Under Section 61 of Maharashtra Regional and Town Planning Act, 1966, Draft Town Planning Scheme

of 1730 Acre under Smart City Mission at Mouza Bharatwada, Punapur, Pardi and Bhandewadi, Distt

Nagpur

Whereas, Government of India has launched 'Smart City Mission with an objective to promote cities that provide core infrastructure and give a decent quality of life to its citizens, a clean and sustainable environment and application of 'smart solution'. As you are aware that Nagpur Municipal Corporation has been selected under this mission, with an intent ro prepare Town Planning Scheme (TPS) for mouza- Bharatwada, Punapur, Pardi and Bhandewadi on the principals of 'Retrofitting.' As per the sanctioned revised Development Plan of Nagpur City the said area is in the Green Belt Scheme for which Nagpur Improvement Trust is the Planning Authority;

And whereas, the Resolution No. 1/1169/20-05-2017 has been passed by Nagpur Improvement Trust to declare the intention for Town Planning Scheme. As per the approvals of Nagpur Improvement Trust M/s. HCP, Design, Planning and Management Pvt. Limited, Ahmedabad, worked as Consultants to the Special Purpose Vehicle, Nagpur Smart and Sustainable City Development Corporation to prepare Town Planning Scheme (TPS) for Mouza- Bharatwada, Punapur, Pardi and Bhandewadi on the principals of 'Retrofitting' by complying to Maharashtra Regional and Town Planning Act, 1966 and Maharashtra Town Planning Scheme Rules, 1974;

And whereas, intention to prepare the Draft TP Scheme has been declared in Official Gazette for 1240 Acre of area under Town Planning Scheme Pardi, Bharatwada, Punapur and Bhandewadi on 7th June 2017;

And whereas, the local corporators of the project area have demanded for including additional 490 Acres of land into the said Town Planning Scheme. vide letter No. NMC-TPD-1031, dated 28th July 2017 Nagpur Improvement Trust approved for increase in area from 1240 Acre to 1730 Acre. The intention for 1730 acre area of Town Planning Scheme Bharatwada, Punapur, Pardi and Bhandewadi was further declared in the Official Gazette on 1st September 2017 and the same has been informed to the state and Director, Town Planning through Letter No. NMC-TPD-1992, dated 3-10-2017 as per Section 60 (2) of Maharashtra Regional and Town Planing Act, 1966;

And whereas, as per the Maharashtra Regional and Town Planning Act, 1966 and Rule 4(1) of Maharashtra Town Planning Rules, 1974 it is required to conduct on Owner's meeting to obtain Suggestions and Objections of the land Owners on the Tentative proposal. Public and Individual notices were released on 01-02-2018 and the Owner's meeting was conducted on 2-02-2018 at Bhawani Mata Mandir Complex, Punapur. After taking into consideration the suggestion from the Land Owners, as per Section 61(1) of Maharashtra Regional and Town Planning Act, 1966 and Rule 4(2) of Maharashtra Town Planning Rules 1974, Consultation of Director, Town Planning was conducted on the Tentative Proposal on 06-03-2018 and 07-03-2018. As per the instructions given by Director Town Planning, the corrected proposal was submitted along with the Letter No. 494/NSSCDCL/2018, dated 13-03-2018. After scrutiniz- ing the proposal, the Director Town Planning, Pune through letter No. Outward No. DTP-3451-3118-TPV-2/1788, dated 15-03-2018 stated to go ahead with the publication of Draft Town Planning Scheme as per section 61 (1) of Maharashtra Regional and Town Planning Act, 1966. The copy of Draft Town Planning Scheme-Pardi, Bharatwada, Punapur and Bhandewadi alongwith Draft Special Development Regulations and required documents as per Reference No. 1 had been submitted to the Planning Authority Nagpur Improvement Trust, Nagpur ;

And whereas, the Planning Authority Nagpur Improvement Trust has granted approval to the Draft Town Planning Scheme- Pardi, Bharatwada, Punapur and Bhandewadi TPS-1, Nagpur alongwith Draft Special Develop- ment Regulations of the area as per Maharashtra Regional and Town Planning Act, 1966 and Maharashtra Town Planning Scheme Rules, 1974 from NITs Board of Trustees Meeting held on 23-03-2018, Resolution No. 13/1178/ S.E./Planning ;

Now, therefore, the Draft Town Planning Scheme- Pardi, Bharatwada, Punapur and Bhandewadi TPS-1, Nagpur alongwith Draft Special Development Regulations of the area is being published and kept open at the office of Dy. Director (Addl. Charge), Town Planning Deptt. of Nagpur Improvement Trust, Station Road, Sadar, Nagpur- 4400 01 during office hours on all working days and on the Nagpur Improvement Trust's website www.nitnagpur.org. Similarly the aforesaid documents are kept open during office hours on all working days at the following offices ._ (1) Chief Executive Officer, Nagpur Smart and Sustainable City Development Corporation Limited, Nagpur Municipal Corporation, Civil Lines, Nagpur.

The Draft Town Planning Scheme- Pardi, Bharatwada, Punapur and Bhandewadi TPS-1, Nagpur alongwith Draft Special Development Regulations shall be kept open for inspection/sale for suggestions and objections for 30 days from the date of aforesaid publication. Any suggestions and objections received during this period to Nagpur Improvement Trust shall be heard by the NIT before submitting the same to State Government for sanction.

Whereas, the Resolution No. 1/1169/20.05-2017 has been passed by Nagpur Improvement Trust to declare the intention for preparation of Town Planning Scheme Pardi, Bharatwada, Punapur and Bhandewadi (TPS-1) as per provisions in Maharashtra Regional and Town Planning Act, 1966 and Maharashtra Town Planning Scheme Rules, 1974;

And whereas, Declaration of Intention in Official Gazette for an area of 501.81 Ha. of area of Town Planning Scheme Pardi, Bharatwada, Punapur and Bhandewadi (TPS-1) has been published on 7th June, 2017.

And whereas, to include an additional 203.67 Ha. area into the aforesaid Town Planning Scheme with area of 501.81 Ha. Nagpur Improvement Trust has approved to increase the total area from 501.81. Ha. to 705.48 Ha. and accordingly the declaration of intention for 705.48 Ha. area of Town Planning Scheme Pardi, Bharatwada, Punapur and Bhandewadi (TPS-1) was published in the Official Gazette on 1st September 2017.

And whereas, the application from the Planning Authority Letter No. DDTP/RACHANA/2982, Dated 02-04- 2018 as per the provisions in Section 61(3) of Maharashtra Regional and Town Planning Act, 1966 proposal for getting extension for Pardi, Bharatwada, Punapur and Bhandewadi (TPS-1) has been submitted;

And whereas, as per Section 61(3) of Maharashtra Regional and Town Planning Act, 1966, the Draft Town Planning Scheme is to be prepared and published within 9 months from the date of declaration of intention in Official Gazette i.e. 6th March 2018;

And whereas, as per Government Notification No. TPS-1813/3211/Letter No. 508/ UD-13, Date 01-12-2016 the powers under Section of 61 (3) has been delegated to the Joint Director, Town Planning;

Now, therefore, taking into consideration the reasons stated by Planning Authority for extension and using the power delegated vide Government Notification No. TPS-1813-3211-Letter No. 508/UD-13, Date 01-12-2016, the Joint Director, Nagpur Division, Nagpur is pleased to extend under subsection (3) of Section 61 of said Act, the period of making and publishing a notice in the Official Gazette and in such other manner regarding its making the said Draft Scheme by three months from 6th March 2018 up to and inclusive of 6th June, 2018;
