भारतीय स्टाम्प ( मध्यप्रदेश द्वितीय संशोधन) अधिनियम , २०२५
[ दिनांक १० दिसम्बर, २०२५ को राष्ट्रपति की अनुमति प्राप्त हुई; अनुमति " मध्यप्रदेश राजपत्र (असाधारण ) " में दिनांक १७ दिसम्बर , २०२५ को प्रथमबार प्रकाशित की गई . ]
मध्यप्रदेश राज्य को लागू हुए रूप में, भारतीय स्टाम्प अधिनियम , १८६६ को और संशोधित करने हेतु अधिनियम .
भारत गणराज्य के छिहत्तरवें वर्ष में मध्यप्रदेश विधान- मण्डल द्वारा निम्नलिखित रूप में यह अधिनियमित हो:-
१ . ( १) इस अधिनियम का संक्षिप्त नाम भारतीय स्टाम्प ( मध्यप्रदेश द्वितीय संशोधन ) अधिनियम, २०२५ है .
संक्षिप्त नाम और प्रारंभ
( २ ) यह मध्यप्रदेश राजपत्र में इसके प्रकाशन की तारीख से प्रवृत्त होगा .
२ . मध्यप्रदेश राज्य को लागू हुए रूप में , भारतीय स्टाम्प अधिनियम, १८६६ ( १८६६ का सं . २ ) ( जो इसमें इसके पश्चात् मूल अधिनियम के नाम से निर्दिष्ट है ) को इसमें इसके पश्चात् उपबंधित रीति में संशोधित किया जाए .
मध्यप्रदेश राज्य को लागू हुए रूप में केन्द्रीय अधिनियम, १८६६ का संख्यांक २ का संशोधन .
३. मूल अधिनियम की धारा ३५ में, परन्तुक में, खंड ( क) के स्थान पर, निम्नलिखित खण्ड स्थापित किया जाए , अर्थात्ः- धारा ३५ का संशोधन .
" ( क) कोई ऐसी लिखत , उस शुल्क के जिससे कि वह प्रभार्य है , भुगतान कर दिये जाने पर अथवा उस लिखत की दशा में, जो अपर्याप्त रूप से स्टाम्पित है , ऐसे शुल्क को पूरा करने के लिए अपेक्षित रकम , स्टाम्प शुल्क की कमी वाले भाग के लिए प्रति माह अथवा उसके भाग के लिए लिखत के निष्पादन की तारीख से एक प्रतिशत के बराबर शास्ति का भुगतान कर दिये जाने पर साक्ष्य में ग्राह्य, रजिस्ट्रीकृत अथवा अधिप्रमाणित होगी . किसी भी मामले में इस प्रकार संगणित की गई शास्ति की राशि वसूल किए जाने वाले कम स्टाम्प शुल्क की मूल राशि से अधिक नहीं होगीः
परन्तु, उक्त के अतिरिक्त स्टाम्प शुल्क की कम वाले भाग के लिए प्रतिमाह अथवा उसके भाग के लिए , लिखत के निष्पादन की तारीख से भुगतान दिनांक तक एक प्रतिशत के बराबर ब्याज भी देय होगा. "
४. मूल अधिनियम की धारा ४० में , उपधारा ( १ ) में , खण्ड ( ख) के स्थान पर, निम्नलिखित खण्ड स्थापित किया जाए , अर्थातः- धारा ४० का संशोधन .
" ( ख ) ( एक ) यदि , जांच करने के पश्चात्, उसकी यह राय है कि ऐसी लिखत शुल्क से प्रभार्य है और वह सम्यक रूप से स्टाम्पित नहीं है , तो वह यह अपेक्षा करेगा कि उचित शुल्क या उसे पूरा करने के लिए अपेक्षित रकम, स्टाम्प शुल्क की कमी वाले भाग के लिये प्रति माह अथवा उसके भाग के लिए लिखत के निष्पादन की तारीख से एक प्रतिशत के बराबर शास्ति का भुगतान किया जाए तथा उस पर पृष्ठांकन द्वारा यह प्रमाणित करेगा कि वह सम्यक् रूप से स्टाम्पित है. यह रकम उस व्यक्ति द्वारा देय होगी , जो कि शुल्क का भुगतान करने के लिए दायी होः
परन्तु किसी भी मामले में इस प्रकार संगणित की गई शास्ति की राशि वसूल किए जाने वाले कम स्टाम्प शुल्क की मूल राशि से अधिक नहीं होगी;
(दो) उक्त के अतिरिक्त , स्टाम्प शुल्क की कमी वाले भाग के लिए प्रतिमाह अथवा उसके भाग के लिए लिखत के निष्पादन की तारीख से भुगतान दिनांक तक एक प्रतिशत के बराबर ब्याज भी देय होगाः 704 (2)

परन्तु जब ऐसी लिखत केवल इस कारण से परिबद्ध की गई है कि वह इस अधिनियम की धारा १३ या धारा १४ के उल्लंघन में लिखी गई है , तब कलेक्टर , यदि यह ठीक समझे तो , इस धारा द्वारा विहित की गई पूरी शास्ति तथा ब्याज को माफी दे सकेगा; " .
५ . मूल अधिनियम की धारा ४१ के स्थान पर, निम्नलिखित धारा स्थापित की जाए , अर्थातूः-
धारा ४१ का संशोधन .
घटनावश असम्यक रूप से स्टाम्पित लिखतें .
"( ४१ ) . रसीद या विनियम - पत्र या वचन - पत्र से भिन्न कोई ऐसी लिखत, जो शुल्क से प्रभार्य है और सम्यक् रूप से स्टाम्पित नहीं है , यदि किसी व्यक्ति द्वारा स्व- प्रेरणा से उसके निष्पादन अथवा प्रथम निष्पादन की तारीख से एक वर्ष के भीतर कलक्टर के समक्ष पेश की जाती है और ऐसा व्यक्ति कलक्टर की जानकारी में यह तथ्य लाता है कि ऐसी लिखत सम्यक् रूप से स्टाम्पित नहीं है और उचित शुल्क की रकम , अथवा उसके पूरा करने के लिए अपेक्षित रकम स्टाम्प शुल्क की कमी वाले भाग के लिए प्रतिमाह अथवा उसके भाग के लिए लिखत के निष्पादन की तारीख से भुगतान दिनांक तक एक प्रतिशत के बराबर ब्याज के साथ चुकाने की कलक्टर को प्रस्थापना करता है , और कलक्टर का समाधान हो जाता है कि ऐसी लिखत घटनावश , भूल या अत्यधिक आवश्यकता के कारण सम्यक् रूप से स्टाम्पित नहीं हो पाई थी, तो वह ऐसी रकम को स्वीकार कर सकेगा और इसके पश्चात् इसमें विहित रूप से आगे की कार्यवाही करेगा. " .

THE INDIAN STAMP (MADHYA PRADESH SECOND AMENDMENT) ACT, 2025
[Received the assent of the President on the 10th December , 2025 ; assent first published in the "Madhya Pradesh Gazette (Extra - ordinary) " , dated the 17th December , 2025. ]
An Act further to amend the Indian Stamp Act, 1899 in its application to the State of Madhya Pradesh .
Be it enacted by the Madhya Pradesh Legislature in the seventy- sixth year of the Republic of India as follows : -
Short title and commencement .
1. (1 ) This Act may be called the Indian Stamp (Madhya Pradesh Second Amend- ment ) Act , 2025 .
(2) It shall come into force from the date of its publication in the Madhya Pradesh Gazette .
2. The Indian Stamp Act , 1899 (II of 1899) ( hereinafter referred to as the principal Act) , shall in its application to the State of Madhya Pradesh be amended in the manner hereinafter provided .

Amendment of Section 35 .
3. In Section 35 of the principal Act , in the proviso , for clause ( a) , the following clause shall be substituted , namely: -
"( a) any such instrument shall be admitted in evidence , registered or authenticated on payment of the duty with which the same is chargeable, or in the case of an instrument insufficiently stamped of the amount required to make up such duty together with a penalty of one percent of the deficient portion of stamp duty for every month or part thereof, from the date of execution of the instrument , but in no case the amount of penalty so calculated shall exceed the principal amount of deficit stamp duty to be recovered: Provided that in addition to above , an interest of one percent of the deficient portion of stamp duty for every month or part thereof, from the date of execution of the instrument till date of payment shall also be payable; " .
Substitution of Section 40 .
4. In Section 40 of the principal Act , in sub- section ( 1 ) , for clause (b) , the follow- ing clause shall be substituted , namely: -
" (b) ( i) if, after holding an enquiry, he is of the opinion that such instrument is chargeable with duty and is not duly stamped, he shall require the payment of the proper duty or the amount required to make up the same, together with a penalty of one percent of the deficient portion of stamp duty for every month or part thereof from the date of execution of the instrument and shall certify by endorsement thereon that it is duly stamped . The amount shall be payable by the person liable to pay the duty:
Provided that in no case the amount of penalty so calculated shall exceed the principal amount of deficit stamp duty to be recovered ;
(ii) in addition to above , an interest of one percent of the deficient portion of stamp duty for every month or part thereof, from the date of execution of the instrument till date of payment shall also be payable :
Provided that when such instrument has been impounded only because it has been written in contravention of Section 13 or Section 14 of this Act, the Collector may, if he thinks fit, remit the whole penalty and interest pre- scribed by this section; " .

Amendment of Section 41 .
5. For Section 41 of the principal Act , the following section shall be substituted , namely : -
Instrument un- duly stamped by accident.
"41. If any instrument chargeable with duty and not duly stamped , not being a receipt or a bill of exchange or promissory note , is produced by any person of his own motion before the Collector within one year from the date of its execution or first execution, and such person brings to the notice of the Collector the fact that such instrument is not duly stamped and offers to pay to the Collector the amount of the proper duty , or the amount required to make up the same , together with an interest of one percent of the deficient portion of stamp duty for every month or part thereof, from the date of execution of the instrument till date of pay- ment, and the Collector is satisfied that the omission to duly stamp such instrument has been occasioned by accident , mistake or urgent necessity, he may, receive such amount and proceed as next hereinafter prescribed. " .
