क्रमांक पतसंस्था/स.आ.५/श्री. शिवाजीराव-सांगली वैभव को-ऑप/विलिनीकरण/१८/४३०.-------- महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १७ (१) व महाराष्ट्र सहकारी संस्था नियम, १९६१ चे नियम १६ नुसार मला प्राप्त झालेल्या अधिकारानुसार मी, डॉ. पी. एल. खंडागळे, अपर निबंधक, सहकारी संस्था (पतसंस्था), महाराष्ट्र राज्य, पुणे, श्री. शिवाजीराव देशमुख बिगरशेती सहकारी पतसंस्था मर्या., आरळा जिचा नोंदणी क्रमांक एस.ए.एन./एस.एल.ए./आर.एस.आर. (सी.आर.) १३७९/१९१९, दिनांक ३ जून १९९२ असा असून सदर संस्थेची संपूर्ण देयता व मालमत्ता, सांगली वैभव को-ऑप. क्रेडीट सोसायटी मर्या., मुंबई जिचा नोंदणी क्रमांक बी.ओ.एम./ आर.एस.आर./जी.एन. वॉर्ड/१३५१ सन १९८१ या नोंदणीकृत संस्थेमध्ये सोबतच्या परिशिष्टामध्ये नमूद केलेल्या अटी व शर्तीस अधीन राहून हस्तांतरीत करण्यास मंजुरी प्रदान करून विलिनीकरण करीत आहे. त्यासाठी निरनिराळ्या हस्तांतरणाचे दस्तऐवजाची, अशा वेळी भारतीय नोंदणी अधिनियम, १९०८ किंवा संपत्ती हस्तांतरण अधिनियम, १८८२ च्या तरतुदी गैरलागू असल्यामुळे जरूरी राहणार नाही.

उक्त आदेशामुळे श्री. शिवाजीराव देशमुख ग्रामीण बिगरशेती सहकारी पतसंस्था मर्या., आरळा या संस्थेचे सांगली वैभव को-ऑप. क्रेडिट सोसायटी मर्या., मुंबई या संस्थेमध्ये विलिनीकरण झाल्यामुळे महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम २१ नुसार श्री. शिवाजीराव देशमुख ग्रामीण बिगरशेती सहकारी पतसंस्था मर्या., आरळा या संस्थेची नोंदणी सहायक निबंधक, सहकारी संस्था, ता. शिराळा, जि. सांगली यांनी रद्द करून संस्थेचे "ड" रजिस्टरवरील नाव कमी करावे.

उक्त दोन्ही आदेश आज दिनांक २१ फेब्रुवारी २०१८ रोजी माझे सही व शिक्क्यानिशी पारित करीत आहे.

क्रमांक वि-१/बाणगंगानागरीपत/क. १५६/सन २०१८.------ महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६ (१) अन्वये मला प्रदान करण्यात आलेल्या शक्तीचा वापर करून मी, निलकंठ करे, जिल्हा उप निबंधक, सहकारी संस्था, नाशिक या आदेशान्वये बाणगंगा सहकारी पतसंस्था मर्या., ओझर (मिग) ता. निफाड, जि. नाशिक या संस्थेचा खालील अधिकायांचे व त्यांचे नावापुढे दर्शविलेल्या कार्यक्षेत्रासाठी महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १०१ व कलम ९१ अन्वये प्राप्त झालेल्या वसुली प्रमाणपत्राची अंमलबजावणी/ कर्ज वसुली करण्याकरिता महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६ (१) व नियम १०७ अनुसार मालमत्ता जप्त करून व तिची विक्री करून रकमा वसूल करण्याचे निबंधकाचे अधिकार खालील अटीस अधीन राहून या आदेशाच्या दिनांकापासून ते दिनांक ३१ मार्च २०१८ या कालावधीकरिता प्रदान करीत आहे :----

(१) (२) ( ३ ) (४) (५) (६) १ श्री. सतीष भास्करराव बुरघाटे एनपीटी-४५/२०१७ वसुली अधिकारी वसुली अधिकारी नाशिक जिल्हा अटी .— १. वसुली अधिकारी यांनी महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६ व नियम, १९६१ चे नियम १०७ मधील तरतुदीनुसार कर्ज वसुलीची कार्यवाही करावी. कर्ज वसुली करताना सहकार कायदा, नियम यातील तरतुदी व परिपत्रकीय सूचनांचे पालन न केल्याचे निदर्शनास आल्यास आवश्यक ती चौकशी करून आवश्यकता भासल्यास सदरचे अधिकार तात्काळ काढून घेण्यात येतील.

२. सदरचे अधिकार सहकार कायदा कलम १०१ व ९१ अन्वये प्राप्त वसुली दाखल्याची अंमलबजावणी करण्याकरिता असतील.

३. वसुली अधिकारी यांनी दरमाह सोबत जोडलेल्या विहीत नमुन्यात 'अ-३', 'अ-४' व 'ब' कर्ज वसुलीची माहिती संबंधित जिल्हा उप निबंधक, सहकारी संस्था यांचे कार्यालयास सादर करावी. ज्या सहकारी संस्थेचे कार्यक्षेत्र विभाग, दोन विभाग अथवा राज्य कार्यक्षेत्र आहे त्या संस्थांनी देखील त्यांचे मुख्य कार्यालय ज्या जिल्ह्यमध्ये आहे त्या जिल्हा उप निबंधक यांचे कार्यालयास माहिती सादर करावी.

४. अधिकार प्रदान केलेल्या वसुली अधिकारी असलेल्या व्यक्ितची बदली झाल्यास किंवा सेवानिवृत्ती झाल्यास किंवा सेवेतून काढून टाकल्यास किंवा मृत्यू झाल्यास, अशा अधिकायास प्रदान केलेले अधिकार आपोआप रद्द होतील.

५. विशेष वसुली अधिकारी यांनी वसूल केलेल्या संपूर्ण सरचार्ज रकमेचा भरणा वसूल केलेल्या महिन्यातच चलनाने शासकीय कोषागारात करावा. वसुली अधिकारी यांनी वसूल केलेला सरचार्ज, त्याचा शासकीय कोषागारात केलेला भरणा याबाबत संस्थास्तरावर स्वतंत्र नोंदवही ठेवण्यात यावी. त्याबाबतचा नमुना 'अ-१', 'अ-२' 'अ-३' 'अ-४' सोबत जोडलेला आहे.

६. मा. उच्च न्यायालय, मुंबई यांनी रिट याचिका क्र. १९४२/२०१३, दि बेसिन कॅथोलिक को-ऑप. बँक विरुद्ध महाराष्ट्र राज्य व इतर या याचिकेमध्ये दिनांक ५ डिसेंबर २०१५ रोजी दिलेला आदेश विचारात घेऊन वसुलीची कार्यवाही करताना महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ अन्वये प्राप्त असलेल्या अधिकारानुसारच वसुलीची कार्यवाही करावी.

७. वसुली अधिकारी यांनी नमूद केलेल्या कालावधीत वसुलीचे कामकाज समाधानकारक केले नसल्याचे निदर्शनास आल्यास किंवा प्रदान केलेल्या अधिकाराचा गैरवापर करीत असल्याचे निदर्शनास आल्यास, प्रदान केलेले अधिकार काढून घेतले जातील व भविष्यात असे कोणतेही अधिकार अशा व्यक्ितस प्रदान करण्यात येणार नाही.

८. शासन निर्णय क्रमांक संकीर्ण-१५०४/प्र. क्र. २३१/१५-स, दिनांक २३ नोव्हेंबर २००६ अन्वये विशेष वसुली अधिकायांना तीन सिंहाच्या राजमुद्रेचा वापर करता येणार नाही.

९. वसुली अधिकायास त्याच्या नावापुढे कोठेही '' महाराष्ट्र शासन नियुक्त '' आणि किंवा '' सिव्हील कोर्ट '', '' एक्झीक्युटीव्ह कोर्ट '' या शब्दांचा अथवा तत्सम शब्दांचा वापर करता येणार नाही. त्याऐवजी वसुली अधिकायांनी त्यांच्या नावापुढे '' वसुली अधिकारी (महाराष्ट्र सह. संस्था अधिनियम, १९६० व नियम, १९६१ चे नियम १०७ अन्वये) '' असे लिहावे.

१०. वसुली अधिकायास वसुलीसाठी वापर करण्यात येणाया वाहनावर '' वसुली अधिकारी ------------ सहकारी बँक/पतसंस्था ------------ '' असा फलक लावता येऊ शकेल.

११. वसुली अधिकायाने पगार जप्तीची कार्यवाही करताना कर्जदाराच्या/जामिनदाराच्या पगार कपातीबाबत राष्ट्रीयकृत बँका वा अन्य बँका यांचेकडे परस्पर वेतन कपातीचा आदेश देऊन परस्पर पगार कपात करता येणार नाही. संबंधित कर्जदार/जामिनदार ज्या आस्थापनेवर काम करीत आहे त्या आस्थापनेवरील आहरण व संवितरण अधिकारी/पगार करणारा अधिकारी यांचेमार्फत पगारातून कर्ज वसूल करण्याची कार्यवाही करावी.

१२. वसुली अधिकायास, थकबाकीदाराकडून वसुली दाखल्यानुसार वसूलपात्र रक्कम व सरचार्ज रक्कम याशिवाय इतर कोणतीही रक्कम वसूल करता येणार नाही.

१३. सोबतच्या यादी प्रमाणे सर्व प्रकरणामध्ये जंगम जप्ती, स्थावर जप्ती, अपसेट प्राईज मंजुरी, जाहीर लिलाव कलम १००/८५ अन्वयेची कार्यवाही ही माहे डिसेंबर, २०१७ अखेर पूर्ण करण्यात यावी. सदर मुदतीत उक्त कार्यवाही पूर्ण न केल्यास आपणांस दिनांक १ एप्रिल २०१८ पासून पुढील कालावधीसाठी कलम १५६ चे अधिकार प्रदान करण्यांत येणार नाही याची गांभीर्याने नोंद घ्यावी व त्याची सर्वस्वी जबाबदारी ही आपली राहील.

क्रमांक जिउनि-यवत/वि-२/क. १५६/७२१/२०१८.------ महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६ (१) अन्वये मला प्रदान करण्यात आलेल्या शक्तीचा वापर करून मी, जिल्हा उप निबंधक, सहकारी संस्था, यवतमाळ या आदेशान्वये महागांव ग्रामीण बिगर शेती सहकारी पत संस्था मर्या., महागांव या संस्थेच्या संचालक मंडळाची सभा दिनांक १२ एप्रिल २०१७ रोजीचे ठरावा मध्ये नमूद कर्मचारी/अधिकारी यांना त्यांच्या नावासमोर दर्शविलेल्या कार्यक्षेत्रासाठी महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १०१ व कलम ९१ अन्वये प्राप्त झालेल्या वसुली प्रमाणपत्राची अंमलबजावणी/कर्ज वसुली करण्याकरिता महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६ (१) व नियम १०७ अनुसार मालमत्ता जप्त करून व तिची विक्री करून रकमा वसूल करण्याचे निबंधकाचे अधिकार खालील अटीस अधीन राहून या आदेशाच्या दिनांकापासून ते दिनांक ३१ मार्च २०१८ या कालावधीकरिता प्रदान करीत आहे :----

(५) नुसार संस्थेच्या वसुली अधिकायांना याबाबत सूचित करण्यात येते की, त्यांनी जप्त केलेल्या मालमत्तेचा कर्जदाराकडील ताबा, जोपयर्ंत अशा मालमत्ता सार्वजनिक लिलावात विकली जाणार नाही तोपयर्ंत घेऊ नये.

वरीलप्रमाणे अधिकार खाली नमूद केलेल्या अटी व शर्तीस अधिन राहून प्रदान करण्यात आलेले आहेत.

अटी.— १. वसुली अधिकारी यांनी महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६ व नियम, १९६१ चे नियम, १०७ मधील तरतुदीनुसार कर्ज वसुलीची कार्यवाही करावी. कर्ज वसुली करताना सहकार कायदा, नियम यातील तरतुदी व परिपत्रकीय सूचनांचे पालन न केल्याचे निदर्शनास आल्यास आवश्यक ती चौकशी करून आवश्यकता भासल्यास सदरचे प्रदान केलेले अधिकार तात्काळ काढून घेण्यात येतील. भाग एक (म.उ.वि.)--१अ४ महाराष्ट्र शासन राजपत्र, भाग एक--मध्य उप-विभाग, गुुरुवार ते बुधवार, मे १०-१६, २०१८/वैशाख २०-२६, शके १९४० २. सदरचे अधिकार सहकार कायदा कलम १०१ व ९१ अन्वये प्राप्त वसुली दाखल्याची अंमलबजावणी करण्याकरिता असतील.

११. वसुली अधिकायाने पगार जप्तीची कार्यवाही करताना कर्जदाराच्या/जामिनदाराच्या पगार कपातीबाबत राष्ट्रीयकृत बँका वा अन्य बँका यांचेकडे परस्पर वेतन कपातीचा आदेश देऊन परस्पर पगार कपात करता येणार नाही. संबंधित कर्जदार/जामिनदार ज्या आस्थापनेवर काम करीत आहे त्या आस्थापनेवरील आहरण व संवितरण अधिकारी/पगार करणारा अधिकारी यांचेमार्फत पगारातून कर्ज वसूल करण्याची कार्यवाही करावी.

अधिसूचना

क्रमांक अपोमसं(वा)/४५/पोनि (नियो)/मुंबई/२०१८/७६८.-------- यशवंतराव चव्हाण मुंबई-पुणे द्रूतगती मार्गावरील अपघात, वाहतूक कोंडी इत्यादींचा अभ्यास करता असे निदर्शनास येते की द्रूतगती मार्गावरील प्रत्येक वाहिनीत असलेल्या तीन लेन पैकी कार/जीप/टॅम्पो या हलक्या वाहनांनी द्रूतगती मार्गाच्या मध्यलेन मधून, जड-अवजड वाहनांनी सव्र्हीस लेनला लागून असलेल्या सर्वात डाव्याकडील लेन मधून प्रवास करणे तसेच केवळ पुढील वाहनांस ओलांडतांना (ओव्हरटेक) उजवीकडील लेनचा अवलंब करून इतर वेळी उजवीकडील लेन कायम रिकामी ठेवणे आवश्यक आहे. असे असून सुद्धा आमच्या असे निदर्शनास आले की, पहिली लेन ही ओव्हरटेक करीता असून बरीच वाहने पहिल्या लेन मधून प्रवास करताना आवश्यक असणाया विहित गतीचा (ताशी ८० कि.मी.) वापर न करता त्यापेक्षा कमी गतीने वाहने चालवितात. त्यामुळे पाठीमागून येणाया चालकांना वाहन चालविण्यास अडथळा निर्माण होऊन अपघात होण्याची दाट शक्यता नाकारता येत नाही;

ज्याअर्थी, उक्त द्रूतगती मार्गावर अपघाताचे प्रमाण टाळण्यासाठी, वाहतुकीची कोंडी टाळण्यासाठी, तसेच लेनच्या शिस्तीचे पालन करणे यासाठी प्रस्तावित उपाययोजना करणे आवश्यक आहे. त्यासाठी मोटार वाहन कायद्यातील उपरोक्त अनुक्रमांक १ व २ च्या तरतुदीनुसार अधिसूचना जारी करणे आवश्यक आहे अशी माझी खात्री झाली आहे.

त्याअर्थी, मी, आर. के. पद्मनाभन, अपर पोलीस महासंचालक (वाहतूक), महाराष्ट्र राज्य, मुंबई याद्वारे शासन अधिसूचना क्र.एम.व्ही.ए. ०५८९/सीआर-१०६१/टीआरए-२, दिनांक १९ मे १९९० Addendum दिनांक ३० सप्टेंबर २००२ नुसार मोटार वाहन कायदा, १९८८ चे कलम ११५ अन्वये प्रदान केलेल्या अधिकाराचा वापर करून रायगड व पुणे जिल्ह्यच्या हद्दीमध्ये यशवंतराव चव्हाण, मुंबई-पुणे/पुणे-मुंबई द्रूतगती मार्गावर उजवीकडील लेन ओव्हर टेकींगसाठी राखीव असल्यामुळे पहिल्या लेनमधून प्रवास करताना विहित गतीपेक्षा कमी गतीने वाहन चालविण्यास मनाई करण्यात येत आहे यासाठी अधिसूचना जारी करीत आहे.

(१) उक्त निबर्ंधातून अत्यावश्यक सेवा वाहने/रूग्णवाहिका/अग्निशमक वाहने/पोलीस व शासकीय वाहने यांना वगळण्यात येत आहे.

(२) उक्त नमूद केलेप्रमाणे उजवी लेन ही हलक्या वाहनांच्या ओव्हर टेकिंगसाठी राखीव असून कमी गतीने वाहन चालविण्यास मनाई असलेबाबत टोल तिकीटावर 'अटी व शर्ती' म्हणून लेखी स्वरूपात नमूद करावी, तसेच अशा आशयाचे बोर्ड, चिन्हे, फलक, सूचना व तत्सम योग्य ठिकाणी लावणेबाबतची अंमलबजावणी महाराष्ट्र राज्य रस्ते विकास महामंडळ यांनी करावी.

(३) सदरची अधिसूचना आज दिनांक १९ मार्च २०१८ रोजी माझ्या सही व शिक्यानिशी निर्गमित करण्यात येत आहे.

(४) सदरची अधिसूचना जाहीर केल्या तारखेपासून पुढील आदेशापयर्ंत लागू राहील.

क्रमांक पतसंस्था/स.आ.५/का.क.१५६/लेण्याद्री सह पत/२०१८/६९२.-------- महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६ (१) अन्वये मला प्रदान करण्यात आलेल्या शक्तीचा वापर करून मी, डॉ. पी. एल. खंडागळे, अपर निबंधक, सहकारी संस्था (पतसंस्था), महाराष्ट्र राज्य, पुणे या आदेशान्वये लेण्याद्री सहकारी पतपेढी मर्यादित, मुंबई या संस्थेच्या खालील अधिकायांस त्यांच्या नावापुढे दर्शविलेल्या कार्यक्षेत्रासाठी महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १०१ व कलम ९१ अन्वये प्राप्त झालेल्या वसुली प्रमाणपत्राची अंमलबजावणी/कर्ज वसुली करण्याकरिता महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६ (१) व नियम १०७ अनुसार मालमत्ता जप्त करून व तिची विक्री करून रकमा वसूल करण्याचे निबंधकाचे अधिकार, खालील अटींस अधीन राहून या आदेशाच्या दिनांकापासून ते दिनांक ३१ मार्च २०१९ या कालावधीकरिता प्रदान करीत आहे :—

(१) वसुली अधिकारी यांनी महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६ व नियम, १९६१ चे नियम १०७ मधील तरतुदीनुसार कर्ज वसुलीची कार्यवाही करावी. कर्ज वसुली करताना सहकार कायदा, नियम यातील तरतुदी व परिपत्रकीय सूचनांचे पालन न केल्याचे निदर्शनास आल्यास, आवश्यक ती चौकशी करून आवश्यकता भासल्यास, सदरचे प्रदान केलेले अधिकार तत्काळ काढून घेण्यात येतील.

(२) सदरचे अधिकार सहकार कायदा कलम १०१ व ९१ अन्वये प्राप्त वसुली दाखल्याची अंमलबजावणी करण्याकरिता असतील.

(३) वसुली अधिकारी यांनी दर माह सोबत जोडलेल्या विहित नमुन्यात प्रपत्र १,२,३,४ व ५ प्रमाणे कार्यवाही करावी. तसेच कर्ज वसुलीची माहिती संबंधित जिल्हा उप निबंधक, सहकारी संस्था यांचे कार्यालयास सादर करावी. ज्या सहकारी संस्थेचे कार्यक्षेत्र विभाग, दोन विभाग अथवा राज्य कार्यक्षेत्र आहे त्या संस्थांनी देखील त्यांचे मुख्य कार्यालय ज्या जिल्ह्यमध्ये आहे त्या जिल्हा उप निबंधक यांचे कार्यालयास माहिती सादर करावी.

(४) अधिकार प्रदान केलेल्या वसुली अधिकारी असलेल्या व्यक्तीची बदली झाल्यास किंवा सेवानिवृत्ती झाल्यास किंवा सेवेतून काढून टाकल्यास किंवा त्याचा मृत्यू झाल्यास, अशा अधिकायास प्रदान केलेले अधिकार आपोआप रद्द होतील.

(५) वसुली अधिकारी यांनी वसूल केलेल्या संपूर्ण सरचार्ज रकमेचा भरणा वसूल केलेल्या महिन्यातच चलनाने शासकीय कोषागारात करावा. वसुली अधिकारी यांनी वसूल केलेला सरचार्ज, त्याचा शासकीय कोषागारात केलेला भरणा याबाबत संस्था स्तरावर स्वतंत्र नोंदवही ठेवण्यात यावी त्याबाबतचा नमुना प्रपत्र १,२,३,४ व ५ सोबत जोडलेला आहे.

(६) मा. उच्च न्यायालय, मुंबई यांनी रिट याचिका क्रमांक १९४२/२०१३, दि बेसिन कॅथोलिक को-ऑप. बँक विरुद्ध महाराष्ट्र राज्य व इतर या याचिकेमध्ये दिनांक ५ डिसेंबर २०१५ रोजी दिलेला आदेश विचारात घेऊन वसुलीची कार्यवाही करताना महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ अन्वये प्राप्त असलेल्या अधिकारानुसारच वसुलीची कार्यवाही करावी.

(७) वसुली अधिकारी यांनी नमूद केलेल्या कालावधीत वसुलीचे कामकाज समाधानकारक केले नसल्याचे निदर्शनास आल्यास किंवा प्रदान केलेल्या अधिकाराचा गैरवापर करीत असल्याचे निदर्शनास आल्यास, प्रदान केलेले अधिकार काढून घेतले जातील व भविष्यात असे कोणतेही अधिकार अशा व्यक्तीस प्रदान करण्यात येणार नाहीत.

(८) शासन निर्णय क्रमांक संकीर्ण-१५०४/प्र.क्र.२३१/१५-स, दिनांक २३ नोव्हेंबर २००६ अन्वये वसुली अधिकायांना तीन सिंहाच्या राजमुद्रेचा वापर करता येणार नाही.

(९) वसुली अधिकायास त्याच्या नावापुढे कोठेही ""महाराष्ट्र शासन नियुक्त"" आणि किंवा "" सिव्हील कोर्ट"", ""एक्झीक्युटीव्ह कोर्ट"" या शब्दांचा अथवा तत्सम शब्दांचा वापर करता येणार नाही. त्याऐवजी वसुली अधिकायंानी त्यांच्या नावापुढे ""वसुली अधिकारी (महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ चे नियम १०७ अन्वये)"" असे लिहावे.

(१०) वसुली अधिकायास वसुलीसाठी वापर करण्यात येणाया वाहनावर ""वसुली अधिकारी, लेण्याद्री सहकारी पतपेढी मर्यादित, मुंबई "" असा फलक लावता येऊ शकेल.

(११) वसुली अधिकायाने पगार जप्तीची कार्यवाही करताना कर्जदाराच्या/जामीनदाराच्या पगार कपातीबाबत राष्ट्रीयीकृत बँका वा अन्य बँका यांचेकडे परस्पर वेतन कपातीचा आदेश देऊन परस्पर पगार कपात करता येणार नाही. संबंधित कर्जदार/जामीनदार ज्या आस्थापनेवर काम करीत आहे त्या आस्थापनेवरील आहरण व संवितरण अधिकारी/पगार करणारा अधिकारी यांचेमार्फत पगारातून कर्ज वसूल करण्याची कार्यवाही करावी.

(१२) वसुली अधिकायास, थकबाकीदाराकडून वसुली दाखल्यानुसार वसूलपात्र रक्कम व सरचार्ज रक्कम याशिवाय इतर कोणतीही रक्कम वसूल करता येणार नाही.

(१३) वसुली अधिकायाने या कार्यालयाच्या दिनांक १ जानेवारी २०१७ च्या परिपत्रकातील सूचनांची काटेकोरपणे अंमलबजावणी करणेची आहे. सदर परिपत्रकातील सूचनांचे उल्लंघन झाल्यास, वसुलीचे अधिकार काढून घेण्यात येऊन भविष्यकाळात असे अधिकार प्रदान केले जाणार नाहीत याची नोंद घ्यावी.

(१४) संस्थेने या कार्यालयाच्या दिनांक ६ नोव्हेंबर १९८५ च्या आदेशानुसार सरचार्ज आकारणी करून ती संबंधितांकडून वसूल करून शासन कोषागारात तात्काळ भरणा करावी. संस्थेकडे थकीत असलेली व शासनास यापूर्वी भरणा न केलेली सरचार्जची संपूर्ण रक्कम भरण्याची जबाबदारी संस्थेच्या संचालक मंडळाची व व्यवस्थापकांची वैयक्तिकरित्या राहील याची नोंद घेऊन तातडीने वसूल सरचार्ज शासकीय कोषागारात भरणा करावा.

(३) वसुली अधिकारी यांनी दर माह विहित नमुन्यात "अ-३", "अ-४" व "ब" कर्ज वसुलीची माहिती संबंधित जिल्हा उप निबंधक, सहकारी संस्था यांचे कार्यालयास सादर करावी. ज्या सहकारी संस्थेचे कार्यक्षेत्र विभाग, दोन विभाग अथवा राज्य कार्यक्षेत्र आहे त्या संस्थांनी देखील त्यांचे मुख्य कार्यालय ज्या जिल्ह्यमध्ये आहे त्या जिल्हा उप निबंधक यांचे कार्यालयास माहिती सादर करावी.

(४) अधिकार प्रदान केलेल्या वसुली अधिकारी असलेल्या व्यक्तीची बदली झाल्यास किंवा सेवानिवृत्ती झाल्यास किंवा सेवेतून काढून टाकल्यास किंवा त्याचा मृत्यू झाल्यास, अशा अधिकायास प्रदान केलेले अधिकार आपोआप रद्द होतील.

(५) वसुली अधिकारी यांनी वसूल केलेल्या संपूर्ण सरचार्ज रकमेचा भरणा वसूल केलेल्या महिन्यातच चलनाने शासकीय कोषागारात करावा. वसुली अधिकार यांनी वसूल केलेला सरचार्ज त्याचा शासकीय कोषागारात केलेला भरणा याबाबत संस्थास्तरावर स्वतंत्र नोंदवही ठेवण्यात यावी. त्याबाबतचा नमुना "अ-१", "अ-२", "अ-३", "अ-४" सोबत जोडलेला आहे.

(६) "" मा. उच्च न्यायालय, मुंबई यांनी रिट याचिका क्र.१९४२/२०१३, दि बेसिन कॅथोलिक को-ऑप. बँक विरुद्ध महाराष्ट्र राज्य व इतर"" या याचिकेमध्ये दिनांक ५ डिसेंबर २०१५ रोजी दिलेल्या आदेश विचारात घेऊन वसुलीची कार्यवाही करताना महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ अन्वये प्राप्त असलेल्या अधिकारानुसारच वसुलीची कार्यवाही करावी.

(७) वसुली अधिकारी यांनी नमूद केलेल्या कालावधीत वसुलीचे कामकाज समाधानकारक केले नसल्याचे निदर्शनास आल्यास किंवा प्रदान केलेल्या अधिकाराचा गैरवापर करीत असल्याचे निदर्शनास आल्यास, प्रदान केलेले अधिकार काढून घेतले जातील व भविष्यात असे कोणतेही अधिकार अशा व्यक्तीस प्रदान करण्यात येणार नाहीत.

(८) शासन निर्णय क्रमांक संकिर्ण-१५०४/प्र.क्र.२३१/१५-स, दिनांक २३ नोव्हेंबर २००६ अन्वये वसुली अधिकायांना तीन सिंहाच्या राजमुद्रेचा वापर करता येणार नाही.

(९) वसुली अधिकायास त्याच्या नावापुढे कोठेही " महाराष्ट्र शासन नियुक्त " आणि किंवा " सिव्हील कोर्ट ", " एक्झीक्युटीव्ह कोर्ट " या शब्दांचा अथवा तत्सम शब्दांचा वापर करता येणार नाही. त्याऐवजी वसुली अधिकायांनी त्यांच्या नावापुढे " वसुली अधिकारी (महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ चे नियम १०७ अन्वये)" असे लिहावे.

(१०) वसुली अधिकायास वसुलीसाठी वापर करण्यात येणाया वाहनावर "वसुली अधिकारी ....................... सहकारी बँक/ पतसंस्था .................... " असा फलक लावता येऊ शकेल.

(११) वसुली अधिकायाने पगार जप्तीची कार्यवाही करताना कर्जदाराच्या/जामीनदाराच्या पगार कपातीबाबत राष्ट्रीयीकृत बँका वा अन्य बँका यांच्याकडे परस्पर वेतन कपातीचा आदेश देऊन परस्पर पगार कपात करता येणार नाही. संबंधित कर्जदार/जामीनदार ज्या आस्थापनेवर काम करीत आहे त्या आस्थापनेवरील आहरण व संवितरण अधिकारी/पगार करणारा अधिकारी यांचेमार्फत पगारातून कर्ज वसूल करण्याची कार्यवाही करावी.

(१२) वसुली अधिकायास, थकबाकीदाराकडून वसुली दाखल्यानुसार वसूलपात्र रक्कम व सरचार्ज रक्कम याशिवाय इतर कोणतीही रक्कम वसूल करता येणार नाही.

(१३) या आदेशाआधारे कर्ज वसुलीचे अनुषंगाने पत्रव्यवहार करताना या आदेशाचा संदर्भ पत्रामध्ये नमूद करावा.

(६) "" मा. उच्च न्यायालय, मुंबई यांनी रिट याचिका क्र.१९४२/२०१३, दि बेसिन कॅथोलिक को-ऑप. बँक विरुद्ध महाराष्ट्र राज्य व इतर"" या याचिकेमध्ये दिनांक ५ डिसेंबर २०१५ रोजी दिलेल्या आदेश विचारात घेऊन वसुलीची कार्यवाही करताना महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ अन्वये प्राप्त असलेल्या अधिकारानुसारच वसुलीची कार्यवाही करावी.

(७) वसुली अधिकारी यांनी नमूद केलेल्या कालावधीत वसुलीचे कामकाज समाधानकारक केले नसल्याचे निदर्शनास आल्यास किंवा प्रदान केलेल्या अधिकाराचा गैरवापर करीत असल्याचे निदर्शनास आल्यास, प्रदान केलेले अधिकार काढून घेतले जातील व भविष्यात असे कोणतेही अधिकार अशा व्यक्तीस प्रदान करण्यात येणार नाहीत. भाग एक (म.उ.वि.)--२१० महाराष्ट्र शासन राजपत्र, भाग एक--मध्य उप-विभाग, गुुरुवार ते बुधवार, मे १०-१६, २०१८/वैशाख २०-२६, शके १९४० (८) शासन निर्णय क्रमांक संकिर्ण १५०४/प्र.क्र.२३१/१५-स, दिनांक २३ नोव्हेंबर, २००६ अन्वये वसुली अधिकायांना तीन सिंहाच्या राजमुद्रेचा वापर करता येणार नाही.

(९) वसुली अधिकायास त्याच्या नावापुढे कोठेही " महाराष्ट्र शासन नियुक्त " आणि किंवा " सिव्हील कोर्ट ", " एक्झीक्युटीव्ह कोर्ट " या शब्दांचा अथवा तत्सम शब्दांचा वापर करता येणार नाही. त्याऐवजी वसुली अधिकायांनी त्यांच्या नावापुढे " वसुली अधिकारी (महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ चे नियम १०७ अन्वये)" असे लिहावे.

(१०) वसुली अधिकायास वसुलीसाठी वापर करण्यात येणाया वाहनावर "वसुली अधिकारी ....................... सहकारी बँक/ पतसंस्था .................... " असा फलक लावता येऊ शकेल.

(११) वसुली अधिकायाने पगार जप्तीची कार्यवाही करताना कर्जदाराच्या/जामीनदाराच्या पगार कपातीबाबत राष्ट्रीयीकृत बँका वा अन्य बँका यांच्याकडे परस्पर वेतन कपातीचा आदेश देऊन परस्पर पगार कपात करता येणार नाही. संबंधित कर्जदार/जामीनदार ज्या आस्थापनेवर काम करीत आहे त्या आस्थापनेवरील आहरण व संवितरण अधिकारी/पगार करणारा अधिकारी यांचेमार्फत पगारातून कर्ज वसूल करण्याची कार्यवाही करावी.

(१२) वसुली अधिकायास, थकबाकीदाराकडून वसुली दाखल्यानुसार वसूलपात्र रक्कम व सरचार्ज रक्कम याशिवाय इतर कोणतीही रक्कम वसूल करता येणार नाही.

(१३) या आदेशाआधारे कर्ज वसुलीचे अनुषंगाने पत्रव्यवहार करताना या आदेशाचा संदर्भ पत्रामध्ये नमूद करावा.

तसेच असाही आदेश देतो की, महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १७ (२) मधील तरतुदीनुसार संपत्ती हस्तांतरण अधिनियम, १८८२ किंवा भारतीय नोंदणी अधिनियम, १९०८ यात काहीही अंतभर्ूत असेल तरी, सदर बँकेचे रुपांतर करण्यात आल्यामुळे याबाबत सदर बँकेचा याबाबतचा ठराव प्रत्येक बाबतीत, मूळ बँकेची मत्ता व दायित्वे रुपांतरित पतसंस्थेमध्ये निहित होण्याबाबतचे पुरेसे अभिहस्तांतरणपत्र असेल. तसेच कलम १७(३) मधील तरतुदीनुसार सदर बँकेचे रुपांतरामुळे अशा रीतीने रूपांतर केलेल्या बँकेचे कोणतेही हक्क किंवा बंधन यावर परिणाम होणार नाही किंवा रुपांतर करण्यात आलेल्या बँकेकडून किंवा बँकेविरुद्ध जी न्यायिक कार्यवाही चालू ठेवण्यात किंवा सुरू करण्यात आली असेल अशी कोणतीही न्यायिक कार्यवाही सदोष ठरणार नाही आणि तद्नुसार अशी न्यायिक कार्यवाही रुपांतरीत पतसंस्थेस किंवा अशा पतसंस्थेविरूद्ध चालू ठेवता येईल किंवा सुरू करता येईल.

संपत्ती हस्तांतरण अधिनियम, १९८२ किंवा भारतीय नोंदणी अधिनियम, १९०८ यात काहीही अंतभर्ुत असले तरी, विलिनीकरणाशी संबंधित असलेल्या संस्थांचा ठराव प्रत्येक बाबतीत, मुळ संस्थेची किंवा विलीनीकरण केलेल्या संस्थांची मत्ता व दायित्वे नव्या संस्थेत किंवा यथास्थिची रुपांतरीत किंवा विलीनीकरण संस्थेमध्ये निहीत होण्याबाबतचे पुरेसे अभिहस्तांतरणपत्र असेल.

संस्थांचे एकत्रीकरण केल्यामुळे, एकत्रीकरण केलेल्या संस्थांचे कोणतेही हक्क किंवा बंधन यावर परिणाम होणार नाही. एकत्रीकरण संस्थांकडून किंवा संस्थांविरूद्ध जी न्यायिक कार्यवाही चालू ठेवण्यात किंवा सुरू करण्यात आली असेल अशी कोणतीही न्यायिक कार्यवाही सदोष ठरणार नाही, न्यायिक कार्यवाही एकत्रीकरण संस्थेस किंवा संस्थेविरूद्ध चालू ठेवता येईल.
