MAHARASHTRA REGIONAL & TOWN PLANNING ACT, 1963.

Whereas the Development Plan of Ghantanji, (Revised) has been sanctioned by the Government u/s 31 of Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act"), vide Notification No. TPS-2700-3094-CR-193 A-2000-UD-30, Dated 14th May, 2002 and it has come into force with effect from 1st July, 2002; and whereas the remaining part of the Development Plan has been sanctioned vide Notification No. TPS-2703-583-CR-366-2003-UD-30, Dated 13th July, 2005 and it has come into force with effect from 1st September, 2005; (hereinafter referred to as "the said Development Plan");

And whereas, in the said Development Plan, land bearing Survey No. 5/2 & 5/2 C of Mouje Ghatanji, Tq. Ghatanji, Dist- Yavatmal, (hereinafter referred to as "the said land") is included partly in "Site No. 49- High School" and partly in Agriculture Zone (hereinafter referred to as "the said Zone");

And whereas, as per the provisions of Section 37(1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act"), the Municipal Corporation, Amravati Vide its General Body Resolution dated 22nd February, 2013 has resolved to make modification in the sanctioned Development Plan of Ghatanji, so as to delete the said land from the said Zone and to reserve the same for Agriculture Produce Market Committee (hereinafter referred to as "the Proposed Modification") and accordingly submitted the proposal to Government for final sanction;

And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of the opinion that the proposed Modification should be sanctioned with certain conditions;

Now, therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of the said Act, the Government of Maharashtra hereby sanctions the proposed Modification in the said Development Plan with certain conditions and for that purpose amends the above said Notification dated the 13th July, 2005 as follows :-

"In the Schedule of Modifications appended to the Notification sanctioning the said Development Plan, the following new entry shall be added after the last entry"-

ENTRY

"The land bearing Survey No 5/2 & 5/2 C of Mouje Ghatanji, Tq. Ghatanji, Dist- Yavatmal si deleted partly from "Site No. 49- High School" and partly from Agriculture Zone and the land so released is reserved for Agriculture Produce Market Committee as shown on subject to following conditions" :-

Conditon No 1 :- The alignment of 15m wide D.P road on the Northern & Eastern side of the sanction land should be kept as it is and the remaining area should be reserved for Agriculture Produce Market Committee.

Condition No. 2:- The area of "Site No. 49- High School" will remain as it is after deducting the area admeasuring 0.30 ha. of Applicant Committee from the land bearing Survey No 5/2 & 5/2 C.

Condition No 3:- It shall be mandatory to the Applicant Committee to apply for the building permission to the Municipal Council as a Planning Authority.

Condition No 4:- It shall be mandatory to the Applicant Committee to demolish the existing Construction on the land on which the 15 mt. wide D.P Road is proposed.

A copy of the part plan showing the aforesaid sanctioned modification shall be available in the office of the Chief Officer, Municipal Council, Ghatanji during office hours on all working days for inspection of public for a period of one month.

Whereas the Director of Town Planning, Maharashtra State, Pune has given a final sanction to the Shegaon Development Plan (Revised) vide Order No. DS-Shegaon-TPV 6-2755, dated 26th April, 1994 (hereinafter referred to as 'the said Development Plan') and has come into force with effect from the dated 1 st August, 1994 (hereinafter referred to as the "said Notification"); and whereas, the Shegaon Municipal Council is the Planning Authority for the said Development Plan (hereinafter referred to as " the said Planning Authority");

And whereas, State Government has published the Notification under Section 37(2) on 8th December 2017 in the Maharashtra Government Gazette Part I-A Amavati Divisional Supplement, Dated December 28-2017-January 3, 2018, on page Nos. 2 & 3, at Sr. No. 273 the Condition No. 02 in the said notification has some changes as below:

And whereas, according to the proposals of the said Development Plan, the land bear- ing Survey No. 251 of Shegaon City (hereinafter referred to as "the said land") is included in Public/Semi Public Zone, (hereinafter referred to as "the said Zone");

And whereas, the said Planning Authority vide its General Body Resolution No. 4, dated 28-10-2013 resolved to delete the are a admeasuring 500 sq. mt. from the said Zone and the land so released is to be included in Commercial Zone (hereinafter referred to as "the said modification") by carring out a modification to the said Development Plan, by following all the legal formalities stipulated under Section 37 (1) of the Maharashtra Regional and town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act.") And whereas, after making necessary enquiries and after consulting the Director of Town Planning, Maharashtra State, the Government is of the opinion that the said modifi- cation needs to be rejected.

Now, therefore, in exercise of powers conferred by sub-suction (2) of Section 37 of the said Act, the Government of Maharashtra hereby refuses to accord sanction to the said Modification

MAHARASHTRA REGIONAL & TOWN PLANNING ACT, 1966.

No. TPS-2817-1939-CR-159-UD-30-2017.—

Whereas the Revised Development Plan of Amravati City, dist. Amravati has been sanctioned by the Government under Section 31 of the Maharashtra Regional and Town Planning Act, 1966 (Mah.

XXXVII of 1966) (hereinafter referred to as "the said Act"), vide Notification No. TPS-2892-1180-CR-90-92 B -UD-13, Dated 4th December, 1992 and has come into force with effect from the 25th February, 1993;

(hereinafter referred to as "the said Development Plan");

And whereas, according to the proposals of the said Development Plan, the land bearing Survey No. 51 (Part) of Mouje Tarkheda, Ta. & dist. Amravati (hereinafter referred to as "the said land") is reserved for "Site No. 168 D-Garden, admeasuring 975 sq.mt. (hereinafter referred to as "the said Site");

And whereas, the said Planning Authority vide its General Body Resolution No. 3, dated 18-08-2010 resolved as to delete the said land from the said Site and to include the same in "Garden Extension and Play Ground" (hereinafter referred to as "the Proposed modification") by carring out a modification to the said Development Plan and submitted the proposal even after failed to follow all the legal formalities stipulated under Section 37 (1) of the Maharshtra Regional and town Planning Act, 1966 (Mah. XXXVII of 1966) (herein- after referred to as "the said Act.")

And whereas, after making necessary enquiries and after consulting the Director of Town Planning, Maharashtra State, the Government is of the opinion that the said modifi- cation needs to be rejected;

Now, therefore, in exercise of powers conferred by sub-suction (2) of Section 37 of the said Act, the Government of Maharashtra hereby refuses to accord sanction to the said Modification

This Notification shall be kept open for inspection by the general public during office hours in the office of the Municipal Commissioner, Amravati Municipal Corporation.

This Notification shall also be published on the Government website www.maharashtra.gov.in / Acts & Rules.
