मुंबई बंदर विश्वस्तच्या विशेष नियोजन प्राधिकरणाच्या अधिक्षेत्रामध्ये महाराष्ट्र प्रादेशिक आणि नगररचना अधिनियम, १९६६

च्या कलम ५३(८) अन्वये पदनिर्देशित अधिकायाबाबतची सूचना.

No. CE.L/1-1(SPA)/3759.—ज्याअर्थी, महाराष्ट्र शासनाने, महाराष्ट्र प्रादेशिक आणि नगररचना अधिनियम, १९६६ (Mah. XXXVII of 1966), (येथून पुढे उक्त अधिनियम असे निर्देशित करण्यात येईल), च्या कलम ४० च्या उप-कलम (१) मधील खंड (ब) द्वारा प्रदान करण्यात आलेल्या अधिकारानुसार, महाराष्ट्र शासनाच्या नगरविकास विभागाच्या (नविवि) अधिसूचना क्रमांक टीपीबी.४३१७/ ४९२/प्र.क्र. २८९/२०१७/नवि-११, दिनांक २३ एप्रिल २०१८ अन्वये, प्रमुख बंदर कायदा, १९६३ अंतर्गत स्थापित करण्यात आलेल्या आणि नौवहन मंत्रालय, भारत सरकार यांच्या निर्देशनाखाली कार्यरत असणाया मुंबई बंदर विश्वस्त या संस्थेला [यापुढे ज्याचा उल्लेख विशेष नियोजन प्राधिकरण म्हणजेच वि.नि.प्रा. (SPA)] असा उल्लेख करण्यात येईल. ज्याच्या अखत्यारीतील मुंबई समुद्राच्या पूर्व किनारपट्टी नजीकच्या ९६६.३० हेक्टर क्षेत्रासाठी (ज्याचा उल्लेख यापुढे अधिसूचित क्षेत्र असा करण्यात येत आहे.) विशेष नियोजन प्राधिकरण म्हणून घोषित केलेले आहे ;

आणि ज्याअर्थी, उक्त अधिनियमाच्या कलम ५३(८) अन्वये ' नियोजन प्राधिकरण, राजपत्रातील अधिसूचनेद्वारे, या कलमान्वये आणि कलमे ५४, ५५ आणि ५६ अन्वये, नियोजन प्राधिकरणाच्या अधिकारांचा वापर करण्याच्या प्रयोजनासाठी पदनिर्देशित अधिकारी म्हणून, प्राधिकरणाच्या एखाद्या अधिकायास पदनिर्देशित करील. पदनिर्देशित अधिकायास अधिसूचनेमध्ये विर्िनदिष्ट केलेल्या अशा स्थानिक क्षेत्रावर अधिकारिता असेल आणि वेगवेगळ्या स्थानिक क्षेत्रांसाठी वेगवेगळे पदनिर्देशित करता येतील '.

आणि त्याअर्थी, विशेष नियोजन प्राधिकरणाने त्यांच्या दिनांक २ जुलै २०१८ च्या बैठकीमध्ये ठराव क्र. ८३ अन्वये खालील अधिकायांची उक्त अधिनियमाच्या कलमे ५३, ५४, ५५ आणि ५६ अंतर्गत असलेल्या अधिकारांचे प्रत्यायोजन करण्याबाबत नियुक्ती केलेली आहे :---

Notice

Delegation of Powers u/s 53(8) of the MR and TP Act, 1966 for the Jurisdiction of Mumbai

Port Trust as "Special Planning Authority".

No. CE.L/1-1(SPA)/3759.—Whereas, the Government of Maharashtra in exercise of the powers conferred under clause (b) of sub-section (1) of the Section 40 of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as " the said Act ") declared by Notification No.TPB.4317/492/CR-289/2017/UD-11, dated the 23rd April 2018 (hereinafter referred to as " the said Notification "), Mumbai Port Trust (being an organisation established under Major Port Trust Act, 1963 and controlled by Ministry of Shipping, Government of India), (hereinafter referred to as " Mumbai Port Trust ") as Special Planning Authority (hereinafter referred to as " the SPA ") for its area 966.30 Hectare along the Eastern Waterfront of Mumbai (hereinafter referred as "Said notified area") as specified therein;

And whereas, as per the section 53(8) of the said act "The Planning Authority shall, by notification

in the Official Gazette, designate an officer of the Planning Authority to be the "Designated Officer" for

the purpose of exercise of the power of the Planning Authority under this section and sections 54, 55 and

56. The designated Officer shall have jurisdiction over such local area as may be specified in the

notification and different officers may be designated for different local areas.".

Now, therefore, the Special Planning Authority in its meeting held on 2nd July 2018, by its resolution No. 83 designated the following officers for the purpose of exercising the powers u/s 53, 54, 55 and 56 of the said Act.
