महाराष्ट्र सागरी मासेमारी नियमन अधिनियम, १९८१.
क्रमांक मत्स्यवि. १११५/प्र.क्र. २८२/पदुम-१४.---- ज्याअर्थी महाराष्ट्र शासनाने डॉ. कै. व्ही. एस्. सोमवंशी, यांचे अध्यक्षतेखाली पर्ससीन मासेमारी व तिचा राज्याच्या किनायांवरील पारंपारिक मासेमारी व पर्यावरणावर होणारा परिणाम यांचा अभ्यास करण्यासाठी समिती गठित केली होती ;
आणि ज्याअर्थी, समितीने सखोल अभ्यासाअंती अहवाल व आपल्या शिफारशी शासनास १० मे २०१२ रोजी सादर केल्या आहेत ;
आणि ज्याअर्थी, महाराष्ट्र शासनाने सदर समितीच्या शिफारसी स्वीकारल्या आहेत ;
आणि ज्याअर्थी, महाराष्ट्र शासनाने, मासेमारी व्यवसायातील विविध घटकांचे विशेषतः पारंपारिक मच्छीमारांचे हितसंबंध जपणे व मासेमारी प्रयत्नांचे व्यवस्थापनाद्वारे मत्स्यसाठयांचे जतन करण्यासाठी आणखी उपाययोजना करण्याचा निर्णय घेतला आहे ;
आणि ज्याअर्थी, दक्षतेची उपाययोजना म्हणून, पर्ससीन मासेमारीचे नियमन करून त्याद्वारे तारली, बांगडा व अन्य महवाच्या माशांच्या जातींची पिल्ले प्रजोत्पादनाची किमान अवस्था येण्यापूर्वी पकडणे व त्यांचे जीवनचक्रामध्ये एकदा तरी पुनरुत्पादनाची संधी मिळण्यापूर्वी पकडली जाऊन पुढील वर्षाचे मत्स्य उत्पादनावर होणारा प्रतिकूल परिणाम टाळण्याची आवश्यकता असणे. उथळ पाण्यातील व प्रजोत्पादन हंगामातील पर्ससीन मासेमारीमुळे समुद्राचे तळावरील जीवसृष्टीची होणारी हानी, यामुळे पर्यावरणावर प्रतिकूल परिणाम होऊन कमाल शाश्वत मत्स्योत्पादन बाधित होणे.
आणि, म्हणून, महाराष्ट्र सागरी मासेमारी नियमन अधिनियम, १९८१ कलम ४, पोट-कलम (१) अन्वये प्रदान केलेल्या अधिकारांचा वापर करून, आणि शासन आदेश, कृषी व सहकार विभाग, क्रमांक मत्स्यवि. १०८५/४६०८२/सीआर-२२८/फिश-२, दिनांक १० डिसेंबर १९८७ व शासन आदेश, कृषी, पशुसंवंर्धन, दुग्धविकास व मत्स्यव्यवसाय विभाग क्रमांक लावेसु. ४९९/१४१४१/(सीआर-८८)/एडीएफ-१४, दिनांक १३ ऑक्टोबर १९९९ अधिक्रमीत करून, महाराष्ट्र शासन उक्त कलम ४ च्या पोट-कलम (२) मध्ये विर्िनदिष्ट केलेल्या बाबी विचारात घेऊन, उक्त अधिनियमाच्या कलम ३ अन्वये रचना करण्यात आलेल्या सल्लागार समित्यांशी विचार विनिमय केल्यानंतर, याद्वारे राज्याच्या सागरी जलधिक्षेत्रात पुढील मासेमारीचे नियमन करण्यात येत आहे :----
(१) पर्ससीन/रिंगसीन (मिनी पर्ससीन सह) मासेमारीसाठी नवीन मासेमारी परवाने देण्यात येऊ नयेत. प्रचलित/कार्यरत, पर्ससीन/ रिंगसीन (मिनी पर्ससीन सह) मासेमारी परवान्यांची संख्या टप्याटप्याने कमी करून २६२ वर आणि अंतिमत: १८२ पयर्ंत आणावी.
६ महाराष्ट्र शासन राजपत्र भाग चार-ब, गुरुवार ते बुधवार, मे ३-९, २०१८/वैशाख १३-१९, शके १९४०(२) पर्ससीन/ रिंगसीन (मिनी पर्ससीन) जाळ्याने सप्टेंबर ते डिसेंबर या कालावधीतच आणि खंड (३) मध्ये विहित केल्यानुसार क्षेत्र क्र. २, ३ व ४ मध्ये मासेमारी करता येईल.
(३) मत्स्यव्यवसायाचे जतन करण्यासाठी तसेच सागरी किनायाची रचना व खंडांतर्गत उतार विचारात घेऊन पर्ससीन मासेमारीचे नियमन खालील ४ क्षेत्रांमध्ये विहित केल्यानुसार करण्यात येईल,----
(अ) क्षेत्र क्र. १ - झाई ते मुरुड - किनायापासून १२ सागरी मैलापयर्ंतचे क्षेत्र पारंपारिक मासेमारांसाठी राखीव. पर्ससीन/ रिंगसीन (मिनी पर्ससीन सह) मासेमारी या क्षेत्रामध्ये निषिद्ध राहील.
(ब) क्षेत्र क्र. २ - मुरुड ते बुरुंडी - किनायापासून १० मिटर ( ५ वाव) खोलीपयर्ंतचे क्षेत्र पारंपारिक मासेमारांसाठी राखीव.
यापुढील क्षेत्रामध्ये पर्ससीन/रिंगसीन (मिनी पर्ससीन सह) मासेमारीसाठी खुले राहील.
(क) क्षेत्र क्र. ३ - बुरुंडी ते जयगड - किनायापासून २० मिटर ( १० वाव) खोलीपयर्ंतचे क्षेत्र पारंपारिक मासेमारांसाठी राखीव. यापुढील क्षेत्रामध्ये पर्ससीन/रिंगसीन (मिनी पर्ससीन सह) मासेमारीसाठी खुले राहील.
(ड) क्षेत्र क्र. ४ - जयगड ते बांदा - किनायापासून २५ मिटर ( १२.५ वाव) खोलीपयर्ंतचे क्षेत्र पारंपारिक मासेमारांसाठी राखीव. यापुढील क्षेत्रामध्ये पर्ससीन/रिंगसीन (मिनी पर्ससीन सह) मासेमारीसाठी खुले राहील.
(४) राज्याच्या जलधीक्षेत्रात यांत्रिक मासेमारी नौकेद्वारे पर्ससीन/रिंगसीन (मिनी पर्ससीन) जाळ्यांने मासेमारी करणाया पर्ससीन जाळ्यांचे आसाची लांबी, तारली माशांसाठी २५ मि.मी. व बांगडा माशांसाठी ४९ मि.मी. पेक्षा कमी असणार नाही.
(५) राज्याच्या जलधीक्षेत्रात यांत्रिक मासेमारी नौकेद्वारे खालील तपशिलाव्यतिरिक्त पर्ससीन/रिंगसीन (मिनी पर्ससीन) जाळ्यांचा वापर करता येणार नाही :----

MAHARASHTRA MARINE FISHING REGULATION ACT, 1981.
No. MATSYAVI-1115/CR-282/ADF-14.— Whereas the Government of Maharashtrta has appointed the Committee under the Chairmanship of Late Dr. V. S. Somvanshi to study the status of purse seine fishing and its impact on the traditional fishing and ecology along Maharashtra Coast;And Whereas, the said Committee has submitted the report after detailed study to the Government on the 10th May 2012 with recommendations ;
And Whereas, the Government of Maharashtra has accepted the recommendations of the said Committee ;
And Whereas, the Government of Maharashtra has decided further to protect the interest of different sections of persons engaged in fishing particularly traditional fishing and to conserve the fish stocks by adopting best management practices such as controlling of the fishing efforts ;
And Whereas, it is necessary to apply precautionary approach to restrict purse seine fishing so as to avoid catching huge quantities of juveniles of oil sardines, mackerel and other targeted species as most of the fishes are caught before reaching the minimum size of maturity and not even having opportunity to reproduce once during their lifetime thereby affecting the next year's production from the fishery. The purse seine operation in shallow water and in breeding season of the fishes have adverse ecological impact due to disturbance of bottom benthic flora and fauna which affects the Maximum Sustainable Yield level of fishing ;
Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 4 of the Maharashtra Marine Fishing Regulation Act, 1981(Mah. LIV of 1981), and in supersession of Government Order, Agriculture and Co-operation Department, No. MATSYAVI.1085/46082/CR-228/FISH-2, dated the 10th December 1987 and Agriculture, Animal Husbandry, Dairy Development and Fisheries Department, No. Lavesu-499/14141/ (CR-88)/ADF-14, dated the 13th October 1999, the Government of Maharashtra hereby having regard to the matters referred to in sub-section (2) of Section 4 of the said Act, after consultation with the Advisory Committee constituted under section 3 of the said Act, hereby regulate the fishing in the territorial waters of the State as follows :—
(1) No new licenses for purse seine/ring seine (including mini-purse seine) fishing shall be issued. The number of existing/operational purse seine/ring seine (including mini-purse seine) fishing licenses shall be brought down upto 262 step-by-step and finally to be brought down upto 182.
(2) The purse seine/ring seine (including mini-purse seine) gear shall be operated by any mechanized vessel, during the period September to December only and within the Zones II, III and IV specified in clause (3).
(3) In order to conserve the existing fishery and considering the configuration of coastline as well as continental shelf profile, purse seine fishing shall be regulated in four Zones specified below,—
(a) Zone (I) - Zai to Murud – Area from shore to 12 NM (Nautical Miles) shall be reserved for traditional fishing. The purse seine/ring seine (including mini-purse seine) fishing shall be prohibited in this Zone.
(b) Zone (II) - Murud to Burundi - Area upto 10 m ( 5 fathom) depth from shore shall be reserved for traditional fishing. The purse seine/ring seine (including mini-purse seine) fishing shall be permitted beyond the 10 m ( 5 fathom) depth.
(c) Zone (III) - Burundi to Jaigad - Area upto 20 m ( 10 fathom) depth from shore shall be reserved for traditional fishing. The purse seine/ring seine (including mini-purse seine) fishing shall be permitted beyond the 20 m ( 10 fathom) depth.
(d) Zone (IV) - Jaigad to Banda - Area upto 25 m ( 12.5 fathom) depth from shore shall be reserved for traditional fishing. The purse seine/ring seine (including mini-purse seine) fishing shall be permitted beyond the 25 m depth ( 12.5 fathom) depth.
८ महाराष्ट्र शासन राजपत्र भाग चार-ब, गुरुवार ते बुधवार, मे ३-९, २०१८/वैशाख १३-१९, शके १९४०(4) No purse seine/ ring seine (including mini-purse seine) gear having less than, 25 mm mesh size for oil sardines and 49 mm mesh size for mackerels shall be operated by mechanized fishing vessels within the territorial waters of the State.
(5) No purse seine/ ring seine (including mini-purse seine) gear other than specifications mentioned below shall be operated by any mechanized fishing vessel in the territorial waters of the State.
