आणि ज्याअर्थी, महाराष्ट्र शासनाच्या नगरविकास विभागातर्फे शासन पत्र क्र. टिपीएस-१२००/१९५७/सीआर-३२/२००१/युडी-१२, दिनांक २२ मार्च २००१ अन्वये कल्याण संकुल अधिसूचित क्षेत्रासाठी " उल्हासनगर, अंबरनाथ, कुळगांव-बदलापूर आणि परिसर अधिसूचित क्षेत्र " असा बदल करण्यास मान्यता दिली ;

आणि ज्याअर्थी, महाराष्ट्र शासनाच्या नगरविकास विभागाने अधिसूचना क्र. टिपीएस-१२०२/८०६/सीआर-८३/२००२/युडी-१२, दिनांक २६ ऑक्टोबर २००४ अन्वये उल्हासनगर महानगरपालिका क्षेत्र " उल्हासनगर, अंबरनाथ, कुळगांव-बदलापूर आणि परिसर अधिसूचित क्षेत्रा " मधून वगळले व सदर अधिसूचित क्षेत्राच्या नावात " अंबरनाथ, कुळगांव-बदलापूर आणि परिसर अधिसूचित क्षेत्र " असा बदल केला (यापुढे ज्याचा उल्लेख " उक्त अधिसूचित क्षेत्र " असा केला आहे) ;

आणि ज्याअर्थी, महाराष्ट्र शासनाच्या नगरविकास विभागाने अधिसूचना क्र. टिपीएस-१२०४/९४१/सीआर-१६३/०४/युडी-१२, २५ जुलै २००५ अन्वये उक्त अधिसूचित क्षेत्रासाठीची विकास योजना विकास नियंत्रण नियमावलीसह मंजूर केली व काही भाग ई.पी. (Excluded Parts) च्या स्वरूपात प्रसिद्ध केला ;

आणि ज्याअर्थी, महाराष्ट्र शासनाच्या नगरविकास विभागाने अधिसूचना क्र. टिपीएस-१२०४/९४१/सीआर-१६३/ ०४(भाग-II)/युडी-१२, दिनांक ११ ऑगस्ट २००८ अन्वये उक्त अधिसूचित क्षेत्रासाठीच्या ई. पी. (Excluded Parts) ला मंजुरी दिली ;

आणि ज्याअर्थी, शासनाने आदेश क्र. मुमंस/टिपीएस-१२०६/२०९७/प्र. क्र. ५६४/०८/नवि-१२, दिनांक १३ मे २००९ व त्यावरील दिनांक २८ ऑक्टोबर २००९ रोजीच्या शुद्धिपत्रकान्वये उक्त अधिनियमाचे कलम ३७(१) अन्वये उक्त अधिसूचित क्षेत्रासाठीच्या मंजूर विकास योजनेमधील मौ. बेलवली, ता. अंबरनाथ येथील स. नं. ६९, हि. नं. २/२ ही जमीन 'आरक्षण क्र. ५- पब्लिक ऑफिस व स्टाफ क्वॉर्टर्स ' आणि 'आरक्षण क्र. ६- ट्रक र्टमिनस ' या आरक्षणामधून वगळणेबाबत प्राधिकरणास उक्त अधिनियमाचे कलम ३७ अन्वयेची " उक्त फेरबदलाची " सर्व वैधानिक कार्यवाही पूर्ण करून फेरबदल प्रस्ताव अंतिम मंजुरीसाठी शासनास सादर करण्याचे निदेश दिले आहेत;

आणि ज्याअर्थी, उक्त फेरबदलाबाबतची बाब टिप्पणी प्राधिकरणाच्या दि. १२ जानेवारी २०१८ रोजी झालेल्या १४४ व्या बैठकीमध्ये सादर केली होती. प्राधिकरणाने सदर बैठकीतील ठराव क्र. १४३० अन्वये उक्त अधिसूचित क्षेत्राच्या मंजूर विकास योजनेमधील मौ. बेलवली, ता.अंबरनाथ येथील स. नं. ६९, हि. नं. २/२ ही जमीन ' आरक्षण क्र. ५- पब्लिक ऑफिस व स्टाफ क्वॉर्टर्स ' व 'आरक्षण क्र. ६- ट्रक र्टमिनस' मधून वगळून रहिवास परिमंडळात समाविष्ट करण्यासाठी उक्त अधिनियमाच्या कलम ३७(१) अन्वये फेरबदलाच्या प्रस्तावास, उक्त अधिसूचित क्षेत्राच्या मंजूर विकास योजनेच्या भाग नकाशावर दर्शविल्याप्रमाणे मान्यता दिली आहे (यापुढे ज्याचा उल्लेख " उक्त फेरबदल " असा करण्यात आला आहे) ;

आणि ज्याअर्थी, प्राधिकरणाच्या ठराव क्र. १४३० नुसार मुंबई महानगर प्रदेश विकास प्राधिकरण अधिनियम, १९७४ अन्वये प्राप्त झालेल्या अधिकारांचा वापर करून उक्त अधिनियमाच्या कलम ३७ मधील सर्व वैधानिक कार्यवाही पूर्ण करण्यासाठी जसे जनतेकडून सूचना/हरकती मागविणेसाठी नोटीस प्रसिद्ध करणे, शासनास सदर फेरबदल प्रस्ताव मंजुरीसाठी सादर करणे यासाठी व अधिनियमानुसार आवश्यक असलेली सर्व कार्यवाही पूर्ण करण्यास महानगर आयुक्त यांना प्राधिकृत केले आहे.

म्हणून आता, उक्त अधिसूचित क्षेत्राच्या मंजूर विकास योजनेमधील मौ. बेलवली, ता. अंबरनाथ येथील स. नं. ६९, हि. नं. २/२ या जमिनी 'आरक्षण क्र. ५- पब्लिक ऑफिस व स्टाफ क्वॉर्टर्स' आणि 'आरक्षण क्र. ६- ट्रक र्टमिनस' मधून वगळून रहिवास परिमंडळात समाविष्ट करणेबाबत उक्त अधिनियमाच्या कलम ३७ मधील तरतुदींन्वये उक्त फेरबदलाबाबत जनतेकडून सूचना आणि/किंवा आक्षेप मागविण्यासाठी ही नोटीस प्रसिद्ध करण्यात येत आहे.

उक्त फेरबदल दर्शविणारा मंजूर विकास योजनेचा भाग नकाशा खालील कार्यालयांत, कार्यालयीन वेळेमध्ये जनतेच्या निरिक्षणासाठी ठेवण्यात आला आहे.

MUMBAI METROPOLITAN REGION DEVELOPMENT AUTHORITY

Notice

(Maharashtra Regional and Town Planning Act, 1966)

WHEREAS, the Government of Maharashtra has appointed the Mumbai Metropolitan Region Development Authority (hereinafter referred to as " the said Authority ") established under the Mumbai Metropolitan Region Development Authority Act, 1974 (Mah. IV of 1975), to be the Special Planning Authority for the " Kalyan Complex Notified Area " by the Urban Development and Public Health Department Notification No.TPB-1275/1199/UD-8, dated 15th March 1976 promulgated in exercise of its powers conferred by section 40 (1)(c) of the Maharashtra Regional and Town Planning Act, 1966. (hereinafter referred to as the "said Act");

AND WHEREAS, the Government of Maharashtra, Urban Development Department by its Notification No. TPS -1200/1957/CR-32/2001/UD-12, dated 22nd March 2001 has changed the name of the Kalyan Complex Notified Area as "Ulhasnagar, Ambernath, Kulgaon-Badlapur & Surrounding Notified Area";

AND WHEREAS, the Government of Maharashtra, Urban Development Department by its Notification No.TPS-1202/806/CR-83/2002/UD-12, dated 26th October 2004 excluded the area within the jurisdiction of Ulhasnagar Municipal Corporation from " Ulhasnagar, Ambarnath, Kulgaon-Badlapur & Surrounding Notified Area " and name of the said Notified Area is changed to " Ambarnath, Kulgaon-Badlapur & Surrounding Notified Area " (hereinafter referred to as the " said Notified Area ");

AND WHEREAS, the Government of Maharashtra, Urban Development Department by its Notification No.TPS-1204/941/CR-163/04/UD-12, dated 25th July 2005 has sanctioned the Development Plan along with Development Control Regulations for the said Notified Area & published certain parts in the form of E.P.(Excluded Parts);

AND WHEREAS, the Government of Maharashtra, in Urban Development Department by its Notification No.TPS-1204/941/CR-163/04(Part-II)/UD-12, dated 11th August, 2008 has sanctioned the E.P. (Excluded Parts) for the said Notified Area;

AND WHEREAS, the Government of Maharashtra in Urban Development Department vide letter bearing No. मुमंस/टिपीएस-१२०६/२०९७/प्र. क्र. ५६४/०८/नवि-१२, dated 13th May 2009 and vide corrigendum dated 28th October 2009 issued orders for carrying out the statutory process u/s 37(1) of the said Act for modification to Development Plan of the said Notified Area regarding deletion of land bearing S.No. 69, H.No. 2/2 from Reservation No. 5 'Public Office and Staff Quarters' and Reservation No. 6 'Truck Terminus' in village Belvali, Tal. Ambernath and accordingly, submit the final report to the Government for sanction.

AND WHEREAS, the Authority in its 144th meeting held on 12th January, 2018 by Resolution No. 1430 has accorded its approval to initiate the procedure u/s 37(1) of the said Act for carrying out the said modification to Sanctioned Development Plan of the said Notified Area for deletion of land bearing S.No. 69, H.No. 2/2 from Reservation No. 5 'Public Office and Staff Quarters' and Reservation No. 6 'Truck Terminus' in village Belvali, Tal. Ambernath and include the area under modification to Residential zone, as shown on the map of Sanction Development Plan of the said area (hereinafter referred as "the said modification");

AND WHEREAS, as per the said Resolution No. 1430, in exercise of the powers under the MMRDA Act, 1974 has authorized the Metropolitan Commissioner to carry out all the statutory procedure u/s 37 of the said Act viz. publication of Notice for inviting suggestion/objection from public, to submit the said modification proposal to the Government and to carry out all required necessary action under the said Act.

NOW THEREFORE, this notice is hereby published under Section 37 of the said Act for inviting suggestions and/or objections from public for carrying out the said modification to the Sanctioned Development Plan of the said Notified Area for deletion of land bearing S.No. 69, H.No. 2/2 from Reservation No. 5 'Public Office and Staff Quarters' and Reservation No. 6 ' Truck Terminus ' in village Belvali, Tal. Ambernath and include the area under modification to Residential zone, as shown on the map of Sanctioned Development Plan.

आणि ज्याअर्थी, महाराष्ट्र शासनाच्या नगरविकास विभागाने अधिसूचना क्र. टिपीएस-१२०४/९४१/सीआर-१६३/ ०४(भाग-II)/युडी-१२, दिनांक ११ ऑगस्ट, २००८ अन्वये उक्त अधिसूचित क्षेत्रासाठीच्या ई. पी. ला. (Excluded Parts) मंजुरी दिली ;

आणि ज्याअर्थी, शासनाने आदेश क्र. मुमंस/टिपीएस-१२०८/८/प्र. क्र. २०८/०९/नवि-१२, दिनांक ४ फेब्रुवारी २०१० अन्वये उक्त अधिसूचित क्षेत्रासाठीच्या मंजूर विकास योजनेमधील मौ. कात्रप येथील स. नं. ७४, ७५, ८१, ८३ (भाग) व ८४ (भाग) या जमिनीना विकास परिमंडळामधून वगळून रहिवास परिमंडळात समाविष्ट करणेबाबत प्राधिकरणास उक्त अधिनियमाच्या कलम ३७(१) नुसार विहित वैधानिक कार्यवाही पूर्ण करून फेरबदल प्रस्ताव अंतिम मंजुरीसाठी शासनास सादर करणेबाबत निर्देश दिले आहेत;

आणि ज्याअर्थी, उक्त फेरबदलाबाबतची बाब टिप्पणी प्राधिकरणाच्या दिनांक १२ जानेवारी, २०१८ रोजी झालेल्या १४४ व्या बैठकीमध्ये सादर केली होती. प्राधिकरणाने सदर बैठकीतील ठराव क्र. १४५५ अन्वये उक्त अधिसूचित क्षेत्राच्या मंजूर विकास योजनेमधील मौ. कात्रप येथील स. नं. ७४, ७५, ८१, ८३ (भाग) व ८४ (भाग) या जमिनीना विकास परिमंडळामधून वगळून रहिवास परिमंडळात समाविष्ट करण्यासाठी उक्त अधिनियमाच्या कलम ३७(१) अन्वयेच्या फेरबदलाच्या प्रस्तावास इको सेन्सेटिव्ह झोनच्या हद्दीलगत असलेल्या जमिनीवर कमीतकमी २५.०० मी. रुंदीच्या पट्टयामध्ये झाडांची लागवड करणे व त्यांची निगा राखणे तसेच रस्त्याची रुंदी वगळून इमारतीसाठी सोडावे लागणारे सामासिक अंतर यांचा सदर २५ मी. रुंदीच्या पट्टयामध्ये समाविष्ट करता येईल या अटीसापेक्ष, उक्त अधिसूचित क्षेत्राच्या मंजूर विकास योजनेच्या भाग नकाशावर दर्शविल्याप्रमाणे मान्यता दिली आहे (यापुढे ज्याचा उल्लेख " उक्त फेरबदल " असा करण्यात आला आहे);

WHEREAS, the Government of Maharashtra has appointed the Mumbai Metropolitan Region Development Authority (hereinafter referred to as " the said Authority ") established under the Mumbai Metropolitan Region Development Authority Act, 1974, (Mah. IV of 1975) to be the Special Planning Authority for the " Kalyan Complex Notified Area " by the Urban Development and Public Health Department Notification No.TPB-1275/1199/UD-8, dated 15th March 1976 promulgated in exercise of its powers conferred by Section 40 (1)(c) of the Maharashtra Regional and Town Planning Act, 1966. (hereinafter referred to as the " said Act ");

AND WHEREAS, the Government of Maharashtra, Urban Development Department by its Notification No. TPS -1200/1957/CR-32/2001/UD-12, dated 22nd March, 2001 has changed the name of the Kalyan Complex Notified Area as "Ulhasnagar, Ambernath, Kulgaon-Badlapur & Surrounding Notified Area";

AND WHEREAS, the Government of Maharashtra, Urban Development Department by its Notification No.TPS-1202/806/CR-83/2002/UD-12, dated 26th October 2004 excluded the area within the jurisdiction of Ulhasnagar Municipal Corporation from "Ulhasnagar, Ambarnath, Kulgaon-Badlapur & Surrounding Notified Area" and name of the said Notified Area is changed to "Ambarnath, Kulgaon-Badlapur & Surrounding Notified Area" (hereinafter referred to as the "said Notified Area");

AND WHEREAS, the Government of Maharashtra, Urban Development Department by its Notification No.TPS-1204/941/CR-163/04/UD-12, dated 25th July 2005 has sanctioned the Development Plan along with Development Control Regulations for the said Notified Area & published certain parts in the form of E.P.(Excluded Parts);

AND WHEREAS, the Government of Maharashtra, in Urban Development Department by its Notification No.TPS-1204/941/CR-163/04(Part-II)/UD-12, dated 11th August 2008 has sanctioned the E.P. (Excluded Parts) for the said Notified Area;

AND WHEREAS, the Government of Maharashtra in Urban Development Department vide letter bearing No. मुमंस/टिपीएस-१२०८/८/प्र. क्र. २०८/०९/नवि-१२, dated 4th February 2010 issued orders for carrying out the statutory process under section 37(1) of the said Act for modification to Development Plan of the said Notified Area regarding deletion of land bearing S.No. 74, 75, 81, 83(pt) and 84(pt) in village Katrap from No Development Zone and include them to Residential Zone and accordingly, submit the final report to the Government for sanction.

AND WHEREAS, the Authority in its 144th meeting held on 12th January, 2018 by Resolution no. 1455 has accorded its approval to initiate the procedure u/s 37(1) of the said Act for carrying out the said modification to Sanctioned Development Plan of the said Notified Area for deletion of land bearing S.no. S.No. 74, 75, 81, 83(pt) and 84(pt) of village Katrap from No Development Zone and inclusion of them to Residential Zone, as shown on the map of Sanction Development Plan of the said area, subject to plantation and maintenance of trees within minimum 25m wide belt adjacent to boundary of Eco sensitive zone. Also by excluding width of road, marginal open space of building can be included within this 25m wide belt. (hereinafter referred as "the said modification");

AND WHEREAS, as per the said Resolution No. 1455, in exercise of the powers under the MMRDA Act, 1974 has authorized the Metropolitan Commissioner to carry out all the statutory procedure under section 37 of the said Act viz. publication of Notice for inviting suggestion/ objection from public, to submit the said modification proposal to the Government and to carry out all required necessary action under the said Act;

NOW THEREFORE, this notice is hereby published under Section 37 of the said Act for inviting suggestions and/or objections from public for carrying out the said modification to the Sanctioned Development Plan of the said Notified Area for deletion of land bearing S.No. 74, 75, 81, 83(pt) and 84(pt) of village Katrap from No Development Zone and inclusion of them to Residential Zone, as shown on the map of Sanctioned Development Plan.

WHEREAS, the Government of Maharashtra under Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as the ' said Act ') appointed Mumbai Metropolitan Region Development Authority (hereinafter referred as ' MMRDA '), to be the ' Special Planning Authority ' (hereinafter referred to 'the said Special Planning Authority') for Bhiwandi Surrounding Notified Area, which includes the area of 51 villages (revised 60 villages) from Bhiwandi Tahsil of Thane District (hereinafter referred as 'the said Notified Area') and the Government of Maharashtra in Urban Development Department by its Notification dated 11th March, 2015 has accorded part sanction to the Development Plan alongwith Development Control Regulations for the said Notified Area & on 4th November, 2016; 10th March, 2017; 24th March, 2017 and 13th June, 2017 (published in Maharashtra Government Gazette on 13th March, 2015; 10th-16th November, 2016; 6th-12th April, 2017; 13th-19th April, 2017 and 29th June-5th July 2017 respectively) has accorded sanction to the Excluded Parts of the Development Plan of the said Notified Area under Section 31 (1) of the said Act;

AND WHEREAS, the MMRDA in its 144th authority meeting by its Resolution No. 1429 has accorded approval to initiate the procedure u/s 37(1) of the said Act for carrying out modification to the Sanctioned Development Control Regulation of the said Notified Area, table under Regulation No. AF 1.1(b) of Appendix - AF, under Regulation 6.18 for the development of land in Transport Hub and Logistic Part Zone is to be replaced with the revised table (hereinafter referred as 'the said modification').
