[दिनांक १७ दिसम्बर, २०२५ को राज्यपाल की अनुमति प्राप्त हुई; अनुमति " मध्यप्रदेश राजपत्र ( असाधारण) " में दिनांक १६ दिसम्बर, २०२५ को प्रथमबार प्रकाशित की गई . ] मध्यप्रदेश नगरपालिका अधिनियम , १ ९ ६१ को और संशोधित करने हेतु अधिनियम. भारत गणराज्य के छिहत्तरवें वर्ष में मध्यप्रदेश विधान- मण्डल द्वारा निम्नलिखित रूप में यह अधिनियमित होः-
संक्षिप्त नाम और प्रारंभ.
१. (१ ) इस अधिनियम का संक्षिप्त नाम मध्यप्रदेश नगरपालिका ( संशोधन ) अधिनियम, २०२५ है . (२ ) यह "मध्यप्रदेश राजपत्र ' ' में इसके प्रकाशन की तारीख से प्रवृत्त होगा.
धारा १ ९ का संशोधन .
२. मध्यप्रदेश नगरपालिका अधिनियम , १ ९ ६१ (क्रमांक ३७ सन् १ ९ ६१ ) (जो इसमें इसके पश्चात् मूल अधिनियम के नाम से निर्दिष्ट है ) की धारा १९ में, उपधारा (१ ) में, खण्ड (क) के स्थान पर, निम्नलिखित खण्ड स्थापित किया जाए, अर्थात्: - " (क) नगरपालिका क्षेत्र से प्रत्यक्ष निर्वाचन द्वारा निर्वाचित अध्यक्ष अर्थात् सभापति (चेयरपर्सन ) ; " .
धारा २० का संशोधन.
३. मूल अधिनियम की धारा २० में, -
(एक) उपधारा (२ ) में, खण्ड (ख ) में, उपखण्ड (तीन ) के स्थान पर, निम्नलिखित उपखण्ड स्थापित किया जाए, अर्थात्ः-
"(तीन ) अध्यक्ष के निर्वाचन की दशा में, नगरपालिका क्षेत्र के किसी मतदाता द्वारा ; " ;
(दो) उपधारा (३ ) में , खण्ड (एक ) के स्थान पर, निम्नलिखित खण्ड स्थापित किया जाए, अर्थात्: -
"(एक) वह उस तारीख से, जिसको कि ऐसे निर्वाचन या नामनिर्देशन का परिणाम राजपत्र में अधिसूचित किया गया है, तीस दिन के भीतर प्रस्तुत न की जाए, और . " .
धारा ३२ का संशोधन.
४. मूल अधिनियम की धारा ३२ में, शब्द " पार्षदों " , जहां कहीं भी वह आया हो , के पूर्व शब्द "अध्यक्ष तथा " अंतःस्थापित किए जाएं.

५. मूल अधिनियम की धारा ३२ - क के स्थान पर , निम्नलिखित धारा स्थापित की जाए, अर्थात्: -
धारा ३२ - क का स्थापन .
निर्वाचन व्ययों का लेखा.
"३२ - क. ( १ ) अध्यक्ष तथा पार्षदों का प्रत्येक अभ्यर्थी निर्वाचन संबंधी उपगत उस सब व्यय का जो, उस तारीख के जिसको वह नामनिर्दिष्ट किया गया है और उस निर्वाचन के परिणामों की घोषणा की तारीख के मध्य जिनके अंतर्गत ये दोनों तारीखें सम्मिलित हैं, स्वयं या उसके निर्वाचन अभिकर्ता द्वारा उपगत या उपगत करने के लिए प्राधिकृत किया गया है, पृथक् और सही लेखा या तो वह स्वयं रखेगा या अपने निर्वाचन अभिकर्ता द्वारा रखवाएगा .
स्पष्टीकरण-एक. - किसी अध्यक्ष तथा पार्षद के निर्वाचन के संबंध में किसी राजनैतिक दल द्वारा अथवा व्यक्तियों
के किसी अन्य संगम या निकाय द्वारा अथवा अध्यक्ष तथा पार्षद या उसके निर्वाचन अभिकर्ता से भिन्न किसी व्यक्ति द्वारा उपगत या प्राधिकृत किए गए किसी व्यय के बारे में इस उपधारा के प्रयोजनों के लिए यह नहीं समझा जाएगा कि वह निर्वाचन के संबंध में अध्यक्ष तथा पार्षद या उसके निर्वाचन अभिकर्ता द्वारा उपगत या प्राधिकृत किया गया व्यय है .
स्पष्टीकरण दो.- शंकाओं को दूर करने के लिए यह घोषित किया जाता है कि सरकार की सेवा में के और लोक प्रतिनिधित्व अधिनियम, १ ९ ५१ ( १ ९ ५१ का ४३ ) की धारा १२३ के खण्ड (७ ) में वर्णित वर्गों में से किसी व्यक्ति द्वारा या उस खण्ड के परन्तुक में यथा वर्णित अपने पदीय कर्तव्य के निर्वहन या तात्पर्यित निर्वहन में किए गए किसी इंतजाम, दी गई किसी सुविधा या किए गए किसी अन्य कार्य या की गई किसी बात की बावत् उपगत किसी व्यय के बारे में इस उपधारा के प्रयोजनों के लिए यह नहीं समझा जाएगा कि वह निर्वाचन के संबंध में अध्यक्ष तथा पार्षद या उसके निर्वाचन अभिकर्ता द्वारा उपगत या प्राधिकृत किया गया व्यय है.
(२ ) उक्त व्यय का जोड़ उस रकम से अधिक नहीं होगा जो राज्य सरकार द्वारा निर्वाचन आयोग के परामर्श से विहित कीजाए.
(३ ) व्यय के लेखे में ऐसी विशिष्टियां अन्तर्विष्ट होंगी जैसी राज्य निर्वाचन आयोग द्वारा विहित की जाएं. " .
६. मूल अधिनियम की धारा ३२ - ख में , शब्द " पार्षद " के पूर्व , शब्द " अध्यक्ष तथा अंतःस्थापित किए जाएं .
धारा ३२ -ा का संशोधन.
७. मूल अधिनियम की धारा ३२ - ग में , शब्द "पार्षद " के पूर्व, शब्द " या अध्यक्ष ' अंतःस्थापित किए जाएं .
धारा ३२ - ग का संशोधन.
धारा ३३ का संशोधन.
८. मूल अधिनियम की धारा ३३ में, शब्द "पार्षदों " या " पार्षद " , जहां कहीं भी वह आया हो , के पूर्व शब्द " अध्यक्ष या " अंतःस्थापित किए जाएं.
धारा ३४ का संशोधन.
९. मूल अधिनियम की धारा ३४ में, उपधारा (३ ) के पश्चात्, निम्नलिखित उपधारा जोड़ी जाए, अर्थात्: -
" (४ ) यदि कोई व्यक्ति अध्यक्ष और पार्षद दोनों पदों के लिए निर्वाचित हो जाता है, तो उसे निर्वाचित घोषित किए जाने की तारीख से सात दिवस के भीतर किसी एक पद से अपना त्यागपत्र देना होगा. " .
धारा ३५ का संशोधन.
१०. मूल अधिनियम की धारा ३५ में , प्रारंभिक पैरा के स्थान पर, निम्नलिखित पैरा स्थापित किया जाए, अर्थात्ः-
"कोई भी व्यक्ति अध्यक्ष या पार्षद के पद के लिए अभ्यर्थी के रूप में निर्वाचित या नामनिर्देशित होने के लिए पात्र नहीं होगा, यदि वह-" .
धारा ४३ का संशोधन.
११. मूल अधिनियम की धारा ४३ में, -
(एक ) पार्श्व शीर्ष में, शब्द " अध्यक्ष तथा " का लोप किया जाए,
(दो) उपधारा ( १ ) में, शब्द " अध्यक्ष तथा " और शब्द "एक अध्यक्ष तथा " का लोप किया जाए.
(तीन ) उपधारा (३ ) में, शब्द "अध्यक्ष तथा " का लोप किया जाए.
धारा ४३ - क का १२. मूल अधिनियम की धारा ४३ - क में, -
संशोधन.
(एक ) पार्श्व शीर्ष में , शब्द " अध्यक्ष या " का लोप किया जाए.

दो ) उपधारा (१ ) में , शब्द " अध्यक्ष या " जहां कहीं भी वे आए हों, का लोप किया जाए .
( (तीन ) उपधारा (२ ) में खण्ड (दो ) में, शब्द और अल्प विराम " अध्यक्ष, " का लोप किया जाए.
धारा ४५ का संशोधन.
१३. मूल अधिनियम की धारा ४५ में, पार्श्व शीर्ष में तथा उपबंध में, शब्द "पार्षदों " से पूर्व, शब्द " अध्यक्ष तथा " अंतःस्थापित किए जाएं.
१४. मूल अधिनियम की धारा ४५ और धारा ४६ , जो कि रिक्त है, के पश्चात् निम्नलिखित धारा अंतःस्थापित की धारा ४७ का अंतःस्थापन .
जाए, अर्थात्: -
अध्यक्ष का वापस बुलाया जाना.
"४७. (१ ) किसी परिषद् के अध्यक्ष द्वारा अपना पद तत्काल रिक्त कर दिया गया समझा जाएगा यदि उसे ऐसी प्रक्रिया के अनुसार जो कि विहित की जाए, नगरपालिका क्षेत्र के मतदान करने वाले मतदाताओं की कुल संख्या के आधे से अधिक मतदाताओं के बहुमत द्वारा गुप्त मतदान से वापस बुलाया जाए:
परन्तु वापस बुलाने की ऐसी कोई प्रक्रिया तब तक आरंभ नहीं की जाएगी , जब तक कि निर्वाचित पार्षदों की कुल संख्या के कम से कम तीन चौथाई पार्षदों द्वारा प्रस्ताव पर हस्ताक्षर न कर दिए जाएं और उसे कलक्टर को प्रस्तुत न कर दिया जाए:
परन्तु यह और कि, ऐसी कोई प्रक्रिया-
(एक ) उस तारीख से जिसको कि ऐसा अध्यक्ष निर्वाचित होता है और अपना पद धारण करता है , तीन वर्ष की कालावधि के भीतर आरंभ नहीं की जाएगी;
(दो) यदि उपचुनाव में निर्वाचित अध्यक्ष की आधी कालावधि का अवसान न हो गया हो, आरंभ नहीं कीजाएगी:
परन्तु यह और भी कि अध्यक्ष को वापस बुलाए जाने की प्रक्रिया उसकी संपूर्ण अवधि में एक बार से अधिक बार आरंभ नहीं की जाएगी.
(२ ) कलक्टर अपना समाधान कर लेने और यह सत्यापन कर लेने के पश्चात् कि उपधारा (१ ) में विनिर्दिष्ट तीन चौथाई पार्षदों ने वापस बुलाए जाने के प्रस्ताव पर हस्ताक्षर कर दिए हैं, प्रस्ताव राज्य सरकार को भेजेगा और राज्य सरकार उसे राज्य निर्वाचन आयोग को निर्देशित करेगी;
(३ ) राज्य निर्वाचन आयोग निर्देश प्राप्त होने पर, वापस बुलाए जाने के प्रस्ताव पर, ऐसी रीति में जैसी किविहित की जाए, मतदान कराने के लिए व्यवस्था करेगा . " .
धारा ५५ का संशोधन.
१५. मूल अधिनियम की धारा ५५ में, शब्द "अध्यक्ष तथा'' का लोप किया जाए.
धारा ६३ का संशोधन.
१६. मूल अधिनियम की धारा ६३ में, परन्तुक में , शब्द "किसी समिति के सभापति " से पूर्व , शब्द "उपाध्यक्ष, या " अन्तःस्थापित किया जाए.
धारा ३२८ का संशोधन .
१७. मूल अधिनियम की धारा ३२८ में , उपधारा ( १ ) में, खण्ड (ख ) में, शब्द "अध्यक्ष तथा " जहां कहीं भी वे आए हों, कालोप किया जाए.
निरसन या व्यावृत्ति. १८. (१ ) मध्यप्रदेश नगरपालिका (संशोधन ) अध्यादेश २०२५ (क्रमांक ०१ सन् २०२५ ) एतद्वारा निरसित किया जाता है.
(२ ) उक्त अध्यादेश के निरसन के होते हुए भी, उक्त अध्यादेश के अधीन की गई कोई बात या की गई कोई कार्यवाई, इस अधिनियम के तत्स्थानी उपबंधों के अधीन की गई बात या की गई कार्यवाही समझी जाएगी.

MADHYA PRADESH ACT
No. 29 OF 2025
THE MADHYA PRADESH MUNICIPALITIES ( AMENDMENT) ACT, 2025 [ Received the assent of the Governor on the 17th December , 2025 ; assent first published in the "Madhya Pradesh Gazette ( Extra - ordinary) " , dated the 19th December , 2025. ]
An Act further to amend the Madhya Pradesh Municipalities Act , 1961 .
Be it enacted by the Madhya Pradesh Legislature in the seventy - sixth year of the Republic of India as follows : -
Short title and commencement .
1. ( 1) This Act may be called the Madhya Pradesh Municipalities (Amendment) Act, 2025 .
(2) It shall come into force from the date of its publication in the Madhya Pradesh Gazette .
Amendment of Section 19 .
2. In Section 19 of the Madhya Pradesh Municipalities Act , 1961 (No. 37 of 1961 ) (hereinafter referred to as the principal Act) , in sub - section ( 1 ) , for clause (a) , the following clause shall be substituted, namely : -
"( a) the President , that is Chairperson , elected by direct election from the Municipal area ; " .
3. In Section 20 of the principal Act , -
Amendment of Section 20 .
(i) in sub -section (2) , in clause (b) , for sub -clause ( iii) , the following sub- clause shall be substituted, namely: -
"(iii) in the case of election of President by any voter of the Municipal area; " ;
(ii) in sub - section (3) , for clause ( i ) , the following clause shall be substituted, namely : -
"(i) it is presented within thirty days from the date on which the result of such election or nomination was notified in the Gazette ; and . " .
Amendment of Section 32 .
4. In Section 32 of the principal Act , before the word " Councillors " , wherever it occurs the words " President and " shall be inserted .
Substitution of Section 32 - A .
5. For Section 32 -A of the principal Act , the following section shall be substituted , namely:-
"
Account of election expensess.
32- A. ( 1 ) Every candidate at election of President and Councillor shall , either by himself or by his election agent , keep a separate and correct account of all expenditures in connection with the election incurred or authorized by him or by his election agent between the date on which he has been nominated and the date of declaration of the result thereof, both dates inclusive .
Explanation - I.- Any expenditure incurred or authorised in connection with the election of a President and Councillor by a political party or by any other asso- ciation or body of persons or by any individual other than the President and Councillor or his election agent shall not be deemed to be expenditure in connec- tion with the election incurred or authorised by the President and Councillors or by his election agent for the purpose of this sub - section .
Explanation - II.- For the removal of doubt , it is hereby declared that any expen- diture incurred in respect of any arrangement made, facilities provided or any other मध्यप्रदेश राजपत्र, दिनांक 19 दिसम्बर 2025

act or thing. done by any person in the service of the Government and belonging to any of the classes mentioned in clause (7) of Section 123 of the Representation of the Peoples Act , 1951 (43 of 1951 ) , in the discharge or purported discharge of his official duty as mentioned in the proviso to that clause shall not be deemed to be expenditure in connection with the election incurred or authorised by a President and Councillors or by his election agent for the purpose of this sub - section .
(2) The total of the said expenditure shall not exceed, such amount , as may be prescribed by the State Government , in consultation with the State Election Commission .
(3) The account of expenditure shall contain such particulars , as may be prescribed by the State Election Commission . " .
Amendment of Section 32- B .
6. In Section 32 -B of the principal Act , before the word "Councillor " , the words "President and " shall be inserted .
Amendment of Section 32 - C .
7. In Section 32 - C of the principal Act , before the word "Councillor " , the words "President or shall be inserted .
Amendment of Section 33 .
8. In Section 33 of the principal Act , before the word "Councillors " or " Councillor " , wherever it occurs the words " President or " shall be inserted.
Amendment of Section 34 .
9. In Section 34 of the principal Act , after sub - section (3 ) , the following sub - section shall be added, namely: -
"(4) If any person is elected to both the offices of President and Councillor, he shall , within seven days from the date on which he is so declared to be elected , resign from either of the offices . " .
Amendment of Section 35 .
10. In Section 35 of the principal Act , for the opening paragraph , the following paragraph shall be substituted , namely: -
"No person shall be eligible to be elected or nominated as a candidate for the office of President or Councillor, if he- " .
11. In Section 43 of, the principal Act , -
Amendment of Section 43 .
(i) in the marginal heading, the words " President and " shall be omitted.
(ii) in sub - section ( 1 ) , the words "President and " and the words " a President and shall be omitted .
(iii) in sub - section (3 ) , the words " the President and " shall be omitted.
12. In Section 43 - A of the principal Act, -
Amendment of Section 43 - A .
(i) in the marginal heading , the words "President or " shall be omitted.
(ii) in sub - section ( 1 ) , the words " the President or " wherever they occur shall be omitted .
(iii) in sub - section (2 ) , in clause ( ii ) , the word and comma " President , " shall be omitted .
Amendment of Section 45.
13. In Section 45 of the principal Act , in the marginal heading and in the provision, before the word "Councillors " , the words "President and " shall be inserted.

Insertion of Section 47 .
14. After Section 45 of the principal Act and Section 46 that is vacate , the following section shall be inserted, namely: -
Recalling of President .
"47. ( 1 ) President of any Council shall forthwith be deemed to have vacated his office , if he is recalled through a secret ballot by a majority of more than half of the total number of voters of the municipal area casting the vote in accordance with the procedure , as may be prescribed: Provided that no such process for recall shall be initiated unless a proposal is signed by not less than three- fourth of the total number of elected Councillors and presented to the Collector :
Provided further that no such process shall be initiated: -
(i) within a period of three years from the date on which such President is elected and enters his office;
(ii) if half of the period of tenure of the President elected in a by- election has not expired:
Provided also that process for recall of the President shall not be initiated more than once in his whole term .
(2) The Collector, after satisfying himself and verifying that the three fourth of the Councillors specified in sub - section ( 1 ) have signed the proposal of recall , shall send the proposal to the State Government and the State Government shall make a reference to the State Election Commission .
(3) On receipt of the reference, the State Election Commission shall arrange for voting on the proposal of recall in such manner, as may be prescribed. "
15. In Section 55 of the principal Act , the words " a President and " shall be omitted .
Amendment of Section 55 .
Amendment of Section 63 .
16. In Section 63 of the principal Act , in the proviso , before the words "the Chairman of any committee " , the words "Vice- President , or " shall be inserted .
Amendment of Section 328 .
17. In Section 328 of the principal Act, in sub -section ( 1 ) , in clause (b) , the words "President and " wherever they occur shall be omitted .
Repeal and saving .
18. ( 1 ) The Madhya Pradesh Municipalities (Amendment ) Ordinance , 2025 (No. 1 of 2025) is hereby repealed .
(2) Notwithstanding the repeal of the said Ordinance , anything done or any action taken under the said Ordinance shall be deemed to have been done or taken under the corresponding provision of this Act .
