MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.—
No. TPS-2617-1943-CR-163-2017-UD-30.—
Whereas, the Director of Town Planning, Maharashtra State, Pune has given a final sanction to the Shegaon Development Plan (Revised) vide Order No. DS-Shegaon-TPV 6-2755, dated 24th April, 1994 (hereinafter referred to as ' the said Development Plan') and has come into force with effect from the dated 1st August, 1994 (hereinafter referred to as the "said Notification") ; and whereas, the Shegaon Municipal Council is the Planning Authority for the said Development Plan (hereinafter referred to as "the said Planning Authority") ;
And whereas, according to the proposals of the said Development Plan, the land bearing Survey No. 251/2 of City Shegaon (hereinafter referred to as " the said land ") is included in "Agriculture Zone" (hereinafter referred to as " the said Zone ") ;
And whereas, the said Planning Authority vide its General Body Resolution No. 05, dated 27-2-2009 resolved as to delete the said land from the said Zone and is to include the same in Residential Zone (hereinafter referred to as "the Proposed Modification") by carrying out a modification to the said Development Plan and submitted the proposal without following the legal formalities stipulated under Section 37(1) of the Maharshtra Regional and Town Planning Act, 1966. (Mah. XXXVII of 1966) (herein- after referred to as "the said Act") ;
And whereas, after making necessary enquiries and after consulting the Director of Town Planning, Maharashtra State, the Government is of the opinion that the said modification needs to be rejected.
Now, therefore, in exercise of powers conferred by sub-section (2) of Section 37 of the said Act, the Government of Maharashtra hereby refuses to accord sanction to the said Modification.
This Notification shall be kept open for inspection by the general public during office hours in the office of the Chief Officer, Shegaon Municipal Council, Shegaon.
This Notification shall also be published on the Government website www.maharashtra.gov.in By order and in the name of the Governor of Maharashtra,

And whereas, the said Planning Authority vide its General Body Resolution No. 05, dated 28-10-2013 resolved to delete the area admeasuring 800 sq. mt. from the "Site No. 24-Play Ground" and the land so released is include in Commercial Zone (hereinafter referred to as " the said Modification") by carrying out a modification to the said Development Plan and submitted the proposal without following the legal formalities stipulated under Section 37(1) of the Maharshtra Regional and Town Planning Act, 1966. (Mah. XXXVII of 1966) (hereinafter referred to as " the said Act") ;
And whereas, after making necessary enquiries and after consulting the Director of Town Planning, Maharashtra State, the Government is of the opinion that the said modification needs to be rejected.
