महाराष्ट्र झोपडपट्टी (सुधारणा, निमर्ुलन व पुर्नविकास) अधिनियम, १९७१.

क्रमांक भूसंपा.२०१२/प्र.क्र.८९/झोपनि-२.---ज्याअर्थी, अप्पर जिल्हाधिकारी (अति./निष्का.) आणि सक्षम प्राधिकारी, पश्चिम उपनगरे, मुंबई उपनगर जिल्हा, यांच्या अभिवेदनावरून महाराष्ट्र शासनास असे दिसून आले आहे की, उक्त प्राधिकायास यासोबत जोडलेल्या अनुसूचीच्या (यात यापुढे ज्याचा निर्देश उक्त अनुसूची असा करण्यात आला आहे.) स्तंभ -४ मध्ये नमूद केलेल्या झोपडपट्टी क्षेत्राच्या संबंधातील सुधार कामे पार पाडणे शक्य व्हावे म्हणून उक्त अनुसूचीच्या स्तंभ ५ मध्ये विर्िनदिष्ट केलेली जमीन (यात यापुढे जिचा निर्देश उक्त जमीन असा करण्यात आला आहे.) संपादीत करणे आवश्यक आहे ;

आणि ज्याअर्थी, महाराष्ट्र झोपडपट्टी (सु.नि.व पु.) अधिनियम, १९७१ (यात यापुढे ज्याचा निर्देश उक्त अधिनियम असा करण्यात आला आहे.) च्या कलम १४ च्या पोट-कलम (१) नुसार अप्पर जिल्हाधिकारी (अति./निष्का.) आणि सक्षम प्राधिकारी, पूर्व उपनगरे, मुंबई उपनगर जिल्हा यांनी बजावलेल्या त्यांच्या क्र.अजि /अति /निष्का /मुंपुउ/युनिट-३/डेस्क-८/१४(१)/एसआर-६/०६, दि.१३ डिसेंबर २०११ नोटीशीद्वारे तसेच दैनिक ""सकाळ"" आणि ""दि फ्री प्रेस जर्नल"" या वृत्तपत्रात दि.२० जानेवारी २०१२ रोजी प्रसिद्ध करण्यात आली आहे आणि उक्त अनुसूचीच्या स्तंभ ६ मध्ये नमूद केलेल्या ज्या व्यक्ती, उक्त जमिनीचे मालक आहेत, अशा व्यक्तींना उपरोक्त नोटीस मिळाल्यापासून १५ दिवसांच्या कालावधीच्या आत उक्त जमीन का संपादित करण्यात येऊ नये, याबाबतची कारणे दाखविण्यास फर्माविले होते ;

आणि ज्याअर्थी, मुख्य कार्यकारी अधिकारी, झोपडपट्टी पुनर्वसन प्राधिकरण, बांद्रा, मुंबई यांचेकडून, उक्त अधिनियमाच्या प्रकरण I-A च्या कलम ३(D)(c)(i) च्या परिच्छेद (A) अन्वये सुधारणा करण्यात आलेल्या प्रकरण पाच मधील कलम १४ च्या पोट-कलम (१) नुसार उक्त अनुसूचीच्या स्तंभ (६) मध्ये नमूद केलेल्या व्यक्तींना, क्र.झोपुप्रा/उजि/टे/डी-६/साई गणेश/सुनावणी/२०१३/४०७, दि. १५ मार्च २०१३ अन्वये, उक्त अनुसूचीच्या स्तंभ (५) मध्ये नमूद जमीन ही संरक्षणप्राप्त झोपडपट्टीवासियांकरिता झोपडपट्टी पुनर्वसन योजना राबविण्यासाठी संपादन करण्याचा प्रस्ताव शासन मान्यतेसाठी का पाठविण्यात येवू नये, याकरिता दि. २५ मार्च २०१३, ०६ एप्रिल २०१२, १० एप्रिल २०१३ आणि दि. १६ एप्रिल २०१३ रोजी सुनावणी ठेवल्याची नोटीस बजावण्यात आली ;

आणि ज्याअर्थी, जमीन मालकांकडून आलेले आक्षेप व संबंधित झोपडीधारकांच्या सहकारी गृहनिर्माण संस्थेच्या वतीने करण्यात आलेला युक्तीवाद, अधिकार अभिलेखांतील नोंदी, उक्त जमिनीवर विकास आराखडयानुसार असलेले आरक्षण यांचा विचार करून झोपडीधारकांनी सादर केलेली मागणी न्याय्य असल्याबाबत उक्त जमीन संपादनाबाबतचे अभिवेदन मुख्य कार्यकारी अधिकारी, झोपडपट्टी पुनर्वसन प्राधिकरण यांनी राज्य शासनास दि. २४ सप्टेंबर २०१३ रोजी सादर केले आहे ; भाग चार ब---१०७----१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, एप्रिल ११, २०१८/चैत्र २१, शके १९४० आणि ज्याअर्थी, उक्त अधिनियमाच्या प्रकरण I-A च्या कलम ३ (D)(c)(i)च्या परिच्छेद (A)अन्वये सुधारणा करण्यात आलेल्या प्रकरण पाच मधील कलम १४ च्या पोट-कलम (१) नुसार मुख्य कार्यकारी अधिकारी, झोपडपट्टी पुनर्वसन प्राधिकरण, वांद्रे (पू.), मुंबई यांनी सादर केलेल्या दि. २४ सप्टेंबर २०१३ रोजीच्या अभिवेदनानुसार राज्य शासनास उक्त अनुसूचीत नमूद केलेली उक्त जमीन झोपडपट्टी क्षेत्राच्या विकासासाठी झोपडपट्टी पुनर्वसन योजनेखाली विकास करणे शक्य व्हावे म्हणून संपादित करणे आवश्यक असल्याचे दिसून आले आहे ;

त्याअर्थी आता, उक्त अधिनियमाच्या प्रकरण I-A च्या कलम ३ (D)(c)(i)च्या परिच्छेद (A)अन्वये सुधारणा करण्यात आलेल्या प्रकरण पाच मधील कलम १४ च्या पोट-कलम (१) द्वारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून महाराष्ट्र शासन या नोटिशीद्वारे असे घोषित करीत आहे की त्याने उक्त जमीन संपादित करण्याचे ठरविले आहे.

NOTIFICATION

MAHARASHTRA SLUM AREAS (IMPROVEMENT, CLEARANCE AND REDEVELOPMENT) ACT, 1971.

No.Bhusampa.2012/C.R.89/Zopni-2.—Whereas, on a representation from the Additional Collector (Encroachment/Removal) and Competent Authority, Western Suburbs, Mumbai Suburbs District, Mumbai, it appears to the Government of Maharashtra that in order to enable the said Authority to execute the works of improvement in relation to the slum areas mentioned in Schedule appended hereto (hereinafter referred to as "the said Schedule") it is necessary that the land specified in column (5) of the said Schedule (hereinafter referred to as "the said land") should be acquired ;

And whereas, as required by the proviso to sub-section (1) of section 14 of Chapter V of the Maharashtra Slum Areas (Improvement, Clearance and Redevelopment) Act, 1971(hereinafter referred to as "the said Act") Additional Collector (Encroachment/Removal) and Competent Authority, Western Suburbs, Mumbai Suburbs District, Mumbai has by his Notice No.Addl.Coll./ENC/REM/Unit-3/D-8/14 (1)/ SR-6/06, dtd. 13th December 2011 served in the prescribed manner and also notice published in the daily News Papers "Dainik Sakal" and "The Free Press Journal" dated 20th January 2012 called upon the persons mentioned in column (6) of said Schedule, who are the owners of the said land or any other persons interested therein, to show cause, within a period of fifteen days from the receipt of the aforesaid notice, as to why the said land should not be acquired ;

And whereas, as required by the proviso to sub-section (1) of section 14 of Chapter V read with Paragraph (A) of sub-clause (i) of clause (c) of section 3D of Chapter I-A of the said Act, Chief Executive Officer, Slum Rehabilitation Authority, Bandra, Mumbai, as by his notice No.SRA / Dy.Coll./ T/D6 / Sai Ganeshi /Hearing /2013/407, dated the 15th March 2013 served in the prescribed manner, called upon the persons mentioned in column (6) of the Said Schedule who are the owners of the said land to be heard on 25th March 2013, 06th April 2013, 10th April 2013 and 16th April 2013 as to why the proposal to acquire the said land for implementation of the Slum Rehabilitation Scheme for the concerned protected slum dwellers should not be sent to State Government for approval ;

And whereas, Chief Executive Officer, Slum Rehabilitation Authority, Bandra, Mumbai after considering objections received from the owner of said land and after considering the pleading on behalf of the proposed Co-operative Housing Society of the Slum dwellers, entries as to the rights in the land record, reservation in development plan and the legitimate request of the protected slum dwellers, Chief Executive Officer, Slum Rehabilitation Authority, Bandra, Mumbai submitted a proposal of the acquisition of the said land mentioned in the said schedule ; by his representation dated 24th September 2013 ;

And whereas, as required by the proviso to sub-section (1) of Section 14 of Chapter V read with Paragraph (A) of sub-clause(i) of clause (c) of section 3D of Chapter I-A of said Act, on a representation dated 24th September 2013 from the Chief Executive officer, Slum Rehabilitation Authority, Bandra, Mumbai, it appears to the State Government that in order to enable to Slum Rehabilitation Authority to carry out the development under the Slum Rehabilitation Scheme in the slum areas mentioned in column (4) of the said Schedule, should be acquired ;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 14 read with Paragraph (A) of sub-clause(i) of clause (c) of section 3D of the said Act, the Government of Maharashtra hereby declares, by this notice, that it has decided to acquire the said lands.
