क्रमांक एमपीआय.-१११८/प्र.क्र. ३२९/पोल-११.----ज्याअर्थी, नॅशनल स्पॉट एक्सचेंज लि., एफटी टॉवर, सिटीएस नं. २५६ व २५७, सुरेन रोड, चकाला, अंधेरी (पूर्व), मुंबई (यात यापुढे उक्त वित्तीय संस्था असा निर्देश करण्यात आला आहे) या वित्तीय संस्थेचे अध्यक्ष/ संचालक यांनी ठेवीदारांकडून स्वीकारलेल्या ठेवी मुदतपूर्तीनंतर परत करण्यास कसूर केली आहे, अशा तक्रारी त्यांच्याविरुद्ध बहुतांश ठेवीदारांकडून प्राप्त झालेल्या आहेत ;
आणि ज्याअर्थी, आरोपींविरुद्ध आ.गु.शा. मुंबई गु.र.क्र. ८९/१३ भा.दं.वि. कलमे ४०९, ४६५, ४६७, ४७१, ४७४, ४७७(अ), १२०(ब) सह महाराष्ट्र ठेवीदारांच्या (वित्तीय संस्थांमधील) हितसंबंधाचे संरक्षण अधिनियम, १९९९ च्या कलम ३ व ४ अन्वये गुन्हा नोंदविण्यात आला आहे ;
आणि ज्याअर्थी, राज्य शासनाची अशी खात्री झाली आहे की, उक्त वित्तीय संस्था आणि त्यांचे अध्यक्ष/संचालक ठेवीदारांना त्यांच्या ठेवी परत करण्याची शक्यता नाही आणि म्हणून, राज्य शासनाला अशा ठेवीदारांच्या हितसंबंधाचे रक्षण करावे लागेल.
गुंतवणूकदारांच्या ठेवी परत करण्याच्या प्रयोजनार्थ उक्त वित्तीय संस्था एन.एस.ई.एल.कडे कोणतीही मालमत्ता नसल्याने महाराष्ट्र ठेवीदारांच्या (वित्तीय संस्थांमधील) हितसंबंधाचे संरक्षण अधिनियम, १९९९ च्या कलम ४(१)(२) मधील तरतूद, ""अशा वित्तीय संस्थेने गोळा केलेल्या ठेवींमधून स्वत:च्या नावाने किंवा कोणत्याही अन्य व्यक्तीच्या नावाने संपादन केला असल्याचा मानण्यात येणारा पैसा किंवा अन्य मालमत्ता किंवा असा पैसा किंवा अन्य मालमत्ता जप्तीसाठी उपलब्ध नाही किंवा ठेवीची परतफेड करण्यासाठी पुरेशी नाही असे त्यास दिसून आले तर, उक्त वित्तीय संस्थेची किंवा तिचा प्रवर्तक, संचालक, भागीदार किंवा व्यवस्थापक किंवा सदस्य यांची शासनाला योग्य वाटेल अशी अन्य मालमत्ता जप्त करण्याचा आदेश देता येईल"" ही तरतूद लागू करून उक्त वित्तीय संस्था एन.एस.ई.एल.चे प्रवर्तक, संचालक, भागीदार व सदस्य यांची मालमत्ता महाराष्ट्र ठेवीदारांच्या (वित्तीय संस्थांमधील) हितसंबंधाचे संरक्षण अधिनियम, १९९९ च्या कलम ४(१)(२) मधील तरतूद अन्वये शासन अधिसूचना दिनांक २८ ऑगस्ट २०१४, दिनांक १२ मार्च २०१५, दिनांक २२ जून २०१५, दिनांक १३ जानेवारी २०१६, दिनांक १७ मार्च २०१६, दिनांक ३१ मार्च २०१७ व दिनांक ४ एप्रिल २०१८ च्या अधिसूचनेअन्वये जप्त करण्यात आली आहे. तथापि, सदर मालमत्ता ही ठेवीदारांच्या ठेवी परत करण्यास पुरेशी नाही.

भाग चार--ब--१०२---१महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, एप्रिल ९, २०१८/चैत्र १९, शके १९४० २ उक्त वित्तीय संस्था एन.एस.ई.एल. ही फायनान्सीयल टेक्नोलॉजी (इंडिया) लि. या संस्थेच्या संपूर्ण मालकीची आहे. एन.एस.ई.एल. या वित्तीय संस्थेमध्ये फायनान्सील टेक्नोलॉजी (इंडिया) लि. संस्थेमध्ये ९९.९९ टक्के शेअर्स आहेत. तसेच, एन.एस.ई.एल.ची प्रवर्तक कंपनी ही फायनान्सीयल टेक्नोलॉजी (इंडिया) लि. आहे. फायनान्सीयल टेक्नोलॉजी (इंडिया) लि. या संस्थेच्या काही मालमत्ता दिनांक २१ सप्टेंबर २०१६ च्या अधिसूचनेअन्वये जप्त करण्यात आली आहे. तथापि, यापैकी काही मालमत्ता ही त्या संस्थेची नसल्याचे अथवा नवीन मालमत्ता खरेदी करण्याकरिता विक्री केली असल्याचे असे उघडकीस आले आहे.
त्याअर्थी आता, महाराष्ट्र ठेवीदारांच्या (वित्तीय संस्थांमधील) हितसंबंधाचे संरक्षण अधिनियम, १९९९ (२००० चा महा. १६) (यात यापुढे ज्याचा उक्त अधिनियम असा निर्देश करण्यात आला आहे.) याच्या कलम ४ चे पोट-कलम (१) याद्वारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून महाराष्ट्र शासन याद्वारे अनुसूचीत विर्िनदिष्ट केल्याप्रमाणे, मे. ६३ मून्स टेक्नोलॉजी लि. [ पूर्वीचे नाव फायनान्सीयल टेक्नोलॉजी (इंडिया) लि.] एन.एस.ई.एल. ची प्रवर्तक कंपनी, या वित्तीय संस्थेच्या नावे असलेली मालमत्ता जप्त करीत आहे.
उक्त अधिनियमान्वये नियुक्त करण्यात आलेल्या पदनिर्देशित न्यायालयातील विशेष सरकारी अभियोक्ता, विशेष न्यायालयात अर्ज दाखल करताना सक्षम प्राधिकायास आवश्यक ते सहाय्य करतील.

आरोपी यांच्या जप्त करावयाच्या मालमत्तेची सूची खालीलप्रमाणे आहे :----
(अ) जंगम मालमत्ता--(सॉफ्टवेअर)
(१) ओडीइन सॉफ्टवेअर
(२) ओडीइन सॉफ्टवेअरमधून आयपीआर लाइसेंसप्रमाणे प्राप्त होणारी फी (रक्कम).

NOTIFICATION
No. MPI. 1118/C.R. 329/Pol. 11.—Whereas complaints were received from a number of depositors against National Spot Exchange Limited, FT Tower, CTS No. 256 and 257, Suren Road, Chakala, Andheri (East), Mumbai 400 093 (hereinafter referred to as "the said Financial Establishment") that it had collected money by promising attractive returns to depositors but failed to return the deposits when the time for repayment came ;
And whereas, an offence has been registered against the accused at E.O.W. Mumbai vide C.R. No. 89/13, u/s. 409, 465, 467, 471, 474, 477(A), 120(B) IPC r/w sections 3 and 4 of Maharashtra Protection of Interest of Depositors (In Financial Establishment) Act, 1999 ;
And whereas, the State Government in satisfied that the said Financial Establishment is not likely to return the deposits to the depositers and the Government has to protect the interests of the depositers.
The said Financial Establishment NSEL does not have properties which can be attached for the purpose of repayment of the deposits, the following provision of section 4(1)(ii) of MPID Act " if it transpires that such money or other property is not available for attachment or not sufficient for repayment of the deposits, such other property of the said financial establishment, or promoter, director or partner or manager or member of the said Financial Establishment as the Government may think fit " was invoked and the properties and monies of the promoters, directors and members of NSEL have already been attached under section 4(1) (ii) of the MPID Act by the Government of Maharashtra vide notification dated 28th August 2014, 12th March 2015, 22nd June 2015, 13th January 2016, 17th March 2016, 31st March 2017 and 4th April 2018 but since the total value of the attached properties and monies is not sufficient for the repayment of the deposits to the depositors.
The said Financial Establishment NSEL is a wholly-owned subsidiary of Financial Technologies (India) Limited (FTIL), FTIL's shareholding in NSEL was at 99.99% FTIL was also the promoter of NSEL. Some properties of FTIL were attached vide notification dated 21st September 2016, but it has subsequently transpired that out of those properties, some properties are either not owned by FTIL or have been sold by FTIL for purchasing new properties.
Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 4 of the MPID Act, the Government of Maharashtra hereby attached the properties of M/s. 63 Moons Technologies Ltd., [ Previously known as Financial Technologies (India) Limited - FTIL ] the promoter of the Financial Establishment NSEL as specified in the Schedule.
The Special Public Prosecutor in designated Court appointed under the said act shall render necessary assistance to the Competent Authority in filing the application before the Special Court.

(A) Movable Property-(Software)
(1) ODINTM software
(2) Receivables from IPR license of ODINTM software.
