क्रमांक GAD / 2/ 0012/ 2024 / GAD - 1-01 ( GAD ) - भारत के संविधान के अनुच्छेद 166 के खण्ड (2 ) एवं (3 ) द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, मध्यप्रदेश के राज्यपाल, एतद्वद्वारा, मध्यप्रदेश शासन कार्य (आवंटन ) नियमों में निम्नलिखित और संशोधन करते हैं, अर्थात्ः-

संशोधन

उक्त नियमों में, नियम 2 में, अनुसूची में: -

1. शीर्षक " एक-सामान्य प्रशासन विभाग " के अंतर्गत भाग (अ ) में , अनुक्रमांक 95 में , मद क्रमांक (दो) तथा उससे संबंधित प्रविष्टियों के स्थान पर, निम्नलिखित मद क्रमांक तथा उससे संबंधित प्रविष्टियां स्थापित की जाएं , अर्थात्ः-

" (दो). भारतीय नागरिक सुरक्षा संहिता , 2023 ( 2023 का 46) की धारा 218 तथा विशेष/अन्य अधिनियमों के अधीन लोक सेवकों के विरुद्ध अभियोजन की स्वीकृति.

2. शीर्षक "दो-गृह विभाग " के अंतर्गत भाग (अ) में: -

1. शीर्षक " अ-सामान्य" के अंतर्गतः-

(क) अनुक्रमांक 32- ख तथा उससे संबंधित प्रविष्टियों के स्थान पर, निम्नलिखित अनुक्रमांक तथा उससे संबंधित प्रविष्टियां स्थापित की जाएं , अर्थातः-

"32-ख . राज्य शासन के विरुद्ध भारतीय न्याय संहिता, 2023 (2023 का 45) की धारा 196, 197 एवं 299 के अधीन किए गए दाण्डिक अपराधों तथा आपराधिक षड़यंत्र के अपराधियों के अभियोजन के लिए भारतीय नागरिक सुरक्षा संहिता , 2023 ( 2023 का 46) की धारा 217 के अधीन पूर्व अनुज्ञा. "

(ख) अनुक्रमांक 34 में , मद क्रमांक (दो ) तथा उससे संबंधित प्रविष्टियों के स्थान पर, निम्नलिखित मद क्रमांक तथा उससे संबंधित प्रविष्टियां स्थापित की जाएं , अर्थात्-

(दो) भारतीय नागरिक सुरक्षा संहिता, 2023 ( 2023 का 46) की धारा 218 तथा विशेष/अन्य अधिनियमों के अधीन लोक सेवकों के विरुद्ध अभियोजन की स्वीकृति. "

2. शीर्षक "आ- पुलिस " के अंतर्गत अनुक्रमांक 19 में मद क्रमांक ( दो) तथा उससे संबंधित प्रविष्टियों के स्थान पर निम्नलिखित मद क्रमांक तथा उससे संबंधित प्रविष्टियां स्थापित की जाएं , अर्थात्ः-

"(दो) भारतीय नागरिक सुरक्षा संहिता, 2023 ( 2023 का 46) की धारा 218 तथा विशेष/अन्य अधिनियमों के अधीन लोक सेवकों के विरुद्ध अभियोजन की स्वीकृति. "

3. शीर्षक " तीन -जेल विभाग" के अन्तर्गत भाग (अ) में, अनुक्रमांक 8 में, मद क्रमांक(दो) तथा उससे संबंधित प्रविष्टियों के स्थान , पर निम्नलिखित प्रविष्टियां स्थापित की जाएं, अर्थातः-

"(दो). भारतीय नागरिक सुरक्षा संहिता, 2023 (2023 का 46) की धारा 218 तथा विशेष/अन्य अधिनियमों के अधीन लोक सेवकों के विरुद्ध अभियोजन की स्वीकृति। " .

4. शीर्षक "चार-वित्त विभाग " के अंतर्गत, भाग (अ) में , अनुक्रमांक 37 में , मद क्रमांक(दो) तथा उससे संबंधित प्रविष्टियों के स्थान पर , निम्नलिखित मद क्रमांक तथा उससे संबंधित प्रविष्टियां स्थापित की जाएं, अर्थातः-

"(दो) . भारतीय नागरिक सुरक्षा संहिता , 2023 (2023 का 46) की धारा 218 तथा विशेष/अन्य अधिनियमों के अधीन लोक सेवकों के विरुद्ध अभियोजन की स्वीकृति। "

5. शीर्षक "पांच-वाणिज्यिक कर विभाग के अंतर्गत , भाग (अ) में, अनुक्रमांक 23 में, मद क्रमांक(दो) तथा उससे संबंधित प्रविष्टियों के स्थान पर , निम्नलिखित मद क्रमांक तथा उससे संबंधित प्रविष्टियां स्थापित की जाएं , अर्थातः-

"(दो) भारतीय नागरिक सुरक्षा संहिता, 2023 (2023 का 46) की धारा 218 तथा विशेष/अन्य अधिनियमों के अंतर्गत लोक सेवकों के विरुद्ध अभियोजन की स्वीकृति। ".

6. शीर्षक " सात-राजस्व विभाग" के अंतर्गत, भाग (अ) में अनुक्रमांक 50 में, मद क्रमांक( दो) तथा उससे संबंधित प्रविष्टियों के स्थान पर निम्नलिखित मद क्रमांक तथा उससे संबंधित प्रविष्टियां स्थापित की जाएं , अर्थात, - मध्यप्रदेश राजपत्र, दिनांक 30 दिसम्बर 2025

7. शीर्षक "आठ-परिवहन विभाग" के अंतर्गत भाग (अ) में अनुक्रमांक 12 में, मद क्रमांक(दो ) तथा उससे संबंधित प्रविष्टियों के स्थान पर निम्नलिखित मद क्रमांक तथा उससे संबंधित प्रविष्टियां स्थापित की जाएं , अर्थातः-

" (दो) भारतीय नागरिक सुरक्षा संहिता , 2023 (2023 का 46) की धारा 218 तथा विशेष/अन्य अधिनियमों के अधीन लोक सेवकों के विरुद्ध अभियोजन की स्वीकृति.

8. शीर्षक " नौं- खेल और युवा कल्याण विभाग " के अंतर्गत भाग (अ) में , अनुक्रमांक 21 में , मद क्रमांक(दो) तथा उससे संबंधित प्रविष्टियों के स्थान पर , निम्नलिखित मद क्रमांक तथा उससे संबंधित प्रविष्टियां स्थापित की जाएं , अर्थातः-

"(दो) भारतीय नागरिक सुरक्षा संहिता, 2023 (2023 का 46) की धारा 218 तथा विशेष/अन्य अधिनियमों के अधीन लोक सेवकों के विरुद्ध अभियोजन की स्वीकृति। "

9. शीर्षक "ग्यारह -औ‌द्योगिक नीति एवं निवेश प्रोत्साहन विभाग" के अंतर्गत भाग (अ) में,अनुक्रमांक 24 में , मद क्रमांक (दो) तथा उससे संबंधित प्रविष्टियों के स्थान पर निम्नलिखित मद क्रमांक तथा उससे संबंधित प्रविष्टियां स्थापित की जाएं , अर्थातः-

"(दो) भारतीय नागरिक सुरक्षा संहिता, 2023 (2023 का 46) की धारा 218 तथा विशेष/अन्य अधिनियमों के अधीन लोक सेवकों के विरुद्ध अभियोजन की स्वीकृति।"

10. शीर्षक " बारह -खनिज साधन विभाग " के अंतर्गत भाग (अ ) में अनुक्रमांक 10 में , मद क्रमांक (दो) तथा उससे संबंधित प्रविष्टियों के स्थान पर निम्नलिखित मद क्रमांक तथा उससे संबंधित प्रविष्टियां स्थापित की जाएं , अर्थात, -

"(दो) भारतीय नागरिक सुरक्षा संहिता, 2023 (2023 का 46) की धारा 218 तथा विशेष/अन्य अधिनियमों के अधीन लोक सेवकों के विरुद्ध अभियोजन की स्वीकृति.

11. शीर्षक " चौदह -किसान कल्याण तथा कृषि विकास विभाग" के अंतर्गत, भाग (अ ) में , अनुक्रमांक 18में , मद क्रमांक (दो) तथा उससे संबंधित प्रविष्टियों के स्थान पर निम्नलिखित मद क्रमांक तथा उससे संबंधित प्रविष्टियां स्थापित की जाएं , अर्थात, - मध्यप्रदेश राजपत्र , दिनांक 30 दिसम्बर 2025

12. शीर्षक "पंद्रह -सहकारिता विभाग " के अंतर्गत भाग (अ) में, अनुक्रमांक 9 में, मद क्रमांक(दो) तथा उससे संबंधित प्रविष्टियों के स्थान पर निम्नलिखित मद क्रमांक तथा उससे संबंधित प्रविष्टियां स्थापित की जाएं , अर्थातः-

" (दो) भारतीय नागरिक सुरक्षा संहिता, 2023 ( 2023 का 46) की धारा 218 तथा विशेष/अन्य अधिनियमों के अधीन लोक सेवकों के विरुद्ध अभियोजन की स्वीकृति । "

13. शीर्षक " सोलह -श्रम विभाग" के अंतर्गत भाग (अ ) में अनुक्रमांक 13 में, मद क्रमांक(दो) तथा उससे संबंधित प्रविष्टियों के स्थान पर निम्नलिखित मद क्रमांक तथा उससे संबंधित प्रविष्टियां स्थापित की जाएं, अर्थातः-

" (दो) भारतीय नागरिक सुरक्षा संहिता, 2023 (2023 का 46) की धारा 218 तथा विशेष/अन्य अधिनियमों के अधीन लोक सेवकों के विरुद्ध अभियोजन की स्वीकृति ! "

14. शीर्षक " सत्रह-लोक स्वास्थ्य एवं चिकित्सा शिक्षा विभाग " के अंतर्गत भाग (अ ) में, अनुक्रमांक 32 में, मद क्रमांक (दो) तथा उससे संबंधित प्रविष्टियों के स्थान पर निम्नलिखित मद क्रमांक तथा उससे संबंधित प्रविष्टियां स्थापित की जाएं , अर्थातः- "(दो) भारतीय नागरिक सुरक्षा संहिता, 2023 (2023 का 46) की धारा 218 तथा विशेष/अन्य अधिनियमों के अधीन लोक सेवकों के विरुद्ध अभियोजन की स्वीकृति । "

15. शीर्षक "अठारह -नगरीय विकास एवं आवास विभाग " के अंतर्गत भाग (अ) में, अनुक्रमांक 31 में, मद क्रमांक(दो)तथा उससे संबंधित प्रविष्टियों के स्थान पर निम्नलिखित मद क्रमांक तथा उससे संबंधित प्रविष्टियां स्थापित की जाएं , अर्थातः-

17. शीर्षक " बीस -स्कूल शिक्षा विभाग" के अंतर्गत भाग (अ ) में, अनुक्रमांक 25 में , मद क्रमांक (दो) तथा उससे संबंधित प्रविष्टियों के स्थान पर निम्नलिखित मद क्रमांक तथा उससे संबंधित प्रविष्टियां स्थापित की जाएं , अर्थातः-

" (दो) भारतीय नागरिक सुरक्षा संहिता, 2023 ( 2023 का 46) की धारा 218 तथा विशेष/अन्य अधिनियमों के अधीन लोक सेवकों के विरुद्ध अभियोजन की स्वीकृति । "

18. शीर्षक " इक्कीस- विधि और विधायी कार्य विभाग " के अंतर्गत-

( 1 ) भाग (अ ) में, शीर्षक " भाग अ- विधि परामर्श शाखा " के अंतर्गत-

(क)अनुक्रमांक 3 तथा उससे संबंधित प्रविष्टियों के स्थान पर निम्नलिखित अनुक्रमांक तथा उससे संबंधित प्रविष्टियां स्थापित की जाएं , अर्थातः-

"3. दण्ड विधि, जिसमें भारतीय न्याय संहिता, 2023 (2023 का 45) में के समस्त विषय सम्मिलित किए गए हैं। "

(ख) अनुक्रमांक 4 में , मद क्रमांक(एक) तथा उससे संबंधितप्रविष्टियों के स्थान पर , निम्नलिखित मद क्रमांक तथा उससे संबंधित प्रविष्टियां स्थापित की जाएं , अर्थात, -

"(एक) दण्ड प्रक्रिया जिसमें, भारतीय न्याय संहिता, 2023 (2023 का 45) की धारा 196, 197 एवं 299 के अधीन अभियोजन के लिए धारा 217 के अधीन पूर्व स्वीकृति तथा अपराधियों की परिवीक्षा को छोड़कर भारतीय नागरिक सुरक्षा संहिता, 2023 ( 2023 का 46 ) में के समस्त विषय सम्मिलित हैं" (ग) अनुक्रमांक 21 में , मद क्रमांक (दो) तथा उससे संबंधित प्रविष्टियों के स्थान पर, निम्नलिखित मद क्रमांक तथा उससे संबंधित प्रविष्टियां स्थापित की जाएं, अर्थातः-

"(दो) . भारतीय नागरिक सुरक्षा संहिता, 2023 (2023 का 46) की धारा 218 तथा विशेष/अन्य अधिनियमों के अधीन लोक सेवकों के विरुद्ध अभियोजन की स्वीकृति.

19. शीर्षक " तेईस- योजना, आर्थिक और सांख्यिकी विभाग " के अंतर्गत भाग (अ ) में, अनुक्रमांक 18 में, मद क्रमांक(दो) तथा उससे संबंधित प्रविष्टियों के स्थान पर निम्नलिखित मद क्रमांक तथा उससे संबंधित प्रविष्टियां स्थापित की जाएं , अर्थात, -
