महाराष्ट्र जमीन महसूल संहिता, १९६६.
क्रमांक जमीन २०१५/प्र.क्र.५५/ज-१.---महाराष्ट्र जमीन महसूल संहिता, १९६६ (१९६६ महा. ४१) च्या कलम ३२८, च्या पोट-कलम (१) आणि पोट- कलम (२) च्या खंड (चार),(दहा), (चौदा) आणि (त्रेसष्ठ) अन्वये प्रदान करण्यात आलेल्या अधिकारांचा व त्याबाबत समर्थ करणाया इतर सर्व अधिकारांचा वापर करून " महाराष्ट्र जमीन महसूल (सरकारी जमिनीची विल्हेवाट करणे) नियम, १९७१ " यामध्ये सुधारणा करण्यासाठी जे नियम करण्याचे योजले आहे, त्या नियमांचा पुढील मसूदा उक्त संहितेच्या कलम ३२९, पोट-कलम (१) द्वारे आवश्यक असल्याप्रमाणे त्याद्वारे बाधा पोहचण्याचा संभव असलेल्या सर्व व्यींच्या माहितीसाठी त्याद्वारे प्रसिद्ध करण्यात येत आहे आणि अशी नोटीस देण्यात येत आहे की, उक्त मसूदा दिनांक १३ सप्टेंबर, २०१८ किंवा त्यानंतर महाराष्ट्र शासन विचारात घेईल.
२. महाराष्ट्र शासनाचे अपर मुख्य सचिव (महसूल), महसूल व वन विभाग, मादाम कामा मार्ग, हुतात्मा राजगुरू चौक, मंत्रालय, मुंबई ४०० ०३२, यांचेकडे वरील दिनांकापूर्वी उ मसुद्याच्या संबंधात कोणत्याही व्यींकडून येणाया / प्राप्त होणाया हरकती व सूचना शासनाकडून विचारात घेण्यात येतील.
नियमांचा मसुदा
१. या नियमांना, " महाराष्ट्र जमीन महसूल (सरकारी जमिनीची विल्हेवाट करणे) (तिसरी सुधारणा) नियम, २०१८ " असे म्हणावे.
२. महाराष्ट्र जमीन महसूल (सरकारी जमिनींची विल्हेवाट करणे) नियम, १९७१ च्या नियम ६ च्या पोट-नियम (३) मध्ये,—
(i) खंड (ब) मधील " विभागास महसूल मुक्त व सारामाफीने " या शब्दानंतर " किंवा शासनाने अन्यथा विवक्षितपणे विर्िनदिष्ट केलेले असल्यास त्यानुसार " हे शब्द समाविष्ट करण्यात येत आहेत;
(ii) खंड (ब) खाली पुढीलप्रमाणे परंतुक समाविष्ट करण्यात येत आहे :—
" तथापि, अशा प्रकल्पास रितसर मान्यता प्रदान करताना, जर शासनाने शासकीय जमीन प्रदान करण्याकरिता शासकीय यंत्रणा नामनिर्देशित केली असेल, व त्याकरिता शासकीय जमीन प्रदानाच्या काही विवक्षित अटी/शर्ती विहीत केल्या असतील, तर अशा

भाग चार--ब--२९७---१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, ऑगस्ट १३, २०१८/श्रावण २२, शके १९४० जमिनीचे भोगवटामुल्य कितीही असले तरी, जिल्हाधिकारी अशा अटी व शर्तीप्रमाणे अशी शासकीय जमीन राज्य शासनाने नामनिर्देशित शासकीय यंत्रणेस उक्त प्रकल्पासाठी प्रदान करण्यास सक्षम असतील. "
३. या मुख्य नियमांच्या सोबत जोडलेल्या नमुना एक-अ मध्ये,---
(i) शिर्षकामध्ये " समुचित प्राधिकरण " या शब्दानंतर " किंवा शासकीय यंत्रणा " या शब्दांचा समावेश करण्यात यावा.
(ii) दुसया परिच्छेदातील " समुचित प्राधिकरण " या शब्दानंतर " किंवा शासकीय यंत्रणा " या शब्दांंचा समावेश करण्यात यावा.
(iii) चौथ्या परिच्छेदातील " राज्य शासनाच्या प्रशासकीय विभागास " या शब्दानंतर " किंवा शासकीय यंत्रणा यांना शासनाने अन्यथा विवक्षितपणे विनिर्दीष्ट केलेले असल्यास ---------- {{^{{FOOTNOTE *}}}} ------------- (याठिकाणी ज्या आदेशात जमीन प्रदान विषयक ज्या अटी व शर्ती नमुद केलेल्या असतील त्या आदेशाचा तपशील देण्यात यावा.) त्यानुसार " या शब्दांचा समावेश करण्यात यावा.

NOTIFICATION
MAHARASHTRA LAND REVENUE CODE, 1966.
No. Jamin-2015/C.R.55 /J-1.—The following draft of rules further to amend the Maharashtra Land Revenue (Disposal of Government Lands) Rules, 1971, which the Government of Maharashtra, proposes to make in exercise of the powers conferred by sub-section (1) and clause (iv),(x),(xiv) (lxiii) of sub- section (2) of section 328 of the Maharashtra Land Revenue Code, 1966 ( Mah. XLI of 1966) and all other powers enabling it in that behalf, is hereby published as required by sub-section (1) of section 329 of the said Code, for the information of all persons likely to be affected thereby; and notice is hereby given that the said draft will be taken into consideration by the Government of Maharashtra on or after 13th September, 2018.
2. Any objection or suggestion, which may be received by the Additional Chief Secretary to the Government of Maharashtra, (Revenue) Revenue and Forests Department, Madam Cama Marg, Hutatma Rajguru Chowk, Mantralaya, Mumbai-400 032, from any person with respect to the said draft on or before the aforesaid date, will be considered by the Government.
DRAFT RULES
1. These rules may be called the Maharashtra Land Revenue (Disposal of Government Lands) (Third Amendment) Rules, 2018.
2. In rule 6 of the Maharashtra Land Revenue (Disposal of Government Lands) Rules, 1971,(hereinafter referred to as "the principal Rules"), in sub-rule (3),–
(i) in clause (b), after the words "free of land revenue", in the words "or on such terms, if any, as specified by the Government." shall be inserted;
(ii) after the clause (b) the following proviso shall be inserted, namely :–
" Provided that, if at the time of grant of administrative approval to such project, any government agency has been designated by the Government for grant of government land for such projects and terms and conditions of such grant of land have been specified by it, the Collector shall be competent to grant government land for such project to such designated government agency on such terms and conditions as specified by the Government."
3. In Form I-A appended to the principal Rules,—
(i) in the Heading, after the words "State Government" the words"/Government Agency" shall be inserted;
(ii) in second paragraph, after the words "State Government" the words "/Government Agency" shall be inserted;
(iii) in fourth paragraph, after the words "State Government Department" the words and brackets "/ on the terms and conditions specified by the Government in ——*—— (here specify the details of the document containing terms and conditions of grant of land)" shall be inserted.
