भारताचे संविधान.
क्रमांक आरटीएस. २०१७/प्र. क्र. ४९/१८ (र.व का.).-----भारताच्या संविधानाच्या अनुच्छेद ३०९ च्या परंतुकाद्वारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून आणि याबाबतीत करण्यात आलेले आणि महाराष्ट्र राज्यात अंमलात असलेले सर्व विद्यमान नियम, आदेश किंवा संलेख यांचे अधिक्रमण करून, महाराष्ट्राचे राज्यपाल, याद्वारे महाराष्ट्र राज्य सेवा हक्क आयोग यांच्या कार्यालयातील उप सचिव, गट-अ व कक्ष अधिकारी, गट-ब (राजपत्रित) ह्य पदांच्या सेवाप्रवेशाचे विनियमन करणारे पुढील नियम करीत आहेत :----
१. (१) संक्षिप्त नाव.--- या नियमांना, महाराष्ट्र राज्य सेवा हक्क आयोगाच्या कार्यालयातील उप सचिव, गट-अ व कक्ष अधिकारी, गट-ब राजपत्रित, (सेवाप्रवेश) नियम, २०१८ असे संबोधण्यात यावे.
(२) सदर सेवाप्रवेश नियम आजपासून अंमलात आले असल्याचे मानण्यात येईल.
२. या नियमांमध्ये संदर्भानुसार दुसरा अर्थ अपेक्षित नसेल तर,----
(क) "" आयोग "" याचा अर्थ, महाराष्ट्र लोकसेवा हक्क अधिनियम, २०१५ (२०१५ चा ३१) याच्या कलम १३ च्या पोट-कलम (१) अन्वये घटित केलेला राज्य सेवा हक्क आयोग, असा आहे ;
(ख) "" विभाग "" याचा अर्थ, भारताचे संविधान याच्या अनुच्छेद-१६६ अन्वये केलेल्या महाराष्ट्र शासन कार्यनियमावलीला जोडलेल्या पहिल्या अनुसूचीमध्ये विर्िनदिष्ट केलेला विभाग, असा आहे ;
(ग) "" शासन "" याचा अर्थ, महाराष्ट्र शासन, असा आहे.
३. आयोगाच्या कार्यालयातील उप सचिव पदावरील नियुक्ती ही, मंत्रालयातील कोणत्याही विभागातील उप सचिवाचे पद धारण करणाया किंवा राज्य शासनाच्या कोणत्याही कार्यालयातील उप सचिव पदाचे समतुल्य पद धारण करणाया एखाद्या योग्य व्यक्तीच्या प्रतिनियुक्तीद्वारे करण्यात येईल.
४. आयोगाच्या कार्यालयातील कक्ष अधिकारी पदावरील नियुक्ती ही, मंत्रालयातील कोणत्याही विभागातील कक्ष अधिकायाचे पद धारण करणाया किंवा राज्य शासनाच्या कोणत्याही कार्यालयातील कक्ष अधिकारी पदाचे समतुल्य पद धारण करणाया एखाद्या योग्य व्यक्तीच्या प्रतिनियुक्तीद्वारे करण्यात येईल.
(१)
भाग चार-अ--६३---१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, मार्च १३, २०१८/फाल्गुन २२, शके १९३९ ५. नियम ३ किंवा ४ यांमध्ये नमूद केलेल्या पदावर नियुक्त केलेल्या व्यक्तीने, त्याबाबतीत करण्यात आलेल्या नियमांनुसार हिंदी व मराठी भाषा परीक्षा अगोदरच उत्तीर्ण केलेल्या नसतील किंवा त्या परीक्षा उत्तीर्ण करण्यापासून तिला सूट मिळालेली नसेल तर, त्या व्यक्तीस उक्त परीक्षा उत्तीर्ण होणे आवश्यक असेल.
६. नियम ३ किंवा ४ यांमध्ये नमूद केलेल्या पदावर नियुक्त झालेली प्रत्येक व्यक्ती, माहिती तंत्रज्ञान संचालनालय, महाराष्ट्र शासन यांनी वेळोवेळी विहित केलेले संगणक हाताळणीबाबतचे प्रमाणपत्र धारण करील.
७. राज्य सेवांसाठी प्रतिनियुक्तीबाबतचे विद्यमान नियम किंवा राज्य शासनाने याबाबतीत वेळोवेळी विहित केलेले धोरण, आयोगाच्या कार्यालयातील नियम ३ व ४ यांमध्ये नमूद केलेल्या पदांवर प्रतिनियुक्तीद्वारे करण्यात येणाया नियुक्त्यांना लागू असेल.

CONSTITUTION OF INDIA.
No. RTS2017/C.R.49/18 (O and M) :— In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, and in suppression of all existing rules, orders or instruments made in this behalf, and in force in the State of Maharashtra, the Governor of Maharashtra is hereby pleased to make the following Rules regulating recruitment to the posts of Deputy Secretary, Group-A and Section Officer, Group-B (Gazetted) in office of the Maharashtra State Right to Service Commission, namely :—
1. (1) Short title.— These rules may be called the Deputy Secretary, Group-A and Section Officer, Group-B (Gazetted) in the office of the Maharashtra State Right to Service Commission, (Recruitment) Rules, 2018.
(2) They shall be deemed to have come into force from today.
2. In these rules, unless the context requires otherwise,—
(a) " the Commission" means the Maharashtra State Right to Service Commission constituted under sub-section (1) of section 13 of the Maharashtra Right to Public Services Act, 2015 (XXXI of 2015);
(b) " the Department " means the Department specified in the First Schedule appended to the Maharashtra Government Rules of Business made under article 166 of the Constitution of India ;
(c) " the Government " means the Government of Maharashtra ;
3. Appointment to the post of Deputy Secretary in office of the Commission by deputation of a suitable person holding the post of Deputy Secretary in any department in Mantralaya or post equivalent to the post of Deputy Secretary in any office under the State Government ;
4. Appointment to the post of Section Officer in office of Commission by deputation of a suitable person holding the post of Section Officer in any department in Mantralaya or post equivalent to the post of Section Officer in any office under the State Government ;
5. A person appointed tothe post mentioned in rule 3 or 4 shall be required to pass the examinations in Hindi and Marathi languages according to the rules made in this behalf, unless he has already passed or has been exempted from passing those examinations ;
6. A person appointed to the post mentioned in rule 3 or 4 shall possess a certificate in computer operations prescribed by the Directorate of Information Technology, Government of Maharashtra from time to time ;
7. Existing rules regarding deputation or policy prescribed in this regard by the State Government, from time to time, for the State Services shall be applicable to the appointments by deputation to the posts mentioned in rules 3 and 4 in office of the Commission ;

१. (१) संक्षिप्त नाव : या नियमांना, महाराष्ट्र राज्य सेवा हक्क आयोगाच्या कार्यालयातील सहायक कक्ष अधिकारी, उच्च श्रेणी लघुलेखक, निम्न श्रेणी लघुलेखक व लिपिक-टंकलेखक, (सेवाप्रवेश) नियम, २०१८ असे संबोधण्यात यावे.
(२) सदर सेवाप्रवेश नियम आजपासून अंमलात आले असल्याचे मानण्यात येईल.
२. या नियमांमध्ये संदर्भानुसार दुसरा अर्थ अपेक्षित नसेल, तर,----

३. आयोगाच्या कार्यालयातील सहायक कक्ष अधिकारी पदावरील नियुक्ती ही, मंत्रालयातील कोणत्याही विभागातील सहायक कक्ष अधिकारी हे पद धारण करणाया किंवा राज्य शासनाच्या कोणत्याही कार्यालयातील सहायक कक्ष अधिकारी पदाचे समतुल्य पद धारण करणाया एखाद्या योग्य व्यक्तीच्या प्रतिनियुक्तीद्वारे करण्यात येईल.
४. आयोगाच्या कार्यालयातील उच्च श्रेणी लघुलेखक पदावरील नियुक्ती ही, मंत्रालयातील कोणत्याही विभागातील उच्च श्रेणी लघुलेखक हे पद धारण करणाया किंवा राज्य शासनाच्या कोणत्याही कार्यालयातील उच्च श्रेणी लघुलेखक पदाचे समतुल्य पद धारण करणाया एखाद्या योग्य व्यक्तीच्या प्रतिनियुक्तीद्वारे करण्यात येईल.
५. आयोगाच्या कार्यालयातील निम्न श्रेणी लघुलेखक पदावरील नियुक्ती ही, मंत्रालयातील कोणत्याही विभागातील निम्न श्रेणी लघुलेखक हे पद धारण करणाया किंवा राज्य शासनाच्या कोणत्याही कार्यालयातील निम्न श्रेणी लघुलेखक पदाचे समतुल्य पद धारण करणाया एखाद्या योग्य व्यक्तीच्या प्रतिनियुक्तीद्वारे करण्यात येईल.
६. आयोगाच्या कार्यालयामधील लिपिक-टंकलेखक पदावरील नियुक्ती ही,------
(क) (एक) गट "" ड "" संवर्गामधील पद धारण करणाया आणि आयोगाच्या कार्यालयात त्या पदावर तीन पेक्षा कमी नसेल इतकी वर्षे नियमित सेवा पूर्ण केलेल्या ;
आणि
(दोन) पदवी धारण करणाया ; आणि
(तीन) मराठी टंकलेखनामधील प्रती मिनीट ३० शब्दांपेक्षा किंवा इंग्रजी टंकलेखनामधील प्रती मिनीट ४० शब्दांपेक्षा कमी नसेल इतक्या वेगाचे शासकीय वाणिज्य प्रमाणपत्र किंवा संगणक टंकलेखन प्रमाणपत्र धारण करणाया, व्यक्तींमधून ज्येष्ठतेच्या आधारे, एखाद्या योग्य व्यक्तीच्या पदोन्नतीद्वारे करण्यात येईल.
किंवा
(ख) ज्या व्यक्तीने लिपिक-टंकलेखक या पदास पसंती दिली असेल अशा, आयोगातील गट-क मधील वाहन चालकाचे पद धारण केलेल्या व त्या पदावर तीन वषार्ंपेक्षा कमी नाही इतकी नियमित सेवा पूर्ण झालेल्या आणि खंड (क) च्या उप-खंड (दोन) व (तीन) मध्ये नमूद केलेली अर्हता धारण केलेल्या व्यक्तींमधून, योग्यतेस अधीन राहून ज्येष्ठतेच्या आधारे, एखाद्या योग्य व्यक्तीच्या स्थायी संवर्ग बदलीद्वारे करण्यात येईल.
महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, मार्च १३, २०१८/फाल्गुन २२, शके १९३९ ५लिपिक-टंकलेखक पदावर नियुक्ती केलेल्या वाहनचालकाची ज्येष्ठता ही, लिपिक-टंकलेखक पदावर त्याची नियुक्ती केल्याच्या दिनांकापासून निश्चित करण्यात येईल ;
किंवा
(ग) मंत्रालयातील कोणत्याही विभागामधील लिपिक-टंकलेखक पद किंवा राज्य शासनाच्या कोणत्याही कार्यालयातील लिपिक-टंकलेखक पदाचे समतुल्य पद धारण करणाया एखाद्या योग्य व्यक्तीच्या प्रतिनियुक्तीद्वारे करण्यात येईल.
७. नियम ३, ४, ५ किंवा ६ यांमध्ये नमूद केलेल्या पदावर नियुक्त केलेल्या व्यक्तीने, त्याबाबतीत करण्यात आलेल्या नियमांनुसार हिंदी व मराठी भाषा परीक्षा अगोदरच उत्तीर्ण केलेल्या नसतील किंवा त्या परीक्षा उत्तीर्ण करण्यापासून तिला सूट मिळालेली नसेल तर, त्या व्यक्तीस उक्त परीक्षा उत्तीर्ण होणे आवश्यक असेल.
८. नियम ३, ४, ५ किंवा ६ यांमध्ये नमूद केलेल्या पदावर नियुक्त झालेली प्रत्येक व्यक्ती, माहिती तंत्रज्ञान संचालनालय, महाराष्ट्र शासन यांनी वेळोवेळी विहित केलेले संगणक हाताळणीबाबतचे प्रमाणपत्र धारण करील.
९. राज्य सेवांसाठी प्रतिनियुक्तीबाबतचे विद्यमान नियम किंवा याबाबतीत राज्य शासनाने वेळोवेळी विहित केलेले धोरण, आयोगाच्या कार्यालयातील नियम ३, ४, ५ व ६ यांमध्ये नमूद केलेल्या पदांवर प्रतिनियुक्तीद्वारे करण्यात येणाया नियुक्त्यांना लागू असेल.

2. In these rules, unless the context requires otherwise, —
(a) " the Commission " means the Maharashtra State Right to Service Commission constituted under sub-section (1) of section 13 of the Maharashtra Right to Public Services Act, 2015 (XXXI of 2015) ;

Appointment to the post of Assistant Section Officer in office of the Commission by deputation of a suitable person holding the post of Assistant Section Officer in any department in Mantralaya or post equivalent to the post of Assistant Section Officer in any office under the State Government. 4. Appointment to the post of Higher Grade Stenographer in office of Commission by deputation of a suitable person holding the post of Higher Grade Stenographer in any department in Mantralaya or post equivalent to the post of Higher Grade Stenographer in any office under the State Government.
5. Appointment to the post of Lower Grade Stenographer in office of Commission by deputation of a suitable person holding the post of Lower Grade Stenographer in any department in Mantralaya or post equivalent to the post of Lower Grade Stenographer in any office under the State Government.
6. Appointment to the post of Clerk-typist in office of the Commission shall be made,—
(a) by promotion of suitable person on the basis of seniority from amongst persons,—
(i) holding the post in Group 'D' cadre ; and having not less than three years regular service in that post in office of the Commission ;
(ii) possess a degree ; and
(iii) possess the Government Commercial Certificate or Computer Typing Certificate with a speed of not less than 30 words per minute in Marathi typewriting or 40 words per minute in English Typewriting ;
महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, मार्च १३, २०१८/फाल्गुन २२, शके १९३९ ७(b) by permanent cadre transfer of a suitable person on the basis of seniority subject to fitness from amongst the persons holding the post of Driver, Group C, in the Commission, who prefer the post of Clerk-Typist, having completed not less than three years of regular service on the post of Driver and possesses qualifications mentioned in sub-clauses (ii) and (iii) of clause (a). The seniority of Driver appointed on the post of Clerk-Typist shall be fixed from the date of his appointment on the post of Clerk-Typist ;
or
(c) by deputation of a suitable person holding the post of Clerk-Typist in any Department in Mantralaya or post equivalent to the post of Clerk-Typist in any office under the State Government.
7. A person appointed to the post mentioned in rule 3, 4, 5 or 6 shall be required to pass the examinations in Hindi and Marathi languages according to the rules made by the Government in this behalf, unless he has already passed or has been exempted from passing those examinations.
8. A person appointed to the post mentioned in rule 3, 4, 5 or 6 shall possess a certificate in computer operations prescribed by the Directorate of Information Technology, Government of Maharashtra from time to time.
9. Existing rules regarding deputation or policy prescribed in this regard by the State Government, from time to time, for the State Services shall be applicable to the appointments by deputation to the posts mentioned in rules 3, 4, 5 and 6 in office of the Commission.
