मोटार वाहन अधिनियम, १९८८.

क्रमांक एमसीटी. ०७१८/प्र. क्र. १५४/परिवहन-५.----- ज्याअर्थी, मोटार वाहन अधिनियम, १९८८ (१९८८ चा ५९) याच्या कलम (१) व (२) द्वारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून, मोटार वाहनांच्या वापरामुळे झालेल्या व्यक्तीचा मृत्यू किंवा त्यांना झालेली शारीरिक इजा किंवा त्यामुळे झालेल्या तिसया पक्षाच्या कोणत्याही मालमत्तेचे नुकसान किंवा दोन्हीही यांचा अंतर्भाव असणाया अपघाताच्या संबंधातील नुकसान भरपाईसाठीच्या दाव्यावर अभिनिर्णय करण्याच्या प्रयोजनासाठी बृहन्मुंबई महानगर पालिकेच्या हद्दीत समाविष्ट असलेल्या क्षेत्रासाठी एकूण आठ, नागपूर येथे एकूण चार, पुणे व ठाणे येथे प्रत्येकी एक अशी एकूण १४ मोटार अपघात दावा न्यायाधिकरणे गठित करण्यात आली आहेत.

त्याअर्थी, आता, मोटार वाहन अधिनियम, १९८८ (१९८८ चा ५९) च्या कलम १६५ अन्वये प्रदान करण्यात आलेल्या अधिकारांचा वापर करून व त्याखाली तयार करण्यात आलेल्या नियमान्वये महाराष्ट्र शासन याद्वारे श्रीमती संध्या द्वारकानाथ रायकर, प्रधान जिल्हा व सत्र न्यायाधीश, वर्धा यांची अध्यक्ष, मोटार अपघात दावा न्यायाधिकरण, मुंबई आणि पिठासीन अधिकारी, राज्य परिवहन अपील न्यायाधिकरण, महाराष्ट्र राज्य, मुंबई म्हणून त्यांनी पदभार स्वीकारल्यापासून त्यांच्या वयाची ६० वर्षे पूर्ण होईपयर्ंत किंवा शासनाचे पुढील आदेश होईपयर्ंत यापैकी जे अगोदर घडेल तोपयर्ंत नियुक्ती करीत आहे.

NOTIFICATION

MOTOR VEHICLE ACT, 1988.

No. MCT. 0718/CR-154/Transport-5.—Whereas, in exercise of the powers conferred by sub-section (1) and (2) of section 165 of the Motor Vehicle Act, 1988 (59 of 1988), the Government of Maharashtra has constituted 8 Motor Accident Claims Tribunals for the area comprised within the limits of the Municipal Corporation of Brihan Mumbai, 4 Motor Accident Claims Tribunals for Nagpur and 1 Motor Accident Claims Tribunal at Pune and Thane each, total 14 number of Motor Accident Claims Tribunals for the purpose of adjudicating upon the claims for compensation in respect of accident involving the death or bodily injury to person arising out of the use of motor vehicles of damages to any property of third party so arising of both.

Now, therefore, in exercise of the powers conferred by section 165 of the Motor Vehicles Act,1988 (59 of 1988), and rules framed under this, the Government of Maharashtra hereby appoints Smt. Sandhya Dwarkanath Raikar, Principal District and Session Judge, Wardha as Chairman, Motor Accident Claims Tribunal, Mumbai and Presiding Officer of the State Transport Appellate Tribunal, Maharashtra State, Mumbai with effect from the date he assumes charge upto the age of 60 years or until further orders of Government whichever is earlier.
