भारताचे संविधान.
क्रमांक टिआरएन-०५१७/प्र.क्र. ३५/सीपीटीपी.--भारताचे संविधानयाच्या अनुच्छेद ३०९ च्या परंतुकाद्वारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून, आणि याबाबतीत केलेले सर्व विद्यमान नियम, आदेश व संलेख यांमध्ये अंशतः फेरबदल करून, महाराष्ट्राचे राज्यपाल, याद्वारे एकत्रित परिवीक्षाधीन प्रशिक्षण कार्यक्रमांतर्गत समाविष्ट केलेल्या गट " अ " आणि गट " ब " (राजपत्रित) पदांकरीता विभागीय परीक्षांचे विनियमन करणारे पुढील नियम करीत आहेत ः-----
१. (१) या नियमांना एकत्रित परिवीक्षाधीन प्रशिक्षण कार्यक्रम (सीपीटीपी) अंतर्गत समाविष्ट केलेल्या गट " अ " आणि गट " ब " (राजपत्रित) पदांसाठीच्या पदव्युत्तर पदवी अभ्यासक्रमांतर्गत घेण्यात येणाया विभागीय परीक्षांबाबतचे नियम, २०१८ असे म्हणावे.
(२) ते दिनांक १ ऑगस्ट २०१७ पासून अमलात येतील.
(३) या नियमांच्या नियम २ च्या खंड (ज) अन्वये ज्या अधिकायांना परिवीक्षाधीन अधिकारी म्हणून पदनियुक्त केले आहे अशा अधिकायांना हे नियम लागू असतील.
२. या नियमांमध्ये संदर्भानुसार दुसरा अर्थ अपेक्षित नसेल तर,-------
(क) " जोडपत्र " याचा अर्थ या नियमांना जोडलेले जोडपत्र, असा आहे ;
(ख) एकत्रित परिवीक्षाधीन प्रशिक्षण कार्यक्रम (सीपीटीपी) याचा अर्थ, शासन निर्णय, सामान्य प्रशासन विभाग, क्रमांक टिआरएन- २०१३/सीआर८४/१३/१२-अ, दिनांक २० जानेवारी २०१४ अनुसार आयोजित करण्यात येणारा दोन वषार्ंचा प्रशिक्षण कार्यक्रम, असा आहे;
(ग) " आयोग " याचा अर्थ महाराष्ट्र लोकसेवा आयोग, असा आहे ;
(घ) " विभागीय परीक्षा " याचा अर्थ या नियमान्वये पदव्युत्तर पदवी अभ्यासक्रमाच्या तिसया सत्रामध्ये आयोजित करण्यात येणारी परीक्षा, असा आहे ;
(ड़) " शासन " याचा अर्थ महाराष्ट्र शासन, असा आहे ;
भाग चार-अ-----१
(१)२ महाराष्ट्र शासन राजपत्र भाग चार-अ, गुरुवार ते बुधवार, एप्रिल २६-मे २, २०१८/वैशाख ६-१२, शके १९४० (च) ' गट " अ " आणि गट " ब " (राजपत्रित) पदे ' याचा अर्थ जोडपत्रामध्ये नमूद केलेली " गट " अ " आणि गट " ब " (राजपत्रित) पदे आणि राज्य शासनाकडून आदेशाद्वारे, जोडपत्रात वेळोवेळी समाविष्ट करण्यात येतील अशी पदे, असा आहे ;
(छ) " पदच्युत्तर पदवी " याचा अर्थ, पदव्युत्तर पदवी अभ्यासक्रम यशस्वीरीत्या पूर्ण केल्यानंतर, परिवीक्षाधीन अधिकायांना, मुंबई विद्यापीठाकडून प्रदान करण्यात येणारी पदव्युत्तर पदवी, असा आहे ;
(ज) " पदच्युत्तर पदवी कार्यक्रम " याचा अर्थ, शासन निर्णय, सामान्य प्रशासन विभाग, क्रमांक टिआरएन-०५१७/प्र. क्र. ३६/सीपीटीपी, दिनांक २१ जुलै २०१७ अनुसार परिवीक्षाधीन अधिकायांसाठी आयोजित केला जाणारा पदव्युत्तर पदवी कार्यक्रम असा आहे ;
(झ) " अभ्यासक्रम " याचा अर्थ, विभागीय परीक्षेचा अभ्यासक्रम, असा आहे ;
(त्र) " परिवीक्षाधीन अधिकारी " याचा अर्थ एकत्रित परिवीक्षाधीन प्रशिक्षण कार्यक्रमात समाविष्ट केलेल्या पदांसाठी आयोगाकडून घेण्यात येणाया राज्यसेवा परीक्षेच्या निकालाद्वारे प्राप्त झालेल्या शिफारशींच्या आधारेनियुक्ती करण्यात आली आहे अशी व्यक्ती आणि एकत्रित परिवीक्षाधीन प्रशिक्षण कार्यक्रमात समाविष्ट असलेल्या पदांपैकी कोणत्याही पदावर, शासनाने विशेष बाब म्हणून जिची परिवीक्षाधीन अधिकारी म्हणून नियुक्ती केली आहे अशी व्यक्ती, असा आहे ;
(ट) " यशदा " याचा अर्थ, यशवंतराव चव्हाण विकास प्रशासन अकादमी (यशदा) पुणे, असा आहे ;
३. नामनिर्देशनाने नियुक्त केलेल्या व्यक्तींसाठीच्या विद्यमान सेवाप्रवेश नियमांत किंवा विभागीय परीक्षा नियमांत अंतभर्ूत असलेल्या स्थायी करणासाठीच्या विभागीय परीक्षा उत्तीर्ण होण्याच्या आवश्यकते संबंधीच्या तरतुदी, या नियमांच्या प्रारंभीच्या दिनांकापासून परिवीक्षाधीन अधिकायांना लागू असणार नाहीत.
४. प्रत्येक परिवीक्षाधीन अधिकायाने विभागीय परीक्षा उत्तीर्ण होणे आणि परिवीक्षा कालावधीच्या दोन वषार्ंमधील पदव्युत्तर पदवी कार्यक्रम पूर्ण करणे आवश्यक असेल :
परंतु अपवादात्मक परिस्थितीत, शासनास आपल्या स्वेच्छाधिकारानुसार, परीक्षा देण्यासाठी दोन पेक्षा अधिक नसतील इतक्या अतिरिक्त संधी देता येतील तसेच परिवीक्षा कालावधी वाढविता येईल आणि कोणत्याही परिस्थितीत असा कालावधी हा, एक वर्षापेक्षा अधिक कालावधी पयर्ंत वाढविता येणार नाही :
परंतु आणखी असेकी, अशा पुनर्परीक्षेत देण्यात आलेले गुण सेवाज्येष्ठता निश्चित करण्यासाठी विचारात घेण्यात येणार नाहीत.
५. विभागीय परीक्षेचा अभ्यासक्रम, मुंबई विद्यापीठाशी आणि शासनाच्या संबंधित प्रशासकीय विभागांशी विचारविनिमय केल्यानंतर आणि शासनाकडून निदेश देण्यात येतील त्याप्रमाणे अन्य विषय विचारात घेऊन यशदाकडून विहीत करण्यात येईल. सदर अभ्यासक्रम शासनाकडून वेळोवेळी आदेशाद्वारे प्रसिद्ध करण्यात येईल.
६. परिवीक्षाधीन अधिकायास एकतर मराठीत किंवा इंग्रजीत उत्तरे लिहण्याची मुभा असेल.
७. परिवीक्षाधीन अधिकायाने, मुंबई विद्यापीठाकडून निर्धारीत करण्यात आलेल्या निकषानुसार पदव्युत्तर पदवी कार्यक्रमांतर्गत घेतल्या जाणाया सर्व परीक्षा उत्तीर्ण होणे आवश्यक असेल.
८. ज्याने विभागीय परीक्षा उत्तीर्ण केली नसेल आणि वरील नियम ४ मध्ये नमूद केलेल्या कालावधीमध्ये पदव्युत्तर पदवी कार्यक्रम यशस्वी रित्या पूर्ण केला नसेल असा प्रत्येक परिवीक्षाधीन अधिकारी सेवेतून पदमुक्त केला जाण्यास पात्र असेल.

NOTIFICATION
CONSTITUTION OF INDIA.
No. TRN. 0517/C.R.35/CPTP.—In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India and in partial modification of all existing rules, orders and instruments made in this behalf, the Governor of Maharashtra is hereby pleased to make the following rules regulating the Departmental Examinations for Group "A" and Group "B" (Gazetted) posts included in the Combined Probationary Training Programme, namely :—
1. (1) These rules may be called the Departmental Examinations held within the Course of Post Graduate Degree Programme for Group "A" and Group "B"( Gazetted) posts included in the Combined Probationary Training Programme (CPTP) Rules, 2018.
(2) They shall come into force with effect from the 1st August, 2017.
(3) These rules shall be applicable to the probationary officers, who are defined as Probationary Officers under clause (j) of rule 2 of these rules.
2. In these rules, unless the context otherwise requires,—
(a) " ANNEXURE " means the Annexure appended to these rules ;
(b) " Combined Probationary Training Programme (CPTP) " means the two years Training Programme conducted as per the Government Resolution, General Administration Department, No. TRN. 2013/C.R.84/13/12-A, dated the 20th January, 2014 ;
(c) " Commission " means the Maharashtra Public Service Commission ;
(d) " Departmental Examination " means the examination conducted under these rules and held in 3rd Semester of the Post-Graduate Degree Programme ;
(e) " Government " means the Government of Maharashtra ;
(f) " Group "A" and "Group "B" (Gazetted) post " means the Group "A" and "Group "B" "(Gazetted) posts, mentioned in the ANNEXURE and such posts which shall be included in the Annexure by the State Government, by order , from time to time ;
(g) "Post-Graduate Degree" means Post-Graduate Degree conferred by the University of Mumbai, to the Probationary Officers after successful complition of Post-Graduate Degree Programme ;
(h) " Post-Graduate Degree Programme " means the Post-Graduate Degree Programme Conducted for the Probationary Officers as per Government Resolution, General Administration Department, No. TRN. 0517/C.R.36/CPTP, dated the 21st July, 2017 ;
(i) " Syllabus " means Syllabus for Departmental Examination ;
(j) " Probationary Officer " means the person, who has been appointed on the basis of recommendation obtained through State Services Examination held by the Commission for the posts of Group "A" and Group "B"( Gazetted) included in the Combined Probationary Training Programme and the person, who is appointed as a Probationary Officer by the Government, as special case, on any of the the posts included in the Combined Probationary Training Programme ;
(k) " YASHADA " means the Yashwantrao Chavan Academy of Development Administration (YASHADA), Pune.
५ महाराष्ट्र शासन राजपत्र भाग चार-अ, गुरुवार ते बुधवार, एप्रिल २६-मे २, २०१८/वैशाख ६-१२, शके १९४०3. The provisions regarding requirement of passing of Departmental Examination for confirmation contained in the existing Recruitment Rules and Departmental Examinations Rule for the person appointed by nomination shall not be applicable to the Probationary Officers from the date of commencement of these Rules.
4. Every Probationary Officer shall be required to pass the Departmental Examination and complete the Post-Graduate Degree Programme during two years of probationary period :
Provided that, in exceptional circumstances, the Government may, in its discretion grant not more than two extra chances to appear for the examination by extending the period of the probation and in any circumstances such period shall not be extended for a period more than one year :
Provided further that, the marks awarded to the Probationary Officer in such re-examination shall not be taken in account in determining seniority.
5. Syllabus for Departmental examination shall be prescribed by YASHADA, after the consultation with University of Mumbai and the concerned Administrative Departments of the Government, and the other subjects as may be directed by the Government. The syllabus shall be published by the Government, by order, from time to time.
6. The Probationary Officer shall be allowed to write answers either in Marathi or in English.
7. The Probationary Officer shall be required to pass all the examinations held under the Post- Graduate Degree Programme in accordance with the criteria laid by the University of Mumbai.
8. Every Probationary Officer, who has not passed the Departmental Examination and not completed the Post-Graduate Degree Programme successfully during the period mentioned in rule 4 above, shall be liable to be discharged from service.
