प्रमाणपत्र देण्याचे व त्याच्या पडताळणीचे विनियमन) अधिनियम, २०००.
क्रमांक सीबीसी. १०/२०१७/प्र. क्र. २१९/मावक.-----महाराष्ट्र अनुसूचित जाती, अनुसूचित जमाती, विमुक्त जाती, भटक्या जमाती, इतर मागासवर्ग व विशेष मागासप्रवर्ग (जातीचे प्रमाणपत्र देण्याचे व त्याच्या पडताळणीचे विनियमन) अधिनियम, २००० (सन २००१ चा महा. २३) याच्या कलम १८ च्या पोट-कलम (१) द्वारे प्रदान करण्यात आलेल्या आणि याबाबतीत त्यास समर्थ करणा-या इतर सर्व अधिकारांचा वापर करून महाराष्ट्र शासनाने महाराष्ट्र अनुसूचित जाती, विमुक्त जाती, भटक्या जमाती, इतर मागासवर्ग व विशेष मागासप्रवर्ग (जातीचे प्रमाणपत्र देण्याचे व त्याच्या पडताळणीचे विनियमन) नियम, २०१२ यात सुधारणा करण्यासाठी जे नियम करण्याचे योजिले आहे, त्या नियमांचा पुढील मसुदा हा, त्यामुळे बाधा पोचण्याची शक्यता असलेल्या सर्व व्यक्तींच्या माहितीकरिता, उक्त अधिनियमाच्या कलम १८ च्या पोट-कलम (१) द्वारे आवश्यक असल्याप्रमाणे, याद्वारे, प्रसिद्ध करण्यात येत आहे आणि याद्वारे अशी नोटीस देण्यात येत आहे की, उक्त मसुदा, महाराष्ट्र शासनाकडून दिनांक २ मे, २०१८ रोजी किंवा त्यानंतर विचारात घेण्यात येईल.
२. उपरोक्त दिनांकापूर्वी, उक्त मसुद्याच्या संबंधात, कोणत्याही व्यक्तीकडून ज्या कोणत्याही हरकती किंवा सूचना महासंचालक, डॉ. बाबासाहेब आंबेडकर संशोधन व प्रशिक्षण संस्था, पुणे यांच्याकडे उपरोक्त दिनांकास किंवा त्यापूर्वी प्राप्त होतील, त्या शासन विचारात घेईल.
नियमांचा मसुदा
१. या नियमांस, महाराष्ट्र अनुसूचित जाती, विमुक्त जाती, भटक्या जमाती, इतर मागासवर्ग व विशेष मागासप्रवर्ग (जातीचे प्रमाणपत्र देण्याचे व त्याच्या पडताळणीचे विनियमन) (सुधारणा) नियम, २०१८ असे म्हणावे.
२. महाराष्ट्र अनुसूचित जाती, विमुक्त जाती, भटक्या जमाती, इतर मागासवर्ग आणि विशेष मागासप्रवर्ग (जातीचे प्रमाणपत्र देण्याचे व त्याच्या पडताळणीचे विनियमन) नियम, २०१२ याच्या नियम ४ मधील, उप-नियम (२) मधील खंड (च) ऐवजी पुढील खंड दाखल करण्यात येईल.
" (च) पुढील कागदपत्रांसह, इतर संबंधित लेखी पुरावा, कोणताही असल्यास,-----

(१)२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, एप्रिल ३, २०१८/चैत्र १३, शके १९४० (एक) वडील, काका, आत्या किंवा आजोबा किंवा आजोबांचे भाऊ किंवा बहीण किंवा वडिलांकडील रक्त संबंधातील नातेवाईक यांचा शाळा नोंदवहीतील उतारा किंवा शाळा सोडल्याचा दाखला किंवा जन्म आणि मृत्यू नोंदवही किंवा इतर कोणत्याही शासकीय किंवा निम-शासकीय कागदपत्रांतील जातीच्या नोंदींचा उतारा ;
(दोन) वडिलांकडील रक्तसंबंधातील नातेवाईक यांचा जन्म आणि मृत्यू नोंदवहीतील उतारा (गावची नोंदवही नमुना क्रमांक-१४), स्थानिक स्वराज्य संस्थांची कागदपत्रे ;
(तीन) संबंधित जात प्रवर्गाच्या मानीव दिनांकापूर्वी नोंदविण्यात आलेली वडिलांकडील रक्तसंबंधातील नातेवाईकांच्या कागदपत्रात नमूद करण्यात आलेली जात, उदा. जमीन, घर किंवा इतर स्थावर संपदेच्या विक्री किंवा खरेदी अभिलेख, गहाणखत, करारनामा, इनाम सनद ज्याद्वारे हक्क हस्तांतरित केले गेले असतील ;
(चार) मुख्यत: औरंगाबाद महसुली विभागाकडील राष्ट्रीय नोंद वही यातील वडिलांकडील रक्त संबंधातील नातेवाईकांच्या जातीची नोंद ;
(पाच) विदर्भातील जमिनीच्या संदर्भातील कागदपत्रातील खास करून कोतवाल किंवा कोतवार पुस्तकातील वडिलांकडील रक्त- संबंधातील नातेवाईकांच्या जातीची नोंद, खास-याचा उतारा इत्यादी किंवा वडिलांकडील रक्त संबंधातील नातेवाईकांच्या जन्म आणि मृत्यू दाखल्यातील जातीची नोंद ;
(सहा) पुराभिलेख संचालनालयातील अभिलेखात उपलब्ध असलेले जातीचा पुरावा देणारे इनाम जमिनीशी संबंधित कागदपत्रे उदा.
लेखी विवरणपत्र, मौखिक पुरावा, पर्ुशिस, वंशावळ, इत्यादी ;
(सात) गाव, फेरफार, नोंदवहीतील जातीच्या नोंदीचा क,ड,ई, पत्राच्या नमुन्यातील कागदपत्रे, जुन्या न्याय प्रक्रियांमधील कागदपत्रांमध्ये नमूद केलेल्या रक्तसंबंधातील नातेवाईकांच्या जातीच्या नोंदी ;
(आठ) वडिलांकडील रक्तसंबंधातील पूर्वजांच्या संदर्भात मानीव दिनांकापूर्वी जुन्या जाती व्यवस्थेतील परंपरागत व्यवसायाची नोंद करण्यात आलेले शासकीय आणि निम-शासकीय प्रमाणपत्र ;
(नऊ) आडनावाऐवजी परंपरागत व्यवसायाचा जात म्हणून नोंद असलेला जुना अभिलेख ;
(दहा) मानीव दिनांकापूर्वीची सनद किंवा कामकाज ज्यात महाराष्ट्र कुळवाहीवाट व शेतजमीन अधिनियम, १९४८ (१९४८ चा ६७) किंवा इतर कोणत्याही कायद्यातील तरतुदींनुसार कुळास जमिनीचा मालक म्हणून घोषित करण्यात आले आहे आणि जातीची नोंद करण्यात आली आहे ;
(अकरा) मानीव दिनांकापूर्वी जनगणनेच्या अभिलेखात घेण्यात आलेल्या जातीच्या नोंदी ;
महाराष्ट्राचे राज्यपाल यांच्या आदेशानुसार व नावाने,
दिनेश वाघमारे, शासनाचे सचिव.

NOTIFICATION
MAHARASHTRA SCHEDULED CASTES, SCHEDULED TRIBES, DE-NOTIFIED TRIBES (VIMUKTA JATIS), NOMADIC TRIBES, OTHER BACKWARD CLASSES AND SPECIAL BACKWARD CATEGORY (REGULATION OF ISSUANCE AND VERIFICATION OF) CASTE CERTIFICATE ACT, 2000.
No. CBC-10/2017/C.R. 219/MAVAK.—The following draft of rules which the Government of Maharashtra proposes to amend the Maharashtra Scheduled Castes, De-notified Tribes (Vimukta Jatis), Nomadic Tribes, Other Backward Classes and Special Backward Category (Regulation of Issuance and Verification of) Caste Certificate Rules, 2012, in exercise of the powers conferred by sub-section (1) of section 18 of the Maharashtra Scheduled Castes, Scheduled Tribes, De-notified Tribes (Vimukta Jatis), Nomadic Tribes, Other Backward Classes and Special Backward Category (Regulation of Issuance and Verification of) Caste Certificate Acts, 2000, (Mah. XXIII of 2001) and of all other powers enabling it in that behalf, is hereby published as required by the said sub- section (1) of section 18, for information of all persons likely to be affected thereby ; and notice is hereby given that the said draft rules will be taken into consideration by the Government of Maharashtra on or after the 2nd May 2018.
2. Any objections or suggestions, which will be received by the Director General Dr. Babasaheb Ambedkar Research And Training Institute, Pune from any person with respect to the said draft on or before the aforesaid date, will be considered by the Government.
DRAFT RULES
1. These rules may be called the Maharashtra Scheduled Castes, De-notified Tribes (Vimukta Jatis), Nomadic Tribes, other Backward Classes and Special Backward Category (Regulation of Issuance and Verification of) Caste Certificate (Amendment) Rules, 2018.
2. In rule 4 of the Maharashtra Scheduled Castes, De-notified Tribes (Vimukta Jatis), Nomadic Tribes, other Backward Classes and Special Backward Category (Regulation of Issuance and Verification of) Caste Certificate Rules, 2012, in sub-rule (2) for clause (f), the following clause shall be substituted namely :—
" (f) other relevant documentary evidence, if any, including the following documents :—
(i) an extract of school Admission Register or School Leaving Certificate of the father, uncle, paternal aunt or grandfather or brother or sister of grandfather or great grandfather or brother or sister of great grandfather, blood relatives from paternal side or the entries of caste in the extract of the birth and death register or any other documents of Government or semi-Government ;
(ii) extracts of birth and death register of blood relative from paternal side (Village Register format No. 14), documents of local self-Government ;
(iii) entry of caste mentioned in the documents of blood relatives from paternal side, registered before deemed date of respective caste category, e.g. sale or purchase deed of land, house or other immovable property, mortgage deed, agreement, inam sanad through which rights have been transferred ;
(iv) entry of caste of blood relatives from paternal side in National Registration Book mainly from Aurangabad Revenue Division ;
(v) entry of caste of blood relatives from paternal side in documents in respect of land in Vidarbha region particularly, in kotwal or kotwar book extract of khasara, etc. or entry of caste in birth and death extract of blood relatives from paternal side ;
४ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, एप्रिल ३, २०१८/चैत्र १३, शके १९४०(vi) documents related to Inam land available in the records of Directorate of Archives revealing the evidence of caste, e.g. written statement, oral evidence, pursis, genealogy, etc; (vii) entry of caste in the extract of Village Mutation Register, documents in the format of 'Ka', 'da', 'ee', patra, entries of caste of blood relatives from paternal side mentioned in the documents of old Court proceedings ;
(viii) Government and semi-Government certificates containing traditional occupation of caste in the old Caste System in respect of ancestors in blood relations from paternal side, entered before deemed date ;
(ix) old record wherein name of traditional occupation is mentioned as caste in lieu of surname ;
(x) sanad or proceedings before deemed date, in which the tenant has been declared as the landlord, as per the provisions of the Maharashtra Tenancy and Agricultural Lands Act (LXVII of 1948) or any other law, revealing the entry of caste ;
(xi) entries of caste in Census record entered before deemed date. ".
