Whereas, the Government has sanctioned the Second Revised Development Plan of Nagpur Municipal Corporation (hereinafter referred to as the "said Development Plan") vide Urban Development Department Notification No. TPS-2496-2643-CR-300(A)-1997-UD-9, dated 7th January, 2000 under sub section (1) of Section 31 of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as " the said Act ") which has come into force with effect from the 1st March, 2000 ;
And whereas, the State Government has given its approval to the Nagpur Metro Rail Project (hereinafter referred to as " the said Metro ") vide the Government Resolution No. NIT-3313-CR-64-UD-7, dated the 30th January 2014 and the Central Government also has conveyed its in-principle approval vide its letter No. K-1401-24-2013-MRTS-IV, dated the 11th February 2014 and accorded its final approval vide its letter No. K-14011-(N-1)-2014-MRTS-III, dated 21st August, 2014 ;
And whereas, the Government land bearing Khasara 302, C.T.S. No. 1848 admeasuring about 5.35 Ha. of Mouze Sitabardi is shown as Public/Semi-Public Zone and road in said Development Plan (hereinafter referred to as the "said lands") ;
And whereas, the Nagpur Metro Rail Corporation Ltd., Nagpur has requested to the Government to include the land bearing Khasara No. 302, CTS No. 1848 of Mouje Sitabardi (admeasuring 1872.28 Sq. mt.) which is in Public/ Semi-Public Zone as per Development Plan and the land over the Road admeasuring 1662.328 Sq. mt. thus total land admeasuring 3534.656 sq. mt. in to Commercial Zone for implementation of said Metro Project and Metro Rail Station and allied uses (hereinafter referred to as the "said Proposal") ;
And whereas, the State Government is of the opinion that, in the public interest, it is necessary to take recourse of Section 37 (1AA) (a) of the said Act, to make modification in the sanction Development Plan regarding the said proposal (hereinafter referred to as "the said Modification") ;
And whereas, in exercise of the powers vested under Section 37 (1AA) (a) of the said Act, the Government has published the Notice for inviting Suggestion/Objection from the general public in respect to the said Modification, in the Official Gazette, dated 24th July, 2017 as well as the news paper and for hearing suggestions / objections received respect of the said modification, appointed the Joint Director of Town Planning, Nagpur Division, Nagpur, as the Officer under Section 162 (1) of the said Act. ;
And whereas, the appointed Officer has submitted his report to the Government on 11th October, 2017, and after making necessary inquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government find it expedient that the said modification sanctioned.
Now therefore, in exercise of the powers conferred on it under sub-section (1AA) (C) of Section 37 of the said Act, Government hereby sanctions the said modification accordingly and for that purpose amends the said Development Plan as follows.—

The Development Plan of Umred has already been partly sanction by the Government Urban Development Department vide resolution No. TPS-2498-287-CR-25-98-UD-9, dated 8th July 2003 with effect from 25th August 2003 and vide resolution No. TPS-2498-287-CR-25-98-UD-9, dated 9th July 2005 excluded part Development Plan which came in force with effect from 5th September 2005.
The Municipal Council, Umred has proposed to make modification under Maharashtra Regional and Town Planning Act, 1966 clause 37(1) in the aforesaid final Development Plan vide its General Committee Resolution No. 201 and 202, dated 30th December 2017 as below.––
