क्रमांक.- एफ - एम.आई.एन. /एम.आई.एन./0115/2025-एम.जी. - 1-डी.जी.एम. खान और खनिज (विकास और विनियमन ) अधिनियम , 1957 ( 1957 का 67) की धारा 23 ग द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए , राज्य सरकार , एतद्वारा, मध्यप्रदेश खनिज (अवैध खनन , परिवहन तथा भण्डारण का निवारण) नियम , 2022 में निम्नलिखित संशोधन करती है , अर्थात्-
:: संशोधन::
उक्त नियमों में, -
1. नियम 2 में , उप- नियम ( 1 ) में , खण्ड ( ग) के पश्चात्, निम्नलिखित खण्ड अंतःस्थापित किया जाए , अर्थात्ः-
" (ग -क) "चेक गेट" से अभिप्रेत है , खनिज के परिवहन की निगरानी एवं अवैध परिवहन के निवारण हेतु स्थापित सूचना प्रौद्योगिकी आधारित निगरानी प्रणाली; " ।
2. नियम 6 में , उप- नियम (5) के पश्चात्, निम्नलिखित उप- नियम जोड़े जाएं , अर्थात्ः-
" (6) राज्य शासन द्वारा पंजीकृत वाहन पर वाहन के स्वामी के व्यय से सूचना प्रौद्योगिकी आधारित यंत्र स्थापित किया जाएगा, जिसका रखरखाव वाहन स्वामी द्वारा किया जाएगा।
(7) यदि उप- नियम (6) में विहित यंत्र निष्क्रिय या क्षतिग्रस्त पाए जाने पर , खनिजों के परिवहन हेतु उपयोग में लाए गए , वाहन को प्रतिबंधित किया जा सकेगा अथवा इन नियमों के अधीन किया गया पंजीयन निरस्त किया जा सकेगा । "

3. नियम 7 में, -
(1) शब्द "जाँच चौकियों" जहां कहीं भी वे आए हों के स्थान पर , शब्द एवं चिन्ह "जाँच चौकियां अथवा । और चेक गेट" स्थापित किए जाएं ।
(2) उप- नियम (7 ) के पश्चात्, निम्नलिखित उप - नियम जोड़ा जाए , अर्थात्:-
" (8 ) चेक गेट से प्राप्त जानकारी के विश्लेषण उपरांत , यदि खनिज परिवहन में कोई अनियमितता पाई जाती है , तो इन नियमों के अधीन वाहन स्वामी के विरुद्ध दण्डात्मक कार्यवाही की जा सकेगी । " ।
4. नियम 20 के पश्चात्, निम्नलिखित नियम अंतःस्थापित किया जाए , अर्थात्ः- "20-क . चेक गेट से प्राप्त जानकारी के आधार पर की जाने वाली कार्रवाई.-
(1 ) चेक गेट से प्राप्त जानकारी के विश्लेषण उपरांत, अवैध परिवहन के लिए नियम 19 तथा किसी अभिवहन पारपत्र में दर्ज मात्रा से अधिक के लिए , नियम 20 के उपबंध लागू होंगे ।
(2) यदि नियम 19 के उप -नियम (4 ) अथवा नियम 20 के उप- नियम (5 ) के अधीन कार्रवाई प्रारंभ की जाती है, तो नियम 6 के अधीन किया गया पंजीयन निलंबित अथवा निरस्त किया जा सकेगा तथा संबंधित जिले के कलक्टर द्वारा उसमें अंतर्ग्रस्त वाहन को जप्त करने के निर्देश जारी किए जा सकेंगे ।
(3) उप - नियम (2) के अधीन जप्त किए गए वाहन को सुपुदर्गी में दिए जाने के लिए नियम 21 के उपबंध लागू होंगे।
No.- F - MIN /0115 /2025 - MG - 1 - DGM.- In exercise of the powers conferred by section 23C of the Mines and Minerals ( Development and Regulation ) Act, 1957 ( No. 67 of 1957 ) , the State Government , hereby, makes the following amendments in the Madhya Pradesh Mineral (Prevention of Illegal Mining , Transportation and Storage) Rules, 2022 , namely : -
:: AMENDMENTS ::
Inthe said rules , -
1. in rule 2, in sub - rule ( 1) , after clause ( c) , the following clause shall be inserted , namely: -
"( ca ) " Check gate " means the information technology based monitoring systems established for surveillance of transportation of minerals and prevention of illegal transportation; " .
2. In rule 6, after sub - rule (5 ) , the following sub - rule shall be added, namely: -
" (6) Information technology based instruments shall be installed by the State Government on registered vehicles on the expenses of owner of the vehicle , which shall be maintained by the owner of the vehicle .

(7) The vehicle used for transportation of minerals , may be restricted or registration made under these rules , may be cancelled , if the instrument prescribed in sub- rule(6) is found inactive or damaged . " .
3. In rule7, -
for the words "check posts " , wherever they occur, the words and symbol "check postsor/and check gate " shall be substituted; (1)
(2) after sub - rule (7) , the following sub - rule shall be added , namely: -
"(8) If after the analysis of the information obtained from the check gate, any irregularity found in transportation of minerals , penal action may be taken against the owner of the vehicle under these rules . " .
4. After rule 20, the following rule shall be inserted, namely: -
"20A. Action to be taken on the basis of information obtained from the check gate.-
(1) Provisions of rule 19 , for the illegal transportation and rule 20 , for excess quantity entered in transit pass, shall be applicable , after the analysis of information obtained from the check gate .
(2) Ifaction under sub - rule (4) of rule 19 or sub - rule ( 5) of rule 20 is initiated, registration made under rule 6, may be suspended or cancelled and directions may be issued by the Collector of the concerned District , to seize the vehicle involved therein .
(3) Provisions of rule 21 shall be applicable for handing over the vehicle seized under sub - rule (2) . " .
