क्रमांक अधिसू. २००८/प्र.क्र.८६/रस्ते-६.-----ज्याअर्थी, महाराष्ट्र शासन, सार्वजनिक बांधकाम विभाग, शासन निर्णय क्रमांक डब्ल्यू.आय.एफ.१०९९/प्र.क्र.१२२/रस्ते-६, दिनांक १८ ऑगस्ट २००० अन्वये बांधा, वापरा व हस्तांतरित करा या तवावर विहित अटी व शतर्ींनुसार वांद्रे-वरळी सागरी सेतू प्रकल्पासाठी उद्योजक म्हणून महाराष्ट्र राज्य रस्ते विकास महामंडळास प्राधिकृत केलेले आहे ;
आणि ज्याअर्थी, वांद्रे-वरळी सागरी सेतू प्रकल्पाचे काम पूर्ण झाल्यानंतर ३० वर्षांच्या कालावधीसाठी, प्रकल्पावर झालेला भांडवली खर्च व व्याज वसूल करण्यासाठी विहित दराने पथकर गोळा करण्यासाठी, महाराष्ट्र राज्य रस्ते विकास महामंडळास प्राधिकृत केलेले आहे ;
आणि ज्याअर्थी, महाराष्ट्र शासनाचे असे मत आहे की वांद्रे-वरळी सागरी सेतूचे बांधकाम, संचालन व देखभाल ही जनतेस उपलब्ध करून देण्यात आलेली विशिष्ट सेवा आहे आणि म्हणून सदर मार्गावर पथकर लागू करून तो पथकर नाक्यावर गोळा करणे आवश्यक आहे ;
आणि ज्याअर्थी, महाराष्ट्र शासनाने मुंबई मोटार वाहन कर अधिनियम, १९५८ (१९५८ चा ६५) च्या कलम २० ची पोट-कलमे (१-अ), (१-ब), (१-क), (१-ड) आणि (१-इ) द्वारे प्रदान करण्यात आलेल्या आणि त्याला समर्थनीय करणाया अधिकारांचा वापर करून निर्गमित केलेल्या, सार्वजनिक बांधकाम विभाग, अधिसूचना क्रमांक अधिसू. २००८/प्र.क्र.८६/रस्ते-६, दिनांक ३० जून २००९ सोबतच्या परिशिष्टातील रकाना क्रमांक (२) मध्ये नमूद केलेल्या वाहनांसाठी वांद्रे-वरळी सागरी सेतूचा वापर करण्यासाठी रकाना क्रमांक (३) मध्ये नमूद केलेल्या दराने दिनांक ६ जुलै २००९ ते दिनांक ५ जुलै २०१० या एक वर्षाच्या कालावधीसाठी वांद्रे-वरळी सागरी सेतू प्रकल्पांतर्गत पॅकेज-४ अंतर्गत वांद्रे रिक्लेमेशन, वांद्रे येथे बांधण्यात आलेल्या साखळी क्रमांक १/७४५ येथील पथकर नाक्यावर पथकर बसविला आहे आणि त्यानंतर दिनांक ६ जुलै २०१०, दिनांक ५ जानेवारी २०११, दिनांक ३१ मार्च २०११, दिनांक २ जुलै २०११, दिनांक ३ जानेवारी २०१२, दिनांक २८ मार्च २०१२ आणि दिनांक २० मार्च २०१५ च्या अधिसूचनेन्वये दिनांक ३१ मार्च २०१८ पयर्ंतच्या कालावधीसाठी पथकर बसविला आहे ;

भाग चार--ब--७८--१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, मार्च २१, २०१८/फाल्गुन ३०, शके १९३९ आणि ज्याअर्थी, महाराष्ट्र शासनाने शा.नि. क्र.बांवस-२००४/प्र.क.६४/२००४/रस्ते-६, दिनांक ४ डिसेंबर २०१७ रोजीच्या शासन निर्णयान्वये निश्चित केलेली प्रकल्पाची पुन:सुधारित किंमत आणि व्यवहार्यता तफावत निधीच्या प्रतिपूर्तीसाठी महामंडळास, उभारलेल्या कर्जाचा व्याज दर +२% (दोन टक्के) या दराने अंतर्गत परतावा प्राप्त होण्यासाठी सवलत कालावधी दिनांक ३१ मार्च २०५२ पयर्ंत वाढविण्यास मान्यता देण्यात आली आहे.
त्याअर्थी, मुंबई मोटार वाहन कर अधिनियम, १९५८ (१९५८ चा मुंबई ६५) च्या कलम २० ची पोट-कलमे (१-अ), (१-ब), (१-क), (१- ड) आणि (१-इ) द्वारे प्रदान करण्यात आलेल्या आणि त्याला समर्थनीय करणाया अधिकारांचा वापर करून, महाराष्ट्र शासन याद्वारे घोषित करते की, बांद्रा-वरळी सागरी जोडरस्त्याचा (बांद्रा ते वरळी) वापर करणाया व खालील अनुसूचीच्या स्तंभ (२) मध्ये अनुक्रमे विर्िनदिष्ट केलेल्या प्रकारच्या मोटार वाहनांवर आणि मोटार वाहनांकडून ओढून नेल्या जाणाया अनुयानांवर अनुसूचीच्या स्तंभ (३) मध्ये त्यांच्यासमोर विर्िनदिष्ट केलेल्या दराने " दि.१ एप्रिल २०१८ ते दि.३१ मार्च २०२१ " रोजी संपणाया कालावधीकरिता वांद्रे-वरळी सागरी सेतू प्रकल्पांतर्गत पॅकेज-४ अंतर्गत वांद्रे रिक्लेमेशन, वांद्रे येथे बांधण्यात आलेल्या साखळी क्रमांक १/७४५ येथील पथकर नाक्यावर पथकर बसविण्यात यावा.

दि. १ एप्रिल २०१८ ते ३१ मार्च २०२१ या कालावधीकरिता पथकराचे प्रतिफेरीचे दर (रुपये) (३) १ मोटार वाहन अधिनियम, १९८८(१९८८ चा ५९) मध्ये नमूद केल्याप्रमाणे हलकी मोटार ७० वाहने, (अ) कार, जीप जसे की, टाटा सुमो, ट्रॅक्स, कमांडर, इतर तत्सम वाहने (चालक वगळून १२ प्रवासी क्षमता असलेली), वाहनचालक वगळून सहा आसनी प्रवासी रिक्षा वाहने.
(ब) मिनी बस किंवा तत्सम वाहने (चालक वगळून १२ पेक्षा जास्त पण २० प्रवासी ११० क्षमतेपयर्ंत) आणि अनुक्रमांक २ मध्ये नमूद केलेल्या वाहनाव्यतिरिक्त माल वाहतूक करणारी वाहने.
२ ट्रक, बस
१४५ (१) खालील वाहनांना पथकरातून सूट देण्यात येईल,----
(१) राष्ट्रपती, उप राष्ट्रपती, राज्यांचे राज्यपाल किंवा वाहनावर लाल दिवा लावण्याची परवानगी असलेले लोकप्रतिनिधी प्रवास करीत असलेली वाहने.
(२) संसदेचे विद्यमान सदस्य तसेच महाराष्ट्र विधानसभा व महाराष्ट्र विधानपरिषदेचे विद्यमान सदस्य प्रवास करीत असलेली वाहने.
(३) महाराष्ट्रातील माजी संसद सदस्य किंवा महाराष्ट्र विधानसभा व महाराष्ट्र विधानपरिषदेचे माजी सदस्य प्रवास करीत असलेली वाहने.
(४) केंद्र व राज्य शासकीय वाहने
(५) लष्करी वाहने
(६) पोलीस दलाची वाहने
(७) अग्निशमन दलाची वाहने
(८) रुग्णवाहिका
(९) शववाहिका
(१०) टपाल व तार खात्याची वाहनेमहाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, मार्च २१, २०१८/फाल्गुन ३०, शके १९३९ ३ (२) उपरोल्लेखित पथकर नाक्यावर उपरोल्लेखित कालावधीसाठी पथकर वसूल करण्याचा आणि वसूल झालेल्या पथकराची संपूर्ण रक्कम ठेवून घेण्याचा हक्क महाराष्ट्र राज्य रस्ते विकास महामंडळ मर्यादित, मुंबई यांना प्रदान करण्यात आला आहे.
खालील प्रकारच्या वाहनांना वांद्रे-वरळी सागरी जोड रस्त्याचा (वांद्रे ते वरळी) वापर करण्यास मज्जाव करण्यात येत आहे,----
(१) मोटार सायकल, स्कूटर, मोपेड, ट्रॅक्टर आणि रिकाम्या ट्रॉलीसह ट्रॅक्टर आणि चालक वगळून तीन प्रवासी क्षमतेची ऑटो रिक्षा (२) प्राण्यांकडून ओढण्यात येणारी वाहने व हळू चालणारी वाहने.
(३) वरील अनुसूचित अनुक्रमांक (२) येथे नमूद केलेल्या जड वाहनांव्यतिरिक्त मोटार वाहन अधिनियम, १९८८ (१९८८ चा ५९) अन्वये नमूद केलेली जड वाहने जसे की, ट्रक ट्रेलर्स, दोन पेक्षा जास्त आसांची वाहने.
(३) पथकराच्या दरामध्ये खालीलप्रमाणे सवलत देण्यात येते :----
(अ) पथकराच्या ५० कुपन्सची आगाऊ खरेदी करणाया वाहनधारकास पुस्तिकेच्या किमतीमध्ये १० टक्के सवलत देण्यात येईल.
(ब) पथकराच्या १०० कुपन्सची आगाऊ खरेदी करणाया वाहनधारकास पुस्तिकेच्या किमतीमध्ये २० टक्के सवलत देण्यात येईल.
(क) वारंवार प्रवास करणाया वाहनासाठी परतीच्या पासाचे व दैनिक पासाचे दर हे त्या वाहनाच्या एकेरी पथकराच्या दराच्या अनुक्रमे दीडपट व अडीचपट असतील. परतीचा व दैनिक पास ज्या दिनांकास देण्यात आला असेल, त्या दिवशीच्या रात्री १२-०० वाजेपयर्ंत वैध राहील. हे दर खालीलप्रमाणे असतील :----

NOTIFICATION
MAHARASHTRA MOTOR VEHICLES TAX ACT, 1958.
No. ADHISU.2008/C.R.86/Road-6.—Whereas the Government of Maharashtra has, vide Government Resolution, Public Works Department, No. डब्लु.आय.एफ—१०९९/प्र.क्र.१२२/रस्ते-६ , dated the 18th August 2000, authorized the Maharashtra State Road Development Corporation Limited as an entrepreneur to activate the Bandra-Worli Sea Link Project under the Build, Operate and Transfer (B.O.T) Scheme and to complete the work subject to the terms and conditions mentioned therein;
And whereas, the Maharashtra State Road Development Corporation was authorized to collect the toll, at the rates mentioned therein for the period of 30 years from the date of completion of the construction work of the said road, to recover the Capital Expenditure of the said project and interest thereon;
And whereas, the Government of Maharashtra was of the opinion that the construction, operation and maintenance of the said road is the special service to the public and, therefore, considered it expedient to levy and collect the toll on the said road at the toll collection centre;
And whereas, the Government of Maharashtra has, vide Government Notification, Public Works Department, No. ADHISU.2008/C.R.86/ Road- 6, dated the 30th June 2009, issued in exercise of the powers conferred by sub-sections (1-A), (1-B), (1-C), (1-D) and (1-E) of section 20 of the Maharashtra Motor Vehicles Tax Act, 1958 (LXV of 1958), levied and collected the toll on the classes of motor vehicles specified in column (2) of the Schedule appended thereto passing over the Bandra-Worli Sea Link Road (Bandra to Worli), at the rates specified against each of the said vehicles in columns (3) of the said Schedule for the period of one year with effect from the 6th July 2009 to 5th July 2010, at the toll collection center constructed under Package IV of the project near Bandra Reclamation, Bandra at Chainage No. 1/745 and thereafter, vide Government Notifications dated the 6th July 2010, 5th January 2011, 31st March 2011, 2nd July 2011, 3rd January 2012 , 28th March 2012 and 20th March 2015 up to the 31st March 2018 ;
And whereas, the Government of Maharashtra has, vide Government Resolution, Public Works Department, No. बांवस.२००४/प्र.क्र.६४/२००४/रस्ते-६, dated 4th December 2017, extended the concession period up to 31st March 2052 to recover the revised Capital Expenditure of the above mentioned Project and recovery of interest on the amount of Viability Gap Funding plus 2% (two per cent) IRR.
Now, therefore, in exercise of the powers conferred by sub-sections (1-A), (1-B), (1-C), (1-D) and (1-E) of section 20 of the Maharashtra Motor Vehicles Tax Act (LXV of 1958), the Government of Maharashtra hereby declares that, the toll shall be levied, on the classes of motor vehicles specified in column (2) of the Schedule appended hereto, passing over the Bandra-Worli Sea Link Road (Bandra to Worli), at the rates specified against each of the said vehicles in column (3) of the said Schedule, and collected at the toll collection centre constructed under package-IV of the project near Bandra Reclamation, Bandra in Chainage 1/745, for the period of three years with effect from the 1st April 2018 to 31st March 2021.

1. The following types of vehicles are exempted from payment of toll, namely :—
(a) VVIP vehicles carrying President of India and Vice President of India, Governor of State Public Representatives of peoples entitled for red lamp on vehicle.
(b) Vehicle carrying sitting Members of Parliament, Maharashtra Legislative Assembly and Maharashtra Legislative Council.
(c) Vehicle carrying Ex-members of Parliaments from Maharashtra and Ex-members of Maharashtra Legislative Assembly and Maharashtra Legislative Council.
(d) Central and State Government Vehicles.
(e) Defense Vehicles.
(f) Police Vehicles.
(g) Fire Fighting Vehicles.
(h) Ambulances.
(i) Hearses.
(j) Vehicles of the Posts and Telegraphs Department.
2. The Maharashtra State Road Development Corporation Limited, Mumbai is authorized to collect and retain the amount of toll collected at the above toll collection center, for the above mentioned period.
3. The following types of vehicles have no access to the Bandra-Worli Sea Link Road, i.e. Bandra to Worli section, namely :—
(a) Motor cycle, Scooter, Moped,Tractor, Tractor with unladen trolley and Auto- Rickshaw registered to carry three persons excluding driver.
(b) Animal drawn vehicle and slow moving vehicles.
(c) Heavy motor vehicles as defined in the Motor Vehicles Act, 1988 (59 of 1988) such as truck trailers, multi axle vehicles, etc. except vehicles covered by entry at serial number 2 of the above Schedule.
६ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, मार्च २१, २०१८/फाल्गुन ३०, शके १९३९4. Concessions in rates of toll are as given below :—
(a) Ten per cent. rebate will be given to the purchaser of booklet containing 50 coupons in advance.
(b) Twenty per cent. rebate will be given to the purchaser of booklet containing 100 coupons in advance.
(c) The rates of return journey pass and daily pass of the frequently plying vehicle shall be one and half times and two and half times of their respective one way travel rates. Return journey pass and daily pass will be valid up to 12-00 midnight of the day of issuing the pass.
The rates of pass shall be as follows :––
