उद्घोषणा
महाराष्ट्र नगरपरिषदा, नगरपंचायती व औद्योगिक नगरी अधिनियम, १९६५.
क्रमांक एमयुएन-२०१६/प्र.क्र.४६८/नवि-१८.-----महाराष्ट्र नगरपरिषदा, नगरपंचायती व औद्योगिक नगरी अधिनियम, १९६५ (१९६५ चा महा.४०) (यात यापुढे ज्याचा उल्लेख " उक्त अधिनियम " असा करण्यात आला आहे) याच्या ३४१ क चे पोट-कलम (१), (१क) आणि (२) यांच्या तरतूदीनूसार, महाराष्ट्र शासन याद्वारे सांगली जिल्ह्यतील आटपाडी या तालुका मुख्यालय असलेल्या ग्रामपंचायतीचे स्थानिक क्षेत्र, ग्रामीण क्षेत्रातून नागरी क्षेत्रामध्ये संक्रमित होणारे क्षेत्र आणि तालुका मुख्यालय असल्याने हे संक्रमणात्मक क्षेत्र म्हणून विर्िनदिष्ट करण्याच्या आणि उक्त क्षेत्रासाठी " आटपाडी नगरपंचायत " या नावाने नगरपंचायत घटित करण्याच्या दृष्टीने, उक्त अधिनियमाचे कलम ३४१ क चे पोट-कलम (१), (१क) आणि (२) याद्वारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून, अधिसूचना काढण्याचा आपला हेतू घोषित करीत असून तिचा मसूदा यासोबत जोडलेला आहे.
२. उक्त अधिसूचनेला आक्षेप घेणाया कोणत्याही व्यक्तींने, ही उद्घोषणा महाराष्ट्र शासनाच्या राजपत्रात प्रसिद्ध झाल्याच्या दिनांकापासून तीस दिवसांच्या कालावधीत जिल्हाधिकारी, सांगली यांच्याकडे त्यांची लेखी कारणे सादर करणे आवश्यक असेल.
३. उक्त कालावधीमध्ये मिळालेल्या अशा कोणत्याही आक्षेपावर शासनाकडून विचार करण्यात येईल.

अधिसूचनेचा मसुदा
क्रमांक एमयुएन-२०१६/प्र.क्र.४६८/नवि-१८.---- ज्याअर्थी, शासनाने महाराष्ट्र नगरपरिषदा, नगरपंचायती व औद्योगिक नगरी अधिनियम, १९६५ (१९६५ चा महा. ४०) (यात यापुढे ज्याचा उल्लेख " उक्त अधिनियम " असा करण्यात आला आहे.) याच्या कलम ३४१ क चे पोट-कलम (१), (१क) आणि (२) यांच्या तरतुदीनुसार, शासन उद्घोषणा, नगरविकास विभाग, क्र. एमयुएन-२०१६/प्र.क्र.४६८/नवि-१८, दिनांक २ मे २०१८ याद्वारे महाराष्ट्र शासन राजपत्र असाधारण, दिनांक २ मे २०१८ यामध्ये उद्घोषणा प्रसिद्ध केली असुन, महाराष्ट्र शासनाने सांगली जिल्ह्यतील आटपाडी या ग्रामपंचायतीचे स्थानिक क्षेत्र, ग्रामीण क्षेत्रातुन नागरी क्षेत्रामध्ये संक्रमित होणारे क्षेत्र आणि तालुका मुख्यालय असल्यामुळे हे संक्रमणात्मक क्षेत्र म्हणुन विर्िनदिष्ट करण्यासाठी व उक्त संक्रमणात्मक क्षेत्रासाठी आटपाडी नगरपंचायत या नावाने नगरपंचायत गठित करण्यासाठी, उक्त अधिनियमाचे कलम ३४१ क चे पोट-कलम (१), (१क) आणि (२) या अन्वये अधिसुचना काढण्याच्या आपल्या प्रस्तावावर आक्षेप मागविले होते;
आणि ज्याअर्थी, अधिसूचनेत नमूद कालावधीत जिल्हाधिकारी, सांगली यांच्याकडे प्राप्त झालेल्या आक्षेपांचा शासनाने विचार केला आहे;
आणि ज्याअर्थी, भारताचे संविधानाच्या अनुछेद २४३ थ च्या खंड (२) मध्ये नमूद केलेल्या बाबी विचारात घेऊन महाराष्ट्र शासनाला, यासोबत जोडलेल्या अनुसूची " अ " मध्ये अधिक तपशीलवारपणे वर्णन केलेले उक्त स्थानिक क्षेत्र हे, संक्रमणात्मक क्षेत्र म्हणून विर्िनदिष्ट करणे इष्ट वाटते ;
त्याअर्थी आता, उक्त अधिनियमाचे कलम ३४१ क चे पोट-कलम (१), (१क) आणि (२) अन्वये प्रदान केलेल्या अधिकारांचा वापर करून व त्याबाबतीत समर्थ करणाया इतर सर्व अधिकारांचा वापर करून, महाराष्ट्र शासन, याद्वारे उक्त स्थानिक क्षेत्र हे, संक्रमणात्मक क्षेत्र म्हणुन विर्िनदिष्ट करीत असुन, त्यासाठी उक्त अधिनियमाच्या कलम ३४१ क चे पोट-कलम (२) मध्ये तरतुद केल्याप्रमाणे, आटपाडी नगरपंचायत या नावाने एक नगरपंचायत घटित करण्यात येत आहे. उक्त संक्रमणात्मक क्षेत्राच्या हद्दी यासोबत जोडलेल्या अनुसूची " ब " मध्ये विर्िनदिष्ट केल्याप्रमाणे असतील.

पूर्वेस .---- बोंबेवाडी, खांजोडवाडी व यपावाडी गावाची हद्द
पश्चिमेस .---- मूढेवाडी, बनपूरी या गावाची हद्द व शेंडगेवाडी वस्ती (आटपाडी गट नं. ३२८१ ते ३४०२)
दक्षिणेस .---- तडवळे, मासाळवाडी, बनपूरी गावची हद्द

PROCLAMATION
MAHARASHTRA MUNICIPAL COUNCILS, NAGAR PANCHAYATS AND INDUSTRIAL TOWNSHIPS ACT, 1965.
No-MUN-2016/C.R.468/UD-18.–– In pursuance of the provisions of sub-section (1), (1A) and (2) of section 341A of the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965 (Mah.XL of 1965) (hereinafter referred to as "the said Act"), the Government of Maharashtra,hereby announces its intension to issue a notification, in exercise of the powers conferred by sub-sections (1), (1A) and (2) of section 341A of the said Act with a view to specify the local area of the Village Panchayat of Atpadi in Sangli District, being an area in transition from a rural to an urban area, and a Taluka Headquarter, to be a transitional area and to constitute a Nagar Panchayat by the name of the "Atpadi Nagar Panchayat" for the said local area, the draft of which is appended herewith.
2. Any person who entertains any objections to issuance of the said proclamation is hereby required to submit the same in writing with the reasons therefore to the Collector, Sangali District within a period of thirty days from the date of publication of this proclamation in the Maharashtra Government Gazette.
3. Any such objection which may be received during the said period will be considered by the Government.
DRAFT NOTIFICATION
No. MUN-2017/C.R.358/UD-18.–– Whereas, by the Government Proclamation, Urban Development Department No. MUN-2017/C.R.358/UD-18, Mantralaya Mumbai 400032 dated the 2nd May, 2018 issued in pursuance of the provisions of sub-sections (1), (1A) and (2) of section 341 A of the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965 (Mah.XL of 1965) (hereinafter referred to as "the said Act"), the Government of Maharashtra invited objections to its proposal to issue a notification under sub-sections (1), (1A) and (2) of section 341 A of the said Act, to specify the local area of the Village Panchayat of Atpadi in Sangli District, being an area in transition from a rural to an urban area and a Taluka Headquarter, to be a transitional area and to constitute a Nagar Panchayat by the name of the "Atpadi Nagar Panchayat" for the said transitional area;
And whereas, objections and suggestions so received by the Collector, Sangli District, pursuant to the said Proclamation have been duly considered by Government of Maharashtra;
And whereas, having regard to the factors mentioned in clause (2) of article 243-Q of the Constitution of India, the Government of Maharashtra considers it expedient to specify the said local area, more particularly described in Schedule "A" appended hereto, to be a transitional area.
Now, therefore, in exercise of the powers conferred by sub-sections (1), (1A) and (2) of section 341 A of the said Act and of all other powers enabling it in that behalf, the Government of Maharashtra hereby specifies the said local area to be a transitional area, for which there shall be constituted a Nagar Panchayat, as provided in sub-sections (1), (1A) and (2) of said section 341 A of the said Act, by the name Atpadi Nagar Panchayat.

Schedule "A"
Description of the local area to be specified as a transitional area :–
An area in Atpadi Village Panchayat Gat No.01 to 3280 and 3403 to 4218.
An area in Maptemala Village Panchayat Gat No. 01 to 604.
An area in Bhingewadi Village Panchayat Gat No. 01 to 155.
Schedule "B"
Boundaries of the local area to be specified as a transitional area :–
Boundaries of the area of the Village Panchayat of Atpadi constituted under the Maharashtra Village Panchayats Act (III of 1959).
East :- A boundaries of village Bombewadi, Khanjodwadi and Yapawadi.
West :- A boundaries of village Mudhewadi, Banpuri and Shendgewadiwasthi (Aptadi Gat No. 3281 to 3402).
South :- A boundaries of village Tadwale, Masalwadi, Banpuri.
North :- A boundaries of Galwewadi, Pisewadi, Awalai, Sherewadi Pujarwadi (Atpadi, Deshmukhwadi).
