NO. R.P. NAGPUR/MOUJA SHEKAPUR/TAL. KATOL/KH.NO. 46/2, 46/3, 46/4, 46/5, 46/6 50 & 51/ SECTION 20(4) JDTP/583 -2018.—

Whereas, the Revised Regional Plan of Nagpur Region (hereinafter referred to as "the said Regional Plan") has been sanctioned by the Govenment vide Urban Development Department's Notification No. TPS-2496-1505-CR-273-96-UD-9, dated the 6th May, 2000 under Section 15 of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") and has came into force with effect from the 15th July, 2000.

Whereas, the Government vide Resolution No. TPS-1815-CR-49-15-UD-13 dated 6th May, 2015 has issued directives under Section 154 of the Maharashtra Regional and Town Planning Act, 1966 regard- ing the procedure to be followed under Section 20 of the said Act for making zone changes in the use of land in the areas of sanctioned regional Plans under the said act ;

And whereas, land admeasuring about 9.56 hectare bearing Kh. No. 46/2,46/3,46/4,46/5,46/6,50 & 51 of Mouja Shekapur, Tal. Katol, District Nagpur (hereinafter referred to as "the said area") is included in "Agriculture" Zone in the sanctioned in Regional Plan of Nagpur.

And whereas, the "Proposal Scrutiny & Sanctioning Committee" established under the above men- tioned Government Resolution, had principally approved in meeting held on dt. 24-05-2017 that the change of use of the said land from "Agriculture Zone to Residential Zone" subject to conditions, • Conditions laid down in the abovesaid Government Resolution; and payment of requisite pre- mium and,

• Conditions prescribed by the Hon. Director of Town Planning, Maharashtra State, Pune, Letter Dated 22-02-2017 in this connection.

And whereas, in pursuant to the above, a notice bearing No. R.P. Nagpur-Mouja Shekapur-Tal.Katol- Kh.No. 46/2, 46/3, 46/4, 46/5, 46/6, 50 & 51 Section 20(3)/JDTP/854 Dated 17-06-2017 regarding the proposed modification under sub-section (3) of the Section 20 of the said Act, was published by Joint Director of Town Planning, Nagpur Division, Nagpur which appeared in the Maharashtra Government Official Gazette, Part-I A Nagpur Division Supplement dated 06-12- July 2017 on pages No. 1 & 2 for inviting suggestions and/or objections from the general public and the Assistant Director of Town Plan- ning, Nagpur Branch, Nagpur, was appointed as 'Officer' (hereinafter referred to as the "said Officer") to hear suggestions and/or objections and submit his report to the undersigned;

And whereas, after considering the report submitted by the said Officer, the "Proposal Scrutiny and Sanctioning Committee" is of the opinion that the said lands, should be deleted from "Agriculture Zone" and be included in "Residential Zone" subject to certain conditions ;

And whereas, the owner has deposited necessary premium and charges in the Government Treasury in this regard ;

Now, therefore, in exercise of powers under sub-section (4) of Section20 of the said act delegated to him by the "Proposal Scrutiny & Sanctioning Committee" Joint Director of Town Planning, Nagpur Division, Nagpur hereby sanctions the proposed modification and for that purpose directs that in the Schedule of Modifications appended to the Notification dated the 6th May 2000 sanctioning the said Regional Plan, after the last entry, the following new entry shall be added;

The allocation of land bearing Kh. No. 46/2, 46/3, 46/4, 46/5, 46/6, 50 & 51 Shekapur-Tal. Katol- District-Nagpur Admeasuring 9.56 ha. Approximately, changed from "Agriculture Zone to Residential Zone" more specifically shown on Plan, subject to the following conditions :-

Condition No. 1. It shall be the responsibility of the concerned Land Owner/Developer to provide basic infrastructure and civic amenities drinking water supply, sewerage network, roads, solid waste management, waste water treatment plant etc. in the said lands under modification.

Condition No. 2. The sale of plots/tenements shall be permissible as per the conditions given in undertaking in pursuance of aforesaid Government Resolution dated 06-05-2015 and also all conditions mentioned in the said resolution shall be binding.

If Group Housing Scheme is proposed in the lay-out than the occupancy certificate shall not be given unless civic amenities specified by the Collector are fully developed.

In case breach of any of the above conditions, lay-out approval and non agriculture permission shall be liable to be cancelled.

The copy of part plan showing the above sanctioned modification shall be kept open for inspection by general public during office hours on all working days for a period of one month at the following offices ;

(1) The Collector, Nagpur.

(2) The Joint Director of Town Planning, Nagpur Division, Nagpur.

(3) The Assistant Director of Town Planning, Nagpur Branch, Nagpur.

No. TPS-2214-448-CR-40-UD-9-2016.—

Whereas, the Government of Maharashtra vide Notification Urban Development Department No. TPS-2284-1823- C.R.105-UD-9, Date 29-12-1988, appointed Maharashtra Housing and Area Development Authority (MHADA) to be the " Special Planning Authority " under the provision of Section 40(1) (b) of Maharashtra Regional and Town Planning Act, 1966 (Mah.XXXVII of 1966) (hereinafter referred to as " the said Act ") to undertake planned and orderly development of notified area of New Chandrapur as proposed in the sanctioned Regional Plan of Chandrapur-Ballarpur Region & the Government vide Urban Development Department's Notification No. TPS-2294-471-C.R.-159-UD-9, dated the 30-06- 1998 has sanctioned development plan for the aforesaid notified area and has come into force with effect from the 01-09-1998. (hereinafter referred to as " the said Development Plan " ;

And whereas, in the said Development Plan, land bearing Survey No. 33 (pt.) area 0.69 Hectare of Mouze Padoli is reserved as in Site No. 12 Primary School & Play Ground (hereinafter referred to as " the said Reservation ") ;

And whereas, the Maharashtra Housing & Area Development Authority (MHADA) (hereinafter referred to as ' the said Special Planning Authority "), vide its General Body Resolution No. 1004, dated the 02-11-2001 has resolved to relocated the said reservation to the Southern side of the Survey No. 33 and accordingly submitted to the Government, for its sanction, a modification proposal as per the provisions of sub Section (1) of Section 37 of the said Act, (herein- after referred to as " the Proposed Modification ") ;

And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of the opinion that the proposed Modification should be sanctioned ;

And whereas, the Land Owner of the said reservation have deposited Rs. 34,500 towards the 50% Government share of 5% premium amount as per the value of the said lands as prescribed in the Annual Statement of Rates (ASR) for the year 2017-2018 in the Government Treasury on 09-01-2018 through the Town Planner, Chandrapur Branch, Chandrapur and remaining 50% of the 5% premium amount Rs. 34,500 payable to the Planning Authority has been deposited with the Chief Officer, Nagpur Housing Area Development Authority, (MHADA) Nagpur on 23-01-2018 ;

Now, therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of the said Act, the Government hereby, sanctions the Proposed Modification and for that purpose amends the aforesaid Notification dated the 30-06-1998 as follows ;

" In the Schedule of Modifications appended to the Notification dated 30-06-1998 sanctioning the said Develop- ment Plan, the following new entry shall be added after the last entry—

ENTRY

The reservation is Primary School & Play Ground (Site No. 12) (area 0.69 Ha.) is relocated from land bearing Survey No. 33 (pt.) of Mouze Padoli to the Southern side of Survey No. 33 and the land released due to relocation of the reservation is included in Residential Zone as shown on the plan ".

A copy of the Notification, alongwith the part plan showing the aforsaid sanctioned modification, shall be available for inspection of the general public, in the office of the Chief Officer, Nagpur Housing Area Development Authority, (MHADA) Nagpur, Grihnirman Bhavan, Civil Lines, Nagpur during office hours on all working days for a period of one month.

Whereas, (Revised + Additional) Development Plan of Umred City has been partly sanctioned by the Government vide Urban Development Department's Notification No. TPS-2498-287-CR-25-1998-UD-9, dated the 08-07-2003 and has come into force with effect from the 25-08-2003 and Excluded part of Development Plan has been sanctioned by the Government vide Urban Development Department's Notification No. TPS-2498-287-CR-25-1998-UD-9, dated 19-07- 2005 and has come into force with effect from the 05-09-2005 (hereinafter referred to as " the said Development Plan ") under Section 31 (1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as " the said Act ") ;

And whereas, in the said Development Plan, land bearing C.T.S. No. 2200, 2201, 2202, 2203 & 2079 of Mauze Umred is reserved for Site No. 85 " Children Park " & Site No. 85-A " Vegetable Market " (hereinafter referred to as " the said Reservations ") ;

And whereas, the Umred Municipal Council, Umred being the Planning Authority (hereinafter referred to as " the said Planning Authority "), vide its General Body Resolution No. 75, dated the 16-06-2016 has resolved to delete the said reservations and to include the same in Residential Zone and accordingly submitted to the Government, for its sanction, a modification proposal as per the provisions of sub-section (1) of Section 37 of the said Act, (hereinafter referred to as " the Proposed Modification ") ;

And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of the opinion that the proposed Modification should be sanctioned with some conditions ;

And whereas, the Land Owner of the said reservation have deposited Rs. 1,94,462 towards the 50% Government share of 5% premium amount as per the value of the said lands as prescribed in the Annual Statement of Rates (ASR) for the year 2017-2018 in the Government Treasury on 02-01-2018 through the Assistant Director of Town Planning, Nagpur Branch, Nagpur and remaining 50% of the 5% premium amount Rs. 1,94,462 payable to the Planning Authority has been deposited with the Chief Officer, Umred Municipal Council, Umred on 04-01-2018 ;

Now, therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of the said Act, the Government hereby, sanctions the Proposed Modification and for that purpose amends the aforesaid Notification dated the 08-07-2003 as follows ;

" In the Schedule of Modifications appended to the Notification dated 08-07-2003 sanctioning the said Develop- ment Plan, the following new entry shall be added after the last entry"—

ENTRY

The land bearing C.T.S. No. 2200, 2201, 2202, 2203 & 2079 of Mauze Umred is deleted from Site No. 85 " Children Park " & Site No. 85-A " Vegetable Market " and included in Residential Zone as shown on the plan, subject to the conditions mentioned below–

Condition No. 1 : In addition to open space, necessary Amenity Space shall be provided in the lay-out of the said Land as per the prevailing Development Control Regulations for Umred.

Condition No. 2 : Amenity Space shall be developed by the Land Owner / Developer.

Condition No. 3 : It is obligatory on the land owner / developer, to provide all the Basic Amenities required for the said land at his own cost. Basis Amenities includes Roads, Water Supply and Drainage etc. A copy of the Notification, alongwith the part plan showing the aforsaid sanctioned modification, shall be available for inspection of the general public, in the office of the Chief Officer, Umred Municipal Council, Umred during office hours on all working days for a period of one month.

This Notification shall also be available on the Government web site- www.maharashtra.gov.in

Whereas Government of Maharashtra vide Notification No. 1849-1191-CR-80-98-99-UD-13, dated 23-07-1999 Constituted Nagpur Metropolitan Area;

And whereas, Government of Maharashtra, Urban Development Department vide Notification No. TPS-2409-2890-PR-356-09-UD-9, dated 31-08-2010 appointed NIT Nagpur as special Planning Authority for said area;

And whereas, Government of Maharashtra, Urban Development Department vide Notification No. NMC-2012-CR-1-UD-26, dated 14 May 2013 included the area of Revenue villages of Mouze-Narsala and Mouze Hudkeshwar (Bu.) in Nagpur Municipal Corporation;

And whereas, Government of Maharashtra, Urban Development Department vide Notification No. TPS-2413-405-CR-213-UD-9, dated. 14 October 2013, declares the Nagpur Municipal Corporation being a local Authority shall be the Planning Authority for above said villages;

And whereas, Nagpur Municipal Corporation has published Draft Development Plan for the said Area under Section, 26 of Maharashtra Regional and Town Planning Act, 1966 (herein after it is referred to as the said act) on dated 28-11-2016 in Government Gazette and invited Objections-Suggestions from the general public within the period of 60 days;

And whereas, the Planning Committee Constituted under Section 28 (2) of the said Act has given hearing on the objections and suggestions so received and submitted its report to the Planning Authority on dated 9-1-2018;

And whereas, the Planning Authority, i. e. Nagpur Municipal Corporation vide Resolution No. 185 dated 20-2-2018 has approved the report under Section 28 (4) submitted by Planning Committee under Section 28 (3) of the said Act, and has given rights to the Commissioner, Nagpur Municipal Corporation, Nagpur for submission of Draft Development Plan to the Government for sanction under Section 30 (1) of the said Act.;

Modification U/s 37 of Maharashtra Regional & Town Planning Act, 1966

No. NIT-DDTP-Section-37-267-2018.—

The Revised Development Plan of Nagpur City prepared under the provisions of Maharashtra Regional and Town Planning Act, 1966 have been sanctioned by Government vide Urban Development Department Notification No. TPS-2496-2643-CR-300(a) 97-UD-9, dated the 7th January 2000 and finally sanctioned by Government vide Notification No. TPS-2400-1628-CR-2000-UD-9, dated the 10th September 2001. Also Nagpur Improvement Trust has been declared as "Planning Authority" for the seven Improvement Schemes being implemented by the Nagpur Improvement Trust vide Govt. Notification No. TPS-2401-855-CR-76-UD-9, dated the 27th February 2002. The said land falls in "Green Belt Control Scheme" within 7 schemes mentioned above.

In the said Revised Sanctioned Development Plan, the Nagpur Improvement Trust is desirous of making some modification U/s. 37 of Maharashtra Regional and Town Planning Act, 1966. Accordingly Nagpur Improvement Trust vide its Board Resolution No. 6-1176, dated 21-02-2018-SE-Planning has consented to make the aforesaid modification in Development Plan of Nagpur. The aforesaid modification proposed is as under—
