BY COMPETENT AUTHORITY, NAGPUR MUNICIPAL CORPORATION No. 363-Slum-2018.—
Whereas, the Maharashtra Slum Area (Improvement, Clearance and Re-Development) Act, 1971 has come into force with effect from 3rd day of September, 1971, in the areas within the limits of the Corporation in the City of Nagpur, vide Government Notification of Urban Development, Public Health and Housing Department No. SCA-1571-35325-F-III, dated 3rd September 1971.
And whereas, in exercise of the powers conferred by the sub-section (1) of Section 3 of the Maharashtra Slum Area (improvement, Clearance and Re-Development) Act, 1971 (Mah. XXXVIII of 1971) the Government of Maharashtra has appointed the Executive Engineer (Slum), Nagpur Municipal Corporation as a Competent Authority for Lands belonging to Nagpur Municpal Corporation and Lands belonging to Nagpur Improvement Trust, State Government, Private lands, Abadi lands, Nazul land etc. within limits of Nagpur Municipal Corporation vide Notification on dated 23rd April 2015.
And whereas, I, D. D. Jambhulkar on being appointed as the Competent Authority, I am satisfied that the area specified in the schedule hereto (hereinafter referred to as "the said area") is a source of danger to the health safety or convenience of the public of that area and its neighborhood by reason of the area being overcrowded and lacking in basic amenities have rendered insanitary, squalid or otherwise.
Now, therefore, in exercise of the powers conferred on, me under sub-section (b) (II) of Section 4 of Maharashtra Slum Area (Improvement, Clearance and Re-Development) Act, 1971, declare the said area to be slum area. The map of the area can be inspected at the Office of the Nagpur Municipal Corporation, Nagpur.

1. Public Latrines, single or grouped;
2. Water Mains branches and Public water stand posts;
3. Sewer lines, waste water drains, storm water drains;
4. Widening and re-aligning and paving of existing lanes, roads and pathways and constructing new roads, pathways and lanes;
5. Demolition of dilapidated and obstructive buildings.
6. Street Light poles.
Any person aggrieved by the above said declaration of slum improvement areas may appeal to Tribunal located at Griha Nirman Bhavan, Kala Nagar, Bandra (East), Bombay- 51, within 30 days from the date of declaration of Gazette Notification.

NOTIFICATION UNDER SECTION-20 (4) MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966. .—

Whereas, the Revised Regional Plan of Nagpur Region (hereinafter referred to as "the said Regional Plan") has been sanctioned by the Government vide Urban Development Department's Notification No. TPS-2496-1505-CR-273/96/UD-9, dated 6th May, 2000 under Section 15 of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") and has come into force with effect from 15th July, 2000;
And whereas, the Government vide Resolution No. T.P.S. 1815-CR-49-15-UD-13, dated 6th May, 2015 has issued directives under Section 154 of the Maharashtra Regional and Town Planning Act, 1966 regarding the procedure to be followed under Section 20 of the said Act for making changes in the use of land in the areas of sanctioned Regional Plans under the said Act;
And whereas, land admeasuring about 20.00 Hectare out of total Government land 66.21 Hectare bearing Kh. No. 31 of Mouja-Dudhburdi, Tal. Kalmeshwar, District Nagpur (hereinafter referred to as "the said area") is included in "Forest Zone" in the sanctioned Regional Plan of Nagpur;

and whereas, the Government is of the opinion that it is necessary to delete the said land from notified area of Mouza- Dudhburdi Taluka Kalmeshwar, Dist Nagpur, bearing Survey No. 31 admeasuring 20.00 Hectare out of 66.21 Hectare and to change the allocation of the said Lands, from "Forest" Zone to "Public/Semi Public Zone"; and accordingly to modify the said Regional Plan as per provisions of sub-section (2) of Section 20 of the said Act, (hereinafter referred to as " the proposed Modification")
And whereas, in pursuant to the above, a notice bearing No. TPS-2415/70/CR-173/15/UD-9/Dt. 4th January 2016, regarding the proposed modification under sub-section (3) of the Section 20 of the said Act, was published which appeared in the Maharashtra Government Official Gazette, Part-I-A Nagpur Division Supplement dated 3rd May 2018 on pages No. 1 to 4 Sr. No. 66, for inviting suggestions and /or objections from the general public and the concerned Asst. Director of Town Planning, of the respective Branch was authorised as the 'Officer' (hereinafter referred to as the "said Officer") by the Government to here suggestions and / or objections.
And whereas, after considering the report submitted by the said Officer, no suggestions or objections were received from WCL, forest Deprtment and general Public with respect to modification & opinion received from WCL, forest Department and gernal Public with respect to modification & opinion received from Director Town Planning, Maharashtra State, Pune, Dated 22-6-2018 ; and said land is to be used for research work in agriculture for modernization of agriculture, in large public interest, "Proposal Scrutiny and Sanction Committee" is of the opinion that the said land, should be deleted from "Forest Zone" and be included in "Public/Semipublic Zone" ;
Now therefore, in exercise of the powers under sub-section (4) of Section 20 of the said Act, delegated to him by the Government, Joint Director of Town Planning, Nagpur Division Nagpur hereby sanctions the proposed modification and for that purpose directs that in the Schedule of Modifications appended to the Notification dated the 6th May 2000 sanctioning the said Regional Plan, after the last entry, the following new entry shall be added;

MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.
No. TPS-2217-741-CR-359-UD-9-2017.—
Whereas, the Government has sanctioned the Revised Development Plan of Warora Municipal Council vide Urban Development Department's Notification No. TPS-2212-521(N)-57-C.R.102(A)-UD-9, Dated 28-12-2012 under sub-section (1) of Section 31 of the Maharashtra Regional and Town Planning Act, 1966 (Mah.XXXVII of 1966) (hereinafter referred to as 'the said Act') which came into force with effect from the 27-1-2013 and excluded part of the Revised Development Plan has been sanctioned by the Government vide Urban Development Department's Notification No. TPS-2212-521(N)-57-CR-102-UD-9, dated 3-1-2015 (hereinafter referred to as " the said Development Plan ") ;
And whereas, in the said Development Plan, land bearing Survey No. 283/2, 283/3, 283/4 and 284 (part) admeasuring area 0.84 Hectare of Mauje Khanji is reserved Site No. 03 High School and Play Ground (hereinafter referred to as " the said Reservation ") ;
And whereas, the Warora Municipal Council (hereinafter referred to as " the said Planning Authority"), vide its General Body Resolution No. 14, Dated 14-09-2016 has resolved to delete the said Reservation and to include the same in Residential Zone and accordingly submitted to the Government, for its sanction, a modification proposal as per the provisions of sub section (1) of Section 37 of the said Act, (hereinafter referred to as " the Proposed Modification ") ;
८ द्धन्रु]क्ष् रू न् ॅ-+ न् ह्यम््र ान्म््र, +रू]क्ष् २-८, २०१८/रम् ११-१७, ॅ १९४०And whereas, after making necessary enquiries and consulting the Director of town Planning, Maharashtra State, Pune, the Government is of opinion that the proposed Modification should be sanctioned with some conditions ;
And whereas, the Land Owners of the land bearing Survey No. 283/2, 283/3, 283/4 and 284(part) said lands have deposited Rs. 1,76,400 towards the 50% Government share of 5% premium amount as per the rate of the said lands as prescribed in the Annual Statement of Rates (ASR) for the year 2018-19 in the Government Treasury on 19-6-2018 through the Town Planner, Chandrapur Branch, Chandrapur and remaining 50% of the 5% premium amount Rs. 1,76,400 payable to the Planning Authority has been deposited with the Chief Officer, Warora Municipal Council on 19-6-2018 ;
Now therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of the said Act, the Government hereby, sanctions the Proposed Modification and for that purpose amends the aforesaid Notification dated the 28-12-2012 as follows ;
" In the Schedule of Modifications appended to the Notification dated 28-12-2012 sanctioning the said Develop- ment Plan, the following new entry shall be added after the last entry.—
ENTRY
The land bearing Survey Nos. 283/2, 283/3, 283/4 and 284(part) admeasuring about 0.84 Hectare of Mauze Khanji is deleted from Site No. 03 High School and Play Ground and is included in Residential Zone as shown on the plan, subject to the conditions mentioned specified below—
Condition No. 1.— In addition to open space, necessary Amenity Space shall be provided in the layout of the said Land as per the prevailing Development Control Regulations of Warora.
Condition No. 2.— It is binding on the land owner / developer, to provide all Basic Amenities required for the land at his own cost."
A copy of the Notification, along with the part plan showing the aforesaid sanctioned modification, shall be available for inspection of the general public, in the office of the Chief Officer, Warora Municipal Council during office hours on all working days for a period of one month.
