क्रमांक जेएलएम. ०३१८/प्र.क्र. ४४/पीआरएस-२.---कारागृह अधिनियम, १८९४ (१८९४ चा ९) कलम ५९ चे खंड (८) व (२८) नुसार आणि त्याबाबतीत त्यास समर्थ करणा-या इतर सर्व अधिकारांचा वापर करून, महाराष्ट्र कारागृह (कारागृह इमारती व आरोग्य व्यवस्था) नियम, १९६४ यात आणखी सुधारणा करण्यासाठी महाराष्ट्र शासन, याद्वारे पुढील प्रमाणे नियम करीत आहे.------
(१) या नियमांना, महाराष्ट्र कारागृह (कारागृह इमारती व आरोग्य व्यवस्था) (सुधारणा) नियम, २०१८ असे म्हणावे.
(२) महाराष्ट्र कारागृह (कारागृह इमारती व आरोग्य व्यवस्था) (सुधारणा) नियम, १९६४ मधील मुख्य नियमांमधील नियम ३ ऐवजी खालील नियम दाखल करण्यात येईल :----
"३ (अ) कारागृह हे अंतर्गतदृष्टया अशा प्रकारे संरचित केले जाईल आणि कारागृहाच्या बा तट भिंतीपासून, मुंबई मध्यवर्ती कारागृह, मुंबई याच्या ५०० मीटर परीघ क्षेत्रात, इतर कोणत्याही मध्यवर्ती कारागृहाच्या १५० मीटर परीघ क्षेत्रात, कोणत्याही जिल्हा कारागृहाच्या १०० मीटर परीघ क्षेत्रात व कोणत्याही उप-कारागृहाच्या ५० मीटर क्षेत्रातील बांधकाम हे अशा प्रकारे विनियमित केले जाईल जेणेकरून २० मीटरच्या बफर क्षेत्राची र्िनमिती सुलभ होईल आणि कारागृहाच्या संवेदनशील भागांतील थेट दृश्यमानतेमुळे किंवा, अधिक जोखमीच्या कैद्यांची ये-जा असणा-या भागांमध्ये कोणताही धोका निर्माण होणार नाही."
(ब) कारागृह विभागाचे व नियोजन प्राधिकरणाचे अधिकारी यांचा समावेश असलेली एक समिती गठीत करण्यात येईल आणि या क्षेत्रामध्ये कोणत्याही बांधकामाची परवानगी देताना खंड (अ) च्या अनुपालनार्थ या समितीचा सल्ला घेतला जाईल.

NOTIFICATION
PRISON'S ACT, 1894.
No. JLM. 0318/C.R. 44/PRS-2.—In exercise of the powers conferred by clauses (8) and (28) of section 59 of the Prisons Act, 1894 (IX of 1894) and of all other powers enabling it in this behalf, the Government of Maharashtra, hereby makes the following rules further to amend the Maharashtra Prisons (Prison Building and Sanitary arrangements) Rules, 1964 as follows, namely :—
1. These rules may be called the Maharashtra Prisons (Prison Building and Sanitary arrangements) (Amendment) Rules, 2018.
2. For Rule 3 of the Principal Rules, following Rule shall be substituted, namely :—
" 3 (a) The prison shall be internally so configured and the construction within 500 meters from the perimeter wall of Mumbai Central Prison, Mumbai, 150 meters from the perimeter wall of any other Central Prison, 100 meters from the perimeter wall of any District Prison and 50 meters from the perimeter wall of any Sub- Prison shall be so regulated that the creation of a buffer zone of 20 meters is facilitated and there is no threat due to direct visibility of sensitive areas of the prison or, of areas having movement of prisoners with high security risk.".
(b) The Committee comprising of officers of Prison Department and the Planning Authority shall be constituted and the advice of this committee should be obtained as to the compliance of clause (a) before any building permission is given in that area."
