महाराष्ट्र सागरी मासेमारी नियमन अधिनियम, १९८१.
क्रमांक मत्स्यवि-१११८/प्र.क्र.७२/पदुम-१४.----ज्याअर्थी, भारत सरकार, कृषि आणि किसान कल्याण मंत्रालय, पशुपालन, दुग्धव्यवसाय आणि मत्स्यपालन विभाग यांचे आदेश एफ. क्र. २१००१/३/२०१४-एफवाय (आयएनडी), दिनांक १० नोव्हेंबर २०१७ अन्वये सागरी जलधि क्षेत्राबाहेरील भारतीय विशाल र्आथिक क्षेत्रात ट्रॉलिंग, पर्ससीन आणि अथवा जाळी यांचा वापर करणाया यांत्रिक तसेच यंत्रचलित मासेमारी नौकांवर जनरेटरवर अथवा जनरेटरशिवाय चालणारी विनाशकारी मासेमारी पद्धती, ज्यात बुल व पेअरट्रॉलिंगचा समावेश आहे, तसेच पाण्याखाली/बुडीत अथवा पाण्याच्या पृष्ठभागावर तरंगते कृत्रिम दिवे/एलईडी लाईट, माशांना आर्कषित करणारे दिवे किंवा कोणतीही इतर प्रकाश उत्र्सजित करणारी कृत्रिम साधने/उपकरणे बसवणे अथवा त्याच्या कार्यान्वयनास प्रतिबंध करण्यात आला आहे.
आणि ज्याअर्थी, भारत सरकार, कृषि आणि किसान कल्याण मंत्रालय, पशुपालन, दुग्धव्यवसाय आणि मत्स्यपालन विभाग यांचे पत्र क्र.२१००१/०३/२०१४-एफवाय (आयएनडी), दिनांक ७ मार्च २०१८ अन्वये राज्य शासनास राज्याच्या सागरी जलधि क्षेत्रात अथवा जलधि क्षेत्राबाहेर एल.ई.डी. लाईट वापरून मासेमारी करण्यास प्रतिबंध करण्यासाठी आवश्यक ती उपाययोजना करावी अशा सूचना दिल्या आहेत.
आणि ज्याअर्थी, शास्त्रीय तवावर मासेमारीचे नियमन करण्यासाठी आणि मासेमारीचा व्यवसाय करणाया निरनिराळ्या वर्गातील व्यक्तींच्या आणि विशेषत: पारंपरिक होडी वापरून मासेमारीचा व्यवसाय करणाया व्यक्तींच्या हितसंबंधाचे संरक्षण करण्यासाठी, मासेमारीवर नियंत्रण ठेवणे यासारख्या उत्तम व्यवस्थापन पद्धतींचा अवलंब करून माशांचे जतन करणे आणि समुद्रावर कायदा व सुव्यवस्था राखणे इष्ट आहे असे महाराष्ट्र शासनास वाटते ;

भाग चार--अ--११६-१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, एप्रिल २७, २०१८/वैशाख ७, शके १९४० त्याअर्थी आता, महाराष्ट्र सागरी मासेमारी नियमन अधिनियम, १९८१ (१९८१ चा ५४) याच्या कलम ४ च्या पोट-कलम (१) द्वारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून महाराष्ट्र शासन, उक्त कलम ४ मधील पोट-कलम (२) च्या खंड (अ) (ब) आणि (क) मधील बाबी लक्षात घेऊन, आणि महाराष्ट्र सागरी मासेमारी नियमन अधिनियम, १९८१ याच्या कलम ३ नुसार घटित करण्यात आलेल्या सल्लागार समित्यांशी विचारविनिमय करून, याद्वारे, पुढील बाबीस प्रतिबंध करीत आहे,-----
(एक) महाराष्ट्र राज्याच्या सागरी जलधि क्षेत्रात (१२ सागरी मैल) ट्रॉलिंग किंवा पर्ससीन किंवा गिलनेट किंवा डोलनेट यांचा वापर करणाया यांत्रिक तसेच यंत्रचालित (बोटी) मासेमारी नौकांना जनरेटरवर अथवा जनरेटर शिवाय चालणारे बुडीत/पाण्याखाली अथवा पाण्याच्या पृष्ठभागावर तरंगते कृत्रिम एलईडी लाईट/दिवे, माशांना आर्कषित करणारे दिवे किंवा कोणतीही इतर प्रकाश उत्र्सजित करणारी कृत्रिम उपकरणे यांचा वापर करणे किंवा ती बसवणे अथवा त्याचे कार्यान्वयन करणे.
(दोन) महाराष्ट्र राज्याच्या सागरी जलधि क्षेत्रात (१२ सागरी मैल) बुल आणि पेअर ट्रॉलिंगद्वारे मासेमारी करणे.
हे आदेश महाराष्ट्र राज्याच्या सागरी जलधिक्षेत्रात (१२ सागरी मैल) कार्यरत असणाया सर्व मासेमारी नौका तसेच त्यांना सहाय्य करणाया व आधार/पुरवठा करणाया सर्व संलग्न नौका यांना बंधनकारक असतील.

NOTIFICATION
MAHARASHTRA MARINE FISHING REGULATING ACT, 1981.
No. Matsyavi. 1118/CR-72/ADF-14.—Whereas, Government of India, Ministry of Agriculture and Farmers Welfare, Department of Animal Husbandry, Dairying and Fisheries, vide Order F. No. 21001/3/2014—Fy (Ind.), dated the 10th November 2017 has prohibited destructive fishing method including Bull or Pair trawling, use or installation or operation of surface or submerged artificial lights/LED lights, fish light attractors or any other light equipment with or without generator on mechanised fishing vessel or motorized fishing craft for trawling, purse seining and netting operations in the Indian Exclusive Economic Zone beyond Territorial waters ;
Whereas, Government of India, Ministry of Agriculture and Farmers Welfare, Department of Animal Husbandry, Dairying and Fisheries, vide letter No. 21001/03/2014-Fy (Ind.), dated the 7th March 2018 has advised the State Government to take the necessary steps to prevent use of LED light fishing within and beyond the territorial waters ;
And whereas, the Government of Maharashtra, considers it expedient to regulate fishing on scientific basis, and to protect the interests of different sections of persons engaged in the fishing particularly those engaged in fishing using traditional craft, to conserve fish by adopting best management practices such as controlling of fishing effort and to maintain law and order in the sea.
Now, therefore in exercise of the powers conferred by sub-section (1) of section 4 of the Maharashtra Marine Fishing Regulating Act, 1981 (Mah. LIV of 1981), the Government of Maharashtra, having regard to the matters referred to in clauses (a), (b) and (c) of sub-section (2) of said section 4, and after consultation with the Advisory Committees constituted under section 3 of the Maharashtra Marine Fishing Regulating Act, 1981, hereby prohibit,—
(i) the use or installation or operation of surface or submerged artificial lights / LED lights, fish light attractors or any other light equipment with or without generators, on Mechanized fishing vessel or motorized fishing craft, for trawling or purse seining or gill netting or dol netting operation in the territorial waters (12 nautical miles) of State of Maharashtra ;
(ii) the fishing in the territorial waters (12 nautical miles) of State of Maharashtra by bull or Pair trawling ;
The order will be binding on all fishing vessels and their supporting, supply and auxiliary vessels operating in territorial waters (12 nautical miles) of State of Maharashtra.
