No. SPP. 2018/U.O.R. 14/D-XIV.— In exercise of the powers conferred by sub-section (8) of the section 24 of the Code of Criminal Procedure, 1973 (Act No. II of 1974), the Government of Maharashtra hereby appoints Adv. Raja Thakare as "Special Public Prosecutor" for conducting all the cases arising out of C.R.No. 402/2016, registered at Vile Parle Police Station, Mumbai pending before Sessions Court, Mumbai.

2. The fees of Adv. Raja Thakare, Special Public Prosecutor shall be paid by Home Department as per the proposal approved by this department.

3. His appointment is strictly subject to the conditions of service laid down in the Maharashtra Law Officers (Appointment, Conditions of Service and Remuneration) Rules, 1984.

4. The Government reserves the right to revoke/modify/annul the order without assigning any reasons.

	सामान्य प्रशासन विभाग मंत्रालय, मुंबई ४०० ०३२, दिनांक २६ मार्च २०१८ अधिसूचना क्रमांक डीआयपी-२०१८/प्र.क्र. ७२/३०.----- माजी मंत्री डॉ. पतंगराव श्रीपतराव कदम यांचे शुक्रवार, दिनांक ९ मार्च २०१८ रोजी मुंबई येथे झालेल्या दु:खद निधनाबद्दल राज्य मंत्रिमंडळाने दिनांक १५ मार्च २०१८ चे बैठकीत खालीलप्रमाणे ठराव पारित करून श्रद्धांजली अर्पण केली. '' कै. डॉ. पतंगराव श्रीपतराव कदम यांचा जन्म ८ जानेवारी १९४४ रोजी सांगली जिल्ह्यत कडेगाव तालुक्यातील सोनसळ येथे झाला. त्यांचे शिक्षण एम.ए., एल.एल.बी., पीएच.डी. पयर्ंत झाले होते. सोनसळ या लहान खेडयातील सामान्य शेतकरी कुटुंबातून आलेल्या पतंगरावांनी अतिशय जिद्दीने शिक्षण घेतले. दररोज ४ ते ५ कि.मी. अंतर पायपीट करून ते शेजारच्या गावातील शाळेत जायचे. तिथे प्राथमिक शिक्षण पूर्ण केल्यानंतर त्यांनी कुंडल येथील वस्तीशाळेत दहावीचा टप्पा पार केला. दहावीची परीक्षा उत्तीर्ण झालेले ते सोनसळ गावातील पहिले विद्यार्थी होते. त्यांचे पुढील शिक्षण सातारा येथील शिवाजी कॉलेजात झाले. पतंगरावांनी अत्यंत प्रतिकूल परिस्थितीत ' कमवा आणि शिका ' या योजनेखाली कॉलेज शिक्षण घेतले. पुढे १९६१ मध्ये त्यांनी पुणे गाठले. तिथे एक वर्षाचा डिप्लोमा कोर्स पूर्ण करून ते पुण्यातील रयत शिक्षण संस्थेच्या माध्यमिक शाळेत अर्धवेळ शिक्षक म्हणून रुजू झाले. विद्यार्जनाचे काम करत असतानाच पुणे विद्यापीठातून कायद्याची पदवी व मास्टर्स डिग्री मिळवली. ८० च्या दशकातील शैक्षणिक व्यवस्थापनातील समस्या या विषयावर संशोधन करून त्यांनी पुणे विद्यापीठातून व्यवस्थापनाची डॉक्टरेटही मिळवली. डॉ. पतंगराव कदम एक प्रयत्नवादी व्यक्ितमत्व होते. अत्यंत संघर्षातून शिक्षण घ्यावे लागलेल्या पतंगरावांचा भारती विद्यापीठासारख्या देशातील अग्रगण्य अभिमत शैक्षणिक संस्थेच्या उभारणीपयर्ंतचा प्रवास ही एका विलक्षण जिद्दीची यशकथा आहे. वयाच्या २० व्या वर्षी दिनांक १० मे १९६४ रोजी पुणे येथे भारती विद्यापीठाची स्थापना केली. विविध विषयांच्या १८० पेक्षा अधिक शाखा सुरू करून लाखो विद्याथ्यार्ंना शिक्षण देण्याचे फार मोठे कार्य केले. संस्थापक-कुलगुरू म्हणून जबाबदारी वाहत असताना त्यांनी भारती विद्यापीठांच्या कक्षा देश आणि विदेशात रुंदावल्या. प्रगत शैक्षणिक संकल्पना जाणून त्यांचा आपल्या संस्थांमध्ये कृतीशील अवलंब करण्याचा त्यांचा नेहमीच प्रयत्न असे. ते खया अर्थाने एक प्रयोगशील शिक्षणतज्ज्ञ होते. विद्यापीठासोबत भारतीय विद्यापीठ क्रीडा प्रतिष्ठान स्थापन करून या संस्थेद्वारे त्यांनी गरीब विद्याथ्यार्ंना मदत करण्यासोबतच समाजसेवक, पत्रकार, कलाकारांना मानधन देण्याची योजना सुरू केली. श्रीपतराव कदम प्रतिष्ठान स्थापन करून पंढरपूर येथे वारकरी भवन बांधले. तसेच त्यांनी एस. टी. महामंडळाचे सदस्य, भारती सहकारी बँकेचे संस्थापक-अध्यक्ष, भारतीय विद्यापीठाचे कुलपती, महाराष्ट्र स्टेट को-ऑपरेटिव्ह फेडरेशनचे-अध्यक्ष, पुणे, मुंबई व कोल्हापूर विद्यापीठाचे सिनेट सदस्य, महाराष्ट्र राज्य रस्ते विकास महामंडळाचे संचालक, रयत शिक्षण संस्थेचे सदस्य, महाराष्ट्र राज्य शिक्षण सल्लागार समितीचे सदस्य, स्वामी विवेकानंद शिक्षण संस्थेचे आजीव सदस्य, डेक्कन एज्युकेशन संस्थेचे विश्वस्त, कृष्णा-येरळा सहकारी सुतगिरणीचे चेअरमन, तासगाव तालुका शेतकरी सहकारी साखर कारखान्याचे संस्थापक-संचालक, सोनहिरा दूध उत्पादक सहकारी संस्थेचे संस्थापक, सागरेश्वर सहकारी सूतगिरणीचे संस्थापक-चेअरमन, महाराष्ट्र राज्य औद्यागिक विकास महामंडळाचे अध्यक्ष तसेच सोनहिरा सहकारी साखर कारखान्याचे संस्थापक-अध्यक्ष म्हणूनही उत्तम कार्य केले. सांगली जिल्ह्यतील दुष्काळी भागाला टेंभू-ताकारी व म्हैसाळ योजनेचे पाणी मिळावे यासाठी त्यांनी विशेष योगदान दिले होते. ते काँग्रेस पक्षाचे निष्ठावंत कार्यकर्ते होते.

	कै. डॉ. पतंगराव कदम सन १९८५, १९९०, १९९९, २००४, २००९ व २०१४ असे सहा वेळा सांगली जिल्ह्यतील पलुस-कडेगाव (वांगी-भिलवडी) मतदारसंघातून महाराष्ट्र विधानसभेवर निर्वाचित झाले होते. त्यांनी सन १९९१ ते १९९३ या काळात शिक्षण व माजी सैनिकांचे कल्याण खात्याचे राज्यमंत्री तसेच सन १९९४ ते २०१४ या काळात वेगवेगळ्या टप्प्यात शिक्षण, उच्च व तंत्र शिक्षण, उद्योग, संसदीय कार्य, व्यापार व वाणिज्य, महसूल व मदत पुनर्वसन, सहकार व वने यांसारख्या अनेक महवाच्या खात्यांचे मंत्री म्हणूनही उत्तम कार्य केले होते. अशा या अभ्यासू, उत्तम प्रशासक, उत्कृष्ट संसदपटू, कार्यक्षम लोकप्रतिनिधी, उत्तम संघटक तसेच वक्तृत्व, नेतृत्व व कतर्ृत्व या तिन्ही गुणांचा संगम असणाया जनमानसातील लोकप्रिय नेत्याचे शुक्रवार, दिनांक ९ मार्च २०१८ रोजी मुंबई येथे दु:खद निधन झाले. डॉ. कदम यांच्या निधनाबद्दल हे मंत्रिमंडळ तीव्र दु:ख व्यक्त करीत आहे आणि त्यांच्या कुटुंबियांच्या दु:खात सहभागी आहे. त्यांच्या निधनाचे दु:ख सहन करण्याची ताकद कुटुंबियांमध्ये येवो, अशी प्रार्थना करण्यात येत आहे. 3. Lump sum fees of Rs. 25,000 (Rupees Twenty five thousand only) as quoted by Adv. Satish H. Mhatre has been already deposited by the applicant Smt. Mirabai Laxman Mhatre to the Government, vide R.B.I Challan No. 9992 dated 6th March 2018. The amount will be paid to Adv. Satish H. Mhatre after completion of the case.

(१) वसुली अधिकारी यांनी महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६ व नियम, १९६१ चे नियम १०७ मधील तरतुदीनुसार कर्ज वसुलीची कार्यवाही करावी. कर्ज वसुली करताना सहकार कायदा, नियम यातील तरतुदी व परिपत्रकीय सूचनांचे पालन न केल्याचे निदर्शनास आल्यास आवश्यक ती चौकशी करून आवश्यकता भासल्यास सदरचे प्रदान केलेले अधिकार तत्काळ काढून घेण्यात येतील.

(२) सदरचे अधिकार सहकार कायदा कलम १०१ व ९१ अन्वये प्राप्त वसुली दाखल्याची अंमलबजावणी करण्याकरिता असतील.

(३) वसुली अधिकारी यांनी दरमाह सोबत जोडलेल्या विहित नमुन्यात "अ-३", "अ-४" व "ब" कर्ज वसुलीची माहिती संबंधित जिल्हा उप निबंधक, सहकारी संस्था यांचे कार्यालयास सादर करावी. ज्या सहकारी संस्थेचे कार्यक्षेत्र विभाग, दोन विभाग अथवा राज्य कार्यक्षेत्र आहे त्या संस्थांनी देखील त्यांचे मुख्य कार्यालय ज्या जिल्ह्यमध्ये आहे त्या जिल्हा उप निबंधक यांचे कार्यालयास माहिती सादर करावी.

(४) अधिकार प्रदान केलेल्या वसुली अधिकारी असलेल्या व्यक्तीची बदली झाल्यास किंवा सेवानिवृत्ती झाल्यास किंवा सेवेतून काढून टाकल्यास किंवा त्याचा मृत्यू झाल्यास, अशा अधिकायास प्रदान केलेले अधिकार आपोआप रद्द होतील.

(५) वसुली अधिकारी यांनी वसूल केलेल्या संपूर्ण सरचार्ज रकमेचा भरणा वसूल केलेल्या महिन्यातच चलनाने शासकीय कोषागारात करावा. वसुली अधिकारी यांनी वसूल केलेला सरचार्ज त्याचा शासकीय कोषागारात केलेला भरणा याबाबत संस्था स्तरावर स्वतंत्र नोंदवही ठेवण्यात यावी. त्याबाबतचा नमुना "अ-१", "अ-२", "अ-३", "अ-४" सोबत जोडलेला आहे.

(६) मा. उच्च न्यायालय, मुंबई यांनी रिट याचिका क्रमांक १९४२/२०१३, दि बेसिन कॅथोलिक को-ऑपरेटिव्ह बँक विरुद्ध महाराष्ट्र राज्य व इतर या याचिकेमध्ये दिनांक ५ डिसेंबर २०१५ रोजी दिलेला आदेश विचारात घेऊन वसुलीची कार्यवाही करताना महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ अन्वये प्राप्त असलेल्या अधिकारानुसारच वसुलीची कार्यवाही करावी.

(७) वसुली अधिकारी यांनी नमूद केलेल्या कालावधीत वसुलीचे कामकाज समाधानकारक केले नसल्याचे निदर्शनास आल्यास किंवा प्रदान केलेल्या अधिकाराचा गैरवापर करीत असल्याचे निदर्शनास आल्यास, प्रदान केलेले अधिकार काढून घेतले जातील व भविष्यात असे कोणतेही अधिकार अशा व्यक्तीस प्रदान करण्यात येणार नाहीत.

(८) शासन निर्णय क्रमांक संकीर्ण-१५०४/प्र.क्र.२३१/१५-स, दिनांक २३ नोव्हेंबर २००६ अन्वये वसुली अधिकायांना तीन सिंहाच्या राजमुद्रेचा वापर करता येणार नाही.

(९) वसुली अधिकायास त्याच्या नावापुढे कोठेही " महाराष्ट्र शासन नियुक्त " आणि किंवा " सिव्हील कोर्ट ", " एक्झीक्युटीव्ह कोर्ट " या शब्दांचा अथवा तत्सम शब्दांचा वापर करता येणार नाही. त्याऐवजी वसुली अधिकायांनी त्यांच्या नावापुढे " नवी मुंबई को-ऑप. बँक लि., नवी मुंबई (महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ चे नियम १०७ अन्वये)" असे लिहावे.

(१०) वसुली अधिकायास वसुलीसाठी वापर करण्यात येणाया वाहनावर " वसुली अधिकारी, नवी मुंबई को-ऑप. बँक लि., नवी मुंबई " असा फलक लावता येऊ शकेल.

भाग एक (म.उ.वि.)--२अ१२ महाराष्ट्र शासन राजपत्र, भाग एक--मध्य उप-विभाग, गुुरुवार ते बुधवार, मार्च २९, एप्रिल ४, २०१८ / चैत्र ८-१४, शके १९४० (११) वसुली अधिकायाने पगार जप्तीची कार्यवाही करताना कर्जदाराच्या/जामीनदाराच्या पगार कपातीबाबत राष्ट्रीयीकृत बँका वा अन्य बँका यांच्याकडे परस्पर वेतन कपातीचा आदेश देऊन परस्पर पगार कपात करता येणार नाही. संबंधित कर्जदार/जामीनदार ज्या आस्थापनेवर काम करीत आहे त्या आस्थापनेवरील आहरण व संवितरण अधिकारी/पगार करणारा अधिकारी यांचेमार्फत पगारातून कर्ज वसूल करण्याची कार्यवाही करावी.

(१२) वसुली अधिकायास, थकबाकीदाराकडून वसुली दाखल्यानुसार वसूलपात्र रक्कम व सरचार्ज रक्कम याशिवाय इतर कोणतीही रक्कम वसूल करता येणार नाही.

या कार्यालयाचे आदेश/परिपत्रक दिनांक १ जानेवारी २०१७ मधील क्र. ४ कलम १५६ व नियम १०७ अन्वये वसुली अधिकारी यांनी करावयाची कार्यवाही यामधील मार्गदर्शक सूचनांचे पालन करावे. बँकेचे मुख्य कार्यकारी अधिकारी यांना दरमहा वसुली अधिकायाचे कामकाजाचा कर्जदारनिहाय आढावा परिपत्रकातील प्रपत्र ५ मध्ये नमूद केल्याप्रमाणे घ्यावा.

वसुली अधिकारी यांनी निर्गमित करावयाच्या नोटीस/आदेश/घोषणा यामध्ये त्यांना अधिकार प्रदान केलेल्या या आदेशाचा संदर्भ नमूद करावा.

४. आपली बदली झाल्यास किंवा सेवानिवृत्ती झाल्यास किंवा सेवेतून काढून टाकल्यास किंवा त्याचा मृत्यू झाल्यास, अशा अधिकायास प्रदान केलेले अधिकार आपोआप रद्द होतील.

५. आपण वसूल केलेल्या संपूर्ण सरचार्ज रकमेचा भरणा वसूल केलेल्या महिन्यातच चलनाने शासकीय कोषागारात करावा. वसूल केलेला सरचार्ज, त्याचा शासकीय कोषागारात केलेला भरणा याबाबत संस्थास्तरावर स्वतंत्र नोंदवही सोबत जोडलेल्या नमुना ''अ-१'', ''अ-२'', ''अ-३'' ,''अ-४'' मध्ये ठेवावी.

७. आपण नमूद केलेल्या कालावधीत वसुलीचे कामकाज समाधानकारक केले नसल्याचे निदर्शनास आल्यास किंवा प्रदान केलेल्या अधिकाराचा गैरवापर करीत असल्याचे निदर्शनास आल्यास, प्रदान केलेले अधिकार काढून घेतले जातील व भविष्यात असे कोणतेही अधिकार आपणास प्रदान करण्यात येणार नाही.

८. शासन निर्णय क्रमांक संकीर्ण-१५०४/प्र. क्र. २३१/१५-स, दिनांक २३ नोव्हेंबर २००६ अन्वये आपणास तीन सिंहाच्या राजमुद्रेचा वापर करता येणार नाही.

९. आपणास आपल्या नावापुढे कोठेही '' महाराष्ट्र शासन नियुक्त '' आणि किंवा '' सिव्हील कोर्ट '', '' एक्झीक्युटीव्ह कोर्ट '' या शब्दाचा अथवा तत्सम शब्दांचा वापर करता येणार नाही. त्याऐवजी '' वसुली अधिकारी (महाराष्ट्र सह. संस्था अधिनियम, १९६० व नियम, १९६१ चे नियम १०७ अन्वये) '' असे लिहावे.

१०. आपणास वसुलीसाठी वापर करण्यात येणाया वाहनावर '' वसुली अधिकारी ............. सहकारी बँक/पतसंस्था ............ '' असा फलक लावता येऊ शकेल.

११. आपण पगार जप्तीची कार्यवाही करताना कर्जदाराच्या/जामीनदाराच्या पगार कपातीबाबत राष्ट्रीयीकृत बँका वा अन्य बँका यांचेकडे परस्पर वेतन कपातीचा आदेश देऊन परस्पर पगार कपात करता येणार नाही. संबंधित कर्जदार/जामीनदार ज्या आस्थापनेवर काम करीत आहे. त्या आस्थापनेवरील आहरण व संवितरण अधिकारी/पगार करणारा अधिकारी यांचेमार्फत पगारातून कर्ज वसूल करण्याची कार्यवाही करावी.

१२. आपणास थकबाकीदाराकडून वसुली दाखल्यानुसार वसूलपात्र रक्कम व सरचार्ज रक्कम याशिवाय इतर कोणतीही रक्कम वसूल करता येणार नाही.

१३. नूतनीकरणाचा प्रस्ताव मा. सहकार आयुक्त व निबंधक, सहकारी संस्था, म.रा., पुणे यांचे परिपत्रक क्र. पतसंस्था/सआ-५/वसुली अधिकारी नियुक्ती/फेरनियुक्ती/९/२०१७, दिनांक १ जानेवारी २०१७ मध्ये दिलेल्या सूचनेनुसारच प्रस्ताव दाखल करण्यात यावा.
