महाराष्ट्र शासनाच्या नगरविकास विभागाने अधिसूचना क्रमांक टीपीबी-४३१४/६३० प्र. क्र. १७५/२०१५/नवि-११, ही अधिसूचना दिनांक २४ एप्रिल २०१७ रोजी प्रसिद्ध केलेली असून, सदर अधिसूचनेद्वारे बृहन्मुंबई महानगरपालिकेस महाराष्ट्र राज्य प्रादेशिक व नगररचना अधिनियम, १९६६ च्या कलम ९१(२) अन्वये माहिम नगररचना योजना क्रमांक ३ (प्रथम फेरबदल) (अंतिम) अन्वये अंतिम भूखंड क्रमांक ३०४ या अंतिम भूखंडाच्या ' बी ' फॉर्ममधील "to be kept permanently vacant as on open space" हा अभिप्राय वगळणे, तसेच सदर फेरबदलाचा मसूदा तयार करून महाराष्ट्र राज्य प्रादेशिक व नगररचना अधिनियम, १९६६ च्या कलम ९१(२) मधील तरतुदीप्रमाणे अधिसूचनेच्या दिनांकापासून सहा महिन्यांच्या आत प्रसिद्ध करणे, या करिता फेरबदल करण्यासाठी बृहन्मुंबई महानगरपालिकेस प्राधिकृत केले आहे.

माहिम नगररचना योजना क्रमांक ३ (प्रथम फेबरदल) (अंतिम) ही नगररचना योजना राज्य शासनाने मंजूर केलेली असून ती दिनांक १ मे १९८६ पासून अंमलात आलेली आहे.

अंतिम भूखंड क्रमांक ३०४, माहिम नगररचना योजना क्रमांक ३ (प्रथम फेरबदल) (अंतिम) या भूखंडाच्या 'बी' फॉर्ममध्ये "to be kept permanently vacant as on open space" असा अभिप्राय आलेला आहे.

परंतु, या अंतिम भूखंडाच्या 'बी' फॉर्मवर असलेल्या "to be kept permanently vacant as on open space" अश्या अभिप्रायामुळे सदर जागेचा मोबदला/फायदा जमीनमालकाला मिळू शकत नाही.

सबब, महाराष्ट्र शासनाच्या नगरविकास विभागाने दिनांक २४ एप्रिल २०१७ रोजी प्रसिद्ध केलेल्या अधिसूचनेद्वारे दिलेल्या निर्देशांप्रमाणे महाराष्ट्र राज्य प्रादेशिक व नगररचना अधिनियम, १९६६ च्या कलम ९१(२) नुसार माहिम-III (प्रथम फेरबदल) (अंतिम) या नगररचना योजना खालील फेरबदल करावयाचे आहेत.

(१) अंतिम भूखंड क्र. ३०४ माहिम-III (प्रथम फेरबदल) (अंतिम) च्या 'बी' फॉर्ममधील "to be kept permanently vacant as an open spece" हा अभिप्राय वगळणे.

(२) या उद्देशाकरिता, नगररचना योजना क्र. ३ (प्रथम फेरबदल) (अंतिम) मध्ये फेरबदल करण्यासाठी, फेरबदलाचा मसूदा तयार करून अधिसूचनेच्या दिनांकापासून सहा महिन्यांच्या मुदतीत प्रसिद्ध करणे.

सुधार समितीने ठराव क्र. ७२, दिनांक २३ ऑगस्ट २०१७ व महानगरपालिका ठराव क्र. १११८, दिनांक २१ डिसेंबर २०१७ अन्वये, महाराष्ट्र प्रादेशिक व नगररचना अधिनियम, १९६६ च्या कलम ९१(३) ते ९१(५) अन्वये उपरोक्त फेरबदलासंदर्भात पुढील कार्यवाही करण्यासाठी मा. महापालिका आयुक्त/प्रमुख अभियंता (विकास नियोजन) यांना प्राधिकृत केलेले आहे.

त्यानंतर राज्य शासनाच्या नगरविकास विभागाने पत्र क्र. टीपीबी-४३१४/६३०/प्र.क्र. १७५/२०१५/नवि-११, दिनांक १६ जानेवारी २०१८ अन्वये असे कळविले आहे की, शासन अधिसूचना दिनांक २४ एप्रिल २०१७ नुसार फेरबदलास महापालिकेची मंजुरी घेऊन फेरबदल प्रस्तावाचा मसूदा प्रसिद्ध करावा. प्रस्तावाचा मसूदा प्रसिद्ध करण्याच्या कालावधीमध्ये कार्योत्तर मंजुरी देण्यात येईल.

वरील बाबी लक्षात घेता, सदर अधिनियमाच्या कलम ९१ अन्वये आवश्यक असल्यानुसार उपरोक्त प्रस्तावित फेरबदलाकरिता जनतेक़डून सूचना/हरकती मागविण्यात येत आहेत. सदर सूचना/हरकती महाराष्ट्र शासन, नगरविकास विभाग, ४था मजला, मंत्रालय, मुंबई ४०० ०३२ यांजकडे लेखी स्वरूपात कळवाव्यात व त्याची प्रत प्रमुख अभियंता (विकास नियोजन), बृहन्मुंबई महानगरपालिका, ५वा मजला, विस्तारित इमारत, महापालिका मार्ग, मुंबई ४०० ००१ यांजकडे सदर सूचना प्रकाशित झाल्याच्या तारखेपासून एक महिन्याच्या कालावधीत पाठवावी.

उपरोक्त कालावधीनंतर प्राप्त झालेल्या सूचना/हरकतींचा विचार केला जाणार नाही.

NOTIFICATION

No. EE/TP/Variation/Mahim-III/02/TPS

Subject.—Draft variation of T.P.S.III Mahim (1st Variation) (Final) under section 91 of M.R.& T.P. Act, 1966, to delete remarks "to be kept permanently vacant as open space" in 'B' Form of F.P. No.304, T.P.S.III Mahim.

The State Government, in Urban Development Department, has published Notification u/no. TPB-4314/630/CR- 175/2015/UD-11, dated the 24th April 2017, and as per the said Notification, the State Government has authorised the Corporation under Sub-section (2) of section (91) of the M.R.& T.P. Act, 1996, to undertake variation to T.P. Scheme No. Ill Mahim (1st Variation) (Final) to delete the remarks in 'B' Form of F.P. No. 304 [i.e. to delete the remarks "to be kept permanently vacant as an open space] and to prepare & publish draft variation within a period of six months from the date of issue of the Notification.

T.P.Scheme III, Mahim (1st Variation) (Final) is sanctioned by the State Government and it has come into effect from 1st May 1986.

In the remarks Column of Form 'B' of F.P.No.304, T.P.Scheme III, Mahim (1st Variation) (Final) there is a remark "to be kept permanently vacant as an open space".

However, owner of Final Plot No.304 deprived of the benefits/compensation towards the said plot due to remarks in 'B' Form that "the Plot to be kept permanently vacant as an open space".

As such, the State Government has authorised the Municipal Corporation, vide Notification published under No.TPB-4314/630/CR-175/2015/UD-11, dated the 24th April 2017, under sub-section (2) of section 91 of the said Act to undertake variation in the Town Planning Scheme - Mahim No.III (1st Variation) (Final) in respect of following item to—

(a) delete remarks in 'B' Form of F.P. No. 304 i.e. to delete remark of "to be kept permanently vacant as an open space", in 'B' Form of F.P. No. 304, T.P. Scheme Mahim III (1st Variation) (Final).

(b) Accordingly prepare and publish the draft variation as per provision laid down under section 91(2) of the said Act, within a period of six months from the date of issue of this Notification.

The Improvements Committee vide its Resolution No.72, dated the 23rd August 2017 and Corporation vide its Resolution No. 11, 18, dated the 21st December 2017 has authorised Municipal Commissioner / Chief Engineer (Development Plan) for further action in respect of above variation as per Provisions laid down under section 91(3) to 91(5) of the M.R.& T.P. Act, 1966.

Thereafter, the Urban Development Department of the Government of Maharashtra has directed the Municipal Commissioner, vide letter under No.TPB-4314/630/C.No. 175/2015/UD-11, dated the 16th January 2018 that, the Draft Variation shall be published as per the Notification dated the 24th April 2017 of the Government and Post facto approval will be granted for extension of time period for publishing the Draft Variation proposal.

In view of above, suggestions/objections to above variation are now invited in writing from the public, to abovementioned proposed variation as required under section 91 of the said Act and the same may please be communicated in writing to the Government of Maharashtra, Urban Development Department, 4th Floor, Mantralaya, Mumbai 400 032, with a copy there of to Chief Engineer (Development Plan) Municipal Corporation of Greater Mumbai, 5th Floor, Annex Building, Mahapalika Marg, Mumbai 400 001, not later than a period of One Month from the date of publication of this Notice.

The suggestions /objections received after the aforesaid period will not be considered.

Whereas, it has been reported by M/s. Tile Studio, Add. Sr. No. 42, Shankar Parvati Apartments, BVP. Dattanagar Road, Dattanagar, Ambegaon, Pune Pin code 411 046, holder of TIN No. 27730881325V under MVAT Act, 2002 and R. C. No. 27730881325 under the Central Sales Tax Act, 1956, that the declarations referred in sub-section (4) of section 8 of the Central Sale Tax Act, 1956 (LXXIV) of 1956 in form ' C ' issued to them bearing No. MH-13/A 252998 (Total 1 ' C ' Form) has been lost and to that effect the dealer has given the advertisement in Marathi Language Newspaper 'Prabhat', Pune, dated the 9th October 2015 and English Language, The Times of India, Pune, dated the 6th November 2015 forwarded the newspaper cutting to this office, also submitted indemnity bond of Rs. 420228 respectively.

Therefore, in view of the above I, Ananta Rakh, Joint Commissioner of State Tax-Pune-3 in exercise of the powers vested in me under sub-rule (7) of rule 4(A) of the Central Sales Tax (Bombay) Rules, 1957 hereby declare that the said ' C ' form declaration bearing No. MH-13/A 252998 (Total 1 ' C ' Form) are treated as invalid.

विद्युत कायदा, २००३ च्या कलम १६४ प्रमाणे व महाराष्ट्र शासनाच्या आदेश क्रमांक ०६/प्र. क्र. ३१२/ऊर्जा/४, दिनांक २४ ऑगस्ट २००६ (शासकीय राजपत्र, पान क्रमांक २८०) नुसार, महाराष्ट्र राज्य विद्युत पारेषण कंपनीस प्रदान केलेल्या अधिकारानुसार, खाली नमूद केल्याप्रमाणे अति उच्च दाब पारेषण योजनेचे डी.डी.एफ. अंतर्गत काम हाती घेण्याचे प्रस्तावित करीत आहे. या सर्व अधिकारांचा वापर प्रस्तावित योजनेतील विजेचे पारेषण, वितरण अगर म.रा.वि. पारेषण कंपनी मर्यादितच्या समन्वय, संचलन व सुव्यवस्था या कामाकरिता पारेषण कंपनीद्वारे करण्यात येईल. जनतेच्या माहितीकरिता ही अधिसूचना देण्यात येत आहे.

२. खालील योजना त्या भागातील अति उच्च दाब ग्राहकांच्या वाढत्या विजेची गरज पुरविण्यासाठी व नवीन ग्राहकांना वीज पुरवठा करण्यासाठी, तसेच विद्युत पुरवठा तसेच विद्युत प्रणाली सक्षम करण्यासाठी आहे :----

XXXVII of 1966) (hereinafter referred to as "the said Act") vide Notification by Urban Development, Public Health and Housing Department, No. RPB 1171/18124/113/ll-W, dated the 20th March 1971, and No. RPB / 1173-ll- RPC, dated the 16th August 1973, declared City and Industrial Development Corporation of Maharashtra Limited (company owned and controlled by the Government of Maharashtra and herein after referred to as "The Corporation") as the New Town Development Authority for the area comprised in the site of Navi Mumbai as specified therein ;

And whereas, the Government of Maharashtra in the Urban Development and Public Health Department approved the Development Plan for Navi Mumbai in exercise of the powers conferred under Section 31 of the said Act vide Notification No. RPB 1175/635/B-UD-5, dated 18th August 1979, published in the Maharashtra Government Gazette, dated 27th September 1979 ;

And whereas, in exercise of the powers conferred by sub-section (2) of the Section 37 of the said Act, the Government of Maharashtra has sanctioned modifications to the said approved development plan from time to time. The last modification sanctioned by the State Govt, in respect of the said approved development plan is vide Notification No. TPS-1214/1938/CR- 72/15/UD-12, dated 20th December 2017 ;

And whereas, the Corporation considers it necessary to make further modifications to the approved development plan to cater demand for land in Residential Land-use Zone and has approved the proposal vide Board Resolution No. 11984, dated 29th December 2017 ;

Now, therefore, under sub-section (1) of the Section 37 of the said Act, the Corporation hereby issues and publishes notice declaring its intention to carryout the modifications to the said development plan as specified in the Schedule below :—
