किया जाएगा.

(२) इस अधिनियम के किसी स्थापना पर लागू होने के दिनांक से तीस दिन के भीतर उसका नियोजक पोर्टल पर ऐसी फीस के साथ जैसी कि विहित की जाए, विहित प्ररुप में आवेदन करेगा, जिसमें
निम्नलिखित समाविष्ट होंगे, -
(क) नियोजक, प्रबंधक तथा प्रबंध संबंधी पद धारण करने वाले व्यक्ति का, यदि कोई हो, नाम;
(ख) स्थापना का डाक का पता और स्थापना द्वारा कारोबार प्रारम्भ किये जाने की दिनांक;
(ग) स्थापना का नाम, यदि कोई हो;
(घ ) स्थापना का प्रवर्ग , अर्थात् क्या वह दुकान, वाणिज्य स्थापना, निवास युक्त होटल, उपाहार- गृह, भोजन - गृह, नाट्य शाला अथवा सार्वजनिक आमोद या मनोरंजन का अन्य स्थान है; और
(ड.) ऐसे अन्य ब्यौरे जो विहित किए जाएं.
(३ ) ऑनलाइन विहित जानकारी और फीस के प्राप्त होने पर, पोर्टल द्वारा पंजीयन प्रमाण- पत्र विहित प्ररुप में स्वतः जनित होगा. पंजीयन प्रमाण- पत्र स्थापना पर प्रमुखता से प्रदर्शित किया जाएगा.
(४) पंजीयन फीस नियमों में यथा- विहित अनुसार होगी किन्तु प्रति स्थापना दो हजार पांच सौ रुपए से अधिक नहीं होगी. " .

धारा ७ का स्थापन.
४. मूल अधिनियम की धारा ७ के स्थान पर , निम्नलिखित धारा स्थापित की जाए, अर्थात्ः-
पोर्टल में अद्यतन किए जाने वाला परिवर्तन.
"७. नियोजक का यह कर्तव्य होगा कि वह धारा ६ के अधीन अपने विवरण में अंतर्विष्ट किसी भी जानकारी के संबंध में कोई भी परिवर्तन , पोर्टल पर परिवर्तन होने के सात दिन के भीतर विहित प्ररुप में अद्यतन करें . अद्यतन होने पर, पोर्टल द्वारा स्थापनाओं की पंजी में परिवर्तन किया जायेगा और संशोधित पंजीयन प्रमाण- पत्र या यदि आवश्यक हो तो एक नवीन पंजीयन प्रमाण- पत्र जनित करेगा. " .
धारा ८ का स्थापन .
५. मूल अधिनियम की धारा ८ के स्थान पर, निम्नलिखित धारा स्थापित की जाए, अर्थात्ः-
स्थापना के बंद होने को पोर्टल में अद्यतन किया जाना.
"८. नियोजक अपनी स्थापना बंद होने के दस दिन के भीतर ऐसी स्थापनाओं के बंद होने को पोर्टल पर अद्यतन करेगा. अद्यतन होने पर, ऐसी स्थापनाओं को स्थापना की पंजी से पोर्टल द्वारा हटाया जाएगा और पोर्टल जनित पंजीयन प्रमाण- पत्र निरस्त किया जायेगा. " .
६. मूल अधिनियम की धारा ४१ में, -
धारा ४१ का संशोधन .
(एक) उपधारा (१ ) के खण्ड (क) के स्थान पर , निम्नलिखित खण्ड स्थापित किया जाए, अर्थात्: -
"(क) समस्त उचित समयों पर तथा ऐसे सहायकों सहित , यदि कोई हो जो शासन अथवा किसी स्थानीय प्राधिकरण की सेवा में हों, जैसा कि वह उचित समझे, किसी भी स्थान में जो स्थापना हो या जिसके संबध में उसे यह विश्वास होने का कारण हो कि वह स्थापना, केन्द्रीय निरीक्षण प्रणाली द्वारा आवंटित है , प्रवेश कर सकेगा; " .
(दो) उपधारा (३ ) के स्थान पर , निम्नलिखित उपधास स्थापित की जाए, अर्थात्ः-
" (३ ) उपधारा ( १ ) में अंतर्विष्ट किसी बात के होते हुए भी, कोई भी निरीक्षक, श्रम आयुक्त या उसके द्वारा इस प्रकार प्राधिकृत किसी अधिकारी की अनुज्ञा के सिवाय किसी ऐसी स्थापना में अपनी शक्तियों का प्रयोग नहीं करेगा जहां कि बीस से अनधिक कर्मचारी नियोजित हैं . " .

THE MADHYA PRADESH SHOPS AND ESTABLISHMENTS
( SECOND AMENDMENT) ACT, 2025
| Received the assent of the Governor on the 15th December , 2025 ; assent first published in the "Madhya Pradesh Gazette ( Extra - ordinary ) " , dated the 15th December, 2025. ]
An Act further to amend the Madhya Pradesh Shops and Establishments Act, 1958 .
Be it enacted by the Madhya Pradesh Legislature in the seventy - sixth year of the Republic of India as follows : -
Short title and commencement .
1. (1) This Act may be called the Madhya Pradesh Shops and Establishments (Second Amendment) Act , 2025 .
(2) It shall come into force from the date of its publication in the Madhya Pradesh Gazette .
Amendment of Section 2 .
2. In Section 2 of the Madhya Pradesh Shops and Establishments Act , 1958 (No. 25 of 1958 ) ( hereinafter referred to as the principal Act) , -
( i) after clause ( 1 ) , the following clause shall be inserted , namely : -
" ( 1A) " central inspection system " means the online, computerized platform notified by the state Government for scheduling, allocating , conducting and monitoring inspections under this Act ; " .
(ii) after clause ( 19) , the following clause shall be inserted , namely: -
" ( 19A) "portal " means the online website notified by the Department of Labour of the Government of Madhya Pradesh ; " .
(iii) for clause (20) , the following clause shall be substituted , namely : -
" (20) " register of establishments " means " collation of the portal generated registration certificates issued under this Act " .
(iv) for clause (21 ) , the following clause shall be substituted, namely: -
"(21 ) " registration certificate " means a digital certificate generated by the portal; " .
Substitution of Section 6 .
3. For Section 6 of the principal Act , the following Section shall be substituted, namely: -
Registration of establishments .
"6. (1 ) Every establishment to which this Act applies shall be registered in accordance with the provision of this Section .
(2) Within thirty days from the date on which this Act applies to an establishment , its employer shall , apply in the prescribed format on the portal together with such fees , as may be prescribed containing-
(a) the name of the employer, the manager and the person holding positions of management , if any;
(b) the postal address of, and the date of starting the business by, the establishment ;

(c) the name, if any, of the establishment ;
(d) the category of the establishment , i.e. whether it is a shop , commercial establishment , residential hotel , restaurant , eating - house , theatre or other place of public amusement or entertainment ; and
(e) such other particulars , as may be prescribed.
(3) On receipt of the prescribed information online and the fees , a certificate of registration in the prescribed format shall automatically be generated by the portal . The registration certificate shall be prominently displayed at the establishment .
(4) The registration fee shall be as prescribed in the rules but shall not exceed rupees two thousand and five hundred per establishment . " .
Substitution of Section 7 .
4. For Section 7 of the principal Act , the following section shall be substituted, namely: -
updated in the portal . Change to be " 7. It shall be the duty of an employer to update any change in respect of any information contained in his statement under section 6 within seven days after the change has taken place on the portal . On updation, the register of the establishments shall be changed by the portal and gener- ate the amended registration certificate or a fresh registration certificate, if necessary. " .
Substitution of Section 8 .
5. For Section 8 of the principal Act , the following section shall be Substituted, namely: -
Closing of es- tablishment to be updated in the portal .
" 8. The employer shall , within ten days of closing of the establishment update the closure of such establishments on the portal . On updation , such establishment shall be removed from the register of establishments by the portal and registration certificate shall be cancelled" .
6. In Section 41 of the principal Act , -
Amendment of Section 41 .
(i) for clause ( a) of sub -section ( 1 ) , the following clause shall be substituted , namely: -
"(a) enter, at all reasonable times and with such assistants , if any, being person in the service of the Government or of any local authority, as he thinks fit , any place which is or which he has reasons to believe is an establishment allotted by central inspection system; " .
(ii) For sub - section (3 ) , the following sub - section shall be substituted, namely: -
"(3) Notwithstanding anything contained in sub - section ( 1 ) , no inspector shall exercise his powers , in an establishment where not more than twenty employees are employed, except with the permission of the Labour Commissioner or an officer so authorised by him . " .
