क्रमांक 3/3 /4 / 0006 / 2025 - B -4-02 ( HOM ) भारत के संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए , मध्य प्रदेश के राज्यपाल , एतदद्वारा मध्य प्रदेश पुलिस कार्यपालिक ( अराजपत्रित ) सेवा भर्ती नियम, 1997 में निम्नलिखित और संशोधन करते हैं : - अर्थातः-
संशोधन
उक्त नियमों में -
1 नियम 2 में, खण्ड (ट ) के पश्चात, निम्नलिखित खण्ड जोड़ा जाए,
अर्थात : -
"(ठ)" " उभयलिंगी व्यक्ति" से अभिप्रेत है ऐसा व्यक्ति जिसका लिंग जन्म के समय उस व्यक्ति के नियत लिंग से मेल नहीं खाता है और इसके अंतर्गत उभय- पुरुष या उभय - स्त्री ( चाहे ऐसे व्यक्ति ने लिंग पुनः निर्धारण शल्यक्रिया या हार्मोन चिकित्सा या लेजर चिकित्सा या ऐसी अन्य चिकित्सा करवाई हो या नहीं ) अंतःलिंग विभिन्नताओं वाले व्यक्ति, लिंग समलैंगिक और किन्नर , हिजडा अरावाणी और जोगता जैसी सामाजिक-सांस्कृतिक पहचान रखने वाले व्यक्ति भी सम्मिलित हैं । "

2. नियम 8 में, -
(1 ) उप-नियम ( 1 ) में, -
(एक ) खण्ड (झ ) में, अन्त में , चिन्ह " । " के स्थान पर , चिन्ह " ; " स्थापित किया जाए;
(दो ) खण्ड (झ ) के पश्चात्, निम्नलिखित खण्ड अन्तःस्थापित किया जाए,
अर्थात्ः-
" (ञ ) उभयलिंगी व्यक्ति के संबंध में, जैसा कि उभयलिंगी व्यक्ति को जारी प्रमाण-पत्र में उल्लिखित है , यदि प्रमाण-पत्र में पुरुष उल्लिखित किया गया है , तब पुरुष अभ्यर्थी के लिए विहित मानक लागू होंगे , और यदि महिला उल्लिखित किया गया है, तब महिला अभ्यर्थी के लिए विहित मानक लागू होंगे । " ।
(2 ) उप - नियम ( 2 ) में.-
(एक ) खण्ड ( घ ) में, अन्त में , चिन्ह " । " के स्थान पर , चिन्ह " , " स्थापित किया जाए ,
(दो ) खण्ड ( घ ) के पश्चात्, निम्नलिखित खण्ड जोड़ा जाए , अर्थात्ः-
" (ड. ) उभयलिंगी व्यक्ति हेतु शारीरिक उपयुक्तता परीक्षण-उभललिंगी व्यक्ति को, जिला मजिस्ट्रेट द्वारा जारी पहचान प्रमाण-पत्र के अनुसार पुरुष / महिला के लिए विहित मानक लागू होंगे । " ।
3. नियम 11 में , उप- नियम ( 8 ) के पश्चात्, निम्नलिखित उप- नियम जोड़ा जाए, अर्थात्ः-
" ( 9 ) मध्यप्रदेश शासन , पिछड़ा वर्ग एवं अल्पसंख्यक कल्याण विभाग के आदेश क्रमांक 118 , दिनांक 17 अप्रैल , 2023 जो कि मध्यप्रदेश राजपत्र (आसाधारण ) , दिनांक 18 अप्रैल, 2023 में प्रकाशित हुआ था, के अनुसार उभयलिंगी व्यक्ति को अन्य पिछड़ा वर्ग (ओ.बी.सी. ) की श्रेणी में रखा गया है । चयन में, जिला मजिस्ट्रेट द्वारा जारी पहचान प्रमाण-पत्र के अनुसार , उभयलिंगी अभ्यर्थी को अन्य पिछड़े वर्ग की श्रेणी में पुरुष/ महिला पद के विरूद्ध नियुक्त किया जाएगा। " ।
4. अनुसूची- पांच में , अंत में , निम्नलिखित टीप जोड़ी जाए , अर्थात्ः-
"टीप.- उभयलिंगी व्यक्ति हेतु शारीरिक मापदंड परीक्षण उभयलिंगी व्यकि को, जिला मजिस्ट्रेट द्वारा जारी पहचान प्रमाण-पत्र के अनुसार पुरुष/ महिला के लिए विहित मानक लागू होंगे। " ।

क्र.- 3-3-4-0006-2025 - बी - चार -2 (HOM) .- भारत के संविधान के अनुच्छेद 348 के खण्ड (3 ) के अनुसरण में, इस आशय की समसंख्यक अधिसूचना दिनांक 30 दिसम्बर 2025 का अंग्रेजी अनुवाद राज्यपाल के प्राधिकार से एतद्वारा प्रकाशित किया जाता है .

No. 3/ 3 /4/ 0006 / 2025 - B - 4-02 ( HOM ) , In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, the Governor of Madhya Pradesh, hereby, makes the following further amendments in the Madhya Pradesh Police Executive (Non- Gazetted) Service Recruitment Rules , 1997, namely: -
AMENDMENTS
In the said rules, -
1. in rule 2, after clause (k) , the following clause shall be added , namely : -
" (1 ) " Transgender Person " means a person whose gender does not match with the gender assigned to that person at birth and includes trans - man or trans- woman ( whether or not such person has undergone sex reassignment surgery or hormone therapy or laser therapy or such other therapy ) , person with intersex variations , gender - queer and person having such socio- cultural identities as kinner, hijra , aravani and jogta etc. " .
2. In rule 8, -
(1) in sub - rule ( 1) , -
(1) in clause (i) , at the end, for the symbol " . ", the symbol " ; " shall be substituted;
(ii) after clause (i ) , the following clause shall be added , namely: -
" (j ) in respect of transgender person, mentioned in the certificate issued to the the certificate , then the standards transgender person , if ' Male ' is mentioned in prescribed for male candidates and if ' Female ' is mentioned, then the standards prescribed for female candidates shall apply. " ;
(2) in sub - rule (2 ) , -
(i) in clause ( d) , at the end, for the symbol " " , the symbol " ; " shall be substituted;

" ( e ) physical fitness test for transgender person - As per the Certificate of Identity issued by the District Magistrate to the transgender person , the standards prescribed for male /female shall apply. " .
In rule 11 , after sub - rule ( 8) , the following sub - rule shall be added , namely: -
" (9) As per the Government of Madhya Pradesh , Backward Classes and Minorities Welfare Department's Order No. 118, dated 17th April , 2023 , which was published in the Madhya Pradesh Gazette ( Extraordinary ) , dated 18th April , 2023 , transgender persons have been placed in the Other Backward Classes (OBC ) category . Upon selection , as per the Certificate of Identity issued by the District Magistrate , the transgender candidate shall be appointed against the male / female post in the Other Backward Classes category. " .
4. In Schedule - V, at the end , the following note shall be added , namely : -
"Note.- Physical measurement test for transgender person - As per the Certificate of Identity issued by the District Magistrate to the transgender person , the standards prescribed for male / female shall apply. " .
